A new interpretive technique called “corpus linguistics” has exploded in use over the past five years from state supreme courts and federal courts of appeals to the U.S. Supreme Court. Corpus linguistics involves searching a large database, or corpus, of text to identify patterns in the way in which a certain term is used in context. Proponents of the method argue that it is a more “empirical” approach than referencing dictionaries to determine a word’s public meaning, which is a touchstone in originalist approaches to legal interpretation.
This Article identifies an important concern about the use of corpus linguistics in …
Cyber Due Diligence, Eric Talbot Jensen, Sean Watts
Cyber Due Diligence, Eric Talbot Jensen, Sean Watts

Due diligence—the notion that international law includes a duty to cease and remedy damage that emanates from a State’s territory—has been proposed as an international legal measure to temper destabilizing effects of harm from cyber infrastructure. Yet the extent to which States, particularly the United States, accept due diligence as either a principle of general international law or as a rule of conduct applicable to the context of cyberspace is not clear. This Article examines past and present U.S. experience with due diligence, both as a principle and rule of conduct in general international law. In light of U.S. foreign …

Each week’s module was introduced …
Interactions Between Densely Grafted Molten Polymer Brushes:Scaling Theories Versus Molecular Simulations, Aykut Erbaş
Interactions Between Densely Grafted Molten Polymer Brushes:Scaling Theories Versus Molecular Simulations, Aykut Erbaş
Turkish Journal of Physics
Using molecular dynamics simulations and scaling arguments, we analyzed the interactions between two identical molten polymer brushes intermediately and strongly compressed towards each other at melt conditions. The width of the overlap region, in which monomers of the linear chains composing the two brushes interact, increases as the polymer-grafted surfaces are brought closer. If two-brush coated surfaces are as close as the characteristics size of the grafted chains, the overlap region is directly controlled by intersurface distance. At intermediate compression, the width of the overlap region scales with the end-to-end size of chain sections within the overlap region. This result …

Physics & Astronomy Faculty Publications
We present a new analysis of the profile data from the 47 millisecond pulsars comprising the 12.5 yr data set of the North American Nanohertz Observatory for Gravitational Waves, which is presented in a parallel paper (Alam et al., hereafter NG12.5). Our reprocessing is performed using “wideband” timing methods, which use frequency-dependent template profiles, simultaneous time-of-arrival (TOA) and dispersion measure (DM) measurements from broadband observations, and novel analysis techniques. In particular, the wideband DM measurements are used to constrain the DM portion of the timing model. We compare the ensemble timing results to those in NG12.5 by examining the …
Entitlement To Punishment, Kyron J. Huigens
Entitlement To Punishment, Kyron J. Huigens
Articles
This Article advances the idea of entitlement to punishment as the core of a normative theory of legal punishment's moral justification. It presents an alternative to normative theories of punishment premised on desert or public welfare; that is, to retributivism and consequentialism. The argument relies on H.L.A. Hart's theory of criminal law as a "choosing system," his theory of legal rules, and his theory of rights. It posits the advancement of positive freedom as a morally justifying function of legal punishment.
An entitlement to punishment is a unique, distinctive legal relation. We impose punishment when an offender initiates an ordered …

Biopolitics' New Iteration: Gay Men, Pre-Exposure Prophylaxis And The Pharmaco-Pornographic Imagination, Rory David Crath, J. Cristian Rangel, Adam Gaubinger
School for Social Work: Faculty Publications
This article builds upon Paul Preciado’s conceptualisation of pharmaco-pornographic power to understand the ongoing affects and effects of Pre-Exposure Prophylaxis (PrEP) on queer men’s sexual socialities and subjectivities. Drawing from a new-materialist epistemology, we analyze data from a sexual health pilot study in NYC to trace the techno-sexual health assemblages forming in queer life worlds. Our analysis suggests that these assemblages, entangling PrEP and other pharmacological substances, pornographic imaginaries together with mediatic technologies and public health rationalties, are creating paradoxical desires and practices of intimacy that are both normative and exceed rational health-actor logics and normative understandings of risk. These …

Up to two-thirds of stroke survivors experience persistent sensorimotor impairments. Recovery relies on the integrity of spared brain areas to compensate for damaged tissue. Deep grey matter structures play a critical role in the control and regulation of sensorimotor circuits. The goal of this work is to identify associations between volumes of spared subcortical nuclei and sensorimotor behaviour at different timepoints after stroke. We pooled high-resolution T

Auditory nerve fibers (ANFs) innervating the same inner hair cell (IHC) may have identical frequency tuning but different sound response properties. In cat and guinea pig, ANF response properties correlate with afferent synapse morphology and position on the IHC, suggesting a causal structure-function relationship. In mice, this relationship has not been fully characterized. Here we measured the emergence of synaptic morphological heterogeneities during maturation of the C57BL/6J mouse cochlea by comparing postnatal day 17 (p17, ∼3 days after hearing onset) with p34, when the mouse cochlea is mature. Using serial block face scanning electron microscopy and three-dimensional reconstruction we measured …

Going Remote: Implementing Digital Research Methods At An Academic Medical Center During Covid-19, Katie E Keenoy, Eric J Lenze, Ginger E Nicol
2020-Current year OA Pubs
COVID-19 has forced medical research institutions to conduct clinical research remotely. Here, we describe how a university's mHealth Research Core helped facilitate the shift to remote research during the COVID-19 pandemic. In 2019 (pre-pandemic), we conducted stakeholder interviews and leadership group sessions to identify, create, and implement resources and core functions to support investigator-initiated mHealth research. Between April 2019 and February 2020, we identified four investigator needs: 1) a

Dengue is a mosquito-borne viral disease causing significant health and economic burdens globally. The dengue virus (DENV) comprises four serotypes (DENV1-4). Usually, the primary infection is asymptomatic or causes mild dengue fever (DF), while secondary infections with a different serotype increase the risk of severe dengue disease (dengue hemorrhagic fever, DHF). Complement system activation induces inflammation and tissue injury, contributing to disease pathogenesis. However, in asymptomatic or primary infections, protective immunity largely results from the complement system's lectin pathway (LP), which is activated through foreign glycan recognition. Differences in N-glycans displayed on the DENV envelope membrane influence the lectin pattern …

Deep Learning Versus Spectral Techniques For Frequency Estimation Of Single Tones: Reduced Complexity For Software-Defined Radio And Iot Sensor Communications, Hind R. Almayyali, Zahir M. Hussain
Research outputs 2014 to 2021
Despite the increasing role of machine learning in various fields, very few works considered artificial intelligence for frequency estimation (FE). This work presents comprehensive analysis of a deep-learning (DL) approach for frequency estimation of single tones. A DL network with two layers having a few nodes can estimate frequency more accurately than well-known classical techniques can. While filling the gap in the existing literature, the study is comprehensive, analyzing errors under different signal-to-noise ratios (SNRs), numbers of nodes, and numbers of input samples under missing SNR information. DL-based FE is not significantly affected by SNR bias or number of nodes. …

While anomaly detection is very important in many domains, such as in cybersecurity, there are many rare anomalies or infrequent patterns in cybersecurity datasets. Detection of infrequent patterns is computationally expensive. Cybersecurity datasets consist of many features, mostly irrelevant, resulting in lower classification performance by machine learning algorithms. Hence, a feature selection (FS) approach, i.e., selecting relevant features only, is an essential preprocessing step in cybersecurity data analysis. Despite many FS approaches proposed in the literature, cooperative co-evolution (CC)-based FS approaches can be more suitable for cybersecurity data preprocessing considering the Big Data scenario. Accordingly, in this paper, we have …

Functional Maturation Of Immature Β Cells: A Roadblock For Stem Cell Therapy For Type 1 Diabetes, Zi-Yi Sun, Ting-Yan Yu, Fang-Xu Jiang, Wei Wang
Research outputs 2014 to 2021
Type 1 diabetes mellitus (T1DM) is a chronic autoimmune disease caused by the specific destruction of pancreatic islet β cells and is characterized as the absolute insufficiency of insulin secretion. Current insulin replacement therapy supplies insulin in a non-physiological way and is associated with devastating complications. Experimental islet transplantation therapy has been proven to restore glucose homeostasis in people with severe T1DM. However, it is restricted by many factors such as severe shortage of donor sources, progressive loss of donor cells, high cost, etc. As pluripotent stem cells have the potential to give rise to all cells including islet β …
Educative Power And The Respectful Curricular Inclusion Of Aboriginal And Torres Strait Islander Music, Michael Webb, Clint Bracknell
Educative Power And The Respectful Curricular Inclusion Of Aboriginal And Torres Strait Islander Music, Michael Webb, Clint Bracknell
Research outputs 2014 to 2021
This chapter argues for the full, respectful curricular inclusion of Aboriginal and Torres Strait Islander music in order to promote a more balanced and equitable social and cultural vision of the nation-state in Australian schools. It challenges views that claim Indigenous cultures have been irretrievably lost or are doomed to extinction, as well as the fixation on musical authenticity. We propose that the gradual broadening of Indigenous musical expressions over time and the musical renaissance of the new millennium have created an unprecedented opportunity for current music educators to experience the educative power of Aboriginal and Torres Strait Islander music. …

Research outputs 2014 to 2021
It may not always be possible to conduct a digital (forensic) investigation post-event if there is no process in place to preserve potential digital evidence. This study posits the importance of digital forensic readiness, or forensic-by-design, and presents an approach that can be used to construct a Digital Forensic Readiness Intelligence Repository (DFRIR). Based on the concept of knowledge sharing, the authors leverage this premise to suggest an intelligence repository. Such a repository can be used to cross-reference potential digital evidence (PDE) sources that may help digital investigators during the process. This approach employs a technique of capturing PDE from …

Background While high-quality meta-analyses have confirmed the effectiveness of aphasia therapy after stroke, there is limited evidence for the comparative effectiveness of different aphasia interventions. Two commonly used interventions, Constraint-induced Aphasia Therapy Plus (CIAT Plus) and Multi-modality Aphasia Therapy (M-MAT), are hypothesised to rely on diverse underlying neural mechanisms for recovery and may be differentially responsive to aphasia severity. COMPARE is a prospective randomised open-blinded end-point trial designed to determine whether, in people with chronic post-stroke aphasia living in the community, CIAT Plus and M-MAT provide greater therapeutic benefit compared to usual care, are differentially effective according to aphasia severity, …

The Efficacy Of Aligning Lessons Learnt From Significant Bushfire Incidents To The Organisational Stratum, Jennifer Medbury, David J. Brooks, Michael Coole
Research outputs 2014 to 2021
Australia's bushfire seasons are expected to become longer and more severe due to the effects of climate change and an increasing population living in rural-urban fringes. Social and economic vulnerability to extreme natural hazards means that Australia’s emergency services sector plays a significant role in community safety and wellbeing. Therefore, it is important that the sector continually improves. Australia has a long history of conducting external reviews into significant bushfires. While these reviews receive good support and seek to identify relevant lessons, barriers remain that prevent these lessons from being effectively learnt. It is possible that some of these barriers …

Summary Of Fetal Alcohol Spectrum Disorder (Fasd) Among Aboriginal And Torres Strait Islander People, Australian Indigenous Healthinfonet
Research outputs 2014 to 2021
Fetal Alcohol Spectrum Disorder (FASD) is a condition caused by alcohol exposure before birth. During pregnancy, alcohol freely crosses the placenta. The baby cannot process the alcohol and this may result in damage to the baby’s brain and body. Not all babies exposed to alcohol during pregnancy will develop FASD, but there is no safe level of alcohol use during pregnancy. FASD is a lifelong condition that results in cognitive, physical and behavioural disabilities. FASD occurs everywhere in Australia where people drink alcohol. Many women drink during pregnancy before they know they are pregnant and there is a lack of …

Research outputs 2014 to 2021
This paper considers the effectiveness of narrative inquiry as a research method in collecting and analyzing stories from a purposive sample of intensive care nurses and doctors, regarding their perceptions of the factors that influence decision-making in relation to the withdrawal of life sustaining treatment. Delaying the withdrawal of treatment when it is clearly indicated, may result in unnecessary patient suffering at the end of life, distress for the family as well as moral distress for staff. In narrative inquiry participants’ first-hand accounts of their experiences are told through story; the focus of analysis is the story, with the story …

Digital Labour And Temporal Priorities Within A Secondary School, Nicola F. Johnson
Research outputs 2014 to 2021
Digital devices and ubiquitous online access contribute to the nature and amount of digital labour conducted by school staff. Drawing on more than 40 interviews with staff at one Australian secondary school, the general nature of this digital labour is presented, then Clancy’s notion of temporal autonomous spaces is introduced and applied to theorise why some teachers used digital technologies constantly in their teaching. The article highlights how some teachers invested their time in learning about and using digital technologies because it enhanced their sense of autonomy and increased their sense of freed time. It theorises how teachers who invest …

The deep sea, the largest ocean’s compartment, drives planetary-scale biogeochemical cycling. Yet, the functional exploration of its microbial communities lags far behind other environments. Here we analyze 58 metagenomes from tropical and subtropical deep oceans to generate the Malaspina Gene Database. Free-living or particle-attached lifestyles drive functional differences in bathypelagic prokaryotic communities, regardless of their biogeography. Ammonia and CO oxidation pathways are enriched in the free-living microbial communities and dissimilatory nitrate reduction to ammonium and H2 oxidation pathways in the particle-attached, while the Calvin Benson-Bassham cycle is the most prevalent inorganic carbon fixation pathway in both size fractions. Reconstruction of …

Estimating The Magnitude And Risk Associated With Heat Exposure Among Ghanaian Mining Workers, Victor Fannam Nunfam, Kwadwo Adusei-Asante, Eddie Van Etten, Kwasi Frimpong, Jacques Oosthuizen
Research outputs 2014 to 2021
Many occupational settings located outdoors in direct sun, such as open cut mining, pose a health, safety, and productivity risk to workers because of their increased exposure to heat. This issue is exacerbated by climate change effects, the physical nature of the work, the requirement to work extended shifts and the need to wear protective clothing which restricts evaporative cooling. Though Ghana has a rapidly expanding mining sector with a large workforce, there appears to be no study that has assessed the magnitude and risk of heat exposure on mining workers and its potential impact on this workforce. Questionnaires and …
