The United States Supreme Court’s 2010 opinion in the crush-video case of United States v. Stevens made it extremely difficult to declare new varieties of low-value speech unprotected by the First Amendment. Five years later, the Court’s sign-ordinance ruling in Reed v. Town of Gilbert made it exceedingly tough for facially content-based regulations imposed on presumptively protected speech to be analyzed by any standard of judicial review less rigorous than the demanding strict scrutiny test. In cases that allege price fixing or other per se violations of Section 1 of the Sherman Act, courts usually begin their opinions by saying there is no direct evidence of agreement—evidence like a “recorded phone call” that is “explicit and requires no inferences to establish” that the necessary direct communications occurred. Only at that point do the courts turn to the sufficiency of the inferences of agreement from circumstantial evidence. Courts highlight the absence of direct evidence of agreement in this way because of its special role on motions to dismiss or for summary judgment, when courts do not …

This Article examines the standard of scrutiny courts should apply when testing the validity of laws banning speech-based sexual orientation change efforts (SOCE) against First Amendment challenges. Justice Clarence Thomas’s 2018 opinion for a five-justice conservative majority of the United States Supreme Court in National Institute of Family and Life Advocates v. Becerra casts considerable doubt on whether a level of inquiry less stringent than strict scrutiny applies. The article analyzes how lower courts after Becerra that have reviewed anti-SOCE laws disagree on the issue. And yet, as the Article explains, the Supreme Court refuses to clarify the muddle. In this paper we document the precarity of translingual pedagogies (Canagarajah, 2013), those occurring when languages are in contact and mutually influencing each other with emergent meanings and grammars. Sharing translingual art and literature during a public Lunar New Year Celebration, we turn to memoir methodologies for understanding “trans” practices: those that transgress singular codes, modalities, human/nonhuman cultures, and personal-scientific boundaries. Our findings (and lost things) identify the challenges and possibilities of working in the liminal space of fractured social and linguistic identities.

This thesis shows how The Orphic Hymns function as a katábasis, a descent to the underworld, representing a process of becoming and psychological rebirth. I begin with the Greek concept of sparagmόs, a dismemberment or deconstruction, as a necessary precursor in that it emphasises at once both primordial unity and yet also the incipient tensions within the Orphic initiates on this path to katabasis. The argument herein extends beyond literary explication to consider how the Orphics sought to enact this process in Greek society itself.

BACKGROUND: Robotic surgery presents a challenge to effective teamwork and communication in the operating theatre (OR). Our objective was to evaluate the effect of using a wireless audio headset device on communication, efficiency and patient outcome in robotic surgery.

METHODS AND FINDINGS: A prospective controlled trial of team members participating in gynecologic and urologic robotic procedures between January and March 2015. In the first phase, all surgeries were performed without headsets (control), followed by the intervention phase where all team members used the wireless headsets. The Urla Basin is an approximately 20 km wide and 30 km long N-S-trending strike-slip basin, located in the westernmost part of the Western Anatolia Extensional Province. Although the basin-fill units are generally composed of sedimentary and volcanic rocks of Miocene to Recent, Triassic and Late Cretaceous-Paleocene sedimentary rocks are also exposed in the middle and western part of the basin. We examined relations between ‘darkness’ of dark tourism sites, provocation, and select indicators of the quality of visitors’ immediate subjective experiences. Experience observations (N = 101) were collected from tourists who visited Auschwitz (Krakow), Schindler’s Factory (Krakow), Execution Square (Paris), and a ghost tour (Edinburgh). Research participants completed measures of provocation and quality of experience at the end of their visits to each site. Hypotheses were founded in four theories: self-determination theory, cognitive dissonance theory, arousal theory, and the theory of structured experience. These hypotheses proposed that particular experience outcomes vary according to the ‘darkness’ of the dark tourism site. …

Tchaikovsky’s ballet Sleeping Beauty was first produced in the Mariinsky Theatre in St. Petersburg on January 15, 1890. Since the ballet’s debut, the design and construction of the leading tutus have evolved and spread considerably. In most modern renditions of this particular ballet, the silhouette of the tutu includes a skirt made of net tulle that sticks straight out from either the hip or the waist, depending on the exact style. This silhouette that is so integral to a majority of modern ballets did not appear until the 1870s, just twenty short years before Sleeping Beauty’s debut. This project will …

What are the implications of this for criminalised individuals incarcerated in a prison system in England and Wales, that works with extremely low budgets, makes heavy use of pre-packaged convenience food and serves food to prisoners in their cells? This article explores the possible repercussions of Brexit upon Italian foreign policy. Whilst Italy has not modified its foreign policy fundamentally following the result of the 2016 referendum on Brexit, we argue that Brexit has, however, led to a change in the European balance of power. This has exposed Italian foreign policy, which has had to adjust accordingly. Background: The need for greater flexibility is often used to justify reforms that redistribute tasks through the workforce. However, "flexibility" is never defined or empirically examined. This study explores the nature of flexibility in a team of emergency doctors, nurse practitioners (NPs), and registered nurses (RNs), with the aim of clarifying the concept of workforce flexibility. Taking a holistic perspective on the team's division of labor, it measures task distribution to establish the extent of multiskilling and role overlap, and explores the behaviors and organizational conditions that drive flexibly.

This study explores visitor experience at the National Anzac Centre in Western Australia using multiple qualitative methods. Initially, Nethnography is used to assemble a blend of lived experience and online non-dialogical commentary. Nethnography (an alternative to Netnography) is used here as a mechanism for data grooming. Three data sets inform this study: 500 Trip Advisor comments, 500 Visitors’ Book comments and four days of participant observation. The data are then analysed using Reflexive Thematic Analysis and Leximancer in the unsupervised mode.
