Between Soledad And Attica Brothers: The Raiford Protests And Prison Activism In Florida, Alexander Obermueller Jun 2020

Between Soledad And Attica Brothers: The Raiford Protests And Prison Activism In Florida, Alexander Obermueller

USF Tampa Graduate Theses and Dissertations

In February of 1971 prisoners staged a weeklong protest at Florida’s largest prison near the rural town of Raiford. Prior to the Raiford sit-in and hunger strike, George Jackson had only recently published his prison letters and six months after the Raiford uprising a similar protest would rock Attica Correctional Facility and bring prisoners’ rights into national news. This thesis situates Raiford prisoners’ protests in the context of an emerging prisoners’ rights movement. Prisoners made use of various protest forms, retracted their labor, and engaged in litigation to fundamentally challenge prison and achieve some improvements to their lives behind bars. …

The Role Of An Educational Intervention In Addressing Parent Spectator Behaviors In Louisiana Youth Sports, Jerry F. Reynolds Ii

LSU Doctoral Dissertations

Contemporary youth sports environments present significant psychosocial challenges to the family system. Among the greatest challenges to address are spectator behaviors of parents, which in the public eye has deteriorated and is out of control. Spectator behaviors and their impact upon the sports environment and family system is the topic of investigation in this study. Within the state of Louisiana, the advent of Act 355 extends the consequences of parent behavior and presents challenges to families, referees, and sports organizations. To better understand how legislation impacts parent perceptions of their spectator behaviors, the author examined spectator behaviors parents are observing, …

Is There A Difference Between Democrat And Republican States In The Number Of Female Students Who Experienced Cyberbullying?, Wayne Davis Jun 2020

Is There A Difference Between Democrat And Republican States In The Number Of Female Students Who Experienced Cyberbullying?, Wayne Davis

Lincoln Memorial University Journal of Humanities and Social Sciences

In the United States, cyberbullying has become a major public health concern. Because there is a difference between the Democrat Party and the Republican Party on their philosophies involving laws and government interventions related to the control of electronic communications, it is important to know if there is a difference between political partisanship and cyberbullying. Data were collected in 2011, 2013, 2015, and 2017 using a three-stage cluster sample design, which produced a nationally representative sample of students in grades 9–12 who attended public and private schools. Initially, this study employed Poisson regression, which is a parametric statistic, in an …

“You’Re Almost In This Place That Doesn’T Exist”: The Impact Of College In Prison As Understood By Formerly Incarcerated Students From The Northeastern United States, Hilary Binda, Jill D. Weinberg, Nora Maetzener, Carolyn Rubin

Journal of Prison Education and Reentry (2014-2023)

This qualitative study examines the immediate and lasting impact of liberal arts higher education in prison from the perspective of former college-in-prison students from the Northeastern United States. Findings obtained through semi-structured interviews with formerly incarcerated people are presented in the following three areas: self-confidence and agency, interpersonal relationships, and capacity for civic leadership. This study further examines former students’ reflections on the relationship between education and human transformation and begins to benchmark college programming with attention to the potential for such transformation. The authors identify four characteristics critical to a program’s success: academic rigor, the professor's respect for students, …

The Difference Of One Vote Or One Day: Reviewing The Demographics Of Florida’S Death Row After Hurst V. Florida, Melanie Kalmanson

University of Miami Law Review

As the federal appeals court with jurisdiction over Florida and Alabama—two leaders in capital punishment in the United States—the Eleventh Circuit reviews several claims each year related to capital punishment. Florida is home to one of the largest death row populations in the country. Thus, understanding Florida’s capital sentencing scheme is important for understanding capital punishment nationwide.

This Article analyzes the empirical demographics of Florida’s death row population and reviews how defendants are sentenced to death and ultimately executed in Florida. The analysis reveals that although age is not a factor upon which murder/manslaughter defendants are discriminated against in the …

Early Childhood Neurodevelopmental Profiles: Premature And Small For Gestational Age Infants, Alicia Gibson Jun 2020

Early Childhood Neurodevelopmental Profiles: Premature And Small For Gestational Age Infants, Alicia Gibson

Doctor of Psychology (PsyD)

Infants born premature (<37 >weeks) and small for gestational age (SGA; <5 >lbs, 8ozs, >37 weeks) are at greater risk for neurodevelopmental delays. Delays can be global neurodevelopmental differences, including academic achievement, communication development, and motor skills. Currently, there is not a large enough body of research differentiating the two groups. Neurodevelopmental profile score differences were analyzed between children born premature, children born SGA, children born both premature and SGA, and children born average for gestational age (AGA). Neurodevelopmental domains explored included social, adaptive, communication (expressive and receptive), motor (gross and fine), and cognitive functioning using the Battelle Developmental Inventory (BDI-2 …

Examining The Factors That Mediate The Relationship From Legal Advocacy Satisfaction To Resilience, Desta T. Gebregiorgis Jun 2020

Examining The Factors That Mediate The Relationship From Legal Advocacy Satisfaction To Resilience, Desta T. Gebregiorgis

Clinical Psychology Dissertations

Sexual assault is a public health issue that can impact one’s resilience. Using a multisystemic approach to resilience, there may be person-level and environment-level factors that can affect one’s resilience, such as one’s coping self-efficacy, satisfaction with the court process, and negative effects associated with court process. Legal advocacy programs, such as those offered by the King County Sexual Assault Resource Center (KCSARC), support clients during the court proceedings. In order to better serve KCSARC’s clientele, it is helpful to understand how the legal advocacy program impacts post-trauma resilience. This dissertation had three phases: (a) evaluating the structural validity of …

Examining Afro-Cultural Values In African American Women With Childhood Sexual Abuse History: Its Relationship With Therapeutic Outcomes, Bibi Aneesa Subhan

Student Theses

In the United States, African American women are not only more likely to have experiences of childhood sexual abuse (CSA) but experience some of the severest forms of it. The presence of Afro-cultural values can play a significant role in the therapeutic outcomes of women who do seek out treatment after their experiences of CSA. That is, Afro-cultural values such as spirituality, communalism, utilization of the Black Church, and adherence to the Strong Black Women archetype (SBWA) can impact the efficacy of treatment for Black female survivors of CSA. The purpose of this study is to assess the separate relationships …

Transgender Labour Market Outcomes: Evidence From The Us, Klavs Ciprikis, Damien Cassells, Jenny Berrill

Articles

Alternative labour market outcomes for men and women have been studied extensively in past literature. However, existing studies fail to directly compare labour market differences between transgender and non-transgender people. We utilize data from the 2015 Behavioral Risk Factor Surveillance Sys- tem in the United States to examine employment and wage differentials between transgender persons and non- transgender people using the Fairlie decomposition method of 2005. Our findings suggest that transgender people are less likely than non-transgender people to be employed, and are more likely than non-transgender people to receive lower wages. While some of the difference in employment and …

We began this project in the …

The Great Writ And Federal Courts: Judge Wood's Solution In Search Of A Problem, William H. Pryor Jr. Jun 2020

The Great Writ And Federal Courts: Judge Wood's Solution In Search Of A Problem, William H. Pryor Jr.

Notre Dame Law Review

Judge Diane Wood provides, in her characteristically efficient prose, a thoughtful overview of the history of the Great Writ in service of a thesis that her essay otherwise fails to support. Judge Wood invokes Judge Henry Friendly’s classic article, Is Innocence Irrelevant? Collateral Attack on Criminal Judgments, to suggest that the writ of habeas corpus should be expanded to allow federal courts to review the petitions of state prisoners who allege their actual innocence without otherwise identifying any violation of federal law in securing their convictions. But that thesis cannot be squared with the proposal Judge Friendly championed in …

A Workable Substantive Due Process, Timothy M. Tymkovich, Joshua Dos Santos, Joshua J. Craddock Jun 2020

A Workable Substantive Due Process, Timothy M. Tymkovich, Joshua Dos Santos, Joshua J. Craddock

Notre Dame Law Review

In this Article, we have three objectives. First, we’d like to add our own conceptualization of the various flavors of due process adjudication. Our aim here is not to add a new theory, but to explain what exists in new ways— to put all the pieces of the due process puzzle together and explain how they relate to each other. To the surprise of some, perhaps, we find a small kernel of originalist truth within current forms of substantive due process. In short, the “shocks the conscience” strand of substantive due process jurisprudence prohibits some egregious torts by the state. …

Assessing The Aspirations And Fears Of Costa Rican Youth In Long-Term Correctional Confinement, Theresa A. Ochoa, Yanúa Ovares Fernández, Ana Estrella Meza Rodríguez, Claire De Mezerville López

Journal of Prison Education and Reentry (2014-2023)

This study used the Possible Selves Questionnaire (PSQ) with 30 incarcerated youth in a long term juvenile correctional facility in Costa Rica. The PSQ is a self-administered survey that measures a person’s aspirations and fears for the future and strategies to achieve who they wish to become and avoid becoming. Results showed that while participants reported having Expected and Feared Selves, they struggled to identify concrete strategies to reach their goals. This vulnerable, incarcerated, population faces a variety of social challenges that may hinder their ability to avoid the behavior that led to their initial incarceration once they are …

The Enduring Challenges For Habeas Corpus, Diane P. Wood Jun 2020

The Enduring Challenges For Habeas Corpus, Diane P. Wood

Notre Dame Law Review

Habeas corpus law has not remained static during the half century since Judge Friendly wrote, but neither has it provided satisfactory answers to the problems that he highlighted in his article. Unfortunately, many of the changes—well intended as they were by the enactors and implementers— have done nothing but create endless hurdles, loops, and traps for potential users. Enormous resources are poured into this elusive remedy. The rule of law is not well served when people are told that they have a remedy, but in fact they do not. Far better to have truth-in-labeling, so that the cases that deserve …

Adequate And Effective: Postconviction Relief Through Section 2255 And Intervening Changes In Law, Ethan D. Beck Jun 2020

Adequate And Effective: Postconviction Relief Through Section 2255 And Intervening Changes In Law, Ethan D. Beck

Notre Dame Law Review

This Note begins in Part I by providing a general introduction to modern postconviction relief, with special attention to the interaction between habeas corpus petitions and the § 2255 motion that performs much of the work traditionally assigned to the habeas writ. Section I.A begins to describe the debate in the federal circuit courts over the proper scope of the clause of § 2255 with which this Note is primarily concerned, the so-called “savings clause” of § 2255(e). Section I.B relates the importance of correctly construing the savings clause, as well as the dangers of a split in circuit interpretation …

5 Reasons Police Officers Should Have College Degrees, Leana A. Bouffard, Gaylene Armstrong

Criminology and Criminal Justice Faculty Publications

Following several deaths of unarmed black men at the hands of police, President Donald J. Trump issued an executive order on June 16 that calls for increased training and credentialing to reduce the use of excessive force by police.

The order did not mention the need for police to get a college education, even though higher education was identified in the 2015 President’s Task Force on 21st Century Policing as one of six effective ways to reduce crime and build better relations between police and the communities they serve.

As researchers who specialize in crime and punishment, we see …

Black Lives Matter: Police Brutality In The Era Of Covid-19, Tyra Jean

Population Health Research Brief Series

Although police brutality and COVID-19 are separate tragedies, they intersect. This brief describes how, from COVID-19 to police brutality, the U.S. black population consistently bears the burden of life-threatening consequences due to structural racism throughout multiple institutions.
