Faculty Research 2020

Metabolic dysfunction underlies several chronic diseases, many of which are exacerbated by obesity. Dietary interventions can reverse metabolic declines and slow aging, although compliance issues remain paramount. 17α-estradiol treatment improves metabolic parameters and slows aging in male mice. The mechanisms by which 17α-estradiol elicits these benefits remain unresolved. Herein, we show that 17α-estradiol elicits similar genomic binding and transcriptional activation through estrogen receptor α (ERα) to that of 17β-estradiol. In addition, we show that the ablation of ERα completely attenuates the beneficial metabolic effects of 17α-E2 in male mice. Our findings suggest that 17α-E2 may act through the liver and …

The Rationality Of Motherhood, Genevieve Kineke Dec 2020

The Rationality Of Motherhood, Genevieve Kineke

Theology Graduate Theses

Since both men and women, made in the divine image, bear rational souls, and the Catholic understanding of redemption requires that persons respond freely to the gift of grace, Saint Paul’s comment to Timothy that women can be saved through childbearing (cf. 1 Timothy 2:13-15) indicates that motherhood must be rational. This thesis responds to three different arguments against that premise—those of Simone deBeauvoir, Julia Kristeva, and Gertrude von le Fort—by illustrating that Thomas Aquinas’ application of Aristotelian principles restores both a proper understanding of rationality and how our hylemorphic construct directs us to our supernatural end. Weaving together a …

The Relationship Between Professional Nurse Certification And Nurse-Sensitive Patient Outcomes In The Acute Care Setting: An Integrative Literature Review, Julie Oss Dec 2020

The Relationship Between Professional Nurse Certification And Nurse-Sensitive Patient Outcomes In The Acute Care Setting: An Integrative Literature Review, Julie Oss

Nursing Masters Papers

Healthcare organizations are charged with controlling rising costs, integrating services, and improving the quality of care. This Scholarly Inquiry Project has led to a closer look at the impact nurses have on patient care outcomes. Little research correlates specialty nurse certification with patient outcomes, even though certification is the hallmark of excellence in clinical nursing practice. Qualitative data validates that nurses who attain specialty certification report feeling more empowered, having additional innate worth, and more collaborative influence. Despite the robust subjective evidence, limited data exist to demonstrate the objective benefits of specialty certification on patient outcomes. The purpose of this …

Vessel Trajectory Prediction Using Historical Ais Data, Jagir Laxmichand Charla Dec 2020

Vessel Trajectory Prediction Using Historical Ais Data, Jagir Laxmichand Charla

Dissertations and Theses

Maritime vessel position coordinates are important information for maritime situational planning and organization. A better estimate of future locations of the maritime vessels, from their current locations, can help maritime authorities to make planned decisions, which can be helpful to avoid traffic congestion and longer waiting times. This thesis develops a method for estimating future locations of the vessels using their current and previous locations and other data.

The motivating scenario for this work is that of determining the future locations of the vessels based on their current location and previous locations for accurate modelling of underwater acoustic noise. As …

An Overview Of The Effect Of Bioaerosol Size In Coronavirus Disease 2019 Transmission, Marcelo I. Guzman Dec 2020

An Overview Of The Effect Of Bioaerosol Size In Coronavirus Disease 2019 Transmission, Marcelo I. Guzman

Chemistry Faculty Publications

The fast spread of coronavirus disease 2019 (COVID-19) constitutes a worldwide challenge to the public health, educational and trade systems, affecting the overall well-being of human societies. The high transmission and mortality rates of this virus, and the unavailability of a vaccine or treatment, resulted in the decision of multiple governments to enact measures of social distancing. Such measures can reduce the exposure to bioaerosols, which can result in pathogen deposition in the respiratory tract of the host causing disease and an immunological response. Thus, it is important to consider the validity of the proposal for keeping a distance of …

Metalearning By Exploiting Granular Machine Learning Pipeline Metadata, Brandon J. Schoenfeld Dec 2020

Metalearning By Exploiting Granular Machine Learning Pipeline Metadata, Brandon J. Schoenfeld

Theses and Dissertations

Automatic machine learning (AutoML) systems have been shown to perform better when they use metamodels trained offline. Existing offline metalearning approaches treat ML models as black boxes. However, modern ML models often compose multiple ML algorithms into ML pipelines. We expand previous metalearning work on estimating the performance and ranking of ML models by exploiting the metadata about which ML algorithms are used in a given pipeline. We propose a dynamically assembled neural network with the potential to model arbitrary DAG structures. We compare our proposed metamodel against reasonable baselines that exploit varying amounts of pipeline metadata, including metamodels used …

Zanubrutinib For The Treatment Of Myd88 Wild-Type Waldenström Macroglobulinemia: A Substudy Of The Phase 3 Aspen Trial, M Dimopoulos, Aspen Investigators Dec 2020

Zanubrutinib For The Treatment Of Myd88 Wild-Type Waldenström Macroglobulinemia: A Substudy Of The Phase 3 Aspen Trial, M Dimopoulos, Aspen Investigators

Peninsula Medical School

Patients with Waldenström macroglobulinemia (WM) lacking activating mutations in the MYD88 gene (MYD88WT) have demonstrated relatively poor outcomes to ibrutinib monotherapy, with no major responses reported in a phase 2 pivotal study. Zanubrutinib is a novel, selective Bruton tyrosine kinase (BTK) inhibitor designed to maximize BTK occupancy and minimize off-target activity. The ASPEN study consisted of a randomized comparison of zanubrutinib and ibrutinib efficacy and safety in patients with WM who have the MYD88 mutation, as well as a separate cohort of patients without MYD88 mutation (MYD88WT) or with unknown mutational status who received zanubrutinib. Results from the latter single-arm …

Constraints And Affordances Of Online Engagement With Scientific Information—A Literature Review, Friederike Hendriks, Elisabeth Mayweg-Paus, Mark Felton, Kalypso Iordanou, Regina Jucks, Maria Zimmermann

Faculty Research, Scholarly, and Creative Activity

Many urgent problems that societies currently face—from climate change to a global pandemic—require citizens to engage with scientific information as members of democratic societies as well as to solve problems in their personal lives. Most often, to solve their epistemic aims (aims directed at achieving knowledge and understanding) regarding such socio-scientific issues, individuals search for information online, where there exists a multitude of possibly relevant and highly interconnected sources of different perspectives, sometimes providing conflicting information. The paper provides a review of the literature aimed at identifying (a) constraints and affordances that scientific knowledge and the online information environment entail …

Equitable Defenses In Patent Law, Christa J. Laser Dec 2020

Equitable Defenses In Patent Law, Christa J. Laser

University of Miami Law Review

In patent law, “unenforceability” can have immense consequences. At least five equitable doctrines make up the defense of “unenforceability” as it was codified into the Patent Act in 1952: laches; estoppel; unclean hands; patent misuse; and according to some, inequitable conduct. Yet in the seventy years since incorporation of equitable defenses into the patent statute, the Supreme Court has not clarified their reach. Indeed, twice in the last four years, the Supreme Court avoided giving complete guidance on the crucial questions of whether, and when, such equitable defenses are available to bar damages in cases brought at law.

Several interpretive …

Twenty-First Century Formalism, Thomas B. Nachbar Dec 2020

Twenty-First Century Formalism, Thomas B. Nachbar

University of Miami Law Review

Formalism is one of the most widely applied but misunderstood features of law. Embroiled in a series of conflicts over the course of the twentieth century, formalism’s meaning has become confused as formalism has been enlisted by both proponents and opponents of specific legal methodologies. For some, formalism has simply become an epithet used to describe virtually anything they dislike in legal thinking. Used often and inconsistently as a stand-in (and frequently a strawman), formalism’s distinct identity has been lost, its meaning merged with whatever methodology it is being used to support or attack.

This Article seeks to separate formalism …

The Middle Ground: A Meaningful Balance Between The Benefits And Limitations Of Artificial Intelligence To Assist With The Justice Gap, Katherine L. W. Norton Dec 2020

The Middle Ground: A Meaningful Balance Between The Benefits And Limitations Of Artificial Intelligence To Assist With The Justice Gap, Katherine L. W. Norton

University of Miami Law Review

Access to justice continues to be an ongoing battle for those who cannot afford an attorney in civil legal matters. These civil legal matters touch issues that significantly impact daily life, from issues relating to health, such as advance directives, to family, such as custody of children. Lawyers, courts, and scholars have attempted to tackle this ongoing problem in our justice system. Some suggest that providing free counsel for all civil legal matters is the solution, while others suggest that self-help materials provide more immediate access to services and information. Regardless of the position one takes, the need is clear …

Of What Consequence?: Sexual Offender Laws And Federal Habeas Relief, Katherine A. Mitchell Dec 2020

Of What Consequence?: Sexual Offender Laws And Federal Habeas Relief, Katherine A. Mitchell

University of Miami Law Review

New concerns for an old writ. The relatively recent advent of sex offender registries has led to consequences in the habeas corpus context—and they may be more than collateral. In particular, are the restraints imposed on registered sex offenders severe enough to constitute custody for habeas jurisdiction? With a recent split among the federal circuit courts, this Article attempts to decipher which side of the split the Supreme Court will—and should—fall.

Lamps Plus, Inc. V. Varela: Dark Times Ahead For Class Arbitrations, Joanna Niworowski Dec 2020

Lamps Plus, Inc. V. Varela: Dark Times Ahead For Class Arbitrations, Joanna Niworowski

University of Miami Law Review

The Federal Arbitration Act (“FAA”) was enacted in 1925 to combat judicial hostility towards arbitration. Over the years, the U.S. Supreme Court has interpreted this statute as evidencing a pro-arbitration policy and has upheld the use of arbitration clauses in a variety of contracts. Unfortunately, while the FAA was able to overcome the hostility towards arbitration, it was not able to stop the Court from finding a new target: class arbitrations.

This Comment analyzes the Supreme Court’s recent decision in Lamps Plus, Inc. v. Varela. In critiquing the Court’s continued erosion of the availability of class arbitrations, this Comment considers …

Algorithms And Omertà: A Discussion Of Compatibility Between Seemingly Disparate Legal Spheres, Cameron Chuback Dec 2020

Algorithms And Omertà: A Discussion Of Compatibility Between Seemingly Disparate Legal Spheres, Cameron Chuback

University of Miami Law Review

This Note assesses the viability of federal prosecutors’ use of the Racketeer Influenced and Corrupt Organizations Act (“RICO”) to prosecute spoofing, a market manipulating trading practice characterized by the cancellation of large orders meant to artificially alter market prices. Traditional spoofing convictions have been difficult to secure because of spoofing’s complicated and esoteric nature and difficult-to-prove elements. Now, for the first time, prosecutors in United States v. Smith have indicted alleged spoofers under RICO, which Congress designed with the intent to overcome evidentiary difficulties in organized crime prosecutions, particularly prosecutions of the American Mafia. However, the disparity between spoofing and …

Galectin-1 Improves Sarcolemma Repair And Decreases The Inflammatory Response In Lgmd2b Models, Matthew F. Rathgeber Dec 2020

Galectin-1 Improves Sarcolemma Repair And Decreases The Inflammatory Response In Lgmd2b Models, Matthew F. Rathgeber

Theses and Dissertations

Limb-girdle muscular dystrophy type 2B (LGMD2B) is caused by mutations in the dysferlin gene, resulting in non-functional dysferlin, a key protein found in muscle membrane. Treatment options available for patients are chiefly palliative in nature and focus on maintaining ambulation. Our hypothesis is that galectin-1 (Gal-1), a soluble carbohydrate binding protein, increases membrane repair capacity, myogenic potential, M2 macrophage polarization and decreases NF-κB inflammation in dysferlin-deficient models. To test this hypothesis, we used recombinant human galectin-1 (rHsGal-1) to treat dysferlin-deficient models. We show that rHsGal-1 treatments of 48 h-72 h promotes myogenic maturation as indicated through improvements in size, myotube …

Work Motivation Variances Influence On The Three Major Generations In Federal Student Aid, Dallas B. Mallory Dec 2020

Work Motivation Variances Influence On The Three Major Generations In Federal Student Aid, Dallas B. Mallory

Interdisciplinary Leadership Dissertations

Public service motivation (PSM) is a characteristic that is exhibited through employees' desire to serve in the interest of the communities they serve. In keeping up with the current times and technology advances in the workplace, federal agencies are continually introducing new and innovative ways to complete goals in these environments. Government agencies across the United States are repeatedly asking Commissioners and Secretaries to do more work with fewer workers. In addition to fewer public servants in government, the Baby Boomers looking to retire within the next ten years, and the transfer of knowledge to Generation X and Millennials needs …

Department of Surgery Faculty Papers

Castleman disease (CD) includes a group of rare and heterogeneous disorders with characteristic lymph node histopathological abnormalities. CD can occur in a single lymph node station, which is referred to as unicentric CD (UCD). CD can also involve multicentric lymphadenopathy and inflammatory symptoms (multicentric CD [MCD]). MCD includes human herpesvirus-8 (HHV-8)-associated MCD, POEMS-associated MCD, and HHV-8-/idiopathic MCD (iMCD). The first-ever diagnostic and treatment guidelines were recently developed for iMCD by an international expert consortium convened by the Castleman Disease Collaborative Network (CDCN). The focus of this report is to establish similar guidelines for the management of UCD. To this purpose, …
