Torts: Covid-19 Pandemic Business Safety Act & Executive Order By The Governor Designating Auxiliary Management Workers And Emergency Management Activities, Angelena Velaj, Troy Viger

Georgia State University Law Review

The Executive Order expanded immunity from liability for volunteer health care workers as emergency management workers performing emergency management activities. The Order was not limited to only COVID-19-related activities. When the legislature reconvened, legislators passed the Georgia COVID-19 Pandemic Business Safety Act, which provided liability limitation to businesses against tort claims arising from the pandemic.

Elections: Elections And Primaries Through The Pandemic, Joseph M. Brickman, Logan D. Kirkes Dec 2020

Elections: Elections And Primaries Through The Pandemic, Joseph M. Brickman, Logan D. Kirkes

Georgia State University Law Review

The 2020 election cycle was all but normal. Due to certain health concerns associated with the COVID-19 pandemic, Georgia delayed its primary election three months from March to June and summarily mailed absentee ballot request forms to all active, registered voters. From presidential social media postings to a federal lawsuit, debate ensued over the widespread usage of absentee ballots, their overall effectiveness and security, who would receive request forms, and whether postage requirements qualified as an impermissible poll tax. To further compound these uncertainties, Georgia legislators, who are not permitted to fundraise or campaign during the forty-day legislative session, had …

Preemption: Executive Order By The Governor To Ensure A Safe & Healthy Georgia, Marisa P. Ahlzadeh, Fanny Chac Dec 2020

Preemption: Executive Order By The Governor To Ensure A Safe & Healthy Georgia, Marisa P. Ahlzadeh, Fanny Chac

Georgia State University Law Review

The doctrine of preemption expresses the idea that “a higher authority of law will displace a lower authority of law when the two authorities come into conflict.” Preemption exists on both the federal and state level. According to the Georgia Constitution, local laws are permissible if they do not conflict with the state law on the subject. During a Public Health State of Emergency, the Governor of Georgia maintains certain expanded powers to take necessary action for the health and safety of the public. On April 2, 2020, Governor Brian Kemp (R) used these expanded powers to enact an Executive …

Modeling Neurofibromatosis Type Ii In Zebrafish, Hannah Nuszen Dec 2020

Modeling Neurofibromatosis Type Ii In Zebrafish, Hannah Nuszen

University Honors Program Senior Projects

Neurofibromatosis Type 2 (NF2) is a rare genetic disorder, classified as a neurocutaneous syndrome inherited through an autosomal dominant genetic mutation or deletion of the NF2 gene in humans. The tumor suppressor gene NF2 encodes the cytoskeletal protein MERLIN to promote apoptosis and inhibit abnormal cellular proliferation. Mutations in NF2 lead to a deficiency of functional MERLIN in humans and can result in hearing loss, disability, and premature death. These symptoms are due to uncontrollable growth of schwann cells generating bilateral benign tumors (schwannomas) within the nerve sheath of cranial nerve VIII. Here we seek to understand the function of …

Introduction The prevalence of obesity-related disorders has been steadily increasing over the past couple of decades. Diseases that were once only detected in adults are now prevalent in children, such as hyperlipidemia. The adipose tissue-derived hormonal factor C1q TNF Related Protein 3 (CTRP3) has been linked to triglyceride regulation especially in animal models. However, the relationship between circulating CTRP3 levels and obesity-related disorders in human subjects …

Taxing Book Profits: New Proposals And 40 Years Of Critiques, Mindy Herzfeld

UF Law Faculty Publications

This paper considers recent domestic and international proposals to use financial statement earnings as the basis for imposing additional or minimum taxes on corporate income and to reallocate corporate profits among jurisdictions. It reviews prior research undertaken in the context of previous proposals to partially substitute financial accounts for taxable income and considers how valid critiques of prior proposals are with respect to current initiatives. It concludes by noting that the concerns raised about earlier proposals have neither been fully considered nor addressed in the recent initiatives.

Center for Translational Medicine Faculty Papers

The novel SARS-CoV-2 is responsible for causing the ongoing outbreak of coronavirus disease 19 (COVID-19), a systemic infection in humans. Ever since it was first detected in December 2019, the number of confirmed cases has continued to increase. Within a short period, this disease has become a global issue, and therefore it is characterized as a pandemic. The current understanding and explanations are based on epidemiological, clinical and physiological observations. Besides, it remains a great challenge, as much remains to be understood about this new disease-causing virus. Therefore, we seek to provide an overview of SARS-CoV-2, including its classification, origin, …

Aging, But Not Sex And Genetic Diversity, Impacts The Pathobiology Of Bacterial Endophthalmitis, Pawan Kumar Singh, Sukhvinder Singh, Robert Emery Wright, Ramandeep Rattan, Ashok Kumar

Obstetrics, Gynecology and Women's Health Services Articles

Purpose: Age, sex, and genetics are important biological variables in determining an individual's susceptibility or response to infectious agents; however, their role has not been evaluated in intraocular infections. In this study, we comprehensively examined the impact of these host biological factors in the pathogenesis of experimental bacterial endophthalmitis.

Methods: Endophthalmitis was induced by intravitreal injection of bacteria (Staphylococcus aureus) in the eyes of male and female C57BL/6 mice of different ages: group I (young, 6-8 weeks), group II (mid-age, 18-20 weeks), and group III (old, 1 year). Highly heterogeneous outbred J:DO mice were used for genetic diversity analysis. Eyes …

Being Careful : Progressive Era Women And The Movements For Better Reproductive Health Care, Sarah Patterson Dec 2020

Being Careful : Progressive Era Women And The Movements For Better Reproductive Health Care, Sarah Patterson

Legacy Theses & Dissertations (2009 - 2024)

ABSTRACTFor American and British women, the definition of being healthy changed in the first two decades of the twentieth century. Previously, there had been a resigned acceptance of the fact that a woman’s reproductive capacity often relegated her to a lifetime of suffering and ill health. Certainly, individual women sometimes sought out solutions to their health problems, but there was no concerted social movement to help all women. Then in the Progressive Era that changed. The professionalization of medicine, combined with scientific breakthroughs, such as using Salvarsan to treat syphilis and urine testing to identify eclampsia meant that women could …

The Relationship Between Group Identification And Perceived Control Under Stressful Conditions, Fanshu Jin Dec 2020

The Relationship Between Group Identification And Perceived Control Under Stressful Conditions, Fanshu Jin

Legacy Theses & Dissertations (2009 - 2024)

Group identification provides important psychological resources. One potential benefit is that it may relieve individuals’ strain in stressful situation by increasing their perceived personal control. The current research explores the different roles that group identification plays in reaction to stressful performance situations. In particular, it investigates the extent to which group identification impacts perceived control in performance contexts. It was hypothesized that activating group identification prior to performing a challenging task will bolster perceptions of personal control, thereby sustaining or improving performance. An experimental study was conducted that manipulated salience of group identification, either before or after exposure to a …

Global Apathy And The Need For A New, Cooperative International Refugee Response, Emily Gleichert Dec 2020

Global Apathy And The Need For A New, Cooperative International Refugee Response, Emily Gleichert

Northwestern Journal of Law & Social Policy

While an increasing number of nations move toward isolationist, nationalist policies, the number of refugees worldwide is climbing to its highest levels since World War II. The United Nations High Commissioner for Refugees (UNHCR) is the international body tasked with protecting this population. However, the office’s traditional solutions for refugees – local integration, resettlement in a third country, and voluntary repatriation – have mostly eluded refugees who spend an average of twenty years in exile. The limitations UNHCR’s structure imposes on the office, specifically in its ability to fund its operations and compel nations to act, have contributed to its …

Three Essays On Health Economics, Jihye Kim Dec 2020

Three Essays On Health Economics, Jihye Kim

Legacy Theses & Dissertations (2009 - 2024)

This thesis focuses on various factors affecting health of American adults and the elderly based on the Health and Retirement Study (HRS). In chapter 1, I examine the role of educational and racial differences in life expectancy (LE) and health-adjusted life expectancy (HALE) for Americans at ages 45-64 using Health and Retirement Study (HRS) during 2000-2016. I compute severity-weighted prevalence of diseases with comorbidity adjustments based on the Global Burden of Disease (2015), and map onto the information on 17 doctor-diagnosed diseases and four self-rated disabling health conditions from HRS. This approach allows us to evaluate the importance of major …

Predictive Facts, Brent Ferguson Dec 2020

Predictive Facts, Brent Ferguson

Washington Law Review

A substantial portion of constitutional law rests on untested factual predictions made by the Supreme Court. Such forecasts have played a large role in a wide range of case outcomes, helping the Court decide questions such as whether corporations have the right to spend money on elections and what evidence may be used in criminal cases despite Fourth Amendment violations.

Scholars have not yet studied the frequency of such predictions, the problems they create, or the functions they serve. The literature has looked more closely at court decisions that depend on conclusions of legislative fact—facts not specific to a certain …

Protecting Protected Activity, Daiquiri J. Steele Dec 2020

Protecting Protected Activity, Daiquiri J. Steele

Washington Law Review

The United States Supreme Court recently rolled back protections in employment retaliation cases by requiring plaintiffs to prove that their protected activity was the but-for cause of adverse actions by their employers. As a result, employers may escape liability even though the employee-plaintiffs have proven that employers had an impermissible motive in taking adverse actions. In doing so, the Court undermined the underlying statutes’ retaliation provisions created to help enforce the underlying statute, leading to a court-instituted failure to protect activity that Congress sought to protect.

While legal scholars have paid much attention to the establishment of a but-for causation …

Restoring Reasonableness To Workplace Religious Accommodations, Dallan F. Flake Dec 2020

Restoring Reasonableness To Workplace Religious Accommodations, Dallan F. Flake

Washington Law Review

When Congress amended Title VII of the Civil Rights Act in 1972 to require employers to reasonably accommodate employees’ religious practices absent undue hardship to their business, it intended to protect employees from being forced to choose between their jobs and their religious beliefs. Yet in the decades since, courts have cut away at this right to the point it is practically nonexistent. Particularly concerning is the growing tendency of courts to read reasonableness out of the accommodation requirement, either by conflating reasonableness and undue hardship so that an accommodation’s reasonableness depends solely on whether it would cause the employer …

Aspects Of The Becker Brewing And Malting Company Of Ogden, Utah: A Study Of Labor, Prohibition, And Finance, Jason Neil

All Graduate Plan B and other Reports, Spring 1920 to Spring 2023

Embedded within the economic narrative of the nineteenth and twentieth century American West lays the rich, but frequently forgotten, history of brewing in Utah. While most businesses in Utah centered on agriculture, railroads, and mining, the breweries of Utah also played a significant role in the industrial and economic development of the region. One of the largest and most significant of these breweries was the Becker Brewing and Malting Company of Ogden, Utah. Founded in 1892, this company deeply affected the brewing industry until its dissolution in 1965. Many of the original records kept by the company still exist and …

This compendium summarizes regional information on promising practices, emerging practices, and case studies that form part of the response of the United Nations High Commissioner for Refugees (UNHCR) and its partners to the needs of refugees, internally displaced persons, and host communities in the East and Horn of Africa and Great Lakes region. Documentation of these practices fosters south-south and global exchange, learning, and capacity-building, while inspiring UNHCR and its partner program developers and implementers with fresh ideas for resolving common challenges. The global COVID-19 pandemic makes this compendium even more critical at this time, as operations grapple with meeting …

The Link Between Heart Disease In Low Socioeconomic Communities In America, Khristopher Chea

Nursing | Senior Theses

As a future medical professional in the healthcare field, we continue to see patients admitted for cardiovascular issues. Cardiovascular diseases (CVDs) remain the leading cause of mortality among adults living in the U.S. despite advances in treatment throughout the past century. A number of risk factors such as hypertension, obesity, smoking, and physical inactivity contribute to the significant rise of cardiovascular disease. Research data suggests that there is correlation between cardiovascular disease, low socioeconomic status, and diet. According to the American Phycological Association socioeconomic status is measured by income, educational status, and occupation, and has been shown to be closely …

The Effects Of Moderate-Severe Plaque Psoriasis On Patient Well-Being And Prevention Of Flares, Glenn Devera

Nursing | Senior Theses

Psoriasis is a chronic skin condition that is indicated by red, patchy and scaly skin that can be painful when irritated. Patients with psoriasis have an increased risk for a number of chronic diseases. Despite the expansion of treatments for moderate-to-severe psoriasis over the last decade, patients may still find that treatment strategies are not as successful, leaving them dissatisfied with their treatments. A relationship built upon trust between the nurse and the patient diagnosed with psoriasis may serve to help ensure optimal care. A comprehensive literature review was performed and found that best practices for patient management need to …

Prenatal Care For Undocumented Women In The United States, Cristina Mendoza Dec 2020

Prenatal Care For Undocumented Women In The United States, Cristina Mendoza

Nursing | Senior Theses

Background: While prenatal care is an essential preventive service, access is not equal. Undocumented immigrants in the United States face many barriers that prevent them from accessing primary health care needs, including adequate prenatal care. Throughout the United States, standard Medicaid provides coverage for all pregnancy-related care, encompassing the antenatal period, childbirth, and postpartum. However, undocumented women do not qualify to receive these services. Many studies showed that lack of prenatal care for undocumented pregnant women jeopardizes their health and their neonates’ health by increasing their risk of complications related to pregnancy and birth. Objective: To bring awareness of the …

Gut Microbiota And The Development Of Type 2 Diabetes, Janet Ryan Dec 2020

Gut Microbiota And The Development Of Type 2 Diabetes, Janet Ryan

Nursing | Senior Theses

This paper explores the question: Can interventions focusing on healing the gut microbiome of a prediabetic patient prevent or delay the onset of type 2 diabetes? Diabetes is a major health problem that is becoming the biggest epidemic of the 21st century. Efforts to derail the progression of disrupted blood glucose metabolism are often futile leaving patients frustrated with a lifelong burden of disease management. Recent studies suggest that collectively the gut microbiome acts as an endocrine organ and that injury to this “organ” can lead to dysfunctional glucose regulation. A comprehensive literature review revealed that further studies are …

Is High-Intensity Focused Electromagnetic Field Stimulation More Effective Than Pelvic Floor Muscle Training In Treating Stress Urinary Incontinence In Women?, Monica Friedman Dec 2020

Is High-Intensity Focused Electromagnetic Field Stimulation More Effective Than Pelvic Floor Muscle Training In Treating Stress Urinary Incontinence In Women?, Monica Friedman

Nursing | Senior Theses

INTRODUCTION: Stress urinary incontinence, an involuntary loss of urine during physical exertion or effort, affects a disproportionately large number of women worldwide. Although pelvic floor muscle training is the first-line treatment for urinary incontinence, long term adherence is low, and therefore, is usually not an effective treatment. Medications may be costly and aren’t always effective; surgery is invasive and often not appropriate. This condition warrants further studies to find more effective solutions.

OBJECTIVE: To evaluate whether or not focused electromagnetic field therapy is more effective than pelvic floor muscle training in treating stress urinary continence in women.

PROPOSAL FOR FURTHER …

Characterizing typologies of childhood adversity may inform the development of risk profiles and corresponding interventions aimed at mitigating its lifelong consequences. A neurobiological grounding of these typologies requires systematic comparisons of neural structure and function among individuals with different exposure histories. Using seed-to-whole brain analyses, this study examined associations between childhood adversity and amygdala resting-state functional connectivity (rs-fc) in adolescents aged 11–19 years across three independent studies (N = 223; 127 adversity group) in both general and dimensional models of adversity (comparing abuse and neglect). In a general model, adversity was associated with altered amygdala rs-fc with clusters within the …

The Connections Project (Author, 2012) is designed to assist school personnel in identifying students at- risk for social-emotional concerns by examining students’ perceptions of connectedness with adults and peers in school. Currently used in several states, schools complete the screening measure as part of their use of the Multi-Tiered System of Support (MTSS) framework. While many measures of connectedness are lengthy and designed for elementary grade children, the Connections measure is an efficient, straightforward assessment employed with middle school and high school aged youth and school personnel. The purpose of the current study was to examine student connectedness with adults …

A Content Analysis Of Dissertations On Business Topics: A Quantitative Study, Kat Yamamoto Dec 2020

A Content Analysis Of Dissertations On Business Topics: A Quantitative Study, Kat Yamamoto

Doctor of Education (EdD)

Many students explore business topics in their dissertations because they are relevant research areas for future scholar-practitioners such as leaders, educators, researchers, and consultants. Nevertheless, there is limited scholarship on the content of dissertations from PhD and practitioner doctoral programs. Dissertation research methodology choices, page lengths, and research topics have not been studied extensively. Few studies have been conducted to explore the differences and similarities between researcher-oriented and practitioner-oriented dissertations. This study examined dissertations written on business topics in the recent ten years using content analysis to address these gaps. A sample of dissertations uploaded in the years 2010, 2015, …
