New Rules Of The Game: The Politization Of Community Courts In Mozambique, Molly Utter Dec 2021

New Rules Of The Game: The Politization Of Community Courts In Mozambique, Molly Utter

Washington International Law Journal

After a fifteen-year civil war, the Mozambique government turned to customary justice to address the conflicts that emerged during the war by creating Community Courts. The goal of the Community Courts was to mimic their successful grassroots predecessors, the Popular Courts, and to bring justice to the people, by the people. Yet one year before the creation of the Community Courts, the Mozambican government implemented the Law on the Organization of the Judiciary, which limited formal jurisdiction to the district level and excluded grassroot courts from the official judicial structure. Grassroot courts, most significantly the Popular Courts, ceased to run …

Free Speech Still Matters, Joel M. Gora Dec 2021

Free Speech Still Matters, Joel M. Gora

Brooklyn Law Review

In its first ten years, the Roberts Court proved to be the most speech protective Court in a generation, if not in our history; however, in the intervening five years, the Court has faced intense pressures, ranging from heightened criticism of its First Amendment jurisprudence to seismic changes in the makeup of the Court to very real proposals for court “packing.” Despite these powerful forces, the Roberts Court has surprisingly stayed true to its commitment to—and guardianship of—the First Amendment. Nevertheless, in the face of modern political correctness and cancel culture, free speech has rarely been in a more precarious …

The Online Criminal Trial As A Public Trial, Stephen Smith Dec 2021

The Online Criminal Trial As A Public Trial, Stephen Smith

Faculty Publications

There are two ways of favorably conceiving online trials in Sixth Amendment terms. One is that an online trial is a public trial, by its terms. The other is that an online trial may not be public, for Sixth Amendment purposes, but may nonetheless satisfy applicable constitutional demands for trials considered “closed.” This Essay proposes both: that an online trial is fundamentally “public” for Sixth Amendment purposes and, if it is not, it may still be a constitutional accommodation of the Sixth Amendment’s public trial guarantee, in appropriate circumstances.

The constitutionality of an online trial may be largely an idle …

Critical Hope As Vehicle For Equity: Examining Teachers’ Paradigm And Pedagogy, Heidi Strikwerda, Jose Lalas

Journal of Critical Issues in Educational Practice

This current study framed the concept of “critical hope” and examined how systemic oppression in society continuously perpetrates the “hope gap” in low-income students. We defined critical hope, in this study, as the optimistic way of viewing and acting on the world from a critically historically conscious, socially and culturally situated perspective with a personal belief that inevitable change will inspire a sense of community, advocacy, liberation, and justice (Strikwerda, 2019). This rich definition incorporates the elements of hope deduced from existing related foundational and empirical research literature (Freire, 1970; Freire, 1994; Freire, 1997, bell hooks, 2004; Edwards et al., …

Ware V. Ware And The Presumption Of Undue Influence In Confidential Relationships, Ian W. Fraser Dec 2021

Ware V. Ware And The Presumption Of Undue Influence In Confidential Relationships, Ian W. Fraser

Alaska Law Review

Alaska law has long recognized that a presumption of undue influence arises as a matter of law when a will’s primary beneficiary participates in its drafting and has a fiduciary or confidential relationship with the testator. In its 2007 decision Ware v. Ware, the Alaska Supreme Court extended this principle beyond testamentary scenarios to any situation in which the principal in a confidential relationship benefits from the relationship. But the decision stated the law incorrectly. The court’s analysis, cited precedents, and common sense all demonstrate that the court meant to say that the presumption of undue influence arises when a …

Media Stylistics Linguistic Representation, Realization, And Perception, Hussein Huwail Ghayadh

Uruk Journal of Human Sciences

Communication can be accomplished through the processes of encoding (developing and sending messages) and decoding (turning messages into thoughts). Communication generally manifests itself within the perspective of some social situation which is responsible for setting the context for the conveyed interlocutors’ intentions. This paper looks at how the messages are encoded by the interviewee, how his linguistic choices are stylistically and constructive, and how his arguments are logically arranged. Not only the interviewee’s task, but this paper also detects how the audience perceives the intentions, how they match the linguistic choices with their referents (semantic or pragmatic referents). It also …

Evolution Or Revolution In Telehealth Regulation, George Horvath Dec 2021

Evolution Or Revolution In Telehealth Regulation, George Horvath

Texas A&M Law Review

A frequently repeated adage, attributed to a wide range of authors and orators, holds that a serious crisis should never be allowed to go to waste. The moment in which we find ourselves renders this adage particularly timely. Responses to one of the defining crises of our age—the COVID–19 pandemic—have mostly been reactive. This includes the responses of multiple actors involved with telehealth. Congress, federal regulators, state legislatures, state regulators, private insurers, and health care providers, confronting the challenges of the pandemic, have responded by making ad hoc adjustments to the regulation and use of telehealth. Moving the conversation beyond …

Real Property, Real Problems: Expanding Alaska's Unfair Trade Practices And Consumer Protection Act, Michael E. Keramidas Dec 2021

Real Property, Real Problems: Expanding Alaska's Unfair Trade Practices And Consumer Protection Act, Michael E. Keramidas

Alaska Law Review

Alaska’s Unfair and Deceptive Acts and Practices (UDAP) statute was designed to provide broad, robust protections for everyday Alaskan consumers. Astonishingly, Alaska is one of only three states that does not protect Alaskans under its UDAP statute when they fall victim to fraudulent schemes involving real property. The Alaska Supreme Court has consistently upheld this interpretation of the UDAP statute by relying on precedent from over thirty years ago. At the same time, due to the COVID-19 pandemic, everyday Alaskans are more economically vulnerable than ever before, with the atmosphere being ripe for proliferation of fraudulent real property schemes. This …

Do You Know It When You See It? Using Alaska's Child Pornography Statute As A Nationwide Model For Proscribing Morphed Images, Daisy Gray Dec 2021

Do You Know It When You See It? Using Alaska's Child Pornography Statute As A Nationwide Model For Proscribing Morphed Images, Daisy Gray

Alaska Law Review

In 1982, the United States Supreme Court addressed the tension between free speech and protecting children by holding child pornography outside the scope of First Amendment protections. Critical to the Court’s decision was the fact that child sexual abuse is necessary to produce child pornography. But what if technological advancement removed child abuse from the equation? The recent phenomena of virtual child pornography and morphed images involve the digital alteration of adult pornography to create the appearance of child pornography. The Alaska legislature amended its child pornography statute in response to these developments, proscribing the possession of morphed images. While …

The Ballot Is Stronger Than The Bullet: Alaska's Superior Strict Scrutiny Approach To Ballot Access Laws, Ben Sheppard, Josh Guckert Dec 2021

The Ballot Is Stronger Than The Bullet: Alaska's Superior Strict Scrutiny Approach To Ballot Access Laws, Ben Sheppard, Josh Guckert

Alaska Law Review

Restrictive ballot access laws are the most burdensome requirement for third-party candidates. Such laws implicate First Amendment freedoms to associate both publicly and privately with like-minded individuals in order to advance political causes. Alaskan courts review state ballot access laws under the demanding standard of strict scrutiny. This standard was adopted through the efforts of Joe Vogler and his Alaskan Independence Party. The authors contend that such a standard has fostered Alaska’s unique openness toward third-party candidacies. Nonetheless, the Supreme Court of the United States does not utilize this same strict scrutiny review, instead using the Anderson-Burdick test, which balances …

The Effect Of Covid-19 Pandemic On Volatility Transmission Between The U.S. And Emerging Asia Stock Markets: A Case Study Of Tiger Cub Economies, Mien Nguyen Thi Ngoc, Tung Mai Son

Asia-Pacific Social Science Review

The globalization in financial markets has highlighted the importance of a clear understanding of volatility transmission among equity markets in different countries. This paper looks into the effect of the COVID-19 pandemic on the volatility transmission between the U.S. stock market and five emerging equity markets called Tiger Cub economies in Southeast Asia. As the result of the dynamic conditional correlation GARCH (DCC-GARCH), the U.S. stock market’s volatility links positively to these smaller economies’ volatilities, and these linkages become stronger during the pandemic. We also find evidence of statistically significant co-volatility across five Tiger Cub markets. Due to the increase …
