An Audience Analysis Of The Effectiveness Of A Speech: A Blueprint For Planning Successful Motivational Speeches, Robert Gerald Lawrie Jan 2021

An Audience Analysis Of The Effectiveness Of A Speech: A Blueprint For Planning Successful Motivational Speeches, Robert Gerald Lawrie

Theses and Dissertations

This applied dissertation was designed to provide specific information as to how a person can become a better motivational speaker. The current literature on the topic of effective public speaking, especially in light of this growing trend in the nation and around the world is outdated, cumbersome, or inadequate. Even though there is an abundance of material on the topic of public speaking, most of it has not included empirical evidence concerning what characteristics of the speaker might affect an audience’s perceptions about the effectiveness of the speech.

The researcher adopted an audience analysis framework to examine the variables that …

Courts Beyond Judging, Michael C. Pollack Jan 2021

Courts Beyond Judging, Michael C. Pollack

Articles

Across all fifty states, a woefully understudied institution of government is responsible for a broad range of administrative, legislative, law enforcement, and judicial functions. That important institution is the state courts. While the literature has examined the federal courts and federal judges from innumerable angles, study of the state courts as institutions of state government — and not merely as sources of doctrine and resolvers of disputes — has languished. This Article remedies that oversight by drawing attention for the first time to the wide array of roles state courts serve, and by evaluating the suitability of both the allocation …

Karina Soto, 2021: Applied Dissertation, Nova Southeastern University, Abraham S. Fischler College of Education and School of Criminal Justice. Keywords: expulsion, suspension, behavior problems, interventionExpulsion and suspension are exclusionary practices that were previously reserved for students in kindergarten to 12th grade. They have now become commonplace in preschool. Though researchers have been unable to identify the reasons why this is occurring, many have studied the classroom climate and other elements surrounding the child; however, to this date, no research exists that supports effective strategies implemented …

Population Genetic Structure Of Bobcats (Lynx Rufus) In South Dakota: Using Harvested Samples To Inform Management, Stuart C. Fetherston Jan 2021

Population Genetic Structure Of Bobcats (Lynx Rufus) In South Dakota: Using Harvested Samples To Inform Management, Stuart C. Fetherston

Electronic Theses and Dissertations

A primary objective of state wildlife management agencies is to establish sustainable harvest levels for game species. An important component of sustainable management practices is the identification of appropriate management units for monitoring and establishing defensible harvest levels. Across their range, bobcats (Lynx rufus) are an ecologically and economically important species. Despite their importance, little is known about the genetic structure of bobcat populations in South Dakota. We used tissue sampled from n = 1,215 bobcats harvested across the state from 2014–2019 to infer population genetic structure. We used 17 microsatellite loci and a sex identification marker to assign individuals …

Advanced Analytical Techniques For The Analysis Of Therapeutics Of Toxic Inhalation Agents And Pharmacokinetic Investigation, Subrata Bhadra Jan 2021

Advanced Analytical Techniques For The Analysis Of Therapeutics Of Toxic Inhalation Agents And Pharmacokinetic Investigation, Subrata Bhadra

Electronic Theses and Dissertations

Toxic inhalation agents (TIAs), (i.e., cyanide (CN) and reduced sulfur compounds (RSCs)), including hydrogen sulfide (H2S) and methanethiol (MT)) are extremely poisonous upon exposure. Many TIAs act by inhibiting mitochondrial cytochrome c oxidase, resulting in cellular hypoxia, cytotoxic anoxia, apnea, respiratory failure, cardiovascular collapse, seizure and potentially death. CN is generated in structural fires and cigarette smoke as well as in mining, electroplating and polymer processing, whereas H2S and MT are found in petroleum, oil and natural gas, waste treatment facilities and decaying organic matter. All are common occupational gas exposure hazards in chemical industries and for first responders, including …

Changes In Pregnancy - Associated Glycoproteins Associated With Fetal Age, Postpartum Interval And Evaluation Of A Chute-Side Lateral Flow Assay, Adalaide C. Kline Jan 2021

Changes In Pregnancy - Associated Glycoproteins Associated With Fetal Age, Postpartum Interval And Evaluation Of A Chute-Side Lateral Flow Assay, Adalaide C. Kline

Electronic Theses and Dissertations

Transrectal ultrasonography is known as the gold standard for pregnancy detection but requires costly equipment and technical skill. Access to a cheaper and more user-friendly method with similar accuracy to transrectal ultrasonography would be beneficial to individual cattle producers and to the cattle industry as a whole. Pregnancy diagnosis by detection of pregnancy-associated glycoproteins (PAGs) has the ability to accurately determine pregnancy in ruminants, however, usually requires specialized equipment for the assay. Pregnancy-associated glycoprotein pregnancy tests are gaining in popularity due to their ease of use and the unique feature of not requiring specialized training. Recently, a new lateral flow …

Kent State And The Failure Of First Amendment Law, Gregory P. Magarian Jan 2021

Kent State And The Failure Of First Amendment Law, Gregory P. Magarian

Scholarship@WashULaw

Since the U.S. Supreme Court decided its first free speech case 100 years ago, two very different eras have defined First Amendment law. For a half century, before 1970, the Supreme Court focused on protecting the expressive freedom of political dissidents and social reformers. In 1970, amid protests against the Vietnam War, the Ohio National Guard senselessly gunned down four students at Kent State University. The Kent State massacre exposed the fragility in our country of political protest, free speech, and democracy itself. That atrocity should have inspired First Amendment law to affirm and enhance its protection of dissenters and …

Pandemic Nationalism, Covid-19, And International Law, Leila Nadya Sadat Jan 2021

Pandemic Nationalism, Covid-19, And International Law, Leila Nadya Sadat

Scholarship@WashULaw

This Essay explores possible reforms to the World Health Organization (WHO) considering its response to the COVID-19 pandemic. It also suggests using existing mechanisms to enforce the WHO Constitution and the International Health Regulations (IHR). The Essay focuses on three aspects of global health governance: (1) how nationalism of powerful States renders pandemic control difficult given the “weakest-link public goods” character of global health emergencies; (2) how legal and practice reforms might nonetheless strengthen and fortify the WHO’s response; and (3) how existing provisions of the WHO Constitution and the IHR might be enforced through the dispute resolution clauses in …

Pragmatic Reconstruction In Jurisprudence: Features Of A Realistic Theory, Brian Z. Tamanaha Jan 2021

Pragmatic Reconstruction In Jurisprudence: Features Of A Realistic Theory, Brian Z. Tamanaha

Scholarship@WashULaw

A century ago the pragmatists called for reconstruction in philosophy. Philosophy at the time was occupied with conceptual analysis, abstractions, a priori analysis, and the pursuit of necessary, universal truths. Pragmatists argued that philosophy instead should center on the pressing problems of the day, which requires theorists to pay attention to social complexity, variation, change, power, consequences, and other concrete aspects of social life. The parallels between philosophy then and jurisprudence today are striking, as I show, calling for a pragmatism-informed theory of law within contemporary jurisprudence. The realistic theory outlined in this essay focuses on what law does, what …

Wage Theft Criminalization, Benjamin Levin Jan 2021

Wage Theft Criminalization, Benjamin Levin

Scholarship@WashULaw

Over the past decade, workers’ rights activists and legal scholars have embraced the language of “wage theft” in describing the abuses of the contemporary workplace. The phrase invokes a certain moral clarity: theft is wrong. The phrase is not merely a rhetorical flourish. Increasingly, it has a specific content for activists, politicians, advocates, and academics: wage theft speaks the language of criminal law, and wage theft is a crime that should be punished. Harshly. Self-proclaimed “progressive prosecutors” have made wage theft cases a priority, and left-leaning politicians in the United States and abroad have begun to propose more criminal statutes …

Imagining The Progressive Prosecutor, Benjamin Levin Jan 2021

Imagining The Progressive Prosecutor, Benjamin Levin

Scholarship@WashULaw

As criminal justice reform has attracted greater public support, a new brand of district attorney candidate has arrived: the “progressive prosecutors.” Commentators increasingly have keyed on “progressive prosecutors” as offering a promising avenue for structural change, deserving of significant political capital and academic attention. This essay asks an unanswered threshold question: what exactly is a “progressive prosecutor”? Is that a meaningful category at all, and if so, who is entitled to claim the mantle? In this essay, I argue that “progressive prosecutor” means many different things to many different people. These differences in turn reveal important fault lines in academic …

"Keep Your Facts, I'M Going With The Truth": Toward An Ethical Perfromance Of Satire In The Age Of Hyper-Polarization And Culture War, Carson Betts Jan 2021

"Keep Your Facts, I'M Going With The Truth": Toward An Ethical Perfromance Of Satire In The Age Of Hyper-Polarization And Culture War, Carson Betts

Electronic Theses and Dissertations, 2020-2023

Satire is having a unique cultural moment. Conversations about what constitutes satire, why it should be performed, and how can it be done ethically are abundant in American popular culture. As with many forms of art and entertainment, satire has become a major subject of discussion in the great American Culture Wars: the conflict between the highly stratified ideological poles of right and left over the dominance of each's closely held social values, political ideals, and aesthetic sensibilities. Divides, real and imagined, in the American public have given popular discourse a sharp and biting edge, driven by growing political polarization …

The Actor And The Iceberg, Christopher Creane Jan 2021

The Actor And The Iceberg, Christopher Creane

Electronic Theses and Dissertations, 2020-2023

Actors have ingrained vocal, physical, and mental habits they unknowingly use on stage in the form of physical movements, vocalization, and character choices which can inadvertently communicate information to the audience. Rarely, however, are actors asked to play themselves and if their own habits are unconsciously being merged with their intentional character choices, then the audience's perception of the actor's portrayal may be shaped by unintentional behavior. "The Actor and the Iceberg" will be a synthesis of awareness building and control techniques for the mind and body, specifically: meditation, mindfulness, the Feldenkrais Method, and the Alexander Technique. The goal of …

Sympathy For The Devil: A Compassionate Approach To Morally Reprehensible Characters In Drama, Amy Livingston Jan 2021

Sympathy For The Devil: A Compassionate Approach To Morally Reprehensible Characters In Drama, Amy Livingston

Electronic Theses and Dissertations, 2020-2023

Empathy is often heralded as a vital part of the theatrical experience. Generally understood as the experience of feeling what another person is feeling, it is believed to help actors create more honest performances and to help audiences better understand viewpoints different from their own. These empathic experiences are complicated, however, when applied to stories about characters who commit unforgivably evil acts and may lead people to feel manipulated into justifying or sharing the immoral beliefs of these characters. This thesis argues that for theatre practitioners telling stories about morally reprehensible characters, compassion, involving feelings of care and concern for …

The Death Of Beowulf: Exploring The Conception, Process, And Lessons Of An Original Solo Performance Based On A Classic, Jeffrey Sneed Jan 2021

The Death Of Beowulf: Exploring The Conception, Process, And Lessons Of An Original Solo Performance Based On A Classic, Jeffrey Sneed

Electronic Theses and Dissertations, 2020-2023

The Death of Beowulf: Exploring the Conception, Process, and Lessons of an Original Solo Performance Based on a Classic is the exploration of a performer's journey understanding how their own identity and aesthetic has been defined by other works of art and how it affects their creative expression. The author examines the nature of classics as culturally and personally formative texts, and how the artist's experiences and interpretation can potentially deliver fresh understandings of a familiar text. Then, by applying this to his own process of devising a script based on the epic poem Beowulf, he grapples with the challenges …

Towards A Postdramatic Jazz Aesthetic: Per(Form)Ance And Its Discontents, Johann Robert Wood Jan 2021

Towards A Postdramatic Jazz Aesthetic: Per(Form)Ance And Its Discontents, Johann Robert Wood

Electronic Theses and Dissertations, 2020-2023

In Karen Jürs-Munby's introduction to her English translation of Hans-Thies Lehmann's Postdramatic Theatre (2006), she positions a single African American theatre practitioner, Suzan-Lori Parks, within the canon of postdramatic writers in spite of Lehmann's blind spot for the contribution of Black artists to innovations in theatre practice and aesthetics. This thesis draws from critical jazz studies, particularly Parks's "Rep & Rev" and Fred Moten's analysis of jazz improvisation from his seminal work, In the Break: The Aesthetics of the Black Radical Tradition (2003), in order to visibilize Black contributions to theatre innovation through what has often been overlooked as merely …

Stock Shows And Rodeos: The Crossroads Of Commodification, Consumption, And Care Of Nonhuman Animals, Erin Kidder Jan 2021

Stock Shows And Rodeos: The Crossroads Of Commodification, Consumption, And Care Of Nonhuman Animals, Erin Kidder

Electronic Theses and Dissertations, 2020-2023

This study explores the complex relationship between humans and nonhuman animals through the lens of stock shows and rodeos (SSR). This study employs a feminist theoretical framework and an interpretive qualitative research methodology to gain insight into the ways in which humans practice a range of speciesist behaviors relating to their commodification, consumption, and care of other animals. Data consist of semi-structured interviews with 21 individuals who participate in SSR as spectators and competitors and with two animal medical experts, along with field observations at three different SSR held in Florida and Texas. Findings suggest that nonhuman animals serve many …

A Preliminary Evaluation Of A Digital Token Economy To Increase Student Engagement During Group Teletherapy, Hunter King, Katerra Miller-Johnson, Keely Mcculla, Aaron J. Fischer, Shengtian Wu, Mikey Miller

Faculty Publications – Psychology

Shortly following the temporary nationwide school dismissal amid COVID-19, the current exploratory case-study evaluated the feasibility of two engagement strategies delivered during group teletherapy: Class Dojo and opportunities to respond (OTR). Three elementary students with emotional and behavioral difficulties participated. An A-B-A design was used to evaluate the effects of Class Dojo on student engagement with therapist-delivered OTRs. Due to one student’s poor response to the contingency, an A-B-C design was used to evaluate the additive effect of student-delivered OTRs on his engagement. Results indicated moderate to high rates of student attendance, and consistently high rates of engagement for two …

Taxing Buybacks, Gregg Polsky, Daniel J. Hemel Jan 2021

Taxing Buybacks, Gregg Polsky, Daniel J. Hemel

Scholarly Works

A recent rise in the volume of corporate share repurchases has prompted calls for changes to the rules governing stock buybacks. These calls for reform are animated by concerns that buybacks enrich corporate executives at the expense of productive investment. This emerging antibuyback movement includes prominent politicians as well as academics and Republicans as well as Democrats. The primary focus of buyback critics has been on securities-law changes to deter repurchases, with only passing mention of potential tax-law solutions. This Article critically examines the policy arguments against buybacks and arrives at a mixed verdict. On the one hand, claims that …

Nation’S Business And The Environment: The U.S. Chamber’S Changing Relationships With Ddt, “Ecologists,” Regulations, And Renewable Energy, Adam D. Orford

Scholarly Works

Nation’s Business was a monthly business magazine published by the U.S. Chamber of Commerce, with a subscription list larger than Business Week, Forbes, or Fortune. This study explores how the magazine responded and adapted to the rise of environmentalism, and environmental regulation of business, by exploring its treatment of four topics: DDT, environmentalists, government regulation, and renewable energy. It is built on a full-text review of all issues of Nation’s Business published between 1945 and 1981. It reveals the development of a variety of anti-environmental logics and discourses, including the delegitimization of environmentalism as emotional and irrational, the undermining …

How Journalists Think About The First Amendment Vis-À-Vis Their Coverage Of Hate Groups, Gregory Perreault, Jonathan Peters, Brett Johnson, Leslie Klein Jan 2021

How Journalists Think About The First Amendment Vis-À-Vis Their Coverage Of Hate Groups, Gregory Perreault, Jonathan Peters, Brett Johnson, Leslie Klein

Scholarly Works

This study, based on in-depth interviews with U.S.-based journalists (n = 18), explores the increasingly fraught circumstances of reporting on hate groups. We examine how journalists think about the First Amendment vis-à-vis their coverage of such groups. Through the lens of media ecology and First Amendment principles and theories, we argue ultimately that journalists who cover hate groups use the First Amendment to identify their place in the journalistic environment.

Exploring Mission With Saint Paul Ten Pastoral-Theological Principles, James H. Kroeger Mm Jan 2021

Exploring Mission With Saint Paul Ten Pastoral-Theological Principles, James H. Kroeger Mm

Asia Pacific Mission Studies

Saint Paul, apostle par excellence, tirelessly labored to spread the Gospel, particularly in the Gentile world. His missionary travels and encounter with diverse peoples, cultures, and religions form the matrix or context of his missionary methods. A comprehensive examination of Paul's writings yields much mission wisdom and insight shaped by his apostolic experience and dynamic faith. This presentation suggests ten “mission principles”—derived from Paul's direct mission experience coupled with his profound faith reflection and then “applied” to missionary engagement today.

To Change A Culture: Reflections On One Attempt To Help Theology Students Reconsider Assumptions, Christine E. Burke Ibvm Jan 2021

To Change A Culture: Reflections On One Attempt To Help Theology Students Reconsider Assumptions, Christine E. Burke Ibvm

Asia Pacific Mission Studies

In a time described by Pope Francis as “not an era of change but a change of era,” assisting students to examine assumptions which are embedded in their culture is critical. Manila has many institutions dedicated to theological and pastoral formation. In a post Vatican II church, where baptism is recognized as empowering all to use their gifts as 'priests, prophets and kings'(spiritual leadership, commitment to justice, and governance), how can we help students to participate in a church challenged by the equality of women and men? Feminist theology offers rich resources to enable students to recognize and support the …

Incarnating The Missionary-Pastoral Character Of The Churches In Asia, Peter Pojol Sj Jan 2021

Incarnating The Missionary-Pastoral Character Of The Churches In Asia, Peter Pojol Sj

Asia Pacific Mission Studies

The emergence and growth of pastoral institutes in Asia manifests the missionary-pastoral trajectories that were made the center of the focus of the Church by Vatican II, echoed by the Federation of Asian Bishops’ Conferences (FABC), and reaffirmed and rejuvenated for our time by Pope Francis. The pastoral institutes of Network Pastoral Asia and Inter-Institutional Collaboration illustrate this impetus. They invite sustained reflection on and creative application of the Council's “principle of pastorality,” which carefully attends to context and faithfully expresses the “centrifugal missionary dimension” of evangelization.

Lamentation And Hope Of University Students During The Covid-19 Pandemic In The Light Of Psalm 73, Nikolas Kristiyanto Jan 2021

Lamentation And Hope Of University Students During The Covid-19 Pandemic In The Light Of Psalm 73, Nikolas Kristiyanto

Asia Pacific Mission Studies

The COVID-19 pandemic is challenging our faith and theology. Its impact is evident in our daily activities. For this reason, this article asks, “How widespread is the impact of COVID-19 on university students’ activities?” Then it tries to analyze that impact by using the structure of Psalm 73: (1) the credo, (2) lamentation, and (3) hope. It then provides a simple pastoral strategy to accompany the university students during this difficult time. This strategy involves all lecturers at every faculty in the university to redesign the teaching materials that can help students to reflect and to deepen their experiences during …

Rubicon: The Dialectic, Marcos Carrasco Yanez Jan 2021

Rubicon: The Dialectic, Marcos Carrasco Yanez

Electronic Theses and Dissertations, 2020-2023

Rubicon: The Dialectic is a virtual reality (VR), multi-channel, video-art installation, created after researching interactivity, virtual reality, 2D and 3D animation, filmmaking, philosophy, and music. I intend to manifest my feelings as a Venezuelan, a Latin-American, and a free thinker by sharing with the spectator a VR immersive piece representing my inner struggle in these times of political meltdown. Attempting to go beyond the two orders that structure reality according to French structuralist psychoanalyst Jacques Lacan, The Imaginary and The Symbolic, I am searching to approach the third Lacanian order that structures human existence--the one that opposes and exists beyond …
