The Ripple Effects Of Gideon: Recognizing The Human Right To Counsel In Civil Adversarial Proceedings, Jonathan K. Stubbs Jan 2020

The Ripple Effects Of Gideon: Recognizing The Human Right To Counsel In Civil Adversarial Proceedings, Jonathan K. Stubbs

Law Faculty Publications

Procedural fairness and equal protection were the core of Gideon’s reasoning for a right to counsel for indigent criminal defendants. Under the same constitutional values, there should be a right to legal assistance of counsel for indigent civil litigants, especially in adversarial proceedings. This Article outlines the constitutional basis for a civil right to counsel. Further, it stresses the need for legislation to address the massive shortfall in legal representation available to indigent persons in the United States. Recognition of civil Gideon as part of the Constitution’s promise of justice accommodates a moral revolution. It exemplifies a shift in …

Exploring The Physical And Mental Health Disparities In The Transgender Male Community In A Southern Community-Based Medical Lgbtq Organization, Karen E. Musgrove

All ETDs from UAB

This dissertation examined the physical and mental health disparities in the transgender male community in a Southern community-based medical LGBTQ (lesbian, gay, bisexual, transgender, queer) organization via a convergent mixed methods study design. There is a paucity of research on the transgender male community in terms of their physical and mental health care needs, services, and disparities. Quantitative data were col-lected via a chart review of 130 transgender male medical charts at the Magic City Well-ness Center (MCWC). The MCWC transgender male medical chart data were compared to three groups separately of the 2018 Behavioral Risk Factor Surveillance System (BRFSS) …

Join With Me, Won't You? Civic Engagement, Covid-19, And The Millennial Generation Of Law Professors, Joseph Schremmer

Faculty Articles

My goals in this essay are to place legal education’s COVID-19 crisis into this broader context and illuminate the unique opportunity that millennial law professors have to create the conditions for more robust community participation within and outside of our law schools. Part I summarizes the decline of civic engagement and social capital in preceding decades and its consequences for law, public discourse, and quality of life. Part II outlines how this deficit of social capital exacerbates the challenges facing law schools and professors in delivering legal education and constructing community during the coronavirus pandemic. Part III explores the unique …

Covid, Crisis, And Courts, Colleen Shanahan, Alyx Mark, Jessica Steinberg, Anna Carpenter

Faculty Articles

Our country is in crisis. The inequality and oppression that lies deep in the roots and is woven in the branches of our lives has been laid bare by a virus. Relentless state violence against Black people has pushed protestors to the streets. We hope that the legislative and executive branches will respond with policy change for those who struggle the most among us: rental assistance, affordable housing, quality public education, comprehensive health and mental health care. We fear that the crisis will fade, and we will return to more of the same. Whatever lies on the other side of …

Digging Into Algorithms: Legal Ethics And Legal Access, Carla L. Reyes, Jeff Ward Jan 2020

Digging Into Algorithms: Legal Ethics And Legal Access, Carla L. Reyes, Jeff Ward

Faculty Journal Articles and Book Chapters

The current discussions around algorithms, legal ethics, and expanding legal access through technological tools gravitate around two themes: (1) protection of the integrity of the legal profession and (2) a desire to ensure greater access to legal services. The hype cycle often pits the desire to protect the integrity of the legal profession against the ability to use algorithms to provide greater access to legal services, as though they are mutually exclusive. In reality, the arguments around protecting the profession from the threats posed by algorithms represent an over-fit in relation to what algorithms can actually achieve, while the visions …

The Voice Of The Gods Is Crippling: Law School For Helicoptered Millennials, Katerina P. Lewinbuk, Taci Villarreal, Elena Bolonina

St. Mary's Journal on Legal Malpractice & Ethics

As millennials dominate law school classrooms, many professors are recognizing the importance of altering the traditional methods of teaching law. Millennials act, think, and learn differently. Numerous factors are linked to why this new generation of law students is distinctively different than previous generations. This article examines these factors and how they influence millennials’ learning styles. Alternative methods of teaching millennial law students are also discussed and proposed, along with a specific example of a tailored professional responsibility textbook and course to the modern law student.

How Twenty-First Century Technology Affects Inmates' Access To Prison Law Libraries In The United States Prison System, Kelsey Brown

Marquette Benefits and Social Welfare Law Review

In today’s generation America is open 24 hours, 7 days a week. Americans live in an open-all-night society, where with one click, one can buy groceries, watch a 3D movie, bowl a perfect game, and eat pizza all at two in the morning without ever leaving his or her living room. Therefore, is not a stretch to imagine a single digital device, such as a computer or phone, that could hold thousand, if not, millions of books with topics ranging from comedy, fiction, nonfiction, business, cooking, fitness, etc. But most importantly, and one of the focuses of this Comment, are …

Background: Lesbian, gay, bisexual, transgender, and queer (LGBTQ) individuals face considerable health disparities, often due to a lack of LGBTQ-competent care. Such disparities and lack of access to informed care are even more staggering in rural settings. As the state medical school for the Washington, Wyoming, Alaska, Montana, and Idaho (WWAMI) region, the University of Washington School of Medicine (UWSOM) is in a unique position to train future physicians to provide healthcare that meets the needs of LGBTQ patients both regionally and nationally.

Objective: To describe our methodology of developing a student-driven longitudinal, region-wide curriculum to train medical students to …

The Fight For Nycha: Rad And The Erosion Of Public Housing In New York, Kyle Giller Jan 2020

The Fight For Nycha: Rad And The Erosion Of Public Housing In New York, Kyle Giller

City University of New York Law Review

The government-funded creation of permanent, affordable housing for millions of middle- and low-income people was one of the greatest social welfare projects of the 20th century. Beginning in the 1970s, however, many Public Housing Authorities (“PHA”) saw decades of funding cuts, neglect, and mismanagement, and many PHAs have been demolished or seriously neglected. New York City Housing Authority (“NYCHA”), with a population larger than many mid-size American cities, is the last remaining large-scale public housing program in the country and one of the last bastions of true affordability in one of the most unaffordable cities in the world. Now, NYCHA, …

Asylum’S Revolving Door: The Future Of Domestic Violence Claims Post -A-B-, Tomei Peppard Jan 2020

Asylum’S Revolving Door: The Future Of Domestic Violence Claims Post -A-B-, Tomei Peppard

Southern Illinois University Law Journal

As global migration reaches unprecedented levels, the United States’ immigration system is struggling to keep up with the growing demand. Prior to June 2018, a number of domestic violence victims, particularly from the most dangerous parts of Central America, sought and received asylum in the United States. However, after the Attorney General issued his decision in Matter of A-B-, thousands of domestic violence victims were precluded from claiming asylum, leaving many victims without any options for relief.

Although domestic violence may not easily fit within the statutory scheme of asylum as interpreted by the Attorney General, a modified version of …

The Never-Ending Sentence: An Examination Of Policies And Programs Targeting Post-Secondary Education Among Currently And Formerly Incarcerated Individuals, Julianne Shumake

USF St. Petersburg campus Honors Program Theses (Undergraduate)

Education serves as potentially the greatest instrument of change and self-improvement within the modern society. With higher education comes a variety of skills and opportunities that foster success within the modern world including lucrative employment, personal growth in relation to skills and knowledge, as well improved mental health, and sense of belonging (Runnel, 2015). Unfortunately, the university system within the United States is designed to exclude a large population of people, those with a felony convictions. As of 2019, the United States has an estimated 24 million individuals with a felony status on their records (Eberstadt, 2019). For these 24 …

Measuring The Impact Of Access To Justice Programs: An Assessment Tool For Funders And Policymakers, Thomas M. Clarke, Paula Hannaford-Agor Jan 2020

Measuring The Impact Of Access To Justice Programs: An Assessment Tool For Funders And Policymakers, Thomas M. Clarke, Paula Hannaford-Agor

Faculty Publications

Across the fifty states and the nation, many organizations have implemented a variety of programs to reduce the access-to-justice gap. The result is a widely varying patchwork of capabilities that provide different services and solutions in very different amounts that do not necessarily or even usually align with the problems that the target populations face. This paper proposes more of an “engineering” approach by introducing an analytical tool for organizations working on closing the access gap to estimate the potential impact of proposed solutions.

The tool can be used to: 1) assess the magnitude of an access problem that could …
