A Public Health Law Path For Second Amendment Jurisprudence, Michael R. Ulrich May 2020

A Public Health Law Path For Second Amendment Jurisprudence, Michael R. Ulrich

UC Law Journal

The two landmark gun rights cases, District of Columbia v. Heller and McDonald v. City of Chicago, came down in 2008 and 2010, respectively. In the decade that has followed, two things have become abundantly clear. First, these cases provide little clarity about the nature and scope of Second Amendment rights, resulting in chaos and circuit splits in the lower courts. Second, growing empirical evidence has revealed that, in the background of the debate on individual constitutional rights, a serious gun violence epidemic is intensifying around the country. In one corner, gun rights advocates worry that increased firearm regulation will …

The Violence Of Nosy Questions, Jeannine Bell May 2020

The Violence Of Nosy Questions, Jeannine Bell

Articles by Maurer Faculty

This Essay examines a little-studied aspect of police procedure: police officers’ unfettered power to ask questions of motorists. The questions officers ask after they have stopped a car can run the gamut from questions about the nature of the motorist’s travel plans to nosy personal questions. Such questions are often intrusive, and drivers report feeling degraded by having to answer them. This Essay argues that these questions should be regulated because giving officers complete control over what they ask motorists provides a significant space for racial discrimination in policing, creates resentment, and encourages minorities to distrust the police.

Conceptualizing Legal Childhood In The Twenty-First Century, Clare Huntington, Elizabeth S. Scott May 2020

Conceptualizing Legal Childhood In The Twenty-First Century, Clare Huntington, Elizabeth S. Scott

Michigan Law Review

The law governing children is complex, sometimes appearing almost incoherent. The relatively simple framework established in the Progressive Era, in which parents had primary authority over children, subject to limited state oversight, has broken down over the past few decades. Lawmakers started granting children some adult rights and privileges, raising questions about their traditional status as vulnerable, dependent, and legally incompetent beings. As children emerged as legal persons, children’s rights advocates challenged the rationale for parental authority, contending that robust parental rights often harm children. And a wave of punitive reforms in response to juvenile crime in the 1990s undermined …

The Effect Upon State Crime Rates Of The Legalization Of Recreational Marijuana In California, Robert Boxerman Apr 2020

The Effect Upon State Crime Rates Of The Legalization Of Recreational Marijuana In California, Robert Boxerman

Theses

This work examines criminal effects of the legalization of recreational marijuana in the state of California in 2016. While multiple states have legalized marijuana for recreational purposes, there is little empirical evidence to determine the criminal effect, if any, of introducing marijuana products into the legal market. The research analyzes crime rates pre and post legalization. Crime rates from the years 1990-2018 are taken from the California Attorney General Office “Crime in California” annual report, and consist of FBI Part I offenses: murder and non-negligent homicide, rape, robbery, aggravated assault, burglary, motor vehicle theft, larceny-theft, and arson. Misdemeanor drug arrests, …

A License To Kill: The Institutional Failure Of The Legal System To Hold Police Accountable, Eliana Fleischer Apr 2020

A License To Kill: The Institutional Failure Of The Legal System To Hold Police Accountable, Eliana Fleischer

Jepson School of Leadership Studies Research Symposium

In recent years, police shootings of unarmed African American men have become nationally visible. With few exceptions, the police officers involved in those shootings have escaped any criminal penalties. This paper addresses the question: Why is it that so few police officers are convicted after shooting unarmed African Americans? This paper takes an interdisciplinary approach in answering this question. First, prosecutorial power and lack of accountability allow prosecutors to advocate for accused police officers to further their own career prospects. Second, the Supreme Court has adapted the qualified immunity and excessive force doctrines to become nearly all-encompassing legal shields for …

The History And Workings Of Virginia’S Community Services Boards: An In-Depth Look At Rappahannock Area Community Services Board, Molly Gehman

Departmental Honors & Graduate Capstone Projects

This thesis studies the historic development of mental health care in the Commonwealth of Virginia and conducts a detailed examination of the mandated mental health services provided by the Rappahannock Area Community Services Board (RACSB). To conduct this review, the mental health services provided by RACSB were compared with two other Community Services Boards (CSBs), the Loudoun County CSB and the Dickenson County CSB. Results show the importance of community health care and jail diversion programs when compared with the historic mental health care methods of institutionalization and imprisonment. Results also show that health care in Virginia is operated out …

Asymmetries In Immigration Protection, Sabrineh Ardalan Apr 2020

Asymmetries In Immigration Protection, Sabrineh Ardalan

Brooklyn Law Review

As increasing numbers of immigrants face deportation, a major asymmetry in existing immigration procedures requires attention. Individuals who are deported from the United States and attempt to reenter are afforded an opportunity to prove their fears of return to their home countries, whereas those with prior deportation orders who have remained in the United States are not. This difference is based on the false premise that the latter have already had their day in court and do not need an additional layer of screening. This article fills a critical gap in the existing scholarship, which has thus far failed to …

A Modern Cat-Tas-Trophe? The Relationships And Impacts Between Feral Cat Management And Sustainable Urban Development: A Literature Review, Gage Mofield Apr 2020

A Modern Cat-Tas-Trophe? The Relationships And Impacts Between Feral Cat Management And Sustainable Urban Development: A Literature Review, Gage Mofield

Honors Theses

For this literature review, I will be reviewing the impacts that feral populations have on sustainable development, specifically in urban environments, and doing an intensive analysis of the economic, social, and most significant, environmental impacts that feral cats have on the respective urban environment. Following this, I will then be reviewing the different management strategies that currently are in place for managing feral cat populations, specifically lethal methods of feral cat management, and then analyzing a non-lethal feral cat management program known as “TNR”, which stands for Trap-Neuter-Return, and seeing which methodology is the best suited for managing urban feral …

Minet Magnetic Indoor Localization, Michael Drake Apr 2020

Minet Magnetic Indoor Localization, Michael Drake

Honors Theses

Indoor localization is a modern problem of computer science that has no unified solution, as there are significant trade-offs involved with every technique. Magnetic localization, though less popular than WiFi signal based localization, is a sub-field that is rooted in infrastructure-free design, which can allow universal setup. Magnetic localization is also often paired with probabilistic programming, which provides a powerful method of estimation, given a limited understanding of the environment. This thesis presents Minet, which is a particle filter based localization system using the Earth's geomagnetic field. It explores the novel idea of state space limitation as a method of …

Covid-19 In Prisons And Jails In The United States, Laura Hawks, Steffie Woolhander, Danny Mccormick

Publications and Research

In mid-March 2020, the first case of novel coronavirus 2019 (COVID-19) was diagnosed at Riker’s Island, the main jail complex in New York City. Within 2 weeks, more than 200 cases were diagnosed within the facility, despite efforts to curb the spread. The situation at the Cook County jail in Chicago is similar, with about 350 incarcerated persons and staff members testing positive for the severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) virus as of early April 2020. Many other jails and prisons have reported outbreaks of COVID-19 and related deaths.

Prior viral epidemics have wrought havoc in carceral settings. An account …

Extraterritorial Rights In Border Enforcement, Fatma E. Marouf Apr 2020

Extraterritorial Rights In Border Enforcement, Fatma E. Marouf

Washington and Lee Law Review

Recent shifts in border enforcement policies raise pressing new questions about the extraterritorial reach of constitutional rights. Policies that keep asylum seekers in Mexico, expand the use of expedited removal, and encourage the cross-border use of force require courts to determine whether noncitizens who are physically outside the United States, or who are treated for legal purposes as being outside even if they have entered the country, can claim constitutional protections. This Article examines a small, but growing body of cases addressing these extraterritoriality issues in the border enforcement context, focusing on disparities in judicial analyses that have resulted in …

“Stealing Conflicts” No More?: The Gaps And Anti-Restorative Elements In States’ Restorative-Justice Laws, Lynn Branham

Saint Louis University Law Journal

This Article first profiles key findings emanating from a statutory analysis of the close to two hundred criminal-justice-related, as well as juvenile-justice-related, statutory provisions in the United States that pertain to restorative justice and practices (RJ/RP). This section of the Article unveils significant gaps and other substantial problems in states’ restorative-justice laws, including ways in which some of them conflict with core restorative tenets. The Article then proffers seven recommended statutory provisions for states’ consideration when enacting or amending their own RJ/RP laws. These recommended provisions, combined with fidelity in their implementation, would help remedy or avert the gaps and …
