Knowing Your Rights In Trump’S America: Paper Trails Of Community Empowerment, Ruth Gomberg-Munoz Aug 2020

Knowing Your Rights In Trump’S America: Paper Trails Of Community Empowerment, Ruth Gomberg-Munoz

Anthropology: Faculty Publications and Other Works

This essay traces the circulation and changing meanings of documents in community education and empowerment campaigns in the wake of Trump’s 2016 election. In particular, I examine how advocates use community education to create and exploit legal gray areas as they advance competing interpretations and uses of documents in sociolegal arenas. I also explore how local campaigns for “sanctuary” seek to sever paper trails of documents that can expose immigrant community members to federal immigration agencies. Finally, as documents form new paper trails through deportation, I attend to their changing meanings as they travel in new directions, traverse jurisdictional boundaries, …

Covid, Crisis And Courts, Anna E. Carpenter, Colleen F. Shanahan, Alyx Mark, Jessica Steinberg

Utah Law Faculty Scholarship

Our country is in crisis. The inequality and oppression that lies deep in the roots and is woven in the branches of our lives has been laid bare by a virus. Relentless state violence against Black people has pushed protestors to the streets. We hope that the legislative and executive branches will respond with policy change for those who struggle the most among us: rental assistance, affordable housing, quality public education, comprehensive health and mental health care. We fear that the crisis will fade, and we will return to more of the same. Whatever lies on the other side of …

Kentucky Transportation Cabinet Right Of Way Process Review (Phase I), Christopher W. Van Dyke, Bryan Gibson, Robin Baskette, Jeff Jasper, Candice Y. Wallace, Steven Douglas Kreis

Kentucky Transportation Center Research Report

From the Executive Summary:

The Kentucky Transportation Cabinet (KYTC) is responsible for planning, developing, constructing, and maintaining a prodigious inventory of roadway and bridge assets throughout the state. Project development is a complex process involving the coordination of numerous divisions and preconstruction disciplines across the Cabinet. On many projects, right-of-way (ROW) acquisition presents many challenges. Frequently, the ROW process is found on the critical path, meaning that it effectively governs a project’s overall duration. In some cases — especially on more complex projects — acquiring the ROW may take several years. Recognizing the need to shorten the duration and improve …

Same Wheel, New Direction: Toward A Sex Trafficking-Specific Framework Of Care, Danielle Joy Dimuzio

All Theses

In 2016, an estimated 3.8 million adults and children were victims of sex trafficking worldwide. Even with so many people affected, and with the mental health effects of sex trafficking victimization being so serious and long-lasting, very little exists on how to most effectively treat this population after they are rescued or escape. The current study contributes to this body of research by obtaining the perspectives of clinical service providers working with sex trafficking survivors, with particular attention paid to their experiences and views on mental health treatment methods for survivors. This study used a systems perspective and qualitative research …

Faculty Scholarship

In many states, the highest number of docketed grievances arise out of criminal and family law matters. The OLR provided the data, enabling analysis of the grievances by gender, age, length of time since law school graduation, type of matter, prior experience with diversion or discipline, and geographical location. The data also revealed the frequency of allegations by practice matter, the types of allegations that led to discipline, and the frequency with which lawyers …

A Qualitative Inquiry Exploring Help-Seeking Behaviors And Resilience Strategies Women With Disabilities Utilize When Experiencing Gender-Based Violence In Rural Communities, Kimberly Ann Aguillard

Dissertations and Theses (Open Access)

Women with disabilities (WWD) are at pronounced risk of experiencing multiple forms of severe and prolonged violence, and they face barriers to accessing help. A multitude of factors associated with disability and rurality may compound the experience of violence, including geographic and social isolation, forcing WWD in rural settings to navigate extremely dangerous situations with limited avenues for accessing help and securing safety. This research explored how women with disabilities experiencing violence while living in rural communities navigate programs and policies, make decisions about seeking and securing help, and build resilience despite experiencing violence. The current study methodology empowers this …

Assessment Of The Growth In Social Groups For Sustainable Agriculture And Land Management, Pretty Jules, Simon Attwood, Richard Bawden, Henk Van Den Berg, Zareen P. Bharucha, Jacob I. Ricks Aug 2020

Assessment Of The Growth In Social Groups For Sustainable Agriculture And Land Management, Pretty Jules, Simon Attwood, Richard Bawden, Henk Van Den Berg, Zareen P. Bharucha, Jacob I. Ricks

Research Collection School of Social Sciences

For agriculture and land management to improve natural capital over whole landscapes, social cooperation has long been required. The political economy of the later twentieth and early twenty-first centuries prioritized unfettered individual action over the collective, and many rural institutions were harmed or destroyed. Since then, a wide range of social movements, networks and federations have emerged to support transitions towards sustainability and equity. Here, we focus on social capital manifested as intentionally formed collaborative groups within specific geographic territories. These groups focus on: (1) integrated pest management; (2) forests; (3) land; (4) water; (5) pastures; (6) support services; (7) …

The Housing Department Rent Stabilization Program In The City Of San José: Has The Tracking Of Tenant Protection Ordinance Eviction Notices Been Successful To Understand Rent And Eviction Trends From 2019 To 2020?, Viviane Nguyen

Master's Projects

This study is a two-part process evaluation of the RSP’s tracking of TPO (2017) just cause eviction filings. This study also intends to understand the RSP’s collected data when it is properly processed. This study’s research questions are as follows: Was the RSP’s process for tracking just cause evictions working to achieve the program’s goal in determining eviction outcomes? At what levels did landlords pursue just cause evictions for failure to pay rent? Is there a significant disparity between market-rate property managers’ eviction filings and rent-controlled apartment landlords’ eviction filings?

Incrementalist Vs. Maximalist Reform: Solitary Confinement Case Studies, Margo Schlanger Aug 2020

Incrementalist Vs. Maximalist Reform: Solitary Confinement Case Studies, Margo Schlanger

Northwestern University Law Review

Among criminal justice reformers, it has long been hotly contested whether moderate reform helps or harms more efforts to achieve more thoroughgoing change. With respect to solitary confinement, do partial and ameliorative measures undermine the goal of solitary confinement abolition? Or do reformist campaigns advance—albeit incrementally—that ultimate goal? Call this a debate between “incrementalists” and “maximalists.” I offer this Essay as an appeal for empirical rather than aesthetic inquiry into the question. After summarizing nationwide reform litigation efforts that began in the 1970s, I try to shed some factual light by examining solitary reform efforts in two states, Massachusetts and …

Black Market Law Firms, Casey E. Faucon Aug 2020

Black Market Law Firms, Casey E. Faucon

Cardozo Law Review

In business and in competition, value exists in striking first. Accountants, the so-called hawks of the professional world, have made the first move. In September 2017, the global accounting giant PwC opened a law firm in Washington, D.C. called ILC Legal. ILC Legal not only provides legal services on non-domestic matters, but also acts as a multidisciplinary provider (MDP) and offers other professional services, such as tax-planning, business consulting, and marketing, throughout its ninety-country network. In June 2018, Deloitte quickly followed suit, the second of the Big Four accounting firms to enter the U.S. MDP market, partnering with a U.S. …

What Does The Digital Revolution Mean For Legal Education?, Emma Ziercke, Dirk Hartung, Klaus-Stefan Hohenstatt Aug 2020

What Does The Digital Revolution Mean For Legal Education?, Emma Ziercke, Dirk Hartung, Klaus-Stefan Hohenstatt

Research Collection Yong Pung How School Of Law

The general consensus amongst legal thought leaders is that legal education needs to be re-designed to, amongst other things, reflect the digital transformation of the legal industry. This opinion exposes the long-standing tension between academic learning and vocational learning in the legal profession. Technology cannot be ignored, but where to begin? What do lawyers actually need to know about technology? To answer this question, we have to understand what it means to “be a lawyer” in the twenty-first century. Technology is multi-dimensional and encompasses lawyers as users of technology, as advisers for new legal issues that stem from the application …

Practising Law For Rich And Poor People: Towards A More Progressive Approach, Allan C. Hutchinson Jul 2020

Practising Law For Rich And Poor People: Towards A More Progressive Approach, Allan C. Hutchinson

Articles & Book Chapters

It is 50 years since Stephen Wexler’s essay, Practicing Law for Poor People, was published. By any reasonable measure, this has become and remains an iconic piece. Whether he is agreed with or disagreed with, Wexler arguments continue to define the terms of the debate about the proper role and responsibilities of those who practice law for poor people. Critics and jurists can be for or against Wexler’s account, but they cannot make serious headway without it. As such, Wexler’s essay deserve to be celebrated and showcased as it reaches its half-century milestone. However, his ideas and their informing assumptions …
