Migratory Timescapes: Experiences Of Pausing, Waiting, And Inhabiting The Meanwhile Of Migrants And Asylum Seekers In Mexico, Isabel Gil Everaert

Based on ethnographic fieldwork in Mexico´s southern border with Guatemala, this dissertation provides insights into contemporary experiences of migration in Mexico by engaging with the notions of movement, control, and settlement from a critical perspective. I explore these experiences through the idea of migratory timescapes, defined as structural temporal-relational contexts in which migrants, refugees, and asylum seekers are socially embedded. In the case of this dissertation, I unpack three migratory timescapes which are situated in a regional context of growing displacement and increasingly restrictive migratory and asylum policies, what I call the block-and-wait system.

Are The Best And Brightest Joining The Public Service?, Luke Fowler, Chris Birdsall

The changing nature of public service has blurred the lines between economic sectors by intermingling public, private, and nonprofit missions, and made it easier for employees to balance extrinsic and intrinsic motivators by seeking employers positioned along a continuum that balance their interests. Using data from the “After the JD” study, the authors analyze responses of law school graduates to determine how academic qualifications and employee motives affect economic sector of employment. Findings suggest that the best and brightest law school graduates are predisposed to employment in the private or nonprofit sectors because they offer the strongest extrinsic or intrinsic …

As part of the symposium on Jack Balkin and Sandy Levinson’s Democracy and Dysfunction, this Article documents another source of the dysfunction that the authors observe—elite lawyers’ unwillingness to break ranks with other elite lawyers who participate in the destruction of various norms that are integral to a well-functioning democracy. These network effects eliminate the possibility of “soft” sanctions on norm violators such as withholding future professional advancement. Thus, rather than enforcing norms and deterring norm violations, the networks serve to insulate norm violators from any meaningful accountability.

This primer is addressed to judges, parole board members, and other legal decisionmakers who use or are considering using the results of risk assessment instruments (RAIs) in making determinations about post-conviction dispositions, as well as to legislators and executive officials responsible for authorizing such use. It is meant to help these decisionmakers determine whether a particular RAI is an appropriate basis for legal determinations and whether evaluators who rely on an RAI have done so properly. This primer does not take a position on whether RAIs should be integrated into the criminal process. Rather, it provides legal decision-makers with information …

This chapter discusses the hearing of essential and urgent court matters in the Singapore courts during the COVID-19 pandemic. On 27 march 2020, the Singapore judiciary notified courst users that remote hearings were to be implemented for certain types of hearings by means of video and telephone conferencing facilities. Court users were also provided with indicative lists of matters which might be considered essential and urgent.

Poverty, Gender, and Youth
The Population Council has a longstanding partnership with indigenous communities in rural Guatemala through the Abriendo Oportunidades program. In compliance with COVID-19 prevention protocols, as of mid-August 2020 government restrictions allowed for inter-district mobility at the national level, classes remain suspended, and businesses were allowed to operate. To better understand indigenous knowledge, perspectives, and evolution of needs related to the COVID-19 pandemic in Guatemala, we conducted a second round of phone interviews with 144 key informants in ten municipalities. The second round represents 75% (n = 108) of the cohort interviewed April 14–18, 2020. Thirty-six new informants were recruited to …

Notaries in Indonesia have existed since the colonial period. Changes in technology and the continuous evolution of information bring a flow of change in all aspects of life, including the legal sector. However, the position of notaries in Indonesia has not undergone significant changes despite ongoing advancements. The promulgation of Law No. 2 of 2014 formally introduced the term “cyber notary” to Indonesian law. However, the idea of cyber notary is not practical because of legal obstacles that seem to form a legal paradox. Rural career development is rarely studied despite a large portion of American students attending school in a rural area. Rural career development is affected by factors such as student attachment to place, access to professional role models, local economic development, school funding, and geographic proximity to professional industries and higher education. Every year, hundreds of thousands of migrants from El Salvador, Guatemala, Honduras, and Nicaragua risk their lives traveling to and toward the U.S. Long before reaching the U.S.-Mexico border, however, they travel thousands of miles across Central America and Mexico, often stopping off in migrant shelters scattered along the way. Whether travelling by foot or riding atop large freight trains known as “the Beast,” migrants spend weeks, months, and even years in transit, navigating a dense landscape of hardening borders and immigration enforcement in Mexico and the U.S. while encountering incredible dangers along the way, such as assault, extortion, kidnapping, …

Unlimited Vindication: Choosing Statutes Of Limitations In The Era Of Constrained Personal Jurisdiction, Patricia Youngblood Reyhan

This Article examines the relationship between personal jurisdiction and choice of law in the context of choosing statutes of limitations to either permit or bar plaintiffs’ claims in cases where the parties or the facts underlying the cause of action are connected with multiple states or nations. During the period of constitutionally-permissible exercises of expansive personal jurisdiction, existing from 1945, when the United States Supreme Court decided International Shoe v. Washington, to the 2010s, states gradually rejected the then-prevalent rule that reflexively chose the limitations law of the forum, whether that law favored the vindication interests of the plaintiff or …

This research is focused on identifying the best practices and methods used by community service providers who serve Arab immigrant women, a heavily marginalized and isolated demographic. Specifically, this research seeks to answer, what are the best practices for community engagement, leadership, and empowerment in the lives of Arab migrant women in San Francisco? I examine the elements of community empowerment, engagement, leadership, and methods of providing services from the Asian Women’s Shelter, the Chinatown Community Development Center, and the Arab Resource and Organizing Center. There is a widespread recognition of the importance of not-for-profit organizations for meeting the access to justice needs of disadvantaged people. Centered within that growing body of literature, this paper points to the importance of community service agencies and voluntary organizations as resources that enable community legal clinics to identify and meet the legal needs and to provide social justice outcomes that would otherwise be beyond their capacity if limited to resources from conventional sources.
