Can Copyright Law Protect People From Sexual Harassment?, Edward Lee Jan 2020

Can Copyright Law Protect People From Sexual Harassment?, Edward Lee

Emory Law Journal

The scandals stemming from the sexual harassment allegedly committed by Harvey Weinstein, Roger Ailes, Les Moonves, Matt Lauer, Bill O’Reilly, Charlie Rose, Bryan Singer, Kevin Spacey, and many other prominent figures in the creative industries show the ineffectiveness of Title VII of the Civil Rights Act of 1964, which prohibits sexual harassment in the workplace, in protecting artists and others in the creative industries. Among other deficiencies, Title VII does not protect independent contractors and limits recovery to, at most, $300,000 in compensatory and punitive damages. Since many people who work in the creative industries, including the top actors, do …

Resurrecting Magnuson-Moss Rulemaking: The Ftc At A Data Security Crossroads, Ian M. Davis

Emory Law Journal

Welcome to the digital age, where consumer data is more valuable than gold. In this era of information, companies treat personal data as a prized commodity, leveraging its potential to boost business and engage an ever-growing number of customers. Yet when companies fail to protect the sensitive data that they hold, consumers are left with few avenues to obtain redress for the harms they may have suffered. In an effort to protect consumers, the Federal Trade Commission (FTC) has been policing inadequate data security practices since the early 2000s. Using its broad authority under Section 5 of the Federal Trade …

Judging Hypocrisy, Todd E. Pettys Jan 2020

Judging Hypocrisy, Todd E. Pettys

Emory Law Journal

Editorialists, politicians, and others sometimes accuse U.S. Supreme Court Justices of hypocrisy, especially when they believe that divisions among the Justices are the product of partisan loyalties rather than good-faith differences in impartial legal judgment. These hypocrisy charges pose a serious threat to the Court’s legitimacy. In legal circles and elsewhere, however, one finds a remarkable lack of clarity about what hypocrisy is and the moral precepts that define its boundaries. As a result, participants in public discourse about the Court can easily find themselves talking past one another. To be assured that the Justices are not hypocrites with respect …

Tailoring Copyright To Protect Artists: Why The United States Needs More Elasticity In Its Protection For Fashion Designs, Robin M. Nagel Jan 2020

Tailoring Copyright To Protect Artists: Why The United States Needs More Elasticity In Its Protection For Fashion Designs, Robin M. Nagel

University of Richmond Law Review

For as long as copyright protection has existed in the United States, protection has never expressly extended to fashion designs because copyright law categorizes fashion designs as “useful articles” that do not receive any protection. In the eighteenth century, this policy perhaps made sense—most clothing was generic, non-decorative, and required little creativity for many of the everyday garments people wore. Clothing in the eighteenth century was commonly made up of useful articles that served very little purpose outside of their utility. However, in today’s society, fashion has transformed into an industry that prizes creativity, ingenuity, innovation, and something more than …

The coronavirus SARS-CoV-2 pandemic has and continues to create a huge number of challenges to the globaleconomy and its associated healthcare systems, including dentistry. In the early stages, we have had to rely onmathematical modelling and plans developed from previous healthcare emergencies. As the emergency develops, itis vitally important that policymakers understand the diference between the science and the real-world evidence sothat policy can adapt rapidly to the changing environment. Efective management of future crises will require openchannels of communication across the whole profession, not only to collect, clean, curate and evaluate data but alsoto assess the benefts and harms …

Cognitive Dissonance In Higher Education: Inflating Grades And Not Feeling Guilty, Ahmad Hassan, Fatma Mohamed, Jonathan Nelson Jan 2020

Cognitive Dissonance In Higher Education: Inflating Grades And Not Feeling Guilty, Ahmad Hassan, Fatma Mohamed, Jonathan Nelson

Faculty Research at Morehead State University

Although there has been growing interest in recent years in investigating the phenomena of grade inflation in higher education, little has focused on the actual psychological processes through which professors may engage in inflating grades without feeling guilty or perceiving this behavior as problematic. Social psychology has focused on the apparent inconsistency between stated attitudes and actual behavior; specifically, cognitive dissonance theory provides insights into why people may behave immorally. By outlining the role of cognitive dissonance in the grade inflation process we provide greater understanding as to how professors cope with the negative psychological arousal associated with grade inflation.

The Worsening Political Divide: Adult Education As Part Of The Cure, Lee W. Nabb, Fujuan Tan, Daryl R. Privott

Faculty Research at Morehead State University

The US is experiencing extreme social and political polarization not seen since the Civil War. This divisiveness is causing civil unrest and governmental dysfunction which threatens the stability of the nation. Four major causes of the current state are party realignment, the deregulation of news broadcasting, algorithmic personalization of electronic information, and an unknowing public. Adult education can and should be part of the remedy reducing or eliminating harmful polarization. Knowledge of authoritative systems is key to the solution. To promote such knowledge, adult educators can create practical and theoretical learning experiences about authoritative systems and incorporate such knowledge into …
