Intellectual Property In The Digital Streaming Age: How Music Becomes A Lawsuit, Alexandra Tasev Dec 2020

Intellectual Property In The Digital Streaming Age: How Music Becomes A Lawsuit, Alexandra Tasev

Honors College Theses

A mix of both entertainment business and law, the purpose of this review is to address the question of “are current copyright laws and procedures too restrictive of new and smaller-name artists from entering the market?” Through a law review and analysis of the history of copyright law, this thesis outlines the issues new, smaller music artists face as a result of rapid digital evolution paired with a slow-moving legal system. Failing to amend the current standards for dealing with old copyright cases will cause further issues with the growing popularity of digital platforms like YouTube, Soundcloud, Spotify, and TikTok. …

© 2020, The Author(s). Pyrite-δ34S and -δ56Fe isotopes represent highly sensitive diagnostic paleoenvironmental proxies that express high variability at the bed (< 10 mm) scale that has so far defied explanation by a single formative process. This study reveals for the first time the paleoenvironmental context of exceptionally enriched pyrite-δ34S and -δ56Fe in bioturbated, storm-reworked mudstones of an early Ordovician storm-dominated delta (Tremadocian Beach Formation, Bell Island Group, Newfoundland). Very few studies provide insight into the low-temperature sulfur and iron cycling from bioturbated muddy settings for time periods prior to the evolution of deep soil horizons on land. Secondary ion mass spectroscopy (SIMS) analyses performed on Beach Formation muddy storm event beds reveal spatially distinct δ34S and δ56Fe values in: (a) tubular biogenic structures and trails (δ34S ~ +40‰; δ56Fe ~ −0.5‰), (b) silt-filled Planolites burrows (δ34S ~ +40‰; δ56Fe ~ +0.5 to + 2.1‰), and (c) non-bioturbated mudstone (δ34S ~ +35‰; δ56Fe ~ +0.5‰). δ34S values of well above + 40.0‰ indicate at least some pyrite precipitation in the presence of a 34S-depleted pore water sulfide reservoir, via closed system (Raleigh-type) fractionation. The preferential enrichment of 56Fe in Planolites burrows is best explained via microbially-driven liberation of Fe(II) from solid iron parent phases and precipitation from a depleted 54Fe dissolved Fe(II) reservoir. Rigorous sedimentological analysis represents a gateway to critically test the paleoenvironmental models describing the formation of a wide range of mudstones and elucidates the origins of variability in the global stable S and Fe isotope record.

The Role Of The Msaabcr Operon In Implant-Associated Chronic Osteomyelitis In Staphylococcus Aureus Usa300 Lac, Gyan S. Sahukhal, Michelle Tucci, Hamed Benghuzzi, Gerri Wilson, Mohamed O. Elasri

Faculty Publications

The msaABCR operon regulates several staphylococcal phenotypes such as biofilm formation, capsule production, protease production, pigmentation, antibiotic resistance, and persister cells formation. The msaABCR operon is required for maintaining the cell wall integrity via affecting peptidoglycan cross-linking. The msaABCR operon also plays a role in oxidative stress defense mechanism, which is required to facilitate persistent and recurrent staphylococcal infections. Staphylococcus aureus is the most frequent cause of chronic implant-associated osteomyelitis (OM). The CA-MRSA USA300 strains are predominant in the United States and cause severe infections, including bone and joint infections.

Using A Species Distribution Approach To Model Historic Camas (Camassia Quamash) In Southern Idaho And Implications For Foraging In The Late Archaic, Royce Johnson

Boise State University Theses and Dissertations

Camas (Camassia quamash) is well documented as a traditional native food source throughout the Northwestern United States and Canada. A better understanding of the historic distribution of camas in Idaho would help to distinguish root foraging in this region from the Pacific Northwest. Modern grazing, development, climate change, and other factors have decimated native camas in this region. This study uses a species distribution model (MaxEnt) to provide a well-informed geospatial projection of the historic distribution and habitat characteristics of camas in Southern Idaho. Understanding the most significant landscape and climate characteristics for camas allows us to estimate …

Soil Response To Fire Frequency In The Northern Columbia Basin Sagebrush Steppe, Leslie C. Nichols Dec 2020

Soil Response To Fire Frequency In The Northern Columbia Basin Sagebrush Steppe, Leslie C. Nichols

Boise State University Theses and Dissertations

Fire is one of the most significant disturbances in an ecosystem, as it is capable of altering the physical, chemical, and biological properties of soil, and the fire frequency in semi-arid ecosystems is increasing. These changes can potentially alter plant-soil feedbacks that may affect post-fire recovery of the native plant and soil communities and lead to an ecosystem state change. However, there is much uncertainty about the magnitude of change as soils are exposed to more fires, because soil recovery and changes in fire severity following a first fire mediate the impact of successive fires on soil properties. To improve …

Identification And Characterization Of Candidate Staphylococcus Aureus Antigens For Inclusion In A Multivalent Bovine Mastitis Vaccine, Danielle Scarbrough

Boise State University Theses and Dissertations

Bovine mastitis, inflammation typically caused by bacterial infection, is the most prevalent disease affecting the global dairy industry. Staphylococcus aureus remains one of the most important pathogens implicated in the disease and can persist within herds at subclinical levels. A preventative S. aureus bovine mastitis vaccine would substantially lessen costs associated with treatment and restore revenue lost due to decreased milk production. One such experimental vaccine is the IsdA-CTA2/B + ClfA-CTA2/B vaccine, containing the S. aureus antigens IsdA and ClfA , each fused to the nontoxic A2/B subunits of cholera toxin, which serves as …

Boise State University Theses and Dissertations

This dissertation addresses problems that arise in a diverse group of fields including cosmology, electromagnetism, and graphic design. While these topics may seem disparate, they share a commonality in their need for fast and accurate algorithms which can handle large datasets collected on irregular domains. An important issue in cosmology is the calculation of the angular power spectrum of the cosmic microwave background (CMB) radiation. CMB photons offer a direct insight into the early stages of the universe's development and give the strongest evidence for the Big Bang theory to date. The Hierarchical Equal Area isoLatitude Pixelation (HEALPix) grid is …

Tissue-Specific Responses From A Global Developmental Signal: A Detailed Subcellular Analysis Of The 20e And Rab Signaling Pathways Controlling Exocrine Secretion During Drosophila Development, Nichalas Nelson

UNLV Theses, Dissertations, Professional Papers, and Capstones

During metamorphosis, the steroid hormone 20-hydroxecydysone (20E) triggers a plethora of tissue-specific responses in the common fruit fly, Drosophila melanogaster. The salivary glands are exocrine organs that respond to a large pulse of 20E to secrete a massive cargo of stored glycoproteins called glue. Because the glands are amenable to ex vivo-organ culture and powerful genetic manipulations, they are an excellent model for studying the conserved developmental and physiological signaling pathways that regulate the general function of these specialized secretory tissues. Our lab has generated transgenic animals in which the secreted glue molecules are tagged with fluorescent proteins. I have …

Association Between White Matter Hyperintensities, Cortical Thinning, And Clinical Outcomes In Mild Traumatic Brain Injury, Thomas Helmut Knoblauch

UNLV Theses, Dissertations, Professional Papers, and Capstones

Traumatic Brain Injury (TBI) is a global health challenge, with over 4.6 million confirmed cases annually in North America alone. Mild traumatic brain injuries (mTBIs) are the most common and make up approximately 81% of all TBI diagnoses worldwide [1]. Studies indicate that 10–15% of patients suffer from trauma induced symptoms (i.e. headache, loss of balance, cognitive impairments, fatigue, and mental health/affective disorders) as far as 1 year post injury [2]. Prediction and management of these post-traumatic sequalae is complicated by a lack of symptom associated neuroimaging findings. In spite of a “prominent distribution” of frontotemporal WMHs in pediatric subjects …

The Effects Of White-Nose Syndrome On Cave-Dwelling Bats During Their Pre-Hibernation Season In Eastern Nebraska, Maggie Bockart

Theses/Capstones/Creative Projects

White-nose syndrome (WNS) is currently the leading cause of death to North American bats and was first documented in the United States in 2006 on the East Coast. Infection with the fungus Pseudogymnoascus destructans (Pd) causes bats to arise from hibernation with unnecessary frequency, leading to depletion of fat reserves that are imperative for extended periods of torpor. In October 2014, biologists surveyed the activity levels of bats at Fontenelle Forest in eastern Nebraska using acoustic detectors and determined what species of bats were present and their relative abundance before being exposed to WNS. By returning to the …

Zoning And Land Use Law, Newton M. Galloway, Steven L. Jones

Mercer Law Review

During the Survey period, the Supreme Court of the United States in Knick v. Township of Scott gave aggrieved property owners in Georgia a federal taking claim for inverse condemnation resulting from a zoning regulation that the Georgia Supreme Court had previously denied them under state law in Diversified Holdings, LLP v. City of Suwanee. The Georgia Court of Appeals further refined York v. Athens College of Ministry. Finally (on a note inseparable with zoning), the Georgia Supreme Court encountered a case defining the parameters of the Georgia Open Meetings Act.

Developing A Tourism Opportunity Index Regarding The Prospective Of Overtourism In Nepal, Susan Phuyal

Graduate Theses/Dissertations

This research explores Nepal's overtourism scenario based on the capacity of a locality to manage sustainable tourism practices. Environmental degradation, local infrastructure degradation, negative tourist experience and local resident responses regarding visitors are the four main variables used in this study to analyze overtourism. In order to analyze the case study of overtourism, we select the three top touristic cities of Nepal, Kathmandu, Pokhara, and Chitwan based on the number of annual visitors. Nepal's case analysis of overtourism conditions reviews the overall threat of over-tourism and establishes a metric by which tourism can be viewed as potentially detrimental to sustainability. …

Haemonchus contortus is a critical parasite of goats and sheep. Infection by this blood-feeding gastrointestinal nematode (GIN) parasite has significant health consequences, especially in lambs and kids. The parasite has developed resistance to virtually all known classes of small molecule anthelmintics used to treat it, giving rise in some areas to multidrug resistant parasites that are very difficult to control. Thus, new anthelmintics are urgently needed. Bacillus thuringiensis (Bt) crystal protein 5B (Cry5B), a naturally occurring protein made by a bacterium widely and safely used around the world as a bioinsecticide, represents a new non-small molecule modality for treating GINs. …
