Effects Of Parental Incarceration On Children’S Mental Health And Educational Success By Race And Gender, Julia Stergas

Perspectives

This literature review will evaluate the extent to which parental incarceration impacts children’s mental health and educational success and how these effects differ by race and gender. An introductory section will be followed by definitions of mental health, educational success, race, and gender as they appear in the literature. My discussion on mental health will focus on how parental incarceration places children at greater risk for poor mental health outcomes and how young boys and girls exhibit different mental health problems after experiencing parental incarceration. My discussion on educational success will focus on how parental incarceration is associated with children’s …

An Examination Of Defense Attorney Knowledge Of Dispatcher Practices In Eyewitness Calls, Elena Christofi Jun 2020

An Examination Of Defense Attorney Knowledge Of Dispatcher Practices In Eyewitness Calls, Elena Christofi

Student Theses

911 dispatchers are often the first point of contact for witnesses to crimes. Dispatchers have an important role in collecting information related to a witness’ observations and recollection of events, and this information can serve as primary evidence in criminal cases. Therefore, it is crucial that evidence collected from eyewitnesses is as accurate and detailed as possible. In the present study, we investigated defense attorneys’ perceptions on how dispatchers gather information from eyewitnesses during 911 calls, because little is known with respect to how defense attorneys review, use, and challenge 911 calls. Using an online survey, we asked defense attorneys …

Worth The Effort?: Assessing The Khmer Rouge Tribunal, Diane Orentlicher

Scholarly Articles in Law Reviews & Journals

Every international and hybrid war crimes court has attracted a measure of controversy, but none more than the Extraordinary Chambers in the Courts of Cambodia (ECCC). While myriad aspects of the ECCC’s record are crucial to its legacy, this article explores one question of overarching importance: whether its performance has justified a key risk the UN assumed when it agreed to support the court — that case selection would be improperly influenced by the Cambodian government. More particularly, it assesses the ECCC’s performance in light of two questions: How well have safeguards against political interference worked? Are survivors of Khmer …

As a native of Omaha with years of accumulated wisdom as to the plight of my beloved race, I have a responsibility to speak up during these tumultuous times. I do not have the right, however, to speak for my community. I am observing a tremendous surge of activism and conversation among black Omahans, from our elected officials and organizational leaders to our lay leaders and, most importantly, our young leaders.

Power Struggles: Sovereignty And The Nonhuman In South Africa, Taelin Wilford Jun 2020

Power Struggles: Sovereignty And The Nonhuman In South Africa, Taelin Wilford

Undergraduate Honors Theses

This thesis uses the theoretical backbone of Jacques Derrida’s The Beast and the Sovereign to look at the theme of the nonhuman in connection with sovereignty in three novels representing three major time periods in South Africa. Zakes Mda’s The Heart of Redness uses the nonhuman in the form of the supernatural to reveal the limits of sovereignty in Colonial South Africa. J.M. Coetzee’s Disgrace makes use of the nonhuman in the form of animals to talk about the transient nature of sovereignty in post-Apartheid South Africa. Lauren Beukes’ Zoo City is set in an alternate future South Africa and …

Appellate Briefs

Amici are scholars of federal courts and/or criminal law, studying the operation and purposes of federal jurisdiction and criminal law. Although they have divergent legal and political outlooks, amici share a keen interest in the federal courts and criminal law, having published extensively on these topics and collected decades of experience examining issues implicated in this case.

Amici share a concern that the lower court’s judgment threatens the rule of law this Court announced in Miller v. Alabama, 567 U.S. 460 (2012) 4 and affirmed in Montgomery v. Louisiana, 136 S. Ct. 718 (2016) that life without the …

#Metoo Meets The Emergency Room: Providing And Paying For Care After A Sexual Assault, Stacey L. Worthy, Shruti R. Kulkarni, Taylor J. Kelly, Jessica Johnson

Saint Louis University Journal of Health Law & Policy

Sexual assault continues to be a major public health problem in the United States. Compounding the problem, survivors of sexual assault all too often face challenges of obtaining and paying for sexual assault forensic exams (SAFEs), commonly referred to as a “rape kit,” and related medical services. Sexual assault survivors who do seek medical care in the emergency department (ED) are often turned away for several reasons, such as EDs determining that sexual assault is not an emergency medical condition, failing to carry SAFEs, or refusing to treat survivors who lack proof of insurance. Denial of care can …

What’S In The Cloud? - An Examination Of The Impact Of Cloud Storage Usage On The Browser Cache., Graeme Horsman Jun 2020

What’S In The Cloud? - An Examination Of The Impact Of Cloud Storage Usage On The Browser Cache., Graeme Horsman

Journal of Digital Forensics, Security and Law

Cloud storage is now a well established and popular service adopted by many individuals, often at limited or no cost. It provides users with the ability to store content on a cloud service provider’s infrastructure offering the benefit of redundancy, reliability, security, flexibility of access and the potential assumed liability of the provider for data loss within the contexts of a licensing agreement. Consequently, this form of remote storage provides a regulatory challenge as content which once resided upon a seized digital exhibit, available for scrutiny during a digital forensic investigatory, may no longer be present where attempting to acquire …

Attitudinal Changes Toward Body-Worn Cameras: Perceptions Of Cameras, Organizational Justice, And Procedural Justice Among Volunteer And Mandated Officers, Jessica Huff, Charles M. Katz, Vincent J. Webb, E. C. Hedberg Jun 2020

Attitudinal Changes Toward Body-Worn Cameras: Perceptions Of Cameras, Organizational Justice, And Procedural Justice Among Volunteer And Mandated Officers, Jessica Huff, Charles M. Katz, Vincent J. Webb, E. C. Hedberg

Criminology and Criminal Justice Faculty Publications

Little is known about officer perceptions of body-worn cameras (BWCs), and whether perceptions change following implementation within their agencies. BWC deployment varies, with some agencies mandating officers to wear BWCs and others using volunteers. Researchers have yet to assess attitudinal differences between volunteers and mandated officers. This study addresses these gaps using data from an evaluation of BWCs in the Phoenix Police Department to examine officer perceptions of the utility of BWCs, perceptions of organizational justice, and support for using procedural justice. We use inverse propensity weighted difference-in-difference models to examine changes in officer perceptions over time between randomly selected …

Putting The Fetus First — Legal Regulation, Motherhood, And Pregnancy, E Milne Jun 2020

Putting The Fetus First — Legal Regulation, Motherhood, And Pregnancy, E Milne

School of Law, Humanities and Social Sciences

The fetus-first mentality advocates that pregnant women and women who could become pregnant should put the needs and well-being of their fetus before their own. As this Article will illustrate, this popular public perception has pervaded criminal law, impacting responses to women deemed to be the “irresponsible” pregnant woman and so the “bad” mother. The Article considers cases from Alabama and Indiana in the United States and England in the United Kingdom, providing clear evidence that concerns about the behavior of pregnant women now hang heavy over criminal justice responses to women who experience a negative pregnancy outcome or who …

Restorative Justice Approaches To The Informal Resolution Of Student Sexual Misconduct, Madison Orcutt B.A., Patricia M. Petrowski J.D., David R. Karp Phd, Jordan Draper Phd Jun 2020

Restorative Justice Approaches To The Informal Resolution Of Student Sexual Misconduct, Madison Orcutt B.A., Patricia M. Petrowski J.D., David R. Karp Phd, Jordan Draper Phd

School of Leadership and Education Sciences: Faculty Scholarship

This article reviews controversies about campus Title IX adjudication and the recent implementation of restorative justice (or RJ) responses to campus sexual harm. The RJ approach focuses on who has been harmed, what their needs are, and how the person who harmed them can meet those needs. Instead of engaging in adjudication, RJ aims to get an individual who caused harm to understand the impact of and take responsibility for their actions. Part I defines the RJ approach, describes various practices, and details the preparation necessary for a structured informal resolution process. Part II explains why RJ approaches have been …

A Component Analysis Of Implementation Planning: Examining Mechanisms That Underlie A Teacher Implementation Support Strategy, James Jaran Upright Jun 2020

A Component Analysis Of Implementation Planning: Examining Mechanisms That Underlie A Teacher Implementation Support Strategy, James Jaran Upright

LSU Doctoral Dissertations

To maximize instructional time, teachers must be able to effectively manage student behavior. However, surveys consistently reveal that a significant portion of teachers feel underprepared to address challenging classroom behavior. One of the most effective ways to reduce problem behaviors in school is with systematic classroom management strategies, such as the good behavior game. However, teachers often struggle to effectively implement such procedures. Promising evidence has emerged for implementation planning as an effective support strategy to improve teachers’ intervention implementation. Implementation planning is a one-time consultation process for intervention procedure planning (action planning) and identification and resolution of implementation barriers …

Immigration, Crime, And Policy, Tiara Grayson Jun 2020

Immigration, Crime, And Policy, Tiara Grayson

Theses

When viewing the criminal justice system, it is always investigated through a criminological approach. Meaning, there are numerous studies that attempt to get an understanding of why crime occurs, rather than the “why” in regards to the criminal justice system. The actors of the criminal justice system and their methods of crime control are rarely examined. In this paper, I will examine the behaviors of those who are attached to the criminal justice system; this includes the police, the media, politicians, and the public, who all play a role in how the criminal justice system functions, regarding immigration. Studying the …
