Conscience In Commerce: Conceptualizing Discrimination In Public Accommodations, Amy J. Sepinwall Jan 2021

Conscience In Commerce: Conceptualizing Discrimination In Public Accommodations, Amy J. Sepinwall

Connecticut Law Review

According to much current law and theory, a public accommodation that offers a good or service to one customer cannot refuse to provide that same good or service to another patron simply because of the latter’s identity. Thus, in many jurisdictions, reception hall owners must rent their spaces to both a Black Baptist Church and the Christian Identity KKK, wedding vendors must sell their goods to a marrying couple no matter the sex of the couple’s members, and foster parent agencies must serve same- and opposite-sex parenting duos alike. Call the principle underpinning this policy the “Equal Access” principle: The …

Compulsory Conjugality, Erez Aloni Jan 2021

Compulsory Conjugality, Erez Aloni

Connecticut Law Review

What happens when the state changes the default rules that govern financial obligations between unmarried partners from opt in to opt out? Most states have an opt-in rule: unmarried partners do not take on financial obligations of one another unless they agree to do so with a contract. Nevertheless, advocates argue that an opt-out system puts the burden in the right place: unmarried couples who want to avoid default obligations should bear the burden of making contracts. A scholarly debate over the opt-in/opt-out model has raged for twenty years, but the issue is now coming to a head. Yet no …

Hate Speech On Social Media: Content Moderation In Context, Richard A. Wilson, Molly Land Jan 2021

Hate Speech On Social Media: Content Moderation In Context, Richard A. Wilson, Molly Land

Connecticut Law Review

For all practical purposes, the policy of social media companies to suppress hate speech on their platforms means that the longstanding debate in the United States about whether to limit hate speech in the public square has been resolved in favor of vigorous regulation. Nonetheless, revisiting these debates provides insights essential for developing more empirically-based and narrowly tailored policies regarding online hate.

First, a central issue in the hate speech debate is the extent to which hate speech contributes to violence. Those in favor of more robust regulation claim a connection to violence, while others dismiss these arguments as tenuous. …

Constitutional Chronometry, Legal Continuity, Stability And The Rule Of Law: A Canadian Perspective On Aspects Of Richard Kay’S Scholarship, Warren J. Newman Jan 2021

Constitutional Chronometry, Legal Continuity, Stability And The Rule Of Law: A Canadian Perspective On Aspects Of Richard Kay’S Scholarship, Warren J. Newman

Connecticut Law Review

The United States and Canada have many common traits, including a constitutional heritage originally derived in part from British common law and statute, a written constitution declared to be supreme law, a federal and local state (or provincial) division of legislative powers, an entrenched bill of rights, written procedures for constitutional amendment, and constitutional judicial review. However, while the United States has a presidential and congressional system of government, Canada is a constitutional monarchy with a parliamentary system of responsible government. Moreover, unlike the United States, Canada achieved its independence from the United Kingdom gradually and incrementally, within the existing …

Legislative Intentions In Antonin Scalia’S And Bryan Garner’S Textualism, Jeffrey Goldsworthy Jan 2021

Legislative Intentions In Antonin Scalia’S And Bryan Garner’S Textualism, Jeffrey Goldsworthy

Connecticut Law Review

In Reading Law, the late Justice Antonin Scalia and his co-author Bryan Garner defend “pure textualism,” partly because they deny that legislatures can have any intentions other than to enact statutory texts. This denial would, if adhered to rigorously, make their version of textualism unviable. It is inconsistent with context and purpose being used to (a) dispel ambiguities, (b) correct scrivener’s errors, (c) reveal presumptions or background assumptions that qualify literal textual meanings, (d) reveal most kinds of implicit and implied content, and (e) resolve conflicts between the interpretive canons. It would, in other words, entail hyperliteralism, which Scalia and …

Two Constitutional Rights, Two Constitutional Controversies, Michael J. Perry Jan 2021

Two Constitutional Rights, Two Constitutional Controversies, Michael J. Perry

Connecticut Law Review

This Article is my contribution to the Festschrift celebrating the distinguished scholarly career of Richard S. Kay, Wallace Stevens Professor Emeritus, and Oliver Ellsworth Research Professor, University of Connecticut School of Law. My overarching aim in the Article is to defend a particular understanding of two constitutional rights and, relatedly, a particular resolution of two constitutional controversies. The two rights I discuss are among the most important rights protected by the constitutional law of the United States: the right to equal protection and the right of privacy. As I explain in the Article, the constitutional right to equal protection is, …

A Low-Cost, Wireless, Multi-Channel Deep Brain Stimulation System For Rodents, F. N. U. Tala, Jordan Leiber, Hayden Fisher, Naga Spandana Muppaneni, Benjamin C. Johnson

Electrical and Computer Engineering Faculty Publications and Presentations

We present a small (43mm x 24mm x 15mm), off-the-shelf wireless neurostimulator for rodent deep brain stimulation research. Our device enables researchers to wirelessly configure stimulator settings, such as amplitude, pulse width, channel selection, and frequency, via a phone app. The system uses impedance-independent current-mode stimulation and steers current to a selected channel. In addition to monophasic and biphasic stimulation, the system also supports arbitrary waveform stimulation using pre-stored lookup tables. The system uses a configurable grounding phase to clear residual charge and a stimulation compliance monitor to ensure safe operation. The compliance monitor wirelessly reports the current during stimulation, …

The Class Action Struggle: Should Bristol-Myer's Limit On Personal Jurisdiction Apply To Class Actions?, John Mikuta Jan 2021

The Class Action Struggle: Should Bristol-Myer's Limit On Personal Jurisdiction Apply To Class Actions?, John Mikuta

Emory Law Journal

In Bristol-Myers Squibb Co. v. Superior Court of California, the Supreme Court held that, in a coordinated mass action, a court may not exercise specific personal jurisdiction over claims from non-resident plaintiffs who did not suffer their injuries in the forum state. The Court, however, did not explicitly state whether and how its holding would apply to class actions. In March 2020, federal appellate courts began to be confronted with the issue. While the D.C. Circuit in Molock v. Whole Foods Group, Inc. side-stepped the personal jurisdiction question, Judge Silberman’s dissenting opinion argued that the logic of Bristol-Myers should …

What Makes Property Liberal?, Adam J. Macleod Jan 2021

What Makes Property Liberal?, Adam J. Macleod

Scholarly Articles

Hanoch Dagan is offering to help an institution that is in the midst of an identity crisis. For many centuries, property has found its identity in service to liberty. Liberty – both broadly construed as a practical ideal and in the technical sense of a Hohfeldian right that is the absence of duty – stood for independence from outside interference and freedom to act upon one’s own plans of action for the use and management of resources, individually and in community with those who share the same common goods. Though many people still think liberty in that sense is important, …

Information Age Technology, Industrial Age Laws, Elizabeth I. Winston Jan 2021

Information Age Technology, Industrial Age Laws, Elizabeth I. Winston

Scholarly Articles

The United States patent system was born during the Industrial Age — at a time where the focus was on promoting innovation in machines, and tangible means of changing the world. With the dawn of the Information Age, innovation is increasingly intangible. The industrial age laws, as currently interpreted, are not well-suited for the changing and evolving technological world. Information age innovators face challenges at the United States Patent and Trademark Office, through the judicial system and at the United States International Trade Commission. It is time for a change in the system to reflect the realities of modern technology. …
