Chappell V. State, 137 Nev. Adv. Op. 83 (Dec. 30, 2021), Kalin Olson

Nevada Supreme Court Summaries

In an opinion drafted by Justice Cadish, the Nevada Supreme Court considered a case in which several mandatory procedural bars apply to postconviction habeas petitions under NRS Chapter 34. A petitioner must demonstrate good cause and prejudice in order to overcome the mandatory procedural bars and avoid dismissal of a postconviction habeas petition. A claim of good cause must be raised by the petitioner within a reasonable time after it becomes available. The Court concludes that the ineffective assistance claims lack merit and affirmed the district court order dismissing Chappell's third postconviction petition for a writ of habeas corpus as …

Transition Administration, Michael Herz, Katherine A. Shaw

Articles

The period from November 3, 2020 to January 20, 2021, was unlike any presidential transition in our history. President Donald Trump refused to accept his ballot-box defeat, instead battling to overturn the election’s outcome. This dramatic public campaign was waged in state and federal courts, state legislatures, the offices of state and local election officials, the Department of Justice, and finally the halls of Congress, where on January 6, 2021, a mob incited by the President stormed the Capitol with the explicit goal of preventing the final counting of electoral votes for Joe Biden. These efforts had more mundane and …

Effect Of Dry Oxidation And Thermal Annealing On Aln/Gan/Aln/Si (111) And Evaluation Of Its Electrical Characteristics, Mohd Zaki Mohd Yusoff, Azzafeerah Mahyuddin, Zainuriah Hasssan, ‪Muhammad Syarifuddin Yahya

Makara Journal of Science

We proposed a technique for improving the platinum (Pt) Schottky contact dark current of the AlN/GaN/AlN/Si(111) substrate. The AlN/GaN/AlN/ heterostructure sample was successfully grown on a silicon substrate by radio frequency molecular beam epitaxy. The high quality of the interlayer heterostructure sample was verified by transmission electron microscopy (TEM). From the TEM image, a good quality single interface layer with spacing less than 1 nm was detected. The strong significant peaks obtained by X-ray diffraction measurement indicated that the sample has a high structural quality for each grown layer. Dry oxidation and thermal annealing were used in conjunction to effectively …

Bioaccumulation Of Trace Metals For Daily Fish Consumption From Selected Former Tin Mining Ponds In Peninsular Malaysia: A Review On Safety Of Fish Consumption, Mohd Hafiz Rosli, Amirul Azuan Md Joni, Nur Khaliesah Abdul Malik

Makara Journal of Science

Tin mining was the predominate mining industry in Malaysia, especially during the mid-19th century. Most of the former mining areas have been reused for aquaculture purposes. Fish produced from former mining areas have been misunderstood as a high health risk if consumed due to their likelihood of containing high heavy metal content in their tissue. Therefore, we review national information on trace metals levels in the tissue of fish from selected former mining ponds in Peninsular Malaysia, together with background concentration of trace metals in their surroundings and food security and human health implications. Seven trace metals (Cu, Zn, As, …

Examining The Economic Impacts Of Restricted Energy Supply Chain On The Vietnamese Economy With Structure Path Analysis, Chung Van Nguyen Dec 2021

Examining The Economic Impacts Of Restricted Energy Supply Chain On The Vietnamese Economy With Structure Path Analysis, Chung Van Nguyen

Asia-Pacific Social Science Review

The paper examines the impact of the restricted energy supply chain on key business sectors of Vietnam’s economy during the COVID-19 period by using structure path analysis combined with constrained fixed price multiplier to examine energy price changes for key business sectors of the economy between 2019 and 2020. The result shows that the change in coal price will likely lead to a downward trend in the overall price of the production. In particular, when the government restricts 10% of the energy supplies chain, the travel services, transportation services, trade, and repair services sectors will have the strongest impact on …

Furthermore, the study showed that two variables—challenge demands and hindrance demands—played significant mediators in the relationship between PSC and burnout. As a result, it is concluded that PSC can reduce …

The Effect Of Covid-19 Pandemic On Volatility Transmission Between The U.S. And Emerging Asia Stock Markets: A Case Study Of Tiger Cub Economies, Mien Nguyen Thi Ngoc, Tung Mai Son

Asia-Pacific Social Science Review

The globalization in financial markets has highlighted the importance of a clear understanding of volatility transmission among equity markets in different countries. This paper looks into the effect of the COVID-19 pandemic on the volatility transmission between the U.S. stock market and five emerging equity markets called Tiger Cub economies in Southeast Asia. As the result of the dynamic conditional correlation GARCH (DCC-GARCH), the U.S. stock market’s volatility links positively to these smaller economies’ volatilities, and these linkages become stronger during the pandemic. We also find evidence of statistically significant co-volatility across five Tiger Cub markets. Due to the increase …

Codeine phosphate is a mild to moderate analgesic and has a weak cough suppressant activity that is available to purchase as an over the counter (OTC) painkiller in Ireland as a compound product. In recent years, countries such as Australia have introduced laws that prohibit the sale of the drug without a valid prescription. This move by Australia begs the question as to why this legislation was introduced and should Ireland follow suit.

The primary aims of the study were to determine knowledge among the general public of codeine-containing medications and their usage levels. The survey also investigated whether current …

An Investigation Into The Prevalence Of Vancomycin-Resistant Enterococci Within An Irish Hospital, Dylan Casey

International Undergraduate Journal of Health Sciences

Vancomycin-resistant enterococci (VRE) are well-recognised nosocomial pathogens that pose a significant threat to public health. Associated with poorer clinical outcomes than their vancomycin-sensitive counterparts, the prevalence of VRE in Ireland has increased in recent times, with the European Antimicrobial Resistance Surveillance Network reporting that out of 29 countries, Ireland demonstrated the highest rates of vancomycin resistance among invasive Enterococcus faecium isolates between 2011 and 2014 (2011; 34.9%, 2012; 44.0%, 2013; 42.7%, 2014; 45.1%). Herein, we investigate VRE prevalence in the Mercy University Hospital (MUH) – an acute care hospital in southern Ireland. A total of 21 first-time VRE infections were …

Using Gamification To Teach And Engage Students In The Act Of Summary Writing, Quang C. Ly

Journal of Media Literacy Education

This study uses the concept of gamification to engage first-year students in the act of summary writing. The researcher uses Robson et al.’s (2015) mechanics, dynamics, and emotions framework and Groh’s (2012) principles of relatedness, competence, and autonomy to explain and justify the integration of gamification to the summary genre. Of the typical gaming elements used in gamification, the researcher relies on the uses of digital badges as a motivator and as a sign of credentials …
