Objectives: To identify dietary supplement products and ingredients marketed for brain health and cognitive performance and perform analyses of select …

Mindful Meditation And Misconduct: A Proposal, Victoria Evans Apr 2020

Mindful Meditation And Misconduct: A Proposal, Victoria Evans

Honors Senior Capstone Projects

Rehabilitation and treatment methods used in incarceration have evolved, causing punishment philosophies in the U. S. to swing from rehabilitation to “zero tolerance” and back again. As this transition occurs, it is essential to evaluate current correctional programs as there has been a trend towards evidence-based corrections. The purpose of this research is to evaluate the SAVR (stress, anger, violence reduction) program implemented by a county jail in Massachusetts. This research will examine the extent to which participating in SAVR reduces inmate misconduct. The participants will be selected through a non-probability, convenience sample of program participants. Misconduct files will be …

California High Speed Rail Central Valley Realignment, Jossian Pineda, Devin Schmidt Apr 2020

California High Speed Rail Central Valley Realignment, Jossian Pineda, Devin Schmidt

Civil, Environmental and Sustainable Engineering Senior Theses

The California High-Speed Rail in California has exceeded its budget and proven that typical methods of laying out High-Speed Rail were inefficient and detrimental to residents. By analyzing routes where the High-Speed Rail could instead be routed through medians or dead space around existing freeways, the project team determined the feasibility and cost efficiency of such an undertaking. The team analyzed multiple routes and upon choosing the best route, completed a curve analysis on a portion of the alignment, as well as completed an analysis on typical bridges that would be required. The analysis proved that utilizing this median space …

School of Biological and Marine Sciences

Coastal urbanisation, energy extraction, food production, shipping and transportation have led to the global proliferation of artificial structures within the coastal and marine environments (sensu “ocean sprawl”), with subsequent loss of natural habitats and biodiversity. To mitigate and compensate impacts of ocean sprawl, the practice of eco-engineering of artificial structures has been developed over the past decade. Eco-engineering aims to create sustainable ecosystems that integrate human society with the natural environment for the benefit of both. The science of eco-engineering has grown markedly, yet synthesis of research into a user-friendly and practitioner-focused format is lacking. Feedback from stakeholders has repeatedly …

Digital Forensic Readiness: An Examination Of Law Enforcement Agencies In The State Of Maryland, James B. Mcnicholas Iii Apr 2020

Digital Forensic Readiness: An Examination Of Law Enforcement Agencies In The State Of Maryland, James B. Mcnicholas Iii

Masters Theses & Doctoral Dissertations

Digital forensic readiness within the law enforcement community, especially at the local level, has gone mostly unexplored. As a result, a current lack of data exists that examines the digital forensic readiness of individual agencies, the possibility of proximity relationships, and correlations between readiness and backlogs. This quantitative, crosssectional research study sought to explore these issues by focusing on the state of Maryland. The study resulted in the creation of a digital forensic readiness scoring model that was then used to assign digital forensic readiness scores to thirty (30) of the one-hundred-forty-one (141) law enforcement agencies throughout Maryland. It was …

‘Not Feeling Like A Caged Animal’: Prisoner Perceptions Of A Remote Video Visitation System, Danielle J. Murdoch, Laura L. King Apr 2020

‘Not Feeling Like A Caged Animal’: Prisoner Perceptions Of A Remote Video Visitation System, Danielle J. Murdoch, Laura L. King

Criminal Justice Faculty Publications and Presentations

In recent years, correctional agencies have increased their use of video visitation in an effort to offset costs and increase security, among other objectives. In the present study, interviews (N = 12) and surveys (N = 58) were conducted with prisoners at a jail in the Northwestern U.S. that had replaced in-person, glass partition visitation with remote video visitation. The results suggested that while there were positive aspects of video visitation, such as the ability to visit with loved ones from afar, there were criticisms as well, including technological and access issues. The policy implications of the findings and directions …

Is Algorithmic Affirmative Action Legal?, Jason R. Bent Apr 2020

Is Algorithmic Affirmative Action Legal?, Jason R. Bent

AI-DR Collection

This Article is the first to comprehensively explore whether algorithmic affirmative action is lawful. It concludes that both statutory and constitutional antidiscrimination law leave room for race-aware affirmative action in the design of fair algorithms. Along the way, the Article recommends some clarifications of current doctrine and proposes the pursuit of formally race-neutral methods to achieve the admittedly race-conscious goals of algorithmic affirmative action.

The Article proceeds as follows. Part I introduces algorithmic affirmative action. It begins with a brief review of the bias problem in machine learning and then identifies multiple design options for algorithmic fairness. These designs are …

Evidence, Arrest Circumstances, And Felony Cocaine Case Processing, Jacqueline G. Lee, Alexander Testa Apr 2020

Evidence, Arrest Circumstances, And Felony Cocaine Case Processing, Jacqueline G. Lee, Alexander Testa

Criminal Justice Faculty Publications and Presentations

Case evidence and situational arrest characteristics are widely speculated to influence courtroom actor decisions, yet such measures are infrequently included in research. Using new data on felony cocaine cases from an urban county in a Southern non-guideline state, this study examines how physical evidence and arrest circumstances affect three stages of case processing: initial charge type, charge reduction, and sentence length. The influence of evidence appeared strongest at the early stage when prosecutors chose the appropriate charge, though certain evidentiary and arrest measures continued to influence later decisions. Charge reductions were driven mostly by legal factors, and while guilt should …

Hybrid Vehicle-Drone Routing Problem For Pick-Up And Delivery Services Mathematical Formulation And Solution Methodology, Aline Karak Apr 2020

Hybrid Vehicle-Drone Routing Problem For Pick-Up And Delivery Services Mathematical Formulation And Solution Methodology, Aline Karak

Civil and Environmental Engineering Theses and Dissertations

The fast growth of online retail and associated increasing demand for same-day delivery have pushed online retail and delivery companies to develop new paradigms to provide faster, cheaper, and greener delivery services. Considering drones’ recent technological advancements over the past decade, they are increasingly ready to replace conventional truck-based delivery services, especially for the last mile of the trip. Drones have significantly improved in terms of their travel ranges, load-carrying capacity, positioning accuracy, durability, and battery charging rates. Substituting delivery vehicles with drones could result in $50M of annual cost savings for major U.S. service providers.

The first objective of …

Vaccinate Her? I Hardly Know Her!: Understanding Vaccine Hesitancy, Zachary M. Marcum Apr 2020

Vaccinate Her? I Hardly Know Her!: Understanding Vaccine Hesitancy, Zachary M. Marcum

Honors Theses

Vaccines are a first defense against highly communicable diseases such as measles. For vaccines to protect the population, a vast majority must be vaccinated to maintain herd immunity. Vaccine hesitancy is delaying vaccination from the suggested schedule or refusing vaccination outright. The hesitance is commonly portrayed as a lack of knowledge or scientific literacy. But highly educated people are still just as likely to be hesitant. The basis of hesitance is likely ethically similar to that of vaccination. Understanding the methods of the vaccine hesitant will better inform attempts to persuade them. Individuals have an obligation to the community to …

Hike At Your Own Risk: In Support Of No-Rescue Wilderness Designations, Travis Coon Apr 2020

Hike At Your Own Risk: In Support Of No-Rescue Wilderness Designations, Travis Coon

Penn State Law Review (2003 - Present)

As the popularity of the National Park system continues to grow, more Americans are venturing into remote and wild areas. Unfortunately, this trend has also corresponded with increased reports of injury and calls for medical rescue. Fueled by the sharing of adventurous photos on social media, hikers frequently head into isolated and exotic locations, often inexperienced in outdoor settings, equipped only with their cell phones.
Those lost or in need of medical help in National Parks or other wilderness settings trigger a search and rescue (SAR) operation. A team of trained professionals conducts a search for missing or injured persons, …

Early Intervention By Counsel: A Multi-Site Evaluation Of The Presence Of Counsel At Defendants’ First Appearances In Court, Alisa Pollitz Worden, Andrew L. B. Davies, Reveka V. Shteynberg, Kirstin A. Morgan Apr 2020

Early Intervention By Counsel: A Multi-Site Evaluation Of The Presence Of Counsel At Defendants’ First Appearances In Court, Alisa Pollitz Worden, Andrew L. B. Davies, Reveka V. Shteynberg, Kirstin A. Morgan

Deason Center Reports

Over the past decade, some states have sought to ensure that defendants are provided counsel at their first appearance in court (CAFA). The rationale for this effort is that having an attorney present at the first court hearing, which is often arraignment, will result in judges releasing more low-risk defendants on recognizance or on lower bails. Early access to legal counsel might also result in better prospects for diversion from prosecution, charge reductions before conviction, and less punitive sentences. The CAFA initiatives in the upstate New York counties have been funded by state grants to indigent defense providers. The participating …

Stretching The Law: The Application Of Public Nuisance To The Opioid Epidemic, Lindsay Manning, Hannah L. Thompson Apr 2020

Stretching The Law: The Application Of Public Nuisance To The Opioid Epidemic, Lindsay Manning, Hannah L. Thompson

Brigham Young University Prelaw Review

Opioid use in the United States increased five-fold in the last decade.

Every day ninety Americans die from drug abuse overdose. Is it

illegal opioid trafficking, or is it a problem within the medical profession?

Recent litigation strategies, like those used in the recent

landmark case of Oklahoma v. Johnson and Johnson, show that opioid

production and distribution are being linked to fueling the opioid

epidemic. Oklahoma is just one of the states that have concluded that

Johnson and Johnson, a large pharmaceutical company, is “overstating”

the efficiency of opioids and “understating” the harmful effects

of these drugs. Consequently, litigation …

A "Meaningful" Seat At The Table: Contemplating Our Ongoing Struggle To Access Democracy, James M. Binnall Apr 2020

A "Meaningful" Seat At The Table: Contemplating Our Ongoing Struggle To Access Democracy, James M. Binnall

SMU Law Review Forum

In recent years, felon-voter disenfranchisement has received considerable attention from academics, policymakers, and the media. In turn, a number of jurisdictions have eased record-based voter restriction statutes. And while those efforts represent a significant step toward full civic reintegration for those with a felony criminal history, they are far from comprehensive, as they regularly omit citizens with certain types of felony convictions and typically address only one form of civic marginalization. Focusing on recent reform in the area of civic restrictions, this Article suggests that incomplete civic restoration comes with significant consequences that ought to be considered during legislative negotiations. …

The Effects Of Unauthorized Immigrants On Crime, Shane C. Shannon Apr 2020

The Effects Of Unauthorized Immigrants On Crime, Shane C. Shannon

Student Publications

The effects of immigrants on crime has been the subject of hostile conversations and bold claims. As anti-immigrant sentiments see an increase in mainstream society, the empirical research suggesting an explanation to such claims are direly needed. Using PEW Research databases, and the States 2016 database in Stata, I evaluate the effects of unauthorized immigrant density of a given region on various crime rates of the aforementioned region. In particular, I assess the violent crime rate, murder crime rate, and property crime rates of states in America. Utilizing confidence intervals, ordinary least squares regression models (OLS), and a number of …

Is It Time For Arkansas To Consider Pretrial Reform?, Judge Cindy Grace Thyer Apr 2020

Is It Time For Arkansas To Consider Pretrial Reform?, Judge Cindy Grace Thyer

University of Arkansas at Little Rock Law Review

Approximately two-thirds of the national jail population consists of pretrial detainees––people who are constitutionally presumed innocent of the charges they are facing. Many, if not most, of these individuals are incarcerated because they are unable to post money bail. This article explores some of the complexities of pretrial release/detention reform. It begins with the history of bail from its early use in England through its grounding in each American state’s constitution, with special emphasis upon the reforms that have occurred in the American system of pretrial release since the 1920s. Drawing on information and experiences from states across the nation, …

Compliance Issues: The Supreme Court’S Confusing Messages To Municipalities, Abigail Greene Apr 2020

Compliance Issues: The Supreme Court’S Confusing Messages To Municipalities, Abigail Greene

Missouri Law Review

Local municipalities are vested with the power to enact zoning ordinances that prohibit signs and flags in residential areas for aesthetic purposes. This power directly competes with an individual’s constitutional right to use private property to express their views. The United States Supreme Court recently struck a balance for this conflict in Reed v. Town of Gilbert. The United States Court of Appeals for the Eighth Circuit applied this test in Willson v. City of Bel-Nor, Missouri and demonstrated the impracticability of the approach the Supreme Court created for municipalities when drafting ordinances.
