Interpreting Code Enforcement Complaint By Complaint: A Hermeneutic Phenomenological Experience In Document Analysis, Daniel John Stallone
Interpreting Code Enforcement Complaint By Complaint: A Hermeneutic Phenomenological Experience In Document Analysis, Daniel John Stallone
Department of Conflict Resolution Studies Theses and Dissertations
The current hermeneutic phenomenological study was completed to provide direction for the content analysis of code enforcement complaint documents by municipal code enforcement agencies. This hermeneutic interpretive research was conducted using qualitative content analysis of greater than 500 code enforcement complaint documents submitted to a municipal code enforcement agency over 12 months. The phenomenological research was guided by the following research questions: 1.What indicators are identified by content analysis in a complaint document received from the community of shareholders of a municipal code enforcement agency? 2. What manner of delivery of a complaint document is most frequently exercised by the …
The Verbal And Non-Verbal Indicators Of Deceit In Financial And Political Fraud: A Case Study Of Bernard L. Madoff, Chen Shui-Bien And Bo Xilai, Vivian Wu
Department of Conflict Resolution Studies Theses and Dissertations
From the earliest financial scams of the seventeenth century, through the headlinegrabbing Wall Street scandals of our time, financial fraud and embezzlement have damaged both domestic and global economic systems. Preventative measures are the best way to reduce fraud. Fraudsters are adaptive and will find ways to circumvent such measures. Detecting fraud is essential once the prevention mechanisms have failed. This dissertation investigated the inherent problems of financial fraud detection for high stake fraudsters in the corporate and political fields in the United States, China and Taiwan. Both verbal and non-verbal signs of deception were examined in the case studies …
Jurisprudence—Merely Judgment: A Fallibilist Account Of The Rule Of Law, Bruce K. Miller
Jurisprudence—Merely Judgment: A Fallibilist Account Of The Rule Of Law, Bruce K. Miller
Western New England Law Review
How should judges decide the cases presented to them? In our system the answer is, “according to law,” as opposed to the judges’ preferred outcomes. But for at least a century, skeptics have cast doubt on whether adjudication under law is possible. Judge Richard Posner, now retired from the U.S. Court of Appeals for the Seventh Circuit, has, for example, argued that the indeterminacy of legal argument and the influence of judges’ predispositions show that it is not. Judge Posner thus recommends that judges give up on the rule of law in contested cases and instead candidly base their decisions …
Constitutional Law—Original Explication: A Democratic Model For The Interpretation Of Modern State Constitutions, Jorge M. Farinacci-Fernós
Constitutional Law—Original Explication: A Democratic Model For The Interpretation Of Modern State Constitutions, Jorge M. Farinacci-Fernós
Western New England Law Review
Most discussions about methods of constitutional interpretation in the United States are limited to the federal Constitution and mostly center on that document’s open-ended clauses, its secret drafting history, the unreliability of the records of its creation, and its seemingly anachronistic nature, among other characteristics that seem unique to it. This federal-centric approach has overlooked the important differences between the U.S. Constitution and many state constitutions adopted in more recent times.
Unlike their federal counterpart, several state constitutions contain substantive policy provisions and were drafted through highly democratic, public, participatory, and popular creation processes. As a result, a different interpretive …

Kanji Acquisition Techniques For L1 And L2 Japanese Studies, Amber Richardson
Undergraduate Honors Theses
Kanji are ideograms, a morphographic system borrowed from the Chinese language and used in Japanese writing. 2,136 kanji are used in the average Japanese newspaper, required for academic certification and for expat job placement. A qualitative study was conducted to observe the optimum methods to learn and acquire kanji. Japanese native speakers who were educated by the Japanese school system grades 1 through 12 are classified as L1 or first language speakers. American students, L2 or second language speakers, must have been educated in the American education system grades 1-12. L1 speakers were students attending Central Washington University (CWU) study …

SATB2-Associated syndrome (SAS) is an autosomal dominant, multisystemic, neurodevelopmental disorder due to alterations in SATB2 at 2q33.1. A limited number of individuals with 2q33.1 contiguous deletions encompassing SATB2 (ΔSAS) have been described in the literature. We describe 17 additional individuals with ΔSAS, review the phenotype of 33 previously published individuals with 2q33.1 deletions (n = 50, mean age = 8.5 ± 7.8 years), and provide a comprehensive comparison to individuals with other molecular mechanisms that result in SAS (non-ΔSAS). Individuals in the ΔSAS group were often underweight for age (20/41 = 49%) with a progressive decline in weight …

In working with English Language Learning Families, we found the following themes: when it comes to schooling, everything is in English; confidence in learning about …
Learning Context-Sensitive Human Emotions In Categorical And Dimensional Domains, Pooyan Balouchian
Learning Context-Sensitive Human Emotions In Categorical And Dimensional Domains, Pooyan Balouchian
Electronic Theses and Dissertations, 2020-2023
Still image emotion recognition (ER) has been receiving increasing attention in recent years due to the tremendous amount of social media content on the Web. Many works offer both categorical and dimensional methods to detect image sentiments, while others focus on extracting the true social signals, such as happiness and anger. Deep learning architectures have delivered great suc- cess, however, their dependency on large-scale datasets labeled with (1) emotion, and (2) valence, arousal and dominance, in categorical and dimensional domains respectively, introduce challenges the community tries to tackle. Emotions offer dissimilar semantics when aroused in different con- texts, however "context-sensitive" …

Motivación Y Experiencia De Los Estudiantes De Español En La Universidad De Kentucky, Rachel Mooney
Lewis Honors College Capstone Collection

Race(Ing) Towards Legal Literacy For (Im)Migration Amidst Covid-19, Patriann Smith, S. Joel Warrican
Teaching and Learning Faculty Publications
Historically and contemporarily, immigration laws have disproportionately affected immigrant faculty and students of color because they often inadvertently function as racial policy. (Critical) legal literacy enacted via a bottom-up approach can help to address such laws. Higher education institutions, organizations, labor unions and associations are uniquely positioned to use critical legal literacy as a tool of advocacy for immigrant faculty and students of color amidst the adverse effects of COVID-19.
Mispronunciation Detection And Diagnosis In Mandarin Accented English Speech, Subash Khanal
Mispronunciation Detection And Diagnosis In Mandarin Accented English Speech, Subash Khanal
Theses and Dissertations--Electrical and Computer Engineering
This work presents the development, implementation, and evaluation of a Mispronunciation Detection and Diagnosis (MDD) system, with application to pronunciation evaluation of Mandarin-accented English speech. A comprehensive detection and diagnosis of errors in the Electromagnetic Articulography corpus of Mandarin-Accented English (EMA-MAE) was performed by using the expert phonetic transcripts and an Automatic Speech Recognition (ASR) system. Articulatory features derived from the parallel kinematic data available in the EMA-MAE corpus were used to identify the most significant articulatory error patterns seen in L2 speakers during common mispronunciations. Using both acoustic and articulatory information, an ASR based Mispronunciation Detection and Diagnosis (MDD) …

Milton's Plant Eyes: Minimal Cognition, Similitude, And Sexuality In The Garden, Perry Guevara
Milton's Plant Eyes: Minimal Cognition, Similitude, And Sexuality In The Garden, Perry Guevara
English and Creative Writing | Faculty Scholarship
This essay turns to minimal cognition, a theoretical extension of embodied cognition, to argue for plant sentience in John Milton’s Paradise Lost. Milton imagines plants as minimally cognitive beings within an affective ecosystem, where they readily enter into the epic poem’s complex circuits of desire with appetites of their own. Specifically, the essay claims that botanical cognition arises at the convergence of two seventeenth-century philosophical systems: the first, Milton’s materialist monism, and the second, Paracelsian medicine, which avers a plant’s therapeutic effect on a human body part sharing morphological resemblance. The essay concludes that Milton’s eroticization of similitude enables a …

When Wuxia Met Romance: The Pleasures And Politics Of Transculturalism In Sherry Thomas’S My Beautiful Enemy, Jayashree Kamble
Publications and Research
A case study of Sherry Thomas’s Qing-era My Beautiful Enemy (and its prequel, The Hidden Blade) allows for a fruitful discussion of changing representations of diversity in romance fiction and its appeal to readers. MBE’s heroine is Anglo-Chinese, and the novel’s plot draws on wuxia, a literary and cinematic genre that has a long history in China, Hong Kong, and Taiwan. It is also associated with immigration and exile, perhaps resonating with Thomas’s own move from China to the U.S. Readers might find its infusion in romance appealing for two reasons: one, it features a warrior heroine (a …

Local Alignment Of Frame Of Reference Assignment In English And Swedish Dialogue, Simon Dobnik, John D. Kelleher, Christine Howes
Local Alignment Of Frame Of Reference Assignment In English And Swedish Dialogue, Simon Dobnik, John D. Kelleher, Christine Howes
Conference papers
In this paper we examine how people assign, interpret, negotiate and repair the frame of reference (FoR) in online text-based dialogues discussing spatial scenes in English and Swedish. We describe our corpus and data collection which involves a coordination experiment in which dyadic dialogue participants have to identify differences in their picture of a visual scene. As their perspectives of the scene are different, they must coordinate their FoRs in order to complete the task. Results show that participants do not align on a global FoR, but tend to align locally, for sub-portions (or particular conversational games) in the dialogue. …

Implementing Evidence-Based Practices Within Multi-Tiered Systems Of Support To Promote Inclusive Secondary Classroom Settings, Michael Mahoney Ph.D.
The Journal of Special Education Apprenticeship
Research suggests that evidence-based practices (EBPs) implemented in secondary school settings will support the academic achievement of students with specific learning needs (Scruggs, Mastropieri, Berkeley, & Graetz, 2010). In order to effectively promote the use of EBPs in general education classroom settings, secondary schools are currently adopting multi- tiered systems of supports (MTSS) such as Positive Behavioral Interventions and Supports and Response to Intervention models (Fuchs & Fuchs, 2006; Sugai & Horner, 2006). However, secondary teachers’ may have limited knowledge of EBPs and adequate training in the implementation of EBPs in general education classroom settings (Kutash, Duchnowski, & Lynn, 2009; …
Cultural Linguistics And Treaty Language: A Modernized Approach To Interpreting Treaty Language To Capture The Tribe's Understanding, Dylan R. Hedden-Nicely
Cultural Linguistics And Treaty Language: A Modernized Approach To Interpreting Treaty Language To Capture The Tribe's Understanding, Dylan R. Hedden-Nicely
Articles
Language is a reflection of a thought world. A worldview that has been shaped by place to describe one's identity in space and time does not equate to species relatedness as a default to know one another. In the legal system of the United States, there is acknowledgement of treaties in colonized lands that there are rights granted from the tribes and not to them, and those rights are land based. Yet, the Indigenous voice is dead before arrival, before it enters the room of science, justice, academe, or otherwise. The exclusion of Indigenous peoples at the table of knowledge …

Preparing For Financial Success: An Online Curriculum For Graduating College Students, Amy Gallagher
West Chester University Master’s Theses
This thesis examines how institutions of higher education can better prepare students for the transition into the development stage of Emerging Adulthood. I explore the following questions: What is the stage of Emerging Adulthood? What knowledge do students have regarding financial literacy? How does social class play a role on students’ knowledge regarding financial literacy? Why are institutions not preparing students for life post-graduation? This thesis uses student identity development thoery, social capital theory, and historical analysis to critically analyze the current college student experience post-graduation in regards to financial literacy. As I dive deeper into the relationship between social …

Facilitating Feedback: The Benefits Of Automation In Monitoring Completion Of Honors Contracts, Erin E. Edgington
National Collegiate Honors Council Monographs: Chapters
As we have seen in this volume so far, contract courses are an increasingly valuable pedagogical strategy for maintaining access to and demand for honors education. Administered with the “[i]ntentionality, transparency, [and] consistency” that Richard Badenhausen proposes in his opening essay (17), they can even, as Margaret Walsh suggests, help “shift [students’] focus from getting out of course requirements to getting into new and different courses to advance their capacity to learn” (40). While good reasons to offer contracts clearly exist, administering them nevertheless presents challenges. This essay considers process and pedagogy, with the aim of empowering both students and …

Making The Global Familiar: Building An International Focus Into The Honors Curriculum, Erin E. Edgington, Daniel C. Villanueva
National Collegiate Honors Council Monographs: Chapters
Increasingly, American colleges and universities are seeking to prepare their students not only for professional success but also for life in a world whose interconnectedness and, indeed, interdependency, will require them to live as global citizens. That the term “global citizen,” or one of its many synonyms, now appears in numerous institutional mission and values statements suggests the significance that institutions of higher education attach to cultivating individuals able to navigate the transnational and intercultural complexities of twenty-first-century economics, politics, and ethics. Honors programs and colleges have enthusiastically adopted a global education orientation along with the larger institutions that house …

Advocates of study abroad have emphasized that semester- and year-long programs offer greater opportunities than short-term programs for students to enhance their personal, academic, and professional development (Dwyer). But can carefully constructed short-term study abroad experiences, which are increasingly popular choices for undergraduates, have similar effects? One study suggests they can achieve important outcomes, such as encouraging tolerance for ambiguity, appreciation for diversity, and openness to experience (Shadowen et al.). Another study shows that even shortterm exposure to other cultures can enhance creativity (Leung et al.), and a third demonstrates that creative problem solving was improved by cultural study in …

A Palimpsestuous Writing: Maxine Hong Kingston's The Woman Warrior, Xiaoqing Liu
Scholarship and Professional Work - LAS
Maxine Hong Kingston’s The Woman Warrior is one of the most successful Asian American literary works. Rather than reading the book as an autobiography of an Asian American girl growing up in Chinatown in America, I view it as a multifarious telling and writing of the stories of Asian American women in their interrelated relationships living in both the past and present in their hyphenated lives between China and America. With her palimpsestuous writing strategy, Kingston reexamines what it means to be an Asian American woman. She not only uncovers what is forbidden, hidden, unspoken, wronged, or covered in the …

Immigration And Violent Crime: Triangulating Findings Across Diverse Studies, Michael T. Light, Isabel Anadon
Immigration And Violent Crime: Triangulating Findings Across Diverse Studies, Michael T. Light, Isabel Anadon
Marquette Law Review
The dramatic increase in both lawful and unauthorized immigration in recent decades produced a groundswell of research on two questions: (1) Does immigration increase violent crime? and (2) What policy responses are most effective at addressing unauthorized immigration (e.g., sanctuary policies, deportations, etc.)? For the most part, these bodies of work have developed independently, and thus we know little as to whether the insights from one inform the other. This Article fills this gap by first reviewing both areas of research and then triangulating shared findings between them. In doing so, we focus on three contemporary immigration policies: (1) increased …
