The disjuncture-response dialectic proposes that the assessment development practices of Indigenous assessment developers exist within a broader environment where attention to broader themes such as settler colonialism (Wolfe, 2006) and Indigenous sovereignty is incorporated. It focused on their academic learning, sociocultural relationship, self-reflection and their identity development. Fields closely related to empirical legal research are enhancing their methods to improve the credibility of their findings. This includes making data, analysis code, and other materials openly available, and preregistering studies. Empirical legal research appears to be lagging behind other fields. This may be due, in part, to a lack of meta-research and guidance on empirical legal studies. The authors seek to fill that gap by evaluating some indicators of credibility in empirical legal research, including a review of guidelines at legal journals. This study explores the lived experiences of second-generation Christian Korean Canadian young adults with mental health issues (MHI) and their use of health services (MHS). In addition, this study asked this cohort to discuss their beliefs about the views their parents held about MHI and MHS. All research participants were born and raised in Canada by Korean born immigrant parents. This study was descriptive, phenomenological, and qualitative in nature; it consisted of in-depth interviews with six male and six female participants. By comparing the academic success and internal processes of immigrant groups, this study aimed to explore the impact of immigration status (first, second, and third-generation) and cultural backgrounds on academic achievement on a holistic level. By measuring acculturation, parental expectations, self-efficacy, goal adjustment, motivation, control beliefs, and vocabulary knowledge of university students, the combination of constructs best correlated to academic achievement was studied with determinants of demographics playing a key role. In addition to quantitative analyses, in-depth interviews supplemented the analyses and further gave insight to the backgrounds of the target population, second-generation immigrant students. This Article explores the civil procedure attendant to private fraudulent transfer litigation (primarily outside the context of bankruptcy). In such litigation, courts ponder whether fraudulent transfers are void or voidable. In fact, they are both simultaneously! According to the theory "at law," a fraudulent transfer is "void." That is, a creditor with a judgment could simply levy the property from a fraudulent grantee as if the grantee had no property rights. This Article questions the constitutional viability of this ancient attitude. Meanwhile, "equity" viewed the transfer as voidable. The grantee gets title, but the title might be set aside. The …

Fraudulent transfer law has historically been an in rem right of a creditor to property fraudulently received by a third party. In a minority of states, courts have treated fraudulent transfers as creating an in personam liability of the transferring debtor, the recipient, and any other third party who "conspired" with the transferor to achieve the transfer. This Article examines the wisdom of this modern trend and finds it wanting. The United States Supreme Court in 1861 was correct: fraudulent transfers are not wrongs. They merely create in rem rights.

A new interpretive technique called “corpus linguistics” has exploded in use over the past five years from state supreme courts and federal courts of appeals to the U.S. Supreme Court. Corpus linguistics involves searching a large database, or corpus, of text to identify patterns in the way in which a certain term is used in context. Proponents of the method argue that it is a more “empirical” approach than referencing dictionaries to determine a word’s public meaning, which is a touchstone in originalist approaches to legal interpretation.

To meet the high-efficiency question answering needs of existing patients and doctors, this system integrates medical professional knowledge, knowledge graphs, and question answering systems that conduct man-machine dialogue through natural language. This system locates the medical field, uses crawler technology to use vertical medical websites as data sources, and uses diseases as the core entity to construct a knowledge graph containing 44,000 knowledge entities of 7 types and 300,000 entities of 11 kinds. The United States is undergoing a demographic transformation. Nearly one in five Americans already is Latinx, and the United States Census Bureau projects that by 2060, nearly one in three will be. Latinx will substantially outnumber every other historically underrepresented racial and ethnic minority group, and non-Hispanic whites no longer will be a majority. Those changes have unsettled traditional approaches to full inclusion.

This paper explores the use of arts and community-based (ACB) approaches to intercultural teacher education. Twenty-four preservice teachers and five adult Yazidi refugees/community members participated in this study which involved a two-week arts-based workshop in Fall 2019 at the University of Nebraska-Lincoln. Data for the study included pre- and post-group discussion recordings as well as oral and written reflections one week after the workshop. Using metaphor analysis, the authors examine the way project participants talk about their experiences in the workshop. Findings showed how ACB approaches hold promise as a vehicle for developing interculturality in teacher education.

This applied dissertation was designed to determine the effectiveness of the Middle School Teacher Training Intervention on the application of culturally relevant instruction and classroom management instructions by teachers in a Title I middle school in the southeastern United States. This school lacked culturally relevant instruction and behavior management, despite its teachers having undergone the training program. Previous literature has identified a difference in emotion comprehension and production of bilinguals. This study aimed to explore differences in emotion expression in the first language (L1) and the second language (L2) among Spanish and English bilinguals. The bilingual participants were interviewed and asked to recount two frustrating events, one in their L1 and one in their L2. These interviews were analyzed for the occurrence of four semantic categories: emotion words (with a subcategory of negative emotion words), emotion-laden words, expressive interjections, and intensifiers that strengthen content words. Categorical perception (CP) of audio is critical to understand how the human brainperceives speech sounds despite widespread variability in acoustic properties. Most studiesthat examine cognitive speech processing have applied methodological approaches that focuson specific or a set of brain regions. Departing from hypothesis-driven approaches, in thisdissertation, we proposed multivariate data-driven approaches to identify the spatiotemporal(i.e., when in time and where in the brain) and spectral (i.e., frequency-band power levels)characteristics of auditory neural activity that reflects CP for speech (i.e., differentiatesphonetic prototypes from ambiguous speech sounds).
