Transformative Constitutions And Constitutionalism : A New Theory And School Of Jurisprudence From The Global South?, Willy Mutunga
Transformative Constitutions And Constitutionalism : A New Theory And School Of Jurisprudence From The Global South?, Willy Mutunga
The Transnational Human Rights Review
The article seeks to interrogate, historicize, and problematize what transformative constitutions and their attendant constitutionalism/jurisprudence are. Some of the critical elements of transformative constitutions are analyzed as well as the development of the jurisprudence that is emerging from these constitutions. In the quest for an answer to the question posed, which is the title of the article, Kenya is used as a case-study. Kenya has had a transformative constitution since it was promulgated on 27 August 2010. Its core elements/pillars of transformation are highlighted in this article. Kenya’s experience with the implementation of this Constitution, particularly with regard to the …

Citizenship Deprivation As An Act Of Persecution: Case Study Of The Assam Citizen Exercise As A Precursor To A Nation-Wide Determination Of Citizenship, Ishita Chakrabarty
The Transnational Human Rights Review
This essay explores the reasons behind describing India’s Citizenship practices (now modified through the Citizenship Amendment Act 2019) as ‘persecutory’. In doing so, the essay refers to the international law on citizenship conferment and withdrawal that has traditionally been viewed as exclusive to a state’s sovereign domain. The essay also looks into the socio-political dynamics, past persecutory conduct exemplified by the Assam-NRC exercise and the lack of protection afforded by those entrusted with the legal duty of conferring and withdrawing citizenship. The essay further uses the Assam-NRC exercise as a case study to claim that there exist well-founded grounds for …

Virtual Photovoice: Methodological Lessons And Cautions, Meagan Call-Cummings, Melissa Hauber-Özer
The Qualitative Report
Photovoice is a type of participatory inquiry, which is a methodological and onto-epistemological stance that seeks to emancipate marginalized individuals, confront inequity, and work for social transformation. Photovoice incorporates Paulo Freire’s problem-posing education, documentary photography techniques, and feminist thought as an approach for community members to identify shared concerns and construct collective knowledge. It also seeks to challenge unequal power relations by disrupting hegemonic structures in the production of knowledge and policy, as photographs and accompanying descriptions can communicate powerfully about community needs and demands for change. University-based researchers or practitioners facilitate this communication by bringing community perspectives to the …

Swift Trust And Sensemaking In Fast Response Virtual Teams, Xiaodan Yu, Yuanyanhang Shen, Deepak Khazanchi
Information Systems and Quantitative Analysis Faculty Publications
Fast-response virtual teams (FRVTs) have been developed as a response to emergent challenges faced by organizations that need to be addressed urgently. Even though FRVTs offer enormous potential in terms of their benefits, their success is not guaranteed. When used, the need for high performing FRVTs has become critical for organizational success. However, there is a lack of detailed understanding of how sensemaking can potentially influence FRVT performance. Drawing on social exchange theory, we identify swift trust as a potential antecedent of sensemaking. In this paper, we report the results of a study that examined the effects of swift trust …

Apalachee Indians, 1704-1763, James W. Covington
Florida Historical Quarterly
One of Florida’s most tragic incidents occurred when Governor James Moore of South Carolina and his small army composed of 1,000 Indians and fifty whites moved into the Apalachee area of North Florida and laid waste to what had been the center of the Franciscan missions. Accounts of this raid describe the gallant defense made at Ayubale mission by Father Miranda and his neophytes, the defeat of the relief column from San Luis under command of Captain Ruiz Mexia, the torture of captives, the destruction of the Apalachee villages, and the removal of 3,000 or more Apalachees for resettlement in …

The Meaning Of Immigrant Women's Experience Of Childbirth For The First Time In A United States Hospital, Carole A. Lorup
Dissertations
The increasing population of immigrants in the United States is largely comprised of immigrant women, whose first contact with the health care system is often to seek maternity care. The literature suggests that immigrant women frequently do not receive the same quality of care and satisfactory experiences from maternity care as their native population counterparts. This study described the experience of maternity care from the perspective of immigrant mothers who gave birth in the United States for the first time. A purposive sample of mothers, who were born outside of the United States, and who have given birth to a …

This report revisits a previous case study focused on the computing machinery and design of communication that are employed at the local, county, regional, state, and federal levels in Oregon to collect, review, and publish damage assessments of disasters and other emergency events. Since the last report, emergency managers throughout Oregon have faced numerous disaster incidents, including the COVID-19 pandemic, ice storms, flooding, and some of the worst heat waves, drought conditions, and megafires on record, with the threat of more to come in the years ahead. After years of research and development, fueled by lessons learned from a catastrophic …

Notes on Lexical Insertion
Our objective in this article is to present a theory which questions the operation of lexical insertion considered as a substitution operation. We will show that this operation is intimately linked to the formal organization of grammar, to such an extent that calling it into question would lead to a profound reorganization of the model of representing linguistic knowledge.

Looking Back, Or Re-Visioning: Contemporary American Jewish Poets On “Lot’S Wife”, Anat Koplowitz-Breier
CLCWeb: Comparative Literature and Culture
Although mentioned only twice in Genesis (19:17, 26), Lot’s wife has been a topic of much discussion amongst both traditional and modern commentators and exegetes. The traditional midrashim seek to explain why she chose to disregard the instructions she was given and the nature of her punishment. In doing so, they follow two principal directions, representing her a) negatively as a wicked sinner, a Sodomite who acted as such even before disobeying the divine decree not to look backwards—thus linking her disobedience with her intrinsic character (e.g., curious, greedy, inhospitable, faithless); or b) positively as a loving mother and daughter. …

Where Are The Women?: An Ecofeminist Reading Of William Golding’S Lord Of The Flies, Hawk Chang
Where Are The Women?: An Ecofeminist Reading Of William Golding’S Lord Of The Flies, Hawk Chang
CLCWeb: Comparative Literature and Culture
The absence of female characters and their voices in William Golding’s Lord of the Flies (1954) has been previously examined. On the surface, this fiction focuses on the struggle and survival of a group of boys who are left alone on a Pacific island against the background of nuclear warfare. The only presence of women in the story seems to be the aunt via a boy’s narration. However, when approaching the fiction through the lens of ecofeminism, we can find a range of feminized entities which are metaphorically embodied in the natural surroundings of the secluded island. The boys’ interactions …
Strange Genre-Related Loops In A Novel-Short Story: The Tension Between The Genres And Their Cultural Context, Orna Levin
CLCWeb: Comparative Literature and Culture
The goal of the current study was to examine the strange genre-related loops in the novel The Short Story Master, by Maya Arad (2009), through the tension between the two genres represented in the text and their cultural contexts. The plot of the novel tells of the professional and personal crisis of the master of the short story, who failed in his mission to write a novel. The text hints to the reader that the central conflict that moves the plot along is neither romantic nor existential, but rather genre-related, and thus the entire work is a manifestation of …

‘Convicted Of Patricide?’: Robert Frost’S Nationalism In The Eyes Of Contemporary Arab-American Women Writers, Eman K. Mukattash
CLCWeb: Comparative Literature and Culture
Given the culturally expansive nature of the American literary tradition of today, the question of the relevance of Robert Frost’s poetry to the poetry of contemporary Arab-American women writers is an issue worth digging into. Writing almost one hundred years ago does not make Frost’s poetry out of date. Frost’s poetry is as relevant to today’s America as it has been to the America of his days. And this can be ascribed to the multiplicity of perspectives he presents in his poetry as he examines crucial questions lying at the core of America’s “grand narrative of national development.” (Westover 2004: …

Improving Teaching Mathematics Using Communicative Competence In Primary Education, Jasur Amirddinovich Mardonkulov Researcher
Central Asian Journal of Education
Human society is unthinkable outside of communication. Communication is a necessary condition for the existence of people, without which it is impossible to fully form not only individual mental functions, processes and properties of a person, but also the personality as a whole. The reality and necessity of communication is determined by joint activity: in order to live, people are forced to interact. Always an active person communicates, whose activities intersect with the activities of other people. Communication allows you to organize social activities and enrich it with new connections and relationships between people.
