Fleming, Amy L. Stevens, Marla Vivero, Irina Patwardhan, Timothy D. Nelson, Jennifer Mize Nelson, Tiffany D. James, Kimberly Andrews Espy, W. Alex Mason
Department of Psychology: Faculty Publications
Identifying childhood cognitive processes that predict adolescent problem behaviors can help guide understanding and prevention of these behaviors. In a community sample of 313 youth recruited in a small Midwestern city between 2006 and 2012 (49% male, 64% European American), executive control and foundational cognitive abilities were assessed at age 5 in a lab setting with performance-based measures. In adolescence, youth provided self-report of problem behaviors in surveys administered annually between ages 14 and 16. Executive control was negatively associated with externalizing behavior problems and adolescents getting in trouble at school, accounting for foundational cognitive abilities and family background covariates. …

Control Or Eradication: Problems In The Management Of Invasive Birds, Michael L. Avery, Chris J. Feare
Control Or Eradication: Problems In The Management Of Invasive Birds, Michael L. Avery, Chris J. Feare
United States Department of Agriculture Wildlife Services: Staff Publications
Humans have captured, transported and intentionally released wild birds for centuries (Blackburn et al., 2009). Motivations for such purposeful introductions include food (West and Zhou, 2007), religion (Agoramoorthy and Hsu, 2007), sport (McDowall, 1994), biocontrol (Bennett and Hughes, 1959; Kurdila, 1995) and aesthetics (Ryan, 1906; Thomson, 1922). Many purposeful bird introductions were the work of acclimatization societies, particularly in North America, New Zealand and Australia. These societies were formed in the 19th century by European settlers to transport bird species from their homelands in efforts to establish them in the newly settled regions (Thomson, 1922; Dunlap, 1997). As a result …

An Analysis On Biometric Privacy Data Regulation: A Pivot Towards Legislation Which Supports The Individual Consumer's Privacy Rights In Spite Of Corporate Protections, Carla Llaneza
St. Thomas Law Review
This Comment will address the different ways in which biometric data has become an integral part of everyday American life, whether it be through the use of facial recognition for national security or the use of fingerprinting to access an individual’s smartphone. Part II will further discuss how biometric data privacy legislation, specifically as set out in the Biometric Illinois Privacy Act (“BIPA”), has become prominent and will analyze its effects on the legal rights of consumers to bring suit against private entities. Part III will discuss the present solutions available to consumers who fall victim to companies who distribute …
Pandemic, Protests, And Prison Reform? Why 2020 Is A Catalyst To Rethink Drug Policy, Keelia Lee
Pandemic, Protests, And Prison Reform? Why 2020 Is A Catalyst To Rethink Drug Policy, Keelia Lee
St. Thomas Law Review
This Article will argue for the abandonment of the current criminal justice system as it relates to drug offenses and for its replacement with a medical model to address the healthcare problem of addiction. The medical model approach calls for complete decriminalization of all controlled substances coupled with better rehabilitation and reintegration policies. This Article argues the criminalization of drugs has targeted minorities under the guise of keeping communities safe. It will look at the differences between the United States and Portugal, a country that has implemented the medical model, while also analyzing recent legislation in the United States addressing …

Retrievable Images On Social Media Platforms: A Call For A New Privacy Tort, Zahra Takhshid
Retrievable Images On Social Media Platforms: A Call For A New Privacy Tort, Zahra Takhshid
Sturm College of Law: Faculty Scholarship
The recognition of a right of privacy in Warren and Brandeis’s famous article has long been celebrated and lamented. It is celebrated because privacy is a central feature of individual well-being that deserves legal protection. It is lamented because the protection they contemplated, and that is actually provided by the law, is quite modest. Modern technology, especially social media platforms, has only raised the stakes. Anytime one goes out in public, one risks having one’s image captured and shared worldwide, leaving us with little or no control over how we are perceived by others.
This Article argues for the recognition …

Are We Still Cheap On Crime? Austerity, Punitivism, And Common Sense In The Trump/Sessions/Barr Era, Hadar Aviram
Hastings Journal of Crime and Punishment
Literature on “late mass incarceration” observed a contraction of the carceral state, with varying opinions as to its causes and varying degrees of optimism about its potential. But even optimistic commentators were taken aback by the Trump-Sessions administration’s criminal justice rhetoric. This paper maps out the extent to which federal, state, and local actions in the age of Trump have reversed the promising trends to shrink the criminal justice apparatus, focusing on federal legislation, continued state and local reform, and the role of criminal justice in 2020 presidential campaigns. The paper concludes that the overall salutary trends from 2008 onward …

Examining Contextual Differences In Participant Characteristics And During-Program Occurrences With Drug Court Program Completion, Shondrah T. Nash
Examining Contextual Differences In Participant Characteristics And During-Program Occurrences With Drug Court Program Completion, Shondrah T. Nash
Faculty Research at Morehead State University
The study purpose was to compare individuals participating in rural and urban drug courts to examine factors associated with program completion. Secondary data (participant assessment; drug court Management Information System) as well as conviction information from a statewide database were examined for a sample of drug court participants (N = 534). Based on multivariate analysis, for rural participants, two variables were significantly associated with increased program completion: age and outpatient treatment. Conversely, for rural participants, the number of felony/misdemeanor convictions before drug court and receiving an incarceration sanction during drug court were associated with program non-completion. For urban participants, gender …
Florida's Late Entrance To The Ongoing Trend: Sexual Orientation In The Workplace, Ernesto Rivero
Florida's Late Entrance To The Ongoing Trend: Sexual Orientation In The Workplace, Ernesto Rivero
St. Thomas Law Review
John Doe is an exceptional firefighter who also happens to be a homosexual. John performs his duties every day to the utmost of his ability; however, in response to his sexual orientation, John is verbally harassed daily, underpaid for his line of work, and subsequently discharged from his position. This is a consequence of practicing his protected constitutional right of same sex marriage at his workplace. Every individual ought to have a fair and inclusive workplace free from discrimination; that is not the case in today’s America. Although employees are protected from discrimination by the Civil Rights Act of 1964 …
Mapping The Seasonal Abundance And Distribution Of Marine Debris On Lido Beach And Siesta Beach: An Annual Gis Study, Raquel Valdes
Mapping The Seasonal Abundance And Distribution Of Marine Debris On Lido Beach And Siesta Beach: An Annual Gis Study, Raquel Valdes
Theses & ETDs
Marine debris can consist of almost any anthropogenic item, which makes its presence in the environment a threat. In this study, the different types, abundances, and distributions of marine debris on a seasonal basis at both Lido Beach and Siesta Beach in Sarasota, Florida were examined. A total of 11,143 pieces of debris were collected from both beaches over all four seasons. While there were no distinct seasonal differences, the Summer season had the largest collection of marine debris (Lido: 2,252 items / Siesta: 3,465 items), while the Spring season had the smallest collection (Lido: 709 items / Siesta: 728 …
A Multispecies Approach To The Intersection Of Hacktivism And Performance Art, Jimi Depriest
A Multispecies Approach To The Intersection Of Hacktivism And Performance Art, Jimi Depriest
Theses & ETDs
The purpose of this thesis is to critique the neoliberal exploitation of science, technology, and media while conceptualizing how hacktivism can be used to disrupt the operations of neoliberal institutions. I will explore how the proletariat can use DIY and decentralized forms of techno scientific creations to fight and dismantle imperialism and devising how these creations can function as tools for catalyzing a post-capitalist society. I will also examine how the relationship between human and nonhuman organisms is continually redefined by abrasive technologies and digital media. I address how hacktivist actions framed as insurrectionary ritualistic practice can alter the digital …
Let Go Of Your Sexual Privacy Or Be Let Go? The Woe Of Public Employees, Sofya Bakradze
Let Go Of Your Sexual Privacy Or Be Let Go? The Woe Of Public Employees, Sofya Bakradze
Marquette Benefits and Social Welfare Law Review
The issue of sexual freedom as a subset of the general right to privacy, while not novel, is still highly controversial both legally and socially. The Circuit Courts of Appeals have yet to agree whether the leading case on the issue, Lawrence v. Texas, 539 U.S. 558 (2003), affirmatively established the fundamental right to sexual privacy. The answer to this question means the difference between a world where off-duty sexual conduct stays private and respected by the government employers and a world where a public employee can be terminated without due process for his or her intimate activities. As a …

Towards A Trans Feminist Disability Studies, Niamh Timmons
Towards A Trans Feminist Disability Studies, Niamh Timmons
Journal of Feminist Scholarship
In this article, I investigate the ways in which Transfeminism and Trans Women can be more integrated and entangled within feminist disability studies and Disability Justice, and vice versa. This would make the field a seemingly rich arena for considering the linkages between Trans Women, Transfeminism, dis/ability, and feminism. Yet, the primary texts of the feminist disability studies consistently leave out Trans Women in their analyses. Specific inclusion and highlighting the experiences of Trans Women, especially Trans Women who are disabled, is often missing from disability rights and disability justice projects. This is especially alarming given the way Trans folks, …

Investigating The Avian Species Composition, Diversity, And Abundance Of Engelhorn Pond, Kiana Rose
Investigating The Avian Species Composition, Diversity, And Abundance Of Engelhorn Pond, Kiana Rose
Undergraduate Honors Theses
Central Washington University’s Engelhorn Pond contains important habitats for many organisms, particularly migratory birds, and is a valuable resource for students. However, little information is available about the wildlife inhabiting the pond. The pond’s discrete location means that many people are unaware of its existence. In addition, the pond is threatened by a number of anthropogenic sources, including chemical runoff, garbage, and feral cats. By using point counts, a common ornithological survey technique, I recorded the bird species present at the pond during all seasons of the year. I collected data using point counts during 13 visits from June of …
The Law Of The Tetrapods, Henry T. Greely
The Law Of The Tetrapods, Henry T. Greely
Vanderbilt Journal of Entertainment & Technology Law
Should there be such a thing as "Technology Law"? This Article explores that question in two ways. It first looks at four substantive issues that appear across many different areas of technology law: privacy, security, property, and responsibility. It then examines five questions that frequently recur about how to regulate very different new technologies. These questions include which agency should regulate, whether regulation should focus on before or after marketing, what jurisdiction should regulate, how relevant new information will be gained and used, and how-politically-good regulation can be enacted. This Article concludes that it may make sense to develop a …

Why Prison Dental Care Matters: Legal, Policy, And Practical Concerns, Anne S. Douds, Eilenn M. Ahlin, Nicholas S. Fiore, Nicholas J. Barrish

Even when controlling for demographic characteristics, prisoners are far more likely than people in the general population to suffer from periodontal disease, to have unresolved oral health issues, to have decayed teeth, and/or to be missing teeth. Correlates of poor oral health, such as poor nutrition and smoking, are more prevalent among people of lower socioeconomic status, and this same population is at a higher risk than others for offending and incarceration. For some, prison is the only time in their adult lives when they will have seen a dentist. There are few free dental clinics in communities, regardless of …
Seeking Shelter: How North Carolina Is Violating The State Constitution By Failing To Properly Educate Its Homeless Students, Wesley A. Stewart
Seeking Shelter: How North Carolina Is Violating The State Constitution By Failing To Properly Educate Its Homeless Students, Wesley A. Stewart
Campbell Law Review
Under Leandro v. State, the North Carolina Constitution guarantees a sound basic education for all students in public schools. North Carolina is failing to meet that demand with respect to the state's homeless students. Testing data from at least the last decade shows that there is a long-standing achievement gap between homeless students and their peers. This demonstrates that homeless students are not obtaining a sound basic education. Moreover, this failure is the result of both the state's action and inaction. There are, however, a number of solutions the state can implement to remedy its constitutional violation. This Comment explores …
