The Off-Label Loophole In The Psychopharmacologic Setting: Prescription Of Antipsychotic Drugs In The Nonpsychotic Patient Population, Lisa E. Smilan
The Off-Label Loophole In The Psychopharmacologic Setting: Prescription Of Antipsychotic Drugs In The Nonpsychotic Patient Population, Lisa E. Smilan
Health Matrix: The Journal of Law-Medicine
U.S. physicians have wide discretion in treating patients with off-label medications. Many consider off-label prescription essential in our country’s health care system, and it is wholly supported by FDA and federal courts. Assumptions about physicians’ expertise, judgments, and commitments to beneficence and nonmaleficence undergird laissez-faire policies that allow and support physicians’ novel and innovate uses of FDA-approved drugs for purposes and populations not studied in original, strictly regulated clinical trials. Though sometimes beneficial, off-label prescribing, which flourishes in privatepractice psychiatry, often harms scores of psychiatric patients. Frequently, potential harms are insufficiently disclosed to patients. In the public health sector, officials …

The Survival Of Critical Infrastructure: How Do We Stop Ransomware Attacks On Hospitals?, Helena Roland
Catholic University Journal of Law and Technology
Our nation’s infrastructure is under an emerging new threat: ransomware attacks. These attacks can cause anything from individual laptops, to entire cities to shut down for a period of time until the victim pays a ransom to the attacker. Unfortunately, these attacks are on the rise and the attackers have a new target: hospitals. Ransomware attacks on hospitals can temporarily shut down operating room technology and limit physician access to patient files, ultimately threatening the safety of hospital patients and the surrounding community. This paper examines how the threat of ransomware attacks on hospitals is on the rise and what …
Registering A Home When Homeless: A Case For Invalidating Washington’S Sex Offender Registration Statute, Sarah Kohan
Registering A Home When Homeless: A Case For Invalidating Washington’S Sex Offender Registration Statute, Sarah Kohan
Washington Law Review Online
Sex offenders experiencing homelessness face unique challenges in Washington that sex offenders with housing do not. When individuals commit a sex offense, they are required to register as a sex offender by providing the state with a current home address. But what happens if an offender has no home? Currently, Washington’s sex offender registration statute forces sex offenders experiencing homelessness to appear in person weekly at the county sheriff’s office to meet registration requirements. Failing to appear for even one week can result in a charge for failure-to-register as a sex offender. In contrast, the statute requires non-homeless sex offenders …

Postmortem Interval Estimation Based On Eukaryotic Community Associated With Soil Under Decomposing Porcine Remains, Amanda M. Haase
Postmortem Interval Estimation Based On Eukaryotic Community Associated With Soil Under Decomposing Porcine Remains, Amanda M. Haase
Master of Science in Forensic Science Directed Research Projects
Recent studies have shown that bacteria associated with soils under a carcass change significantly both temporally and spatially. These studies were done in both laboratory and field conditions, but with limited replications. In addition, limited information exists on temporal and spatial changes in eukaryotic community structure associated with soil under decomposing remains. This study was designed to fill in these gaps and expand on previous studies to improve postmortem interval (PMI) estimation techniques as well as to identify cadaver decomposition islands (CDI) based on eukaryotic community structure associated with soil under vertebrate remains. To accomplish this goal, soil samples were …

Criminal (Dis)Appearance, Pamela R. Metzger, Janet C. Hoeffel
Faculty Journal Articles and Book Chapters
Across the United States, thousands of newly arrested people disappear. They languish behind bars for days, weeks, or even months without ever seeing a judge or an attorney. Yet, the Supreme Court requires more constitutional process for the seizure “of a refrigerator, the temporary suspension of a public school student, or the suspension of a driver’s license,” than it does for a person who has just been arrested. A new arrestee has no clearly established constitutional right to a prompt initial appearance procedure. As a result, there is no constitutional doctrine that guarantees her the right to appear promptly before …

5G mobile communication systems promote the mobile network to not only interconnect people, but also interconnect and control the machine and other devices. 5G-enabled Internet of Things (IoT) communication environment supports a wide-variety of applications, such as remote surgery, self-driving car, virtual reality, flying IoT drones, security and surveillance and many more. These applications help and assist the routine works of the community. In such communication environment, all the devices and users communicate through the Internet. Therefore, this communication agonizes from different types of security and privacy issues. It is also vulnerable to different types of possible attacks (for example, …

In 2014, community advocates in Charlotte, North Carolina, began organizing to press the city to amend its antidiscrimination ordinance to add several new protected classes, including sexual orientation, gender identity, and gender expression. After a contentious hearing where opponents argued that the change-which would allow transgender people to use public restrooms according to their gender identity-would subject women and children to "sexual predators," the city council voted down the amendment. Undaunted, advocates worked over the next several months to elect new council members and a mayor who supported LGBTQ rights. The amendments to the civil rights ordinance were then brought …

Challenging Racial Injustice In The Criminalization Of Homelessness In The United States: A Human Rights Approach, David Berris, Joseph Candelaria, Tamar Ezer, Lily Frances Fontenot
Challenging Racial Injustice In The Criminalization Of Homelessness In The United States: A Human Rights Approach, David Berris, Joseph Candelaria, Tamar Ezer, Lily Frances Fontenot
Articles
The criminalization of homelessness in the United States perpetuates a cycle of racial injustice and violates fundamental human rights. Longstanding discrimination in housing and law enforcement have resulted in disproportionate homelessness among Black Americans. Thus, laws and policies that criminalize life-sustaining behaviors, such as sleeping, in public further exacerbate racial disparities, punishing people for homelessness rather than addressing root causes. Criminalization results in fines that people cannot pay and criminal records, driving employment and housing out of reach and circulating individuals from the street to the criminal justice system and back. The criminalization of homelessness also directly violates international human …

Several practical and theoretical controversies in the current public management approach (PMA) of the local government in the Philippines significantly affect the practice of disaster risk reduction and directly affect the resiliency level of local communities. Thus, this study sought to explore “what innovative PMA is more relevant and effective in the practice of disaster risk reduction management (DRRM) to strengthen disaster resilience within the context of local government.” Data were gathered through survey and focus group discussions and analyzed quantitatively and qualitatively. Results describe the PMA and the various DRRM practices of Legazpi City, Philippines as well as the …
Examining How Comfortable Students Are In Contacting Campus Police At Central Washington University, Luis Gomez
Examining How Comfortable Students Are In Contacting Campus Police At Central Washington University, Luis Gomez
All Master's Theses
The current study examined students’ willingness to contact campus police at Central Washington University. The dataset used to conduct the research study was the Fall 2019 survey collected by the LAJ department. Using Tyler's procedural justice model as a theoretical base, the current study examines students' willingness to contact the police based on key factors. The five demographic variables used were race/ethnicity, gender, sexual orientation, residency, and class standings. In addition to the demographic variables, three police attitude variables (general, demeanor, and effectiveness) were analyzed, but due to multicollinearity between these variables, the general attitudes variable was the only one …

Do Courts Change Politics? Heller And The Limits Of Policy Feedback Effects, Kristin A. Goss, Matthew J. Lacombe
Emory Law Journal
District of Columbia v. Heller was a landmark ruling in which the Supreme Court established that citizens have a constitutional right to possess firearms in their homes for self-protection. The 5-4 decision—along with the Court’s subsequent ruling in McDonald v. Chicago—upended the prevailing wisdom that the Second Amendment protected the right of the states to assemble militias for collective security. In this Article, we examine the effects of these rulings on gun regulation in the United States and, more to the point, on gun politics. We situate our analysis within several related theoretical frameworks, most notably those focused on policy …
