Funding Impacts On Existing Social Workers Providing Services To African American Battered Women, Dalicia Victorica Watson
Funding Impacts On Existing Social Workers Providing Services To African American Battered Women, Dalicia Victorica Watson
Walden Dissertations and Doctoral Studies
Social workers who work in domestic violence shelters have many different impacts that can affect their ability to provide services to battered women. Research is lacking on how funding impacts the abilities of existing social workers to provide services to African American battered women who are at domestic violence shelters in Columbia, South Carolina. The purpose of this study was to examine how a lack of funding impacts the abilities of existing social workers who work at domestic violence shelters to provide services to African American battered women. Conflict theory was used to gain an understanding of how funding issues …
Court Intervention And Recurrence Of Child Maltreatment, Steven Wayne Luke
Court Intervention And Recurrence Of Child Maltreatment, Steven Wayne Luke
Walden Dissertations and Doctoral Studies
The problem of child maltreatment recurrence is both complex and pervasive, affecting nearly every nationality and culture worldwide. The current body of research consistently contains reports of a gap due to the lack of input from the families served that may be resolved through the application of intergroup contact theory. The purpose of this study was to determine if the presence of an attorney representing parents in child maltreatment intervention predicted lower recurrence in child maltreatment as opposed to when those attorneys are absent from the process. While much of the practice of social work is based on ecological systems …
A Less Private Practice: Government Lawyers And Legal Ethics, Jennifer Leitch
A Less Private Practice: Government Lawyers And Legal Ethics, Jennifer Leitch
Dalhousie Law Journal
Government lawyers are public servants and legal professionals. How they differ from private lawyers has much to do with whom they purport to represent and how they exercise power as a lawyer. I will look at a particular case-study—the St. Anne’s Residential school adjudication. This case study illustrates the challenges that government lawyers face in fulfilling their professional duty within a traditional private lawyer framework. St. Anne’s Residential School involved some of the most egregious physical, sexual and psychological abuse of Indigenous children between 1941 and 1972. St. Anne’s Residential School litigation is used as a cautionary (and truly tragic) …
The Regulation Of Equity Index Futures, Lynn Bai
The Regulation Of Equity Index Futures, Lynn Bai
Transactions: The Tennessee Journal of Business Law
Equity index futures are one of the most actively traded derivative instruments in financial markets around the world. Advancements in trading and clearing technologies transformed the marketplace over the past two decades. Regulation drastically changed to keep pace with the market’s development. New rules have been implemented covering trading activities, risk management, market surveillance, and customer protection. Legal literature on the regulation of this important financial instrument is surprisingly antiquated. Existing papers were written decades ago and do not reflect the true metes and bounds of today’s regulatory landscape. This paper fills the void. It provides a comprehensive discussion of …

Capitalizing On Healthy Lawyers: The Business Case For Law Firms To Promote And Prioritize Lawyer Well-Being, Jarrod F. Reich
Capitalizing On Healthy Lawyers: The Business Case For Law Firms To Promote And Prioritize Lawyer Well-Being, Jarrod F. Reich
Georgetown Law Faculty Publications and Other Works
This Article is the first to make the business case for firms to promote and prioritize lawyer well-being. For more than three decades, quantitative research has demonstrated that lawyers suffer from depression, anxiety, and addiction far in excess of the general population. Since that time, there have been many calls within and outside the profession for changes to be made to promote, prioritize, and improve lawyer well-being, particularly because many aspects of the current law school and law firm models exacerbate mental health and addiction issues, as well as overall law student and lawyer distress. These calls for change, made …

Is Airbnb Polluting The Big Apple? The Impact Of Regulating The Short-Term Rental Service In New York City, Kayla Laskin
Journal of Civil Rights and Economic Development
(Excerpt)
Imagine your boss calls you into his office on a Monday morning. You think you are going to chat about the weekly agenda ahead; however, you notice the sullen look on your boss’s face. You immediately become nervous and think that no good news could possibly come from this meeting. You begin to glance over his desk and notice printouts for unemployment counseling and job listings in the area. Sheer panic begins to spread throughout your body, and then your boss states, “I’m sorry, we’re going to have to let you go.” Your stomach drops to the floor. Your …

Solving The Pro Bono Mismatch, Atinuke O. Adediran
Solving The Pro Bono Mismatch, Atinuke O. Adediran
University of Colorado Law Review
The pro bono interests of law firm lawyers tend to differ from the actual legal needs of the poor. This difference results in the mismatch problem or the incongruence between the interests of firm lawyers and the needs of the poor. Today, the mismatch problem has resulted in law firm lawyers' increased demand of immigration matters while legal needs are greatest in housing and family law. This leaves nonprofit legal services organizations scrambling to find pro bono representation for poor clients or otherwise relying on very limited resources to represent poor clients.
The literature on the mismatch problem is lacking …
Toward National Criminal Bar Admission In U.S. District Courts, Gabriel J. Chin
Toward National Criminal Bar Admission In U.S. District Courts, Gabriel J. Chin
Fordham Law Review
In the extensive litigation over bar admission in federal district courts, courts have upheld state bar membership requirements. Nevertheless, the changes to legal practice flowing from the COVID-19 pandemic—the disconnection between workplace and residence, the ability to meet and to hold court proceedings by video, and the unjustifiability of charging clients time and travel for brief, perfunctory in-person meetings and conferences that could be handled effectively and expeditiously online—will make these questions ever more serious

The novel coronavirus COVID-19 has profoundly disrupted life in the United States. Among other challenges, jurisdictions are unlikely to be able to administer the July 2020 bar exam in the usual manner. It is essential, however, to continue licensing new lawyers. Those lawyers are necessary to meet current needs in the legal system. Equally important, the demand for legal services will skyrocket during and after this pandemic. We cannot close doors to the profession at a time when client demand will reach an all-time high.
In this brief policy paper, we outline six licensing options for jurisdictions to consider for …
Using General Counsel To Set The Tone For Work In Large Chapter 11 Cases, Nancy B. Rapoport
Using General Counsel To Set The Tone For Work In Large Chapter 11 Cases, Nancy B. Rapoport
Scholarly Works
This Essay suggests that one way for the general counsel to help bankruptcy professionals make better staffing and budget decisions is to communicate her values more clearly to those professionals at the beginning of the engagement. In her role as the chief legal officer, the general counsel needs to let the bankruptcy professionals in on her thought processes. How does she watch over her own attorneys' decisions in other types of cases? What expenses does she consider reasonable? If she takes an active role in monitoring her bankruptcy professionals' work, her values (assuming that they're good values) will contribute to …

The COVID-19 pandemic and resulting shutdowns are affecting every aspect of society. The legal profession and the justice system have been profoundly disrupted at precisely the time when there is an unprecedented need for legal services to deal with a host of legal issues generated by the pandemic, including disaster relief, health law, insurance, labor law, criminal justice, domestic violence, and civil rights. The need for lawyers to address these issues is great but the prospect of licensing new lawyers is challenging due to the serious health consequences of administering the bar examination during the pandemic.
State Supreme Courts are …

Using Data Analytics To Predict An Individual Lawyer's Legal Malpractice Risk Profile: Becoming An Lpl "Precog", Nancy B. Rapoport, Joseph R. Tiano Jr.

The power of data analytics is revolutionizing the way that business is conducted in nearly every industry. The medical industry, the consumer/retail space, and the banking and financial industries are taking their business operations to the next level by leveraging the power of big data. Despite radical transformations in nearly every other aspect of the legal industry, though, the approach to preventing, predicting, assessing, and resolving malpractice claims hasn't really changed. Malpractice insurers and their law firm clients continue to take an old-fashioned approach when it comes to legal professional liability. Unlike the insurers pricing automobile policies, the vast opportunity …

Papercuts: Hierarchical Microaggressions In Law Schools, Nantiya Ruan
Scholarly Works
The Article investigates law schools as locations of workplace fairness by examining its hierarchical structure and the power dynamics at work. Others have researched and written on the myriad ways in which “legal skills faculty” are treated unfairly as compared to those that primarily teach non-skills (or doctrinal classes) because of the subject matter that they teach and the assumptions that are made about their credentials and ability to contribute to the law school mission. Likewise, other scholars have critically examined the discrimination experienced by law school faculty members based on race, gender, sexual orientation, and other identities. What has …

"Practicing criminal law as a woman is like playing tackle football in a dress." Andrea George, Executive Director of the Federal Public Defender for Eastern Washington and Idaho, began her testimony to the American Bar Association's Women in Criminal Justice Task Force with that powerful observation. In the wake of the #MeToo movement, the ABA has focused on ways to enhance gender equity in the profession and in the justice system. The Criminal Justice Section of the ABA has invested significant resources in the creation of the Women in Criminal Justice Task Force (WCJ TF), which launched its work in …

Contextualizing Performance Of Coordinated Care Network Of Veteran Services In Virginia, Marina Saitgalina, Donta Council
Contextualizing Performance Of Coordinated Care Network Of Veteran Services In Virginia, Marina Saitgalina, Donta Council
School of Public Service Faculty Publications
Coordinated care network is an approach to human service delivery that is recognized to improve client outcomes at a reduced cost. However, general mixed findings on the effectiveness of coordinated care networks warrant research contextualization. This article seeks to discover factors influencing the performance of a coordinated care network delivering social services to veterans and their families. The study provides a contextual analysis of a coordinated care network launched in 2016 in southeastern Virginia for two samples of 1,512 and 375 veterans and their families. Results of the regression analyses indicate that initial progress has been made both in efficiency …
Social Media: A Good Alternative, For Alternative Service Of Process, Emily Davis
Social Media: A Good Alternative, For Alternative Service Of Process, Emily Davis
Case Western Reserve Journal of International Law
A cost efficient and effective means of alternative service of process in civil and commercial cases upon both domestic and international defendants lies in social media. Traditional methods of service of process are preferred, but are not always practicable. When a defendant cannot be reached through traditional methods, judges should use their discretion and allow alternative service by social media in appropriate cases. Current methods of alternative service, such as publication, are not efficient or effective. By allowing alternative service of process via social media in certain cases, the defendant is much more likely to receive actual notice in a …

Disruptive Innovation Within The Legal Services Ecosystem, Donald G. Billings, Douglas G. Campbell
International Journal of Applied Management and Technology
Many law firms have done little to address the opportunities and threats presented by potentially disruptive technology (DT), such as artificial intelligence (AI) and machine learning (ML). The purpose of this multiple case study was to explore strategies that some law firm leaders use to address the potentially detrimental influences of DT on their organizations. The systems approach to management was employed as the conceptual framework. Data were collected from 6 participants at 2 international law firms with offices in California, using semi-structured interviews and organizational artifacts. Data were analyzed using inductive and deductive coding and thematic analysis, resulting in …

Let My People Stay: A Nonprofit's Role In Immigrant Lives, Karla Villa
Mahurin Honors College Capstone Experience/Thesis Projects
This project draws on research that I conducted May to August 2019 with a nonprofit organization, La Casita Center, that provides services to the Hispanic immigrant community in Louisville KY. Despite what appears to be a bleak time in our country for immigrants and immigration reform, there is hope found in the organizations that are working to support and fill the gap that the national government has left. I draw on interviews and participant observation research conducted with staff at La Casita Center to
