Copyright's Fixation Requirement: Is It Still Needed?, Attamongkol Tantratian Dec 2020

Copyright's Fixation Requirement: Is It Still Needed?, Attamongkol Tantratian

Maurer Theses and Dissertations

While the United States requires fixation for an original work to be entitled to federal copyright protection, many other countries ignore such requirement. The difference could lead to partial copyright protection standards across jurisdictions over certain works that are not fixed. Examples of such works include extemporaneous speeches, lectures, improvisational performances, and contemporary arts that are transitory. Moreover, with today’s rapid development of arts and technologies, creative works can be presented via new media without being fixed in a traditional way. The examples include live streams of lectures and music performances, which have become part of the “new normal.” In …

Fruit Bagging: A Small-Grower And Consumer Horticultural Practice Across The Southeastern United States, Ann Katherine Kule Dec 2020

Fruit Bagging: A Small-Grower And Consumer Horticultural Practice Across The Southeastern United States, Ann Katherine Kule

All Theses

Fruit bagging is a simple method used to protect fruit from pests and diseases. It is popular among backyard gardeners in Asia and there is an increasing interest in the United States, especially in regions with warm and humid climates where pests and diseases thrive (Gorsuch and Scott 2020). Two different surveys were created and conducted two consecutive years (2019 and 2020) using Survey Monkey. Separate surveys were sent out: one was for assessing consumer perception at farmer’s markets in South Carolina, Georgia and Florida, and the other was for evaluating bagging success among backyard growers across the nation. Each …

Biomechanical Properties Of Land Based And Shallow Water Wait: A Comparative Review Of Literature, Mostafa Yaghoubi, Philip Fink, Wyatt H. Page, Sarah P. Shultz

International Journal of Aquatic Research and Education

Aquatic locomotion exercises are frequently used in rehabilitation and cross-training for land-based athletes. Hydrostatic pressure, thermal conductivity and drag force affect a person's ability to move; therefore, it is important to understand differences of biomechanical gait in water vs land. This review investigated biomechanical differences between shallow water and land-based exercises. PubMed, Google Scholar, SPORTDiscus and Scopus were searched; 33 studies included walking forward (27), backward (6) and running (6). Electromyographic amplitude was similar or less in submaximal intensity during aquatic gait, in comparison to on land. At maximal intensities, however, the amplitude was similar (n=5) or higher (n=4) in …

“Labour Law Is A Subset Of Employment Law” Revisited, Alan Bogg Dec 2020

“Labour Law Is A Subset Of Employment Law” Revisited, Alan Bogg

Dalhousie Law Journal

This article revisits the arguments in Brian Langille’s seminal law review article, “Labour Law is a Subset of Employment Law.” Langille’s article was based upon two main claims: (a) that (individual) employment law should be understood as the “set” and (collective) labour law the “subset” of employment law (the primacy of employment law); (b) that “public values” have priority over “private values” in the regulation of work (the primacy of public values). These two claims were presented as mutually reinforcing in “Subset.” Drawing on specific examples from UK and Canadian law, this article endorses the first claim but rejects the …

If Labour Law Is A Subset Of Employment Law, What Is Employment Law A Subset Of?, Brian A. Langille Dec 2020

If Labour Law Is A Subset Of Employment Law, What Is Employment Law A Subset Of?, Brian A. Langille

Dalhousie Law Journal

An academic life lived over decades can provide real rewards. One is thinking about a subject, such as labour law, over a significant period. Such longer-term speculation can lead to interesting questions—such as, what makes labour law a subject anyway? A second advantage of academic seniority is the opportunity to sustain longer-term relationships with other scholars. Both the temporal and personal advantages are joined here because four leading labour law scholars whom I have known for a (sometimes very long) while, have written about an essay that I wrote forty years ago. This essay is my effort to join them …

Unifying The Field: Mapping The Relationship Between Work Law Regimes In Ontario, Then And Now, Claire Mumme Dec 2020

Unifying The Field: Mapping The Relationship Between Work Law Regimes In Ontario, Then And Now, Claire Mumme

Dalhousie Law Journal

Since the mid-20th century in Canada, labour and employment law have been treated as two separate but related fields. In 1981 Brian Langille argued in “Labour Law is a Subset of Employment Law” for the unification of the fields, so that all forms of waged work were understood as matters of public policy, rather than leaving some types of work to private law regulation. Taking up Langille’s argument, this paper argues that employment contracts, individual and collective, are structured through the overlap, interaction and gaps between work law regimes. The creation of a unified field moves from studying the regimes …

The Conceptual Gap Between Doré And Vavilov, Mark Mancini Dec 2020

The Conceptual Gap Between Doré And Vavilov, Mark Mancini

Dalhousie Law Journal

This paper argues that there is a fundamental conceptual gap between the cases of Doré and Vavilov. This is because both cases are motivated by different conceptions of administrative law. In Vavilov, the paper suggests that the Court melded together two theories of judicial review; a Diceyan theory based on a harmonious understanding of the principles of legislative sovereignty and the Rule of Law; and a “culture of justification” for administrative decision-makers. On the other hand, Doré is motivated by a functionalist understanding of administrative law, in which the expertise of decision- makers is emphasized. The paper explores the doctrinal …

Development Of Extracellular Vesicle Isolation And Model Systems Toward Early Ovarian Cancer Diagnostics, Tyler Slonecki Dec 2020

Development Of Extracellular Vesicle Isolation And Model Systems Toward Early Ovarian Cancer Diagnostics, Tyler Slonecki

All Dissertations

Ovarian cancer (OC) is characterized by late stage discovery and low survivability. However, when diagnosed early (Stages I or II) the 5-year survival rate is 92% up from 29%.5 The extreme dichotomy in survivability is what makes OC a prime candidate for early diagnosis techniques. Exosomes, a subtype of extracellular vesicles, may bridge the gap between early and late diagnosis, but are lacking consistent isolation and detection technologies. Here poly(ethylene terephthalate) (PET) capillary channeled polymer (C-CP) fibers employing an HIC protocol are investigated as a novel exosome isolation method and a quick, inexpensive, and easy-to-use platform for OC diagnosis. The …

Smart Motor Syringe System, Conard Chan, Jenny Chiao Dec 2020

Smart Motor Syringe System, Conard Chan, Jenny Chiao

Electrical Engineering

Syringe pumps are widely used in many research applications especially in the applications that need precise control. Today most medical research utilizes syringes to control the fluid being pumped to the experiment objects. In most cases microscopic or nano-scopic motion control is required to acquire optimal results, such application includes purification of DNA/RNA from contaminants[1]. The high precision required to control the syringe pump makes it difficult to perform manually. This paper focuses on the design of an intelligent syringe pump motor control system to achieve reliable and precise control for biomedical experiments. This project improves medical research quality with …

Employment Law Revisited, Mark Freedland Dec 2020

Employment Law Revisited, Mark Freedland

Dalhousie Law Journal

This critique of Brian Langille’s famous “Subset” article considers the historical and current meaning of “employment law” in Canada and in the UK. In Canada, “employment law” was fashioned by Innis Christie in the 1980s as the law of personal work relations for the non-unionized sector, with “labour law” applying to the unionized sector of the economy. In the UK, “individual employment law” appeared in the 1970s to be a distinct discipline; but since that time it has largely re-merged with labour law, with the terms “employment law” and “labour law” becoming virtually synonymous. An enlarged scope is proposed for …

Lianas Maintain Insectivorous Bird Abundance And Diversity In A Neotropical Forest, Stefan A. Schnitzer, Nicole L. Michel, Jennifer S. Powers, W. Douglas Robinson Dec 2020

Lianas Maintain Insectivorous Bird Abundance And Diversity In A Neotropical Forest, Stefan A. Schnitzer, Nicole L. Michel, Jennifer S. Powers, W. Douglas Robinson

Biological Sciences Faculty Research and Publications

The spatial habitat heterogeneity hypothesis posits that habitat complexity increases the abundance and diversity of species. In tropical forests, lianas add substantial habitat heterogeneity and complexity throughout the vertical forest profile, which may maintain animal abundance and diversity. The effects of lianas on tropical animal communities, however, remain poorly understood. We propose that lianas have a positive effect on animals by enhancing habitat complexity. Lianas may have a particularly strong influence on the forest bird community, providing nesting substrate, protection from predators, and nutrition (food). Understory insectivorous birds, which forage for insects that specialize on lianas, may particularly benefit. Alternatively, …

Ampakines Stimulate Phrenic Motor Output After Cervical Spinal Cord Injury, L. B. Wollman, Kristi A. Streeter, A. F. Fusco, E. J. Gonzalez-Rothi, M. S. Sandhu, J. J. Greer, D. D. Fuller Dec 2020

Ampakines Stimulate Phrenic Motor Output After Cervical Spinal Cord Injury, L. B. Wollman, Kristi A. Streeter, A. F. Fusco, E. J. Gonzalez-Rothi, M. S. Sandhu, J. J. Greer, D. D. Fuller

Physical Therapy Faculty Research and Publications

Activation of α-amino-3-hydroxy-5-methyl-4-isoxazolepropionic acid (AMPA) receptors increases phrenic motor output. Ampakines are a class of drugs that are positive allosteric modulators of AMPA receptors. We hypothesized that 1) ampakines can stimulate phrenic activity after incomplete cervical spinal cord injury (SCI), and 2) pairing ampakines with brief hypoxia could enable sustained facilitation of phrenic bursting. Phrenic activity was recorded ipsilateral (IL) and contralateral (CL) to C2 spinal cord hemisection (C2Hx) in anesthetized adult rats. Two weeks after C2Hx, ampakine CX717 (15 mg/kg, i.v.) increased IL (61 ± 46% baseline, BL) and CL burst amplitude (47 ± 26%BL) in 8 of 8 …

Two Weeks Of Remote Ischemic Conditioning Improves Brachial Artery Flow Mediated Dilation In Chronic Stroke Survivors, Allison S. Hyngstrom, Jennifer Nguyen, Michael Wright, Sergey Tarima, Brian D. Schmit, David D. Gutterman, Matthew J. Durand

Physical Therapy Faculty Research and Publications

Many stroke survivors have reduced cardiorespiratory fitness as a result of their stroke. Ischemic conditioning (IC) is a noninvasive, cost-effective, easy-to-administer intervention that can be performed at home and has been shown to improve both motor function in stroke survivors and vascular endothelial function in healthy individuals. In this study, we examined the effects of 2 wk of remote IC (RIC) on brachial artery flow mediated dilation (FMD) in chronic stroke survivors. We hypothesized that FMD would be improved following RIC compared with a sham RIC control group. This was a prospective, randomized, double-blinded, controlled study. Twenty-four chronic stroke survivors …

Atmospheric Turbulence Distortion In Video: Restoration Utilizing Sparse Analysis, Benjamin J. Sanda Dec 2020

Atmospheric Turbulence Distortion In Video: Restoration Utilizing Sparse Analysis, Benjamin J. Sanda

Dissertations

The removal of atmospheric turbulence (AT) distortion in long range imaging is one of the most challenging areas of research in imaging processing with an immediate need for solutions in several applications such as in military and transportation systems. AT exacerbates distortion due to non-linear geometric blur and scintillations in long-distance images and videos, severely reducing image quality and information interpretation. AT negatively impacts both human and computer vision systems, compromising visibility essential for accurate object identification and tracking.

In this dissertation, a novel sparse analysis framework is developed to address efficient AT blur and scintillation removal in video. Operating …

Functional And Physiological Role Of Extra-Hypothalamic Corticotropin Releasing Hormone Neurons In The Nucleus Of The Hippocampal Commissure In Regulation Of Stress Response, Hakeem Kadhim Dec 2020

Functional And Physiological Role Of Extra-Hypothalamic Corticotropin Releasing Hormone Neurons In The Nucleus Of The Hippocampal Commissure In Regulation Of Stress Response, Hakeem Kadhim

Graduate Theses and Dissertations

Corticotropin releasing hormone (CRH) neurons located within the paraventricular nucleus (PVN) are known to be involved in regulation of stress responses. Recently, CRH neurons were identified above the PVN within the nucleus of the hippocampal commissure (NHpC) that located in the septum. We hypothesized that CRH neurons in the NHpC play a critical role in the stress response due to their rapid activation and could be a part of the traditional hypothalamo-pituitary-adrenal (HPA) axis. The dissertation addresses the role of 1) CRH expressing neurons in the NHpC compared with those within the PVN utilizing two different stressors, food deprivation (FD) …

The Effect Of Epa And Dha On Skeletal Muscle Physiology And Energy Balance, Saeed Jebor Ghnaimawi

Graduate Theses and Dissertations

Eicosapentaenoic acid (EPA) and Docosahexaenoic acid (DHA) supplementation commonly suggested during pregnancy confers many health benefits on offspring and more recently improves fetal BAT development and induces myoblast trans-differentiation into adiopocytes through activating PPARs expression. Embryonic myoblast is a highly flexible cell showing great capacity to change its phenotype into adipocyte in response to EPA and DHA supplementation in many in vitro models. However, a little is known about the identity of derived adipocytes, whether, they change into brown or white adipocyte, and in vivo evidence is still missing. Given that the myogeneis process is initiated at the mid of …

Documenting A Personal And National History: Echoes Of The Urban-Rural Divide In The Works Of Helga Gamboa, Sonja Gelin Dec 2020

Documenting A Personal And National History: Echoes Of The Urban-Rural Divide In The Works Of Helga Gamboa, Sonja Gelin

Honors Theses

This paper analyzes a series of vessels created by artist Helga Gamboa from 2003-2008. Gamboa, an Angolan artist, based in the United Kingdom, uses her work to recount the experiences of rural women during the Angolan Civil War (1975-2002) and her own experience growing up in the capital during the final years of the Salazar-Caetano regime. Gamboa’s syncretic approach incorporates European tin-glazing and indigenous African hand-building techniques. Early Modern Portuguese and traditional Southern Angolan material culture also guide the artist. The resulting works document a lasting urban-rural divide among Angolan women, dating back to colonial policy, liberation struggles, and civil …
