Faculty as Global Learners offers key findings and recommendations to stimulate conversations among administrators, faculty, and staff about concrete actions they can explore and steps they can take on their campuses to both support faculty leaders …

The Opioid Crisis As Health Crisis, Not Criminal Crisis: Implications For The Criminal Justice System, Haley Hrymak Jan 2020

The Opioid Crisis As Health Crisis, Not Criminal Crisis: Implications For The Criminal Justice System, Haley Hrymak

Dalhousie Law Journal

The criminal justice system’s response to the opioid crisis exacerbates risks faced by people using drugs and is harmful to public health. Interviews with 11 interviewees including defence counsel, probation officers, and public interest lawyers and advocates revealed three key challenges of working in the criminal justice system during the opioid crisis. First, there is a lack of understanding of addiction within the criminal justice system. Second, as a result of the opioid crisis, fentanyl trafficking sentencing decisions in British Columbia emphasize the need for lengthier prison sentences, which disproportionately affects people who use substances. Third, the conditions on bail …

Broken Records: Reconceptualizing Rational Basis Review To Address “Alternative Facts” In The Legislative Process, Joseph Landau Jan 2020

Broken Records: Reconceptualizing Rational Basis Review To Address “Alternative Facts” In The Legislative Process, Joseph Landau

Faculty Scholarship

In 2016, North Carolina passed “HB2,” also known as the “bathroom ban”—a law prohibiting transgender individuals from accessing public restrooms corresponding to their gender identity—based on the unfounded fear that cisgender men posing as transgender women would assault women and girls in bathrooms. Around the same time, Alabama enacted a punishing immigration law in which sponsors distorted statistics regarding the undocumented population by using the terms “Latino/Hispanic” and “illegal immigrant” interchangeably. These laws are reflective of a larger pattern. In our increasingly polarized political climate, policymakers are affirmatively distorting legislative records and promoting dubious justifications for their policy goals—that is, …

Atv Dynamics And Pediatric Rider Safety, James T. Auxier Ii Jan 2020

Atv Dynamics And Pediatric Rider Safety, James T. Auxier Ii

Theses and Dissertations--Biomedical Engineering

It has been observed through numerous academic and governmental agency studies that pediatric all-terrain vehicle ridership carries significant risk of injury and death. While no doubt valuable to safety, the post-hoc approach employed in these studies does little to explain the why and how behind the risk factors. Furthermore, there has been no prolonged, widespread, organized, and concerted effort to reconstruct and catalog the details and causes of the large (20,000+) number of ATV-related injuries that occur each year as has been done for road-based motor vehicle accidents. This dissertation takes the opposite approach from a meta-analysis and instead examines …

An Examination Of Single-Sex Secondary Agricultural Education Classrooms: The Effects Of Teacher Expectancy, Brett Morris Wasden Jan 2020

An Examination Of Single-Sex Secondary Agricultural Education Classrooms: The Effects Of Teacher Expectancy, Brett Morris Wasden

Theses and Dissertations--Community & Leadership Development

The effectiveness of single-sex classrooms in the United States remains unclear. To address this issue, the purpose of this quasi-experiment was to examine single-sex classrooms in secondary agricultural education classrooms in Kentucky. Data were collected through quantitative pretests and posttests from student participants (n = 168) and teacher participants (n = 8). The findings indicated that student participants in single-sex classrooms had higher academic performance, better attendance, and an increased gain in interest in the agriculture, food, and natural resources career pathway. Students participants in coeducational classrooms had less discipline referrals. Teacher participants’ expectation were related to student …

Drug Conspiracy Sentencing And Social Injustice, Emilie Kurth Jan 2020

Drug Conspiracy Sentencing And Social Injustice, Emilie Kurth

University of Colorado Law Review

The D.C. Circuit in United States v. Stoddard confronted a landmine of criminal and socioeconomic justice issues when it held that mandatory minimum sentences for drug conspiracy offenses should be imposed based on the amount of drugs attributable to the individual defendant (the individualized approach) as opposed to the amount of drugs attributable to the conspiracy as a whole (the conspiracy-wide approach). This decision reflects a nationwide circuit split implicating the courts and lawmakers' ideological balancing of the issues of justice, liberty, public safety, and equity. This Comment discusses Stoddard as well as the circuit split in its current form …

Straight Outta Films: A Qualitative Media Analysis Of The Hyperrealities Of Youth Gangs, Naima Lakha Jan 2020

Straight Outta Films: A Qualitative Media Analysis Of The Hyperrealities Of Youth Gangs, Naima Lakha

Theses and Dissertations (Comprehensive)

Much of what people learn outside their neighbourhoods and personal boundaries is through mass media. As such, it is not surprising that the media has potential to significantly influence public perceptions (Bourke, 2013). Due to the media’s profuse ability to influence public perceptions and the frequency in which gangs are depicted within the media, it is important to understand how they are portrayed. Involvement in a gang is depicted in the media as being intriguing for individuals, and as Preston et al. (2012), note that the media is often inclined to sensationalize criminal gang activity. They cite Gordon’s 2001 research …

The Law Against Family Separation, Carrie F. Cordero, Heidi Li Feldman, Chimène Keitner Jan 2020

The Law Against Family Separation, Carrie F. Cordero, Heidi Li Feldman, Chimène Keitner

Georgetown Law Faculty Publications and Other Works

This Article offers the first comprehensive assessment of how domestic and international law limits the U.S. government’s ability to separate foreign children from the adults accompanying them when they seek to enter the United States. As early as March 6, 2017, then-Secretary of Homeland Security John Kelly told CNN’s Wolf Blitzer that he was considering separating families at the border as a deterrent to illegal immigration as part of a “zero tolerance” policy whereby the Trump administration intended the strictest enforcement of immigration law against those migrants coming to the U.S. southern border . Kelly did not say upon what …

Section 230 And The Duty To Prevent Mass Atrocities, David Sloss Jan 2020

Section 230 And The Duty To Prevent Mass Atrocities, David Sloss

Case Western Reserve Journal of International Law

"Of course, any proposal to create a statutory exception to section 230 immunity raises a set of complex questions about the proper scope of such an exception. This article identifies the key issues that would need to be resolved if Congress decided to create an exception along these lines. The remainder of this article consists of three parts. The first part explains why removal of immunity from civil liability is an appropriate mechanism to help prevent use of social media to incite or induce commission of mass atrocity crimes. The second part contends that the exception to section 230 immunity …

The Pursuit Of Procedural Justice And Police Legitimacy: A Case Study Of Community Police Officers’ Perceptions Of The Perceived Benefits Of Higher Education, Tara M. Kane Jan 2020

The Pursuit Of Procedural Justice And Police Legitimacy: A Case Study Of Community Police Officers’ Perceptions Of The Perceived Benefits Of Higher Education, Tara M. Kane

Master's Theses and Doctoral Dissertations

This is a case study of suburban community police officers and their perception of benefits of higher education as it relates to outcomes of procedural justice and legitimacy. Acknowledging controversial, high-profile incidents which have caused the police profession to be generalized in a negative manner, this study sought to examine community-policing initiatives as an effective strategy for promoting positive community-police relationships. Community police officers were queried about academic and professional preparation they perceived as necessary for the demands of the 21st century community police officer.

Previous literature on community policing and procedurally just policing has primarily focused on the perceptions …

The Archaic Attempts To Protect Nonhuman Suffering: Suggestions For The Advancement Of Legislative Regulation Of Online Depictions Of Animal Cruelty, Alana Van Gundy Jan 2020

The Archaic Attempts To Protect Nonhuman Suffering: Suggestions For The Advancement Of Legislative Regulation Of Online Depictions Of Animal Cruelty, Alana Van Gundy

Animal Law Review

The Internet is often used to disseminate acts of cruelty to nonhuman animals through social media postings, live feeds, remote-controlled Internet hunting, and industry videos, such as dogfighting and crush videos. Some state and federal laws regulate the depiction of animal cruelty online, either directly or indirectly. However, current statutory regulations do not fully address or completely prohibit the viewing, promoting, and depicting of animal cruelty online. Preventing Internet animal cruelty requires new or revised legislation encompassing the marketing, promoting, and depicting of online animal suffering. While more specific laws are necessary, legislators must consider numerous issues and potential ramifications …

People Who Hurt Animals Don't Stop With Animals: The Use Of Cross-Checking Domestic Violence And Animal Abuse Registries In New Jersey To Protect The Vulnerable, Emerald Sheay

Animal Law Review

This Note explores the link between domestic violence and animal abuse and argues that due to such a link, New Jersey should enact a publicly searchable, cross-checking animal abuse registry and a domestic violence registry. Numerous studies confirm the connection between domestic violence and animal abuse. By examining the scope and history of these abuses, and exploring the status of registries in various states, this Note aims to explain the problems these issues pose to our society. Enacting these registries in New Jersey could keep law enforcement aware of illegal activity, reveal child abuse, and prevent the online selling of …

The Sherman Act Is A No-Fault Monopolization Statute: A Textualist Demonstration, Robert H. Lande, Richard O. Zerbe Jan 2020

The Sherman Act Is A No-Fault Monopolization Statute: A Textualist Demonstration, Robert H. Lande, Richard O. Zerbe

American University Law Review

The drafters of the Sherman Act originally designed Section 2 to impose sanctions on all monopolies and attempts to monopolize, regardless whether the firm had engaged in anticompetitive conduct. This conclusion emerges from the first ever textualist analysis of the language in the statute, a form of interpretation originally performed only by Justice Scalia but now increasingly used by the Supreme Court, including in its recent Bostock decision.

Following Scalia’s methodology, this Article analyzes contemporaneous dictionaries, legal treatises, and cases and demonstrates that when the Sherman Act was passed, the word “monopolize” simply meant that someone had acquired a monopoly. …

The Age Of The Advertorial: Incorporating Sponsored Content Into The Newsroom, Hayley Robb

Mahurin Honors College Capstone Experience/Thesis Projects

During a time when news is fast, frequent and easier to find than ever, it has become harder for news outlets to not only generate revenue but to establish a need with their readers. Sponsored content pieces, also referred to as native advertising, have offered creative solutions to this problem for student media groups and professional news outlets across the country.

Using WKU’s first-ever content agency, Cherry Creative, as a case study and by analyzing various other news outlets in the U.S., this project aims to develop a series of recommendations for the future of Cherry Creative and student media, …

Mass Seizure And Mass Search, Gregory Brazeal Jan 2020

Mass Seizure And Mass Search, Gregory Brazeal

Faculty Publications

As courts attempt to develop Fourth Amendment doctrine to address the threats to privacy created by digital surveillance technologies, a valuable doctrinal resource has been largely neglected: the law governing the seizure of persons. Just as courts today struggle with the specter of mass search using digital technologies, courts in the 1960s were confronted with the problem of mass seizure through the growing use of stop-and-frisk by police departments. The responses to mass seizure developed by the Supreme Court in Terry v. Ohio, 592 U.S. 1 (1968), and its progeny provide lessons for courts today considering how to respond to …

A Qualitative Descriptive Study About The Experiences And Views Of Undergraduate And Postgraduate Nursing Students: What Influenced Them To Choose The Mental Health Specialty, Kaile Moon

Theses

Nurses perform a vital role in the mental health (MH) speciality. The mental health nurse (MHN) role is complex with expectations to manage a safe milieu, practice person-centred care, crisis management, and therapeutic skills, teach coping skills, provide emotional support, and set professional boundaries. However, MHN recruitment and retention continues to be a global struggle. Nursing students typically have low interest in choosing the MH speciality. Strategies to reduce stigma and improve attitudes and beliefs about MH nursing and mental illness have been successful among nursing students, globally and in Australia. However, these successful strategies have not extended to an …
