Latino Family Engagement In A Network Of Catholic Bilingual Schools, Gabrielle Oliveira, Eunhye Cho, Olivia Barbieri Jul 2021

Latino Family Engagement In A Network Of Catholic Bilingual Schools, Gabrielle Oliveira, Eunhye Cho, Olivia Barbieri

Journal of Catholic Education

In this article, we examine how a Network of Catholic Bilingual Schools (NCBS) serves Latino populations by examining the leadership’s narratives of the school services and outreach. By employing a survey with 16 principals in the NCBS, we argue that the rate of engagement is similar between Latino and non-Latino parents, although the nature of the activities varied. Despite the long-held belief that Latino parents are less likely to participate in schooling than non-Latino parents, we found that Latino parents committed their participation in schools across cultural, linguistic, or religious activities. We highlight how principals acknowledge and describe Latino families’ …

Storytime Programs As Mirrors, Windows, And Sliding Glass Doors? Addressing Children’S Needs Through Diverse Book Selection, Maria Cahill, Erin E. Ingram, Soohyung Joo Jul 2021

Storytime Programs As Mirrors, Windows, And Sliding Glass Doors? Addressing Children’S Needs Through Diverse Book Selection, Maria Cahill, Erin E. Ingram, Soohyung Joo

Information Science Faculty Publications

Much research suggests that exposure to diverse books that feature the lived experiences of people with marginalized or underrepresented identities influences how children perceive their own value and the significance of others who do and do not look like them. Library associations have recently called for greater attention to issues of diversity, equity, and inclusion to be reflected across all aspects of library services and programs. The purpose of this study was to examine the print materials used in public library storytime programs to identify the extent to which storytime exposes children to diverse people. Results indicate that, across all …

Sword And Shield: The Georgia Supreme Court Adopts Third-Party Waiver Of Attorney-Client Privilege, D. Garrett White Jul 2021

Sword And Shield: The Georgia Supreme Court Adopts Third-Party Waiver Of Attorney-Client Privilege, D. Garrett White

Mercer Law Review

The attorney-client privilege is generally held out as a sacred instrument (a shield) reserved for clients and used by attorneys for the benefit of those clients. Persons untrained in the law tend to have a basic understanding of what the attorney-client privilege is and can often explain in a rudimentary sense what it protects. What few non-lawyers realize, however, is that the privilege is not absolute, and is waivable under certain, limited, circumstances. Now, it seems that shield is losing its integrity in the realm of legal malpractice.

In January 2020, the Georgia Supreme Court ruled in Hill, Kertscher & …

Georgetown Law Faculty Publications and Other Works

The Problem: Marginalized populations experience health-harming legal needs—barriers to good health that require legal advocacy to overcome. Medical–legal partnerships (MLPs) embed lawyers into the healthcare team to resolve these issues, but identifying patients with health-harming legal needs is complex, and screening practices vary across MLPs.

Purpose of Article: Academic and community partners who collaborate in an MLP at a school-based health center (SBHC) share their process of co-creating a two-stage legal check-up for adolescents.

Key Points: Screening adolescents for health-harming legal needs is challenging. It took ongoing collaboration to refine the process to fit the needs of …

Paradox And Possibility: Movement Lawyering During The Covid-19 Housing Crisis, Marika Dias Jul 2021

Paradox And Possibility: Movement Lawyering During The Covid-19 Housing Crisis, Marika Dias

City University of New York Law Review

The COVID-19 pandemic put over 22 million U.S. tenants at risk of eviction. It also triggered bolder movement organizing, and demands for radical and enduring solutions to the ongoing housing crisis. Over decades, the field of movement lawyering—legal work that supports grassroots organizing and movement building—has been growing stronger and amassing a body of theoretical and practical frameworks. The potential mass eviction crisis, and the bold campaigns to prevent it, urgently called on movement lawyers to contribute their skills and knowledge to grassroots organizing efforts. This article examines the practice of movement lawyering through the lens of the author’s legal …

What Is Aba Model Rule 8.4(G), Why Is It So Controversial And How Did Illinois Respond?, Allison L. Wood Jul 2021

What Is Aba Model Rule 8.4(G), Why Is It So Controversial And How Did Illinois Respond?, Allison L. Wood

Southern Illinois University Law Journal

The legal profession is a self-regulated profession, in that rules that govern lawyer conduct are written by lawyers. In 1983, the House of Delegates of the American Bar Association (“ABA”) promulgated the ABA Model Rules of Professional Conduct (“MRPC”) for lawyers and the Model Code of Judicial Conduct for judges in 2007. The MRPC specifically provides the baseline for the standards of the legal profession’s conduct. All states, except California, have adopted the MRPC in some form or variation. The ABA Standing Committee on Ethics and Professional Responsibility (“SCEPR”) issues ethics opinions to help interpret the MRPC. Since the MRPC …

Immigration Cyber Prisons: Ending The Use Of Electronic Ankle Shackles, Tosca Giustini, Sarah Greisman, Peter L. Markowitz, Ariel Rosen, Zachary Ross, Alisa Whitfield, Christina Fialho, Brittany Castle, Leila Kang

Online Publications

The call to end immigration detention has garnered strong support in recent years due to a growing public awareness of its devastating impact on the individuals locked away, their families, and entire communities. Throughout the nation, communities, organizers, advocates, and public officials have demanded the shutdown of Immigration and Customs Enforcement (ICE) detention centers, particularly those operated by private prison companies.

However, less attention has been paid to another form of detention that has been insidiously expanding alongside ICE’s brick-and-mortar jails: the Intensive Supervision Assistance Program (ISAP), the primary component of ICE’s so-called “Alternatives to Detention” program. ISAP surveils, monitors, …

Clandestine Awards, Information Asymmetries, And Equality Of Arms In Investment Arbitration, Fernando Dias Simões Jul 2021

Clandestine Awards, Information Asymmetries, And Equality Of Arms In Investment Arbitration, Fernando Dias Simões

Journal of Dispute Resolution

Among the numerous criticisms leveled at investor-state arbitration over the years, it has almost become de rigueur to point out a lack of transparency. In this arena “transparency” refers to the extent to which the public may be aware of the existence of a dispute, have access to key arbitral documents, or attend oral hearings.

Silicosis And The State: Configuring Labour’S Interest As The Public Interest, Shruti Iyer Jul 2021

Silicosis And The State: Configuring Labour’S Interest As The Public Interest, Shruti Iyer

Socio-Legal Review

This article presents a close reading of several Public Interest Litigation (‘PIL’) petitions before the Indian Supreme Court since the 1980s, analysing how the figure of the worker suffering from silicosis, an occupational lung disease, has been constructed in judicial discourse. I trace the shifts in the vocabulary of law which variously constructed informal workers, exposed to dust in the workplace – first, as a community facing forced working conditions; then, as residents suffering air pollution; and finally, as victims of a human rights violation that the state was bound to compensate. This paper builds on and contributes to existing …

Survey Of Illinois Law: Health Care Law, Allison De Corral, Sherri Devito, Keith Emmons, Rick Hindmand, Nick Kurk, Leonard Nelson, Jacob Radecki, Juliet Sorensen, Alexandra Tarzikhan

Southern Illinois University Law Journal

Health care remains among the most active and diverse fields in law. This year’s Survey reviews significant issues in state and federal health care law with respect to Illinois statutory and regulatory health care professional practice changes, the proposed Illinois Physician Orders for Life-Sustaining Treatment (POLST) Registry, the multiple Illinois COVID-19 Executive Orders, the Illinois Biometric Information Privacy Act and recent lawsuit-related issues and the opioid epidemic in the presence of the COVID-19 pandemic. Senior Illinois health care attorneys, most of whom are current or former members of the Illinois State Bar Association’s Health Care Section Council, researched and drafted …

Analyzing The Mediating Effects Of Social Capital And Sense Of Community Between International Student’S College Sports Fan Identification And Acculturation, Kibaek Kim Jul 2021

Analyzing The Mediating Effects Of Social Capital And Sense Of Community Between International Student’S College Sports Fan Identification And Acculturation, Kibaek Kim

Graduate Theses and Dissertations

According to the number provided by the International Institute of Education (IIE), there are over one million international students enrolled in the United States. Although the number of international students is increasing, the incremental rate started to decrease after reaching its peak in the 2017-2018 academic year. While previous studies focused on the role of leisure activities, such as physical activity participation, to analyze how international students can receive social support from their communities to better acculturate in the U.S., this study focused on the role of spectator sports on providing social support and its effect on international student’s acculturation. …

The Role Of Law In Chinese Value Chains, Henry Gao, Gregory Shaffer Jul 2021

The Role Of Law In Chinese Value Chains, Henry Gao, Gregory Shaffer

Research Collection Yong Pung How School Of Law

Since starting its economic reform four decades ago, China has been highly successful in integrating its economy into regional and global value chains (GVCs). This started with simple assembly and processing, then expanded to low-end labor-intensive manufacturing, and gradually moved up to technology-intensive and capital-intensive industries. This article analyzes the development of Chinese law, legal institutions, and international and transnational legal initiatives to support the development of GVCs, which we divide into five phases. The article does not idealize law in terms of ‘commitment’ or ‘rule of law,’ but rather, in the legal realist tradition, views law as an important, …

Career Development And Workforce Experiences Of Trans People In Their Workplaces, Rene Ragmett Alvarez Jun 2021

Career Development And Workforce Experiences Of Trans People In Their Workplaces, Rene Ragmett Alvarez

USF Tampa Graduate Theses and Dissertations

Existing research concerning trans people is sparse, and even less research exists regarding their career development and workforce experiences. Hence, I explored the career development and workforce experience stories of trans people. I used a conceptual and theoretical framework in this study to inform my general approach to trans scholarship leading to the specific examination of the career development and workforce experiences of trans persons. The conceptual and theoretical framework included Hale's (1997) suggested guidelines for non-trans people writing about trans people, constructivism, social cognitive career theory, and minority stress theory and informed the qualitative vehicle of this study to …
