After Whose Order? Kingship And Priesthood In The Book Of Mormon, Avram R. Shannon Jan 2021

After Whose Order? Kingship And Priesthood In The Book Of Mormon, Avram R. Shannon

BYU Studies

The Book of Mormon represents itself as a strand of Israelite and Judahite religious tradition that flourished somewhere in the New World. Its acceptance by The Church of Jesus Christ of Latter-day Saints as scripture means that the Book of Mormon forms part of the essential worldview of the Church. It certainly informs practice and liturgy in the Church, as the adoption of the sacrament prayers from Moroni 3 and 4 as the regular sacrament prayers for the Church indicates.1 The interpretive road is not one-way, however. Just as the Book of Mormon informs and undergirds much of the teachings …

The False Dichotomy Of Corporate Governance Platitudes, Jeffrey M. Lipshaw Jan 2021

The False Dichotomy Of Corporate Governance Platitudes, Jeffrey M. Lipshaw

Suffolk University Law School Faculty Works

In 2019, the Business Roundtable amended its principles of corporate governance, deleting references to the primary purpose of the corporation being to serve the shareholders. In doing so, it renewed the “shareholder vs. stakeholder” debate among academic theorists and politicians. The thesis here is that the zero-sum positions of the contending positions are a false dichotomy, failing to capture the complexity of the corporate management game as it is actually played. Sweeping and absolutist statements of the primary purpose of the corporation are based on arid thought experiments and idiosyncratic cases in which corporate leaders have managed to be either …

Bivens And The Ancien Régime, Carlos Manuel Vázquez Jan 2021

Bivens And The Ancien Régime, Carlos Manuel Vázquez

Georgetown Law Faculty Publications and Other Works

In its most recent decision narrowly construing Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, the Supreme Court derided Bivens as the product of an “‘ancien regime,’ ... [in which] the Court assumed it to be a proper judicial function to ‘provide such remedies as are necessary to make effective’ a statute’s purpose.” This Essay considers the relevance for Bivens claims of the Court’s shift to a nouveau régime to address the implication of private rights of action under statutes. It first describes and assesses the Court’s reasons for shifting to the nouveau r …

Trademarks In Conversation: Assessing Genericism After Booking.Com, Laura A. Heymann Jan 2021

Trademarks In Conversation: Assessing Genericism After Booking.Com, Laura A. Heymann

Faculty Publications

It is a fundamental principle of U.S. trademark law that to serve as a trademark, a word or phrase must “indicate the source” of the goods or services with which it is associated and, conversely, that a term that is understood to be the common name of a good or service is “generic” and cannot be protected as a trademark. Yet it still seems difficult to determine exactly what each concept means, particularly when the actual “source” of any goods or services might be opaque to consumers.

In part, this difficulty comes from the fact that status as a trademark …

Optimal Directional Overcurrent Relay Coordination Based On Computationalintelligence Technique: A Review, Suzana Pil Ramli, Muhammad Usama, Hazlie Mokhlis, Wei Ru Wong, Muhamad Hatta Hussain, Munir Azam Muhammad, Nurulafiqah Nadzirah Mansor Jan 2021

Optimal Directional Overcurrent Relay Coordination Based On Computationalintelligence Technique: A Review, Suzana Pil Ramli, Muhammad Usama, Hazlie Mokhlis, Wei Ru Wong, Muhamad Hatta Hussain, Munir Azam Muhammad, Nurulafiqah Nadzirah Mansor

Turkish Journal of Electrical Engineering and Computer Sciences

An exponential increase in diverse load demand in the last decade has influenced the integration of more power plants into the power system. This increases the fault current due to the bidirectional flow of current, resulting in unwanted tripping of the relays if not properly coordinated. Therefore, it is imperative to ensure the installation of relays in the grid being able to sense the fault current from any direction (i.e. upstream or downstream). This can be accomplished by introducing an optimal directional overcurrent relay (DOCR) coordination scheme into the system. This paper presents an in-depth review of the applications of …

Design And Planning Of A Distribution System Using Renewable Technologies In Arural Area Of Pakistan, Abdur Rehman Yousaf, Ghulam Mujtaba, Muhammad Amjad, Zeeshan Rashid Jan 2021

Design And Planning Of A Distribution System Using Renewable Technologies In Arural Area Of Pakistan, Abdur Rehman Yousaf, Ghulam Mujtaba, Muhammad Amjad, Zeeshan Rashid

Turkish Journal of Electrical Engineering and Computer Sciences

The inclusion of renewable energy sources in a distribution system to form a dispersed or decentralized generation network has gained tremendous progress in recent years. The architecture of the distribution system has the potential to serve as a microgrid during an islanding operation connected directly to the load center while excited fully by renewable technologies. This paper deals with planning and designing of a medium voltage power distribution system in a rural area of Pakistan affluent with abundant reserves of renewable sources of electricity. Two types of distribution system architectures, namely radial and ring systems, are simulated using a power …

New Normal: Cooperative Paradigm For Covid-19 Timely Detection Andcontainment Using Internet Of Things And Deep Learning, Farooque Hassan Kumbhar, Ali Hassan Syed, Soo Young Shin

Turkish Journal of Electrical Engineering and Computer Sciences

The spread of the novel coronavirus (COVID-19) has caused trillions of dollars of damages to the governments and health authorities by affecting the global economies. It is essential to identify, track and trace COVID-19 spread at its earliest detection. Timely action can not only reduce further spread but also help in providing an efficient medical response. Existing schemes rely on volunteer participation, and/or mobile traceability, which leads to delays in containing the spread. There is a need for an autonomous, connected, and centralized paradigm that can identify, trace and inform connected personals. We propose a novel connected Internet of Things …

Humorous Spaces And Serious Magic In William Baldwin’S Beware The Cat, Ashley Jeanette Ecklund Jan 2021

Humorous Spaces And Serious Magic In William Baldwin’S Beware The Cat, Ashley Jeanette Ecklund

Quidditas

When spaces transform in William Baldwin’s Beware the Cat, the transition is marked with humor, consistently signaling magic to follow. As an amalgamation of folklore, including magic that manifests around, for, and through cats, Baldwin’s work offers adventure, laughter, and danger alike. Some cats are diabolical, worshiping or holding the soul of a witch; however, their wit constitutes a jocular contrast to that of our interior narrator, Maister Streamer, whose quotation above demonstrates a serious misunderstanding of St. Augustine’s beliefs. Though Beware The Cat was published at the start of the early modern period, the folklore it contains speaks …

“Same-Sex Marriage?! What Next Polygamy?”: Mormonism In Us Political Culture, K. Mohrman Jan 2021

“Same-Sex Marriage?! What Next Polygamy?”: Mormonism In Us Political Culture, K. Mohrman

Mormon Studies Review

In his dissent to Obergefell v. Hodges, the 2015 Supreme Court decision

that determined marriage was a right that could not be constitutionally

denied to same-sex couples under the Free Exercise and

Equal Protection clauses of the Fourteenth Amendment, Chief Justice

John Roberts queried, “if ‘[t]here is dignity in the bond between

two men or two women who seek to marry and in their autonomy to

make such profound choices,’ . . . why would there be any less dignity

in the bond between three people, who in exercising their autonomy,

seek to make the profound choice to marry?”1 In …

Red Balloon, Paris Nilson Jan 2021

Red Balloon, Paris Nilson

Inscape

I am born in a grocery store for the purpose of something important. The moment of my birth is not a large one, and it is not thought of afterward. I live and die in one breath. Today, as with all coming days, is meant to see how long that initial intake will last me. I am, at every edge, a beginning. I am so round and airy like a globe, it is ironic that I should never have been anywhere. This sudden virility is pregnant with a gaseous content; I am imbued with an upward pull, a magnetic longing. …

The Fable As A Global Genre: Marie De France, Ulrich Bonerius, Don Juan Manuel, And Kalila And Dimna, Albrecht Classen Jan 2021

The Fable As A Global Genre: Marie De France, Ulrich Bonerius, Don Juan Manuel, And Kalila And Dimna, Albrecht Classen

Quidditas

As much as recent scholarship has tried to develop a new approach toward world or global literature, the essential problem continues that in those efforts simply writers and poets from the various countries and continents are placed side by side without any consideration of inter- and transdisciplinarity, if not shared meaning and critical exchange. Drawing from the tradition of medieval fable literature, however, we face a truly productive approach in recognizing what global literature could really entail since the various writers across the continents addressed, broadly speaking, the same issues and fundamentally agreed on the critical values in all of …

A Consistent Estimator Of Nontrivial Stationary Solutions Of Dynamic Neural Fields, Eddy Kwessi Jan 2021

A Consistent Estimator Of Nontrivial Stationary Solutions Of Dynamic Neural Fields, Eddy Kwessi

Mathematics Faculty Research

Dynamics of neural fields are tools used in neurosciences to understand the activities generated by large ensembles of neurons. They are also used in networks analysis and neuroinformatics in particular to model a continuum of neural networks. They are mathematical models that describe the average behavior of these congregations of neurons, which are often in large numbers, even in small cortexes of the brain. Therefore, change of average activity (potential, connectivity, firing rate, etc.) are described using systems of partial different equations. In their continuous or discrete forms, these systems have a rich array of properties, among which is the …

Imagining The Progressive Prosecutor, Benjamin Levin Jan 2021

Imagining The Progressive Prosecutor, Benjamin Levin

Publications

As criminal justice reform has attracted greater public support, a new brand of district attorney candidate has arrived: the “progressive prosecutors.” Commentators increasingly have keyed on “progressive prosecutors” as offering a promising avenue for structural change, deserving of significant political capital and academic attention. This Essay asks an unanswered threshold question: what exactly is a “progressive prosecutor”? Is that a meaningful category at all, and if so, who is entitled to claim the mantle? In this Essay, I argue that “progressive prosecutor” means many different things to many different people. These differences in turn reveal important fault lines in academic …

Wage Theft Criminalization, Benjamin Levin Jan 2021

Wage Theft Criminalization, Benjamin Levin

Publications

Over the past decade, workers’ rights activists and legal scholars have embraced the language of “wage theft” in describing the abuses of the contemporary workplace. The phrase invokes a certain moral clarity: theft is wrong. The phrase is not merely a rhetorical flourish. Increasingly, it has a specific content for activists, politicians, advocates, and academics: wage theft speaks the language of criminal law, and wage theft is a crime that should be punished. Harshly. Self-proclaimed “progressive prosecutors” have made wage theft cases a priority, and left-leaning politicians in the United States and abroad have begun to propose more criminal statutes …

Decolonizing Indigenous Migration, Angela R. Riley, Kristen A. Carpenter Jan 2021

Decolonizing Indigenous Migration, Angela R. Riley, Kristen A. Carpenter

Publications

As global attention turns increasingly to issues of migration, the Indigenous identity of migrants often remains invisible. At the U.S.-Mexico border, for example, a significant number of the individuals now being detained are people of indigenous origin, whether Kekchi, Mam, Achi, Ixil, Awakatek, Jakaltek or Qanjobal, coming from communities in Venezuela, Honduras, Guatemala and other countries. They may be leaving their homelands precisely because their rights as Indigenous Peoples, for example the right to occupy land collectively and without forcible removal, have been violated. But once they reach the United States, they are treated as any other migrants, without regard …

Pandemic Emotions: The Good, The Bad, And The Unconscious —Implications For Public Health, Financial Economics, Law, And Leadership, Peter H. Huang

Publications

Pandemics lead to emotions that can be good, bad, and unconscious. This Article offers an interdisciplinary analysis of how emotions during pandemics affect people’s responses to pandemics, public health, financial economics, law, and leadership. Pandemics are heart-breaking health crises. Crises produce emotions that impact decision-making. This Article analyzes how fear and anger over COVID-19 fueled anti-Asian and anti-Asian American hatred and racism. COVID-19 caused massive tragic economic, emotional, mental, physical, and psychological suffering. These difficulties are interconnected and lead to vicious cycles. Fear distorts people’s decision readiness, deliberation, information acquisition, risk perception, and thinking. Distortions affect people’s financial, health, and …

The Uncanny Swipe Drive: The Return Of A Racist Mode Of Algorithmic Thought On Dating Apps, Gregory Narr Jan 2021

The Uncanny Swipe Drive: The Return Of A Racist Mode Of Algorithmic Thought On Dating Apps, Gregory Narr

Publications and Research

As algorithmic media amplify longstanding social oppression, they also seek to colonize every last bit of sociality where that oppression could be resisted. Swipe apps constitute prototypical examples of this dynamic. By employing protocols that foster absent-minded engagement, they allow unconscious racial preferences to be expressed without troubling users’ perceptions of themselves as non-racist. These preferences are then measured by recommender systems that treat “attractiveness” as a zero-sum game, allocate affective flows according to the winners and losers of those games, and ultimately amplify the salience of race as a factor of success for finding intimacy. In thus priming users …

Black Male Collegiate Athletes’ Perceptions Of Their Career And Academic Preparation: A Mixed Methods Study, Jennifer R. Curry, Franklin A. Soares, Justin E. Maclin, Imre Csaszar Jan 2021

Black Male Collegiate Athletes’ Perceptions Of Their Career And Academic Preparation: A Mixed Methods Study, Jennifer R. Curry, Franklin A. Soares, Justin E. Maclin, Imre Csaszar

Journal of College Access

We employed a mixed methods approach with sequential explanatory design (Creswell & Plano Clark, 2017) and a Social Capital Theory framework (Bourdieu, 1977) to investigate three research questions: (1) In what ways were participants’ career and college readiness capital developed during high school? (2) How do participants view their academic and career growth and development prior to and after coming to college? (3) Who provided career and college development to participants in this study prior to their college entrance? Results revealed potential reasons why disparities existed between Black and White participants beginning in K-12 and continuing through college. Implications for …
