The Revival Of Respondeat Superior And Evolution Of Gatekeeper Liability, Rory Van Loo Oct 2020

The Revival Of Respondeat Superior And Evolution Of Gatekeeper Liability, Rory Van Loo

Faculty Scholarship

In an era of servants and masters, respondeat superior emerged to hold the powerful accountable for the acts of those they control. That doctrine’s significance has only grown in an economy driven by large corporations that rely heavily on legions of subsidiaries and independent contractors, such as banks deploying independent call centers, oil companies using drilling contractors, and tech platforms connecting consumers to app developers. It is widely believed that firms can avoid third- party liability for many laws by outsourcing or creating subsidiaries.

This Article shows that common narratives of the demise of third-party liability are incomplete. Respondeat superior …

Halyomorpha halys (Stål), the brown marmorated stink bug, is an invasive and highly polyphagous insect that has caused serious economic injury to specialty and row crops in the United States and Europe. Here, we evaluated the effects of marking adult and nymphal H. halys with four different colors of fluorescent powder (Blaze Orange, Corona Pink, Horizon Blue, and Signal Green) on mobility and survivorship in laboratory bioassays. Adults and nymphs were marked using liquified fluorescent powder solutions and allowed to dry prior to bioassay. The presence of the marking solution had no significant effects on adult or nymphal mobility, adult …

Nicotinamide Riboside Relieves Paclitaxel-Induced Peripheral Neuropathy And Enhances Suppression Of Tumor Growth In Tumor-Bearing Rats, Marta V. Hamity, Stephanie R. White, Christopher Blum, Katherine N. Gibson-Corley, Donna L. Hammond Oct 2020

Nicotinamide Riboside Relieves Paclitaxel-Induced Peripheral Neuropathy And Enhances Suppression Of Tumor Growth In Tumor-Bearing Rats, Marta V. Hamity, Stephanie R. White, Christopher Blum, Katherine N. Gibson-Corley, Donna L. Hammond

Student Publications

Nicotinamide riboside (NR) is a vitamin B3 precursor of NAD that blunts diabetic and chemotherapy-induced peripheral neuropathy in preclinical models. This study examined whether NR also blunts the loss of intraepidermal nerve fibers induced by paclitaxel, which is associated with peripheral neuropathy. The work was conducted in female rats with N-methyl-nitrosourea (MNU)-induced tumors of the mammary gland to increase its translational relevance, and to assess the interaction of NR with paclitaxel and NR's effect on tumor growth. Once daily oral administration of 200 mg/kg NR p.o. beginning with the first of 3 i.v. injections of 6.6 mg/kg paclitaxel to tumor-bearing …

Human Adaptation To Hypoxia In Critical Illness, Helen T. Mckenna, Andrew J. Murray, Daniel S. Martin Oct 2020

Human Adaptation To Hypoxia In Critical Illness, Helen T. Mckenna, Andrew J. Murray, Daniel S. Martin

Peninsula Medical School

The syndrome of critical illness is a complex physiological stressor that can be triggered by diverse pathologies. It is widely believed that organ dysfunction and death result from bioenergetic failure caused by inadequate cellular oxygen supply. Teleologically, life has evolved to survive in the face of stressors by undergoing a suite of adaptive changes. Adaptation not only comprises alterations in systemic physiology but also involves molecular reprogramming within cells. The concept of cellular adaptation in critically ill patients is a matter of contention in part because medical interventions mask underlying physiology, creating the artificial construct of “chronic critical illness,” without …

Evidence For Physiological Niche Expansion Of An Intertidal Flatworm: Evolutionary Rescue In The Wild, Katharine A. Clayton, John I. Spicer Oct 2020

Evidence For Physiological Niche Expansion Of An Intertidal Flatworm: Evolutionary Rescue In The Wild, Katharine A. Clayton, John I. Spicer

School of Biological and Marine Sciences

Microevolution may enable populations to adapt physiologically to rapid climate change. Where it exists, historical data could provide a rare opportunity to document such adaptation. The intertidal flatworm Procerodes littoralis experiences large changes in salinity throughout the tidal cycle. We investigated whether regeneration performance of P. littoralis has changed over the last century. We repeated identical experiments to those published in 1914 on the same species and from the same location. In the modern experiment, when tested across a range of different salinities (S = 3, 6, 28, 44 and 53), P. littoralis could regenerate at lower salinities (S = …

Are Beginning And Small-Scale Farmers Drawn To Diversification? Ten Years' Findings From Ohio, Matthew Mariola, Amyaz Moledina, Larry A. Nye

Journal of Extension

Diversifying a farm's production operations or marketing channels can boost income and raise farm survival rates. But are beginning and small-scale farmers inclined toward a strategy of diversification? We analyzed 578 attendee surveys from 10 years of an Extension workshop for new and small-scale farmers in Ohio. We investigated the farming profile of beginning and small-scale farmers, the degree to which they are interested in pursuing diversified farming, and whether these interests vary by gender. We found evidence that new and small-scale farmers are interested in alternatives to commodity grain farming, that these alternatives are associated with diversified farming systems, …

National 4-H Hippology And Livestock Skillathon Contests Affect Knowledge And Skills, Savanna Tomoson, Rosemarie Nold

Journal of Extension

Using a mixed model, we evaluated effects of national 4-H hippology and livestock skillathon contests on youths' content knowledge, 21st century skills, and postsecondary plans. Hippology participants gained significant knowledge in all topics except breeds, and livestock skillathon contestants gained significant knowledge in all topics. The contests were similar in their effects on development of 21st century skills and postsecondary plans. Gains in content knowledge indicate that contest preparation is an effective method for increasing youths' technical knowledge. Additionally, findings suggest that contest preparation is a viable venue for 21st century skill development and that such skill development is not …

Muslim renal transplant recipients often ask their physicians if performing certain lifestyles or religious obligations may be harmful to their health. Permissibility as advised by an expert Muslim physician is considered as being religiously accepted. A cross-sectional, survey-based study was conducted enquiring what nephrologists would advise their transplant recipients to do, about some lifestyles and religious duties. Fifty-eight nephrologists responded to the survey. Of these, 77% routinely follow-up post-transplant patients; 34% were from Saudi Arabia, 18% from the USA, and 20% from Pakistan. Fifty-four percent of the respondents would let patients with stable graft function fast during Ramadan, while 20% …

Fatigue-Related Feedback From Calf Muscles Impairs Knee Extensor Voluntary Activation, Harrison T. Finn, David S. Kennedy, Simon Green, Janet L. Taylor Oct 2020

Fatigue-Related Feedback From Calf Muscles Impairs Knee Extensor Voluntary Activation, Harrison T. Finn, David S. Kennedy, Simon Green, Janet L. Taylor

Research outputs 2014 to 2021

INTRODUCTION:

Fatigue-related group III/IV muscle afferent firing from agonist, antagonist or distal muscles impairs the ability to drive the elbow flexors maximally, that is, reduces voluntary activation. In the lower limb, the effect of feedback from distal muscles on the proximal knee extensors is unknown. Here, we test whether maintained group III/IV afferent feedback from the plantarflexor muscles reduces voluntary activation of the knee extensors.

METHODS:

On 2 d, voluntary activation of the knee extensors during maximal voluntary contractions (MVCs) was assessed in 12 participants before and after a 3-min fatiguing task of the plantarflexors. On 1 d, an inflatable …

Global Patterns In Seagrass Herbivory: Why, Despite Existing Evidence, There Are Solid Arguments In Favor Of Latitudinal Gradients In Seagrass Herbivory, K. L. Heck Jr, M. Samsonova, A. G. B. Poore, Glenn A. Hyndes Oct 2020

Hyndes

Research outputs 2014 to 2021

The ecological paradigm that biological interactions are more intense in the tropics than in temperate or polar regions has existed since the mid-twentieth century, but several recent meta-analyses have provided scant evidence for latitudinal gradients in the intensity of herbivory. This contradictory evidence led us to carefully review the data and results of several of those papers that failed to find latitudinal gradients in rates of seagrass herbivory. To re-evaluate the arguments around the presence or absence of latitudinal gradients in herbivory in seagrass, we began by expanding the selection criteria to include more studies to compare the published latitudinal …

Department of Emergency Medicine Faculty Papers

The prognostic power of circulating cardiac biomarkers, their utility, and pattern of release in coronavirus disease 2019 (COVID-19) patients have not been clearly defined. In this multicentered retrospective study, we enrolled 3219 patients with diagnosed COVID-19 admitted to 9 hospitals from December 31, 2019 to March 4, 2020, to estimate the associations and prognostic power of circulating cardiac injury markers with the poor outcomes of COVID-19. In the mixed-effects Cox model, after adjusting for age, sex, and comorbidities, the adjusted hazard ratio of 28-day mortality for hs-cTnI (high-sensitivity cardiac troponin I) was 7.12 ([95% CI, 4.60-11.03] P<0.001), (NT-pro)BNP (N-terminal pro-B-type natriuretic peptide or brain natriuretic peptide) was 5.11 ([95% CI, 3.50-7.47] P<0.001), CK (creatine phosphokinase)-MB was 4.86 ([95% CI, 3.33-7.09] P<0.001), MYO (myoglobin) was 4.50 ([95% CI, 3.18-6.36] P<0.001), and CK was 3.56 ([95% CI, 2.53-5.02] P<0.001). The cutoffs of those cardiac biomarkers for effective prognosis of 28-day mortality of COVID-19 were found to be much lower than for regular heart disease at about 19%-50% of the currently recommended thresholds. Patients with elevated cardiac injury markers above the newly established cutoffs were associated with significantly increased risk of COVID-19 death. In conclusion, cardiac biomarker elevations are significantly associated with 28-day death in patients with COVID-19. The prognostic cutoff values of these biomarkers might be much lower than the current reference standards. These findings can assist in better management of COVID-19 patients to improve outcomes. Importantly, the newly established cutoff levels of COVID-19-associated cardiac biomarkers may serve as useful criteria for the future prospective studies and clinical trials.

Horizontal Genetic Exchange Of Chromosomally Encoded Markers Between Campylobacter Jejuni Cells, Deepti Pranay Samarth, Young Min Kwon Oct 2020

Horizontal Genetic Exchange Of Chromosomally Encoded Markers Between Campylobacter Jejuni Cells, Deepti Pranay Samarth, Young Min Kwon

Poultry Science Faculty Publications and Presentations

Many epidemiological studies provide us with the evidence of horizontal gene transfer (HGT) contributing to the bacterial genomic diversity that benefits the bacterial populations with increased ability to adapt to the dynamic environments. Campylobacter jejuni, a major cause of acute enteritis in the U.S., often linked with severe post-infection neuropathies, has been reported to exhibit a non-clonal population structure and comparatively higher strain-level genetic variation. In this study, we provide evidence of the HGT of chromosomally encoded genetic markers between C. jejuni cells in the biphasic MH medium. We used two C. jejuni NCTC-11168 mutants harbouring distinct …

Microbiota Analysis Of Chickens Raised Under Stressed Conditions, Rabindra Kumar Mandal, Tieshan Jiang, Robert Wideman Jr, Troy Lohrmann, Young Min Kwon

Poultry Science Faculty Publications and Presentations

A substantial progress has been made toward understanding stress-associated gut and extraintestinal microbiota. However, a comprehensive understanding of the extraintestinal microbiota of chickens raised under stressed conditions is lacking. In this study, chickens were raised on a wire-floor model to induce stress, and the microbiota in the gut (ceca) and extraintestinal sites (blood, femur, and tibia) were characterized at different ages (1, 17, and 56 days) using 16S rRNA gene microbiota profiling. Open reference OTU picking showed extraintestinal sites had a significantly higher number of unassigned OTUs compared to ceca across all ages of chickens. Extraintestinal sites of all ages, …

Health Impact Assessment And City Council Policy: Identifying Opportunities To Address Local Social Determinants Of Health & Place-Health Relationships, 10 Years Later, Ryan J. Petteway, Shannon Cosgrove

OHSU-PSU School of Public Health Faculty Publications and Presentations

Background: Health Impact Assessment (HIA) can be used to assess any type of policy/program related to social determinants (SDH). However, local public health departments (LHDs) have been slow to adopt formal use of HIA in efforts to address local SDH, even with growing evidence linking SDH and place-health relationships. Ten years ago we completed a review of Baltimore City Council policies to advance this conversation within the LHD. Our goal here is to revisit this review and, again, outline a process by which LHDs can: a) monitor local policies in regard to SDH and b) identify opportunities for potential HIA …

Self-Efficacy Among Christian Educators, Jonathan Blake Tolbert Oct 2020

Self-Efficacy Among Christian Educators, Jonathan Blake Tolbert

Doctoral Dissertations and Projects

Christian educators often lack specialized training in message delivery which leads to a lower self-efficacy. Christian educators devote their lives to fulfillment of the Great Commission; it is the job of the church universal to provide resources and support that equip the saints to boldly share the Gospel with great confidence. When self-efficacy is low, confidence is low. Theological foundations are often strong and well-developed by the local church. The practical aspect of preaching, meaning delivery, is an area that is underrepresented in academic research. This project presents specialized training in message delivery as a catalyst for improving self-efficacy. The …

The Utility Of Multiplex Closeness Centrality For Predicting Item Difficulty Parameters In Anomia Tests, Khanh L. Nguyen Oct 2020

The Utility Of Multiplex Closeness Centrality For Predicting Item Difficulty Parameters In Anomia Tests, Khanh L. Nguyen

University Honors Theses

Background: Confrontation naming tests for the assessment of aphasia are perhaps the most commonly used tests in aphasiology. Recently, such tests have been modeled using item response theory approaches. Despite their advantages, item response theory models require large sample sizes for parameter estimation that are often unrealistic when working with clinical populations. As an alternative approach, Fergadiotis, Kellough & Hula (2015) explored automatic item calibration by regressing item difficulty parameters on word length, age of acquisition (AOA), and lexical frequency as quantified by the Log10CD index. Despite the high predictive utility that they achieved, the model’s performance was far from …
