“I Want Justice From People Who Did Bad Things To Children”: Experiences Of Justice For Sex Trafficking Survivors, John G. Morrissey, James Havey, Glenn M. Miles, Nhanh Channtha, Lim Vanntheary

Dignity: A Journal of Analysis of Exploitation and Violence

This research from the Butterfly Longitudinal Research Project focused on understanding the experiences and perceptions of justice and the justice system for 93 Cambodia participants (including 88 survivors of sex trafficking) as they navigated the legal system. Thirty-two of these survivors had experiences in court and provided details into their courtroom experiences, predominantly within Cambodia but also in the United States. The survivors’ experiences were diverse; however, the prevailing themes were: fear throughout their legal journeys; a low level of awareness and understanding of their legal experiences; and that NGO support was essential for these survivors to engage in the …

The Myanmar Shwe: Empowering Law Students, Teachers, And The Community Through Clinical Education And The Rule Of Law, Stephen Rosembaum, Britane Hubbard, Kaylee Sharp-Bauer, David Tushaus

Indiana Journal of Global Legal Studies

Myanmar's attorneys, judges, law officers, and law teachers are slowly emerging from the isolated world they inhabited during decades of military authoritarianism. Almost a decade ago, the country triumphantly burst into an era of "disciplined" democracy under the leadership of Aung San Suu Kyi, de facto head of state. Yet, the legal education system continues to be marked by hierarchical and bureaucratic practices, infrastructural and pedagogical neglect, and low confidence in the formal justice sector. The authors-two American law professors and practitioners and two students-discuss the direction of legal education in Southeast Asia and how clinical legal education (CLE) methodologies …

Does Political Orientation Affect The Evaluation Of Artificial Intelligence?, Haejoo Han, Sujin Park, Kyoungmi Lee

Asia Marketing Journal

In this study, we propose that political orientation is related to the evaluation of artificial intelligence. Using AI-based medical and legal service providers, we find that the more politically conservative consumers are, the more likely they are to have a lower evaluation of AI-based professional services. Furthermore, we find that the relationship between political conservatism and the evaluation of AI-based services is driven by the extent of the perceived threat that AI poses to human uniqueness. Other potential underlying factors such as the heightened need for control, gender, socioeconomic status, or technology familiarity do not explain this effect.

Democracy Requires Good Law Libraries – With Books, Franklin L. Runge Aug 2021

Democracy Requires Good Law Libraries – With Books, Franklin L. Runge

Library Scholarship

In this brief commentary, the author argues for the continued presence of a print collection in law libraries because (1) law libraries serve as a fail-safe for democracy, (2) inexperienced researchers achieve a greater understanding of how primary law is produced when exposed to print materials, and (3) there is still a high demand for print materials in scholarly endeavors.

Dignity: A Journal of Analysis of Exploitation and Violence

Social determinants of health (SDH) are defined as the non-medical yet health-affecting conditions of a person’s life. They include such considerations as working conditions, discrimination, and access to health services. The aim of this study was to explore the SDH impacting those who have survived sex trafficking in Cambodia. This study employed a mixed methods, secondary analysis, focusing on 52 survivors of sex trafficking in the Butterfly Longitudinal Research Project from 2010 through 2019. Participants described myriad social determinants of health, including: gender, age, relationship status (marriage), ethnicity, national identification documentation (statelessness), social class, formal education, vocational training, occupation, and …

Wage And Productivity Of Employees In Service Providing Industries In Albania: A Close Look At It And Business Sectors, Sindi Rryta

Theses

Nowadays, outsourcing has created new employment possibilities especially in developing countries. Although Albania is considered as one of the most prominent outsourcing destinations in the Balkans, there is little evidence in terms of the varying levels of wage and productivity of workers within the outsourcing sectors. The aim of this thesis is to provide insights regarding the wage and productivity differentials in two specific service-providing industries in Albania, namely IT BPO and BPO. The analysis of primary data collected through a survey (N=62) in four Albanian companies and eight interviews with representatives of outsourcing companies in both mentioned sectors, shows …

Librarians’ Perception Of License Agreements Of Electronic Resources: A Study, Chitra Singh, Rekha Pai

Library Philosophy and Practice (e-journal)

With the introduction of license agreements, there is no more ownership of the electronic resources, but an access based or subscription-based approach to the electronic resources came into existence. In this recent time of license agreements, the library professionals should have some legal skills. They should know the use of various terms used in license agreements like clauses, tenure, user rights etc. so that they can negotiate and communicate better with publishers and vendors and cater to the needs of the patrons. This study aims to find out the knowledge, attitude, and perception of librarians on license agreements, and to …

J. Stoller denies petitioner’s application for adjournment of trial so that they can seek summary judgment on harassment claim. The court goes into the history of the modern housing court with trial and resolution parts and notes that two weeks were set aside for the trial of this matter and appears rather outraged that despite this the petitioners waited until the morning of trial to let the court know they were not ready for the trial. The court, finding them not ready to proceed dismisses harassment claim.

Journal of Appalachian Health

Introduction: Central Appalachia has been disproportionately affected by the opioid epidemic and overdose fatalities. We developed West Virginia Peers Enhancing Education, Recovery, and Survival (WV PEERS), a program based on peer recovery support, to engage individuals using opioids and link them with a range of services.

Methods: Community partners providing services to individuals with opioid use disorder (OUD) were identified and collaborations were formalized using a standardized memorandum of understanding. The program was structured to offer ongoing peer recovery support specialist (PRSS) services, not just a one-time referral. A website and cards describing the WV PEERS program were developed and …

Who Owns The City? Pension Fund Capitalism And The Parkdale Rent Strike, Jamie Shilton Jul 2021

Who Owns The City? Pension Fund Capitalism And The Parkdale Rent Strike, Jamie Shilton

Journal of Law and Social Policy

Canadian public pension funds play an increasingly significant role as institutional investors, including in the domestic residential property market. Some scholars have suggested that pension fund investments of this kind result in a form of public ownership, sometimes characterized as “pension fund socialism.” However, the actual character of pension fund investment in Canada is much more akin to a financialized pension fund capitalism, with public pension funds adopting investment strategies consistent with private financial market actors. In the summer of 2017, tenants and housing activists in Toronto’s Parkdale neighbourhood organized a successful rent strike against their corporate landlord as well …

Pleading Guilty: Indigent Defendant Perceptions Of The Plea Process, Jeanette Hussemann, Jonah Siegel Jul 2021

Pleading Guilty: Indigent Defendant Perceptions Of The Plea Process, Jeanette Hussemann, Jonah Siegel

Tennessee Journal of Law and Policy

Public defenders and other court actors most often engage in behind-the-scene plea negotiating to manage overwhelming workloads and to dispose of cases as quickly and efficiently as possible. In prior work, scholars have documented an increased reliance on plea bargaining and the deleterious impact of the practice on the legal process and the rights of individuals accused of a crime; however, this research has not systematically analyzed the decisions made, and the perspectives of justice of society's most disadvantaged and arguably most important actors of the court, the defendants. Relying on data collected in a Midwestern public defense system, this …

The Potential For A Family Law Tribunal, Patricia Lynn Robinson Jul 2021

The Potential For A Family Law Tribunal, Patricia Lynn Robinson

PhD Dissertations

This thesis considers the potential for tribunal adjudication in family law, particularly for custody and access cases. The central argument is that a paradigm shift away from adversarialism may enable experimentation with a holistic tribunal-based family law settlement system, at least for family law cases in which a best-interests-of-the-child determination is required. It is suggested that within a holistic tribunal settlement system, multi-disciplinary mediators and adjudicators could share decision-making responsibility, nurture tribunal expertise and develop transparent decision-making guidelines, while adjudication could be relegated to a secondary, inquisitorial component. New empirical research on mediation and adjudication processes in selected tribunals is …
