Distinguishing Permissible Preemption From Unconstitutional Commandeering, Edward A. Hartnett
Distinguishing Permissible Preemption From Unconstitutional Commandeering, Edward A. Hartnett
Notre Dame Law Review
For years, the preemption doctrine and the anticommandeering doctrine lived in an uneasy tension, with each threatening to consume the other. On the one hand, preemption permits Congress to insist that state law give way to congressional demands. On the other hand, the anticommandeering doctrine prohibits Congress from commandeering state legislatures or state executives. Without some way to establish a boundary between the two, preemption could swallow the anticommandeering doctrine by allowing Congress to control state law. Alternatively, absent some boundary, anticommandeering could swallow preemption by empowering states to refuse to be governed by the commands of federal law. Either …
The Double Standard For Third-Party Standing: June Medical And The Continuation Of Disparate Standing Doctrine, Brandon L. Winchel
The Double Standard For Third-Party Standing: June Medical And The Continuation Of Disparate Standing Doctrine, Brandon L. Winchel
Notre Dame Law Review
No jurisdictional principle is more fundamental to the federal judiciary than the doctrine of standing. Before litigants may avail themselves of the tremendous power vested in the federal judiciary, plaintiffs must first establish that they are appropriately situated to assert a legal claim before a court. In analyzing whether a plaintiff possesses the requisite standing to maintain a legal challenge, the Supreme Court has stressed that a court’s analysis must be blind to the underlying dispute: “The fundamental aspect of standing is that it focuses on the party seeking to get his complaint before a federal court and not on …
Class Action Squared: Multistate Actions And Agency Dilemmas, Elysa M. Dishman
Class Action Squared: Multistate Actions And Agency Dilemmas, Elysa M. Dishman
Notre Dame Law Review
As the Supreme Court continues to restrict the reach of private class actions, numerous commentators have championed public enforcement actions by state attorneys general (AGs) as a superior alternative to hold corporations accountable for misconduct. While AG actions fill some of the void left by the forced retreat of the private class action, few scholars have seriously considered whether the agency problems that exist in private class actions also occur in AG actions. And, until now, no scholar has recognized the unique agency problems that arise when AGs act together in multistate actions.
Multistate actions are made up of two …

Sometimes a text-based format will not serve an author’s need –time for a more unique presentation! When does material and research require a multi-modal product? How do you help the author create the final product, be it a database, a video, an interactive work, a website, or an online course? What kinds of files can you accept, publish, and preserve? What material requires any kind of review, and how is that review validated? Who will maintain the site and who gets credit for the creation? Do you have access to a digital humanities center or humanities librarian, and if so …

Evaluating The Effects Of Peer Competition On Physical Activity During School Recess, Heather M. Zerger
Evaluating The Effects Of Peer Competition On Physical Activity During School Recess, Heather M. Zerger
USF Tampa Graduate Theses and Dissertations
With an increase in childhood obesity, engagement in regular physical activity is an important health-related behavior. In addition to being overweight or obese, a lack of physical activity can lead to other serious health risks. With children spending a majority of their weekdays at school, this environment should be used to promote physical activity. The purpose of the current study was to evaluate the effects of peer competition and feedback on children’s step counts. During baseline, participants wore a sealed pedometer during recess and physical education (PE). During intervention, participants with higher step counts were paired with participants with lower …

Neurological disorders, including Parkinson's disease (PD), have increased in prevalence and are expected to further increase in the coming decades. In this regard, PD affects around 3% of the population by age 65 and up to 5% of people over the age of 85. PD is a widely described, physically and mentally disabling neurodegenerative disorder. One symptom often poorly recognized and under-treated by health care providers despite being reported as the most common non-motor symptom is the finding of chronic pain. Compared to the general population of similar age, PD patients suffer from a significantly higher level and prevalence of …

Asian Male Stereotypes: An Investigation Of Current Beliefs About Asian Males And Stereotypes Perpetuated By U.S. Modern Cinema, Noelle Knopp
USF Tampa Graduate Theses and Dissertations
This is a triangulated two-part study with a quasi-experiment design. Study Part 1 performed a textual analysis supported by the theory of framing on the films Crazy Rich Asians, To All the Boys I’ve Loved Before, Always Be My Maybe, and To All the Boys: P.S. I Still Love You to find commonalities among portrayals of prominent East Asian male characters. Using Wong et. al’s findings of common perceived stereotypes by Asian American males, the author used the six traits defined by Wong et. al as a base to see if the films corresponded to or deviated from the stereotypes …
Isolation Of Specific Phospholipids From Nannochloropsis Oculata Microalga For Cosmetic Applications, Ahmet Yener Manisali
Isolation Of Specific Phospholipids From Nannochloropsis Oculata Microalga For Cosmetic Applications, Ahmet Yener Manisali
USF Tampa Graduate Theses and Dissertations
Algae, photosynthetic aquatic organisms, have recently caught the attention of the food, cosmetic, pharmaceutical, and nutraceutical industries due to the variety of natural compounds in their cellular bodies such as carbohydrates, lipids, and proteins. Specifically, microalgae-derived natural compounds such as phospholipids are extensively utilized in cosmetics as part of liposome formers, emulsifiers, solubilizers, and wetting agents. Although phospholipids are currently extracted from food sources, this practice raises sustainability concerns. Hence, growing microalgae on the provision of macronutrients such as nitrates and phosphates will serve as a more sustainable source of the several specific phospholipids such as phosphatidylcholine (PC), phosphatidyl-ethanolamine (PE), …
Circadian Rhythms And The Embodiment Of Social Zeitgebers: Linking The Bio And Social, Tiffany R. Moore
Circadian Rhythms And The Embodiment Of Social Zeitgebers: Linking The Bio And Social, Tiffany R. Moore
USF Tampa Graduate Theses and Dissertations
Virtually all biological processes are under direct or indirect control of the circadian system. Chronic disruption of circadian rhythms, termed chronodisruption, is linked to increased risk for adverse health outcomes such as cancer, depression, and cardiometabolic disease. Circadian rhythms are highly sensitive to sociocultural contexts. As a result, circadian rhythms provide a valuable entryway to explore issues of embodiment. Here, embodiment refers to processes through which social experiences ‘get under the skin’ to become biological and manifest in health. To better understand what proximate social factors influence chronodisruption, this study assessed chronodisruption and social zeitgebers among a population of 15 …

Modeling Early Life: Ontogenetic Growth And Behavior Affect Population Connectivity In Gulf Of Mexico Marine Fish, Kelly Vasbinder
Modeling Early Life: Ontogenetic Growth And Behavior Affect Population Connectivity In Gulf Of Mexico Marine Fish, Kelly Vasbinder
USF Tampa Graduate Theses and Dissertations
This dissertation is an examination of growth, behavior, and dispersal during the early life stages of marine fishes in the Gulf of Mexico. Understanding movements of early life stages is a key part of managing exploited fish populations. Position in the water column can impact larval dispersal, since it determines those currents to which larvae are exposed. First, I investigated the relationship between length and age in early life stages of marine fishes. I found that demersal fish taxa tend to be represented by exponential models, while pelagic fish tend to be represented by linear models. I suggest this may …

Characterizing Childhood And Diet In Migration Period Hungary, Kirsten A. Verostick
USF Tampa Graduate Theses and Dissertations
This project investigates children, childhood and diet of two different Migration Period (4th-8th century AD) populations, the Gepids and the Avars, in the Great Hungarian Plain. The main goal was to assess whether there are differences in treatment of children and differences in breastfeeding and weaning practices in these distinct sites and populations. Secondarily, this research also focused on characterizing diet for the Gepids and the Avars at four different sites from the Migration Period, to understand how the migration and settling into the region and the assimilation of other groups into the two populations affected their …
Parent Coping And Sibling Relationship Quality In Pediatric Cancer: The Moderating Effects Of Parental Emotion Socialization Beliefs, Esther Davila
Parent Coping And Sibling Relationship Quality In Pediatric Cancer: The Moderating Effects Of Parental Emotion Socialization Beliefs, Esther Davila
USF Tampa Graduate Theses and Dissertations
This study examined relations between parent coping and parent-, patient-, and sibling-reported perceptions of sibling relationship quality (SRQ), as well as potential moderating effects of parent emotion socialization (ES) beliefs in the context of pediatric oncology. Questionnaires were completed by 155 parents of pediatric oncology patients, 103 pediatric oncology patients, and 104 healthy siblings of pediatric oncology patients. Parent coping and ES beliefs predicted parent-perceived sibling warmth and dominance disparity. For parents low in emotion-dismissive ES beliefs, parent adaptive coping negatively predicted parent-perceived sibling dominance disparity. For parents low in emotion-coaching ES beliefs, parent adaptive coping positively predicted patient-perceived sibling …

Mapping Narrative Transactions: A Method/Framework For Exploring Multimodal Documents As Social Semiotic Sites For Ethnographic Study, Anne W. Anderson
USF Tampa Graduate Theses and Dissertations
This work grew from my attempts to find a method for studying a body of editorial cartoons—multi-modal documents producing cross-modal responses—that were created and published in an earlier time period, in order to answer questions about the culture in which the cartoons were produced and read. Initially my questions included wondering about the topics cartoonists addressed, the narratives cartoonists created to address the topics, how the narratives were framed, and in what ways the narratives might have been seen as attempts to shape the larger cultural discourse around the topics. However, given the number of possible combinations of information streams …

BACKGROUND: The selective cardiac myosin activator omecamtiv mecarbil has been shown to improve cardiac function in patients with heart failure with a reduced ejection fraction. Its effect on cardiovascular outcomes is unknown.
METHODS: We randomly assigned 8256 patients (inpatients and outpatients) with symptomatic chronic heart failure and an ejection fraction of 35% or less to receive omecamtiv mecarbil (using pharmacokinetic-guided doses of 25 mg, 37.5 mg, or 50 mg twice daily) or placebo, in addition to standard heart-failure therapy. The primary outcome was a composite of a first heart-failure event (hospitalization or urgent visit for heart failure) or death from …
