The article addresses the issue of jurisdiction over claims for damages caused by an infringement of competition law. The paper examines the case-law of the CJEU regarding the application of special jurisdiction stated in Art. 7(2) Regulation 1215/12 in private enforcement cases, with a particular focus on the judgment in case C-451/18 Tibor-Trans. This analysis has shown that the case-law is not yet settled, as the interpretation of the place where the damage arising from competition law violation took place is determined on a case-by-case basis. กระบวนการออกแบบหนังสือดอกไม้ด้วยวิธีการนิเทศศิลป์โดยปรับใช้เทคนิคงานตอกกระดาษของจังหวัดสงขลา, พรรณี วิรุณานนท์

งานวิจัยเชิงสร้างสรรค์นี้มีวัตถุประสงค์เพื่อ (1) พัฒนากระบวนการออกแบบหนังสือศิลปะด้วยวิธีการนิเทศศิลป์โดยปรับใช้งานตอกกระดาษพื้นบ้านภาคใต้ของจังหวัดสงขลาและ (2) จัดทําและนําเสนอหนังสือดอกไม้ตามกระบวนการที่พัฒนาขึ้น โดยแนวคิดที่ใช้ในการออกแบบ คือ “การซ้ํากันและ การสะท้อนกัน” ผลของการสร้างสรรค์ศิลปะ-วิจัยครั้งนี้ ได้เป็น (1) กระบวนการออกแบบหนังสือดอกไม้โดยใช้วิธีการนิเทศศิลป์ที่ปรับใช้เทคนิคงานตอกกระดาษจังหวัดสงขลา ซึ่งมี 3 ขั้นตอนหลัก คือ 1) การสร้างแรงบันดาลใจจากศิลปะไทย 2) การศึกษาและพัฒนาทักษะงานช่างและลวดลายไทย และ 3) กระบวนการออกแบบและการวางจัดหนังสือดอกไม้ และ (2) ชุดของหนังสือดอกไม้ 33 เล่ม และแบบการนําเสนอ ทั้งนี้ดอกไม้ที่ใช้เป็นต้นแบบของหนังสือ จํานวนหนังสือ และต้นแบบของการจัดวางหนังสือดอกไม้ที่พัฒนาขั้นตามกระบวนการ คือ ดอกไม้ในวรรณคดีไทย ที่นับเป็นศิลปะไทยอีกแขนงหนึ่ง

รูปแบบความสัมพันธ์โครงสร้างเชิงสาเหตุของปัจจัยที่ส่งผลต่อประสิทธิผลของโรงเรียนเรียนรวมระดับประถมศึกษาในภาคตะวันออกเฉียงเหนือ, ยงยุทธ สิมสีพิมพ์, สมคิด สร้อยน้ำ, นวัตกร หอมสิน

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาประสิทธิผล และปัจจัยที่มีอิทธิพลต่อประสิทธิผลของโรงเรียนเรียนรวม 2) ตรวจสอบความสอดคล้องของรูปแบบความสัมพันธ์โครงสร้างเชิงเส้นของปัจจัยที่มีอิทธิพลต่อประสิทธิผลของโรงเรียนเรียนรวมกับข้อมูลเชิงประจักษ์ และ 3) ศึกษาอิทธิพลทางตรง อิทธิพลทางอ้อม และอิทธิพลรวมของปัจจัยต่อประสิทธิผลของโรงเรียนเรียนรวม ตัวอย่างคือ ผู้อํานวยการโรงเรียนเรียนรวม จํานวน 572 คน เครื่องมือที่ใช้ คือ แบบสอบถาม วิเคราะห์ข้อมูลด้วยค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน ความเบ้ ความโด่ง การวิเคราะห์สัมประสิทธิ์การกระจาย การวิเคราะห์ความสัมพันธ์โดยหาค่าสัมประสิทธิ์สหสัมพันธ์ของเพียร์สัน และโปรแกรมลิสเรล 8.72 ผลการวิจัย พบว่า 1) ประสิทธิผลและปัจจัยที่มีอิทธิพลต่อประสิทธิผลของโรงเรียนเรียนรวมมีค่าเฉลี่ยระดับมาก (M = 4.16) 2) รูปแบบความสัมพันธ์โครงสร้างเชิงเส้นของปัจจัยที่มีอิทธิพลต่อประสิทธิผลของโรงเรียนเรียนรวมสอดคล้องกับข้อมูลเชิงประจักษ์ (X = 51.32 df = 38, p = 0.073, GFI =0.99, AGFI = 0.96, RMSEA = 0.025, SRMR = 0.015, CN = 664.52) และ 3) ปัจจัยที่มีอิทธิพลต่อโรงเรียนเรียนรวม 1) ปัจจัยที่มีอิทธิพลทางตรง คือ การจัดการทรัพยากรองค์การ บรรยากาศองค์การของสถานศึกษาคุณลักษณะของบุคลากร และภาวะผู้นําของผู้บริหาร 2) ปัจจัยที่มีอิทธิพลทางอ้อม คือ ภาวะผู้นําของผู้บริหาร มีอิทธิพลทางอ้อมผ่านการจัดการทรัพยากรองค์การ และบรรยากาศองค์การของสถานศึกษา และ 3) ปัจจัยที่มีอิทธิพลรวม คือ ภาวะผู้นําของผู้บริหาร การจัดการทรัพยากรองค์การ บรรยากาศองค์การของสถานศึกษา และคุณลักษณะของบุคลากร

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษา 1) ประสิทธิภาพการจัดกิจกรรมการเรียนรู้คณิตศาสตร์ตามแนวคิดทฤษฎีสร้างองค์ความรู้ด้วยตนเองร่วมกับการเรียนรู้แบบร่วมมือเทคนิค STAD เรื่องเซตตามเกณฑ์ 75/75 2) ผลสัมฤทธิ์ทางการเรียน ของนักเรียนชั้นมัธยมศึกษาปีที่ 4 ตามแนวคิดทฤษฎีสร้างองค์ความรู้ด้วยตนเองร่วมกับการเรียนรู้แบบร่วมมือเทคนิค STAD และ 3) ศึกษาความพึงพอใจของนักเรียนที่มีต่อการจัดกิจกรรมการเรียนรู้คณิตศาสตร์ ตามแนวคิดทฤษฎีสร้างองค์ความรู้ด้วยตนเองร่วมกับการเรียนรู้แบบร่วมมือเทคนิค STAD กลุ่มตัวอย่างเป็นนักเรียนชั้นมัธยมศึกษาปีที่ 4 โรงเรียนสาธิตมหาวิทยาลัยรามคําแหง จํานวน 31 คน โดยใช้การสุ่มอย่างง่าย เครื่องมือที่ใช้ในการวิจัย ได้แก่ 1) แบบทดสอบวัดผลสัมฤทธิ์ทางการเรียนคณิตศาสตร์ 2) แบบสอบถามความพึงพอใจ ผลการวิจัยพบว่า 1) กิจกรรมการเรียนรู้คณิตศาสตร์ ตามแนวคิดทฤษฎีสร้างองค์ความรู้ด้วยตนเองร่วมกับการเรียนรู้แบบร่วมมือเทคนิค STAD เรื่องเซต มีประสิทธิภาพเท่ากับ 80.84/75.482) นักเรียนที่ได้รับการสอนด้วยการจัดการเรียนรู้ตามแนวคิดทฤษฎีสร้างองค์ความรู้ด้วยตนเองร่วมกับการเรียนรู้แบบร่วมมือเทคนิค STAD มีผลสัมฤทธิ์ทางการเรียนคณิตศาสตร์หลังเรียนสูงกว่าก่อนเรียน อย่างมีนัยสําคัญทางสถิติที่ .01 และ 3) ความพึงพอใจของนักเรียนที่ได้รับการสอนด้วยการจัดการเรียนรู้ตามแนวคิดทฤษฎีสร้างองค์ความรู้ด้วยตนเองร่วมกับการเรียนรู้แบบร่วมมือเทคนิค STAD มีคะแนนรวมเฉลี่ยอยู่ในระดับดีมาก

การศึกษาประสิทธิผลของรูปแบบการเรียนการสอนตามทฤษฎีการเรียนรู้ทางสังคมเชิงพุทธิปัญญาและแนวคิดการวางแผนยุทธศาสตร์ชีวิต เพื่อเสริมสร้างการกำกับตนเองและผลสัมฤทธิ์ทางการเรียนสุขศึกษาของนักเรียนชั้นมัธยมศึกษาตอนต้นในจังหวัดบุรีรัมย์, อดิศร บาลโสง, วลัย อิศรางกูร ณ อยุธยา, อัมพร ม้าคนอง

การวิจัยแบบกึ่งทดลองนี้ มีวัตถุประสงค์เพื่อ 1) พัฒนารูปแบบการเรียนการสอนตามทฤษฎีการเรียนรู้ทางสังคมเชิงพุทธิปัญญาและแนวคิดการวางแผนยุทธศาสตร์ชีวิต เพื่อเสริมสร้างการกํากับตนเองและผลสัมฤทธิ์ทางการเรียนสุขศึกษาของนักเรียนชั้นมัธยมศึกษาตอนต้น 2) ศึกษาประสิทธิผลของรูปแบบการเรียนการสอน โดยศึกษากลุ่มเดียววัดหลายครั้งแบบอนุกรมเวลา ในนักเรียนชั้นมัธยมศึกษาปีที่ 3 จํานวน 23 คน เครื่องมือที่ใช้ได้แก่ แผนการจัดการเรียนรู้รายวิชาสุขศึกษา จํานวน 20 สัปดาห์ ๆ ละ 1 ชั่วโมง เครื่องมือในการเก็บรวบรวมข้อมูล ได้แก่ 1) แบบวัดการกํากับตนเอง ที่มีค่า IOC ตั้งแต่ 0.90-1.00 ค่าสัมประสิทธิ์แอลฟาของครอนบาค = 95 2) แบบทดสอบความรู้รายวิชาสุขศึกษา ที่มีค่า IOC ตั้งแต่ 0.80-1.00 ค่า KR-20 = .89 ค่าความยาก 0.43-0.70 ค่าอํานาจจําแนก 0.20-0.37 วิเคราะห์ข้อมูลด้วยร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และการทดสอบค่าที ผลการวิจัย พบว่า รูปแบบการเรียนการสอนมีองค์ประกอบหลัก 5 ขั้น คือ 1) สร้างความสนใจ 2) คาดการณ์ล่วงหน้า 3) วางแผนยุทธศาสตร์ 4) ปฏิบัติให้สําเร็จ และ 5) สะท้อนผลงาน และมีประสิทธิผล คือ 1) ค่าเฉลี่ยคะแนนความสามารถในการกํากับตนเองของกลุ่มตัวอย่างมีพัฒนาการสูงขึ้น ร้อยละ 2.98 โดยหลังการทดลองสูงกว่าก่อนการทดลองอย่างมีนัยสําคัญทางสถิติที่ระดับ .05 2) ผลสัมฤทธิ์ทางการเรียนรายวิชาสุขศึกษา หลังการทดลองสูงกว่าก่อนการทดลอง อย่างมีนัยสําคัญทางสถิติที่ระดับ .05

การวิเคราะห์และสังเคราะห์ปรัชญา แนวคิด และหลักการของการศึกษาตลอดชีวิต เพื่อการเป็นชุมชนแห่งการเรียนรู้, อาชัญญา รัตนอุบล

งานวิจัยนี้เป็นการศึกษาเชิงคุณภาพที่มีวัตถุประสงค์เพื่อวิเคราะห์ สังเคราะห์ และนําเสนอปรัชญา แนวคิดและหลักการของการศึกษาตลอดชีวิตเพื่อการเป็นชุมชนแห่งการเรียนรู้ ดําเนินการวิจัยด้วยการวิเคราะห์เอกสารและการประชุมสนทนากลุ่มผู้ทรงคุณวุฒิทางการศึกษาตลอดชีวิตเพื่อประเมินผลข้อมูล ผลการวิจัยพบว่า ปรัชญาของการศึกษาตลอดชีวิตเพื่อเป็นชุมชนแห่งการเรียนรู้มี 4 ข้อ ประกอบด้วย 1. ความเชื่อว่าชุมชนและบุคคลมีศักยภาพ 2. หัวใจของการเปลี่ยนแปลงคือการเรียนรู้ 3. การเรียนรู้ที่มีคุณค่าคือ การเรียนรู้ตามความต้องการ 4. การเรียนรู้ของชุมชนเกิดขึ้นด้วยกลไกการขับเคลื่อนของชุมชนเพื่อพัฒนาชุมชน แนวคิดของการศึกษาตลอดชีวิตเพื่อการเป็นชุมชนแห่งการเรียนรู้มี 4 แนวคิดประกอบด้วย 1. บุคคลมีความเท่าเทียมในการเรียนรู้ด้วยตนเองและเรียนรู้อย่างมีส่วนร่วมกับชุมชน 2. บุคคลสามารถเรียนรู้ได้ด้วยตนเองโดยใช้วิธีและรูปแบบการเรียนรู้ของตนเอง 3. การเรียนรู้และกิจกรรมการเรียนรู้สามารถเกิดขึ้นได้ในทุกพื้นที่ของชุมชน 4. การเรียนรู้ต้องสามารถตอบสนองความต้องการของบุคคลโดยไม่ขัดแย้งกับวัฒนธรรมของชุมชนและสังคม หลักการของการศึกษาตลอดชีวิตเพื่อการเป็นชุมชนแห่งการเรียนรู้มี 6 หลักการ ประกอบด้วย 1. หลักการเรียนรู้ ได้แก่ มีการศึกษาข้อมูลอย่างเป็นระบบ เรียนรู้อย่างมีส่วนร่วม และเรียนรู้อย่างเรียบง่าย สอดคล้องกับธรรมชาติในชุมชน 2. หลักการด้านประโยชน์ตอบแทน ได้แก่ ชุมชนต้องได้รับประโยชน์จาก การแลกเปลี่ยนของบุคคลซึ่งเห็นประโยชน์ของส่วนรวมเป็นหลัก 3. หลักการคิดและลงมือทํา ได้แก่ ชุมชนเรียนรู้การแก้ปัญหาด้วยการมองเห็นภาพปัญหาควบคู่ไปกับการคิดอย่างเป็นองค์รวม มีการลงมือปฏิบัติจริงที่ส่งเสริมการเรียนรู้อย่างเป็นลําดับขั้นตอน 4. หลักการความเป็นผู้นํา ได้แก่ มีผู้ปฏิบัติที่เป็นต้นแบบของการเรียนรู้ 5. หลักการสื่อสารได้แก่ การทําความเข้าใจเพื่อนําไปสู่การเรียนรู้ร่วมกัน และ 6. หลักการระเบิดจากภายใน ได้แก่ การสร้างภูมิต้านทานที่เข้มแข็งภายในชุมชนก่อนที่จะนําความเจริญจากภายนอกเข้ามา

ผลของการจัดการเรียนการสอนโดยใช้การออกแบบการเรียนรู้จากการสร้างมโนภาพทางเคมีที่มีต่อตัวแทนความคิดทางวิทยาศาสตร์และเจตคติต่อการเรียนรู้เคมีของนักเรียนมัธยมศึกษาตอนปลาย, โชติกุล รินลา, สายรุ้ง ชาวสุภา

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาตัวแทนความคิดทางวิทยาศาสตร์ของนักเรียนที่ได้รับการสอนโดยใช้การออกแบบการเรียนรู้จากการสร้างมโนภาพทางเคมี 2) เปรียบเทียบตัวแทนความคิดทางวิทยาศาสตร์ของนักเรียนระหว่างกลุ่มที่ได้รับการสอนโดยใช้การออกแบบการเรียนรู้จากการสร้างมโนภาพทางเคมีและการสอนแบบสืบสอบ 3) ศึกษาเจตคติต่อการเรียนรู้เคมีของนักเรียนที่ได้รับการสอน โดยใช้การออกแบบการเรียนรู้จากการสร้างมโนภาพทางเคมี และ 4) เปรียบเทียบเจตคติต่อการเรียนรู้เคมีของนักเรียนระหว่างกลุ่มที่ได้รับการสอนโดยใช้การออกแบบการเรียนรู้จากการสร้างมโนภาพทางเคมีและการสอนแบบสืบสอบ กลุ่มตัวอย่างคือนักเรียนชั้นมัธยมศึกษาปีที่ 4 แบ่งเป็นกลุ่มทดลองที่ได้รับการสอนโดยใช้การออกแบบการเรียนรู้จากการสร้างมโนภาพทางเคมี จํานวน 44 คน และกลุ่มควบคุมที่ได้รับการสอนแบบสืบสอบ จํานวน 43 คน เครื่องมือวิจัย คือ 1) แบบวัดตัวแทนความคิดทางวิทยาศาสตร์มีค่าความเที่ยงเท่ากับ 0.62 และ 2) แบบวัดเจตคติต่อการเรียนรู้เคมี มีค่าความเที่ยงเท่ากับ 0.67
ผลการวิจัยสรุปว่า 1) นักเรียนกลุ่มทดลองมีคะแนนเฉลี่ยตัวแทนความคิดทางวิทยาศาสตร์อยู่ในระดับพอใช้ 2) นักเรียนกลุ่มทดลองมีคะแนนเฉลี่ยตัวแทนความคิดทางวิทยาศาสตร์สูงกว่านักเรียนกลุ่มควบคุมอย่างมีนัยสําคัญทางสถิติที่ระดับ .05 3) นักเรียนกลุ่มทดลองมีคะแนนเฉลี่ยเจตคติต่อการเรียนรู้อยู่ในระดับดีและ 4) นักเรียนกลุ่มทดลองมีคะแนนเฉลี่ยเจตคติต่อการเรียนรู้เคมีสูงกว่ากลุ่มควบคุมอย่างมีนัยสําคัญทางสถิติที่ระดับ .05

การวิจัยมีวัตถุประสงค์เพื่อศึกษาสภาพการสอนและการใช้ห้องปฏิบัติการเครื่องเคลือบดินเผาในหลักสูตรปริญญาตรี 3 หลักสูตร คือ 1) หลักสูตรผลิตครูศิลปะ 2) หลักสูตรผลิตศิลปิน 3) หลักสูตรผลิตนักออกแบบอุตสาหกรรม และนําเสนอรูปแบบการสอนที่สนองต่อบริบทและลักษณะของห้องปฏิบัติการดําเนินการวิจัยแบบผสมผสาน คือ การวิจัยเชิงคุณภาพ และเชิงปริมาณ เก็บรวบรวมข้อมูลโดย 1) แบบสอบถามอาจารย์ผู้สอน และนักศึกษาระดับปริญญาตรีชั้นปีที่ 2 – 4 2) แบบสัมภาษณ์อาจารย์ผู้สอน และผู้เชี่ยวชาญเครื่องเคลือบดินเผา 3) แบบสังเกตการใช้ห้องปฏิบัติการ วิเคราะห์ข้อมูลเชิงคุณภาพโดยจําแนก จัดหมวดหมู่ และเปรียบเทียบข้อมูลเพื่อหาบทสรุปร่วมกัน ข้อมูลเชิงปริมาณ วิเคราะห์ด้วยสถิติบรรยาย ได้แก่ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และร้อยละ
ผลการวิจัยพบว่า รูปแบบการสอนเครื่องเคลือบดินเผา 3 หลักสูตร ได้แก่ 1) หลักสูตรผลิตครูศิลปะ เรียนรู้กระบวนการผลิตเครื่องเคลือบดินเผาที่ครอบคลุม เน้นการปลูกฝังคุณค่า การเป็นครูต้นแบบและพัฒนาทักษะการสอนของผู้เรียน วัดและประเมินผลจากความเข้าใจในกระบวนการผลิตงานและการออกแบบแผนการสอน 2) หลักสูตรผลิตศิลปิน เรียนรู้กระบวนผลิตชิ้นงาน เน้นพัฒนาความคิดสร้างสรรค์เฉพาะตัวตามหลักการทางสุนทรียภาพ วัดและประเมินผลจากพัฒนาการด้านทักษะและความคิดสร้างสรรค์ 3) หลักสูตรผลิตนักออกแบบอุตสาหกรรม เรียนรู้หลักการออกแบบเชิงอุตสาหกรรมที่คํานึงถึงความงามวัสดุ และหน้าที่ใช้สอย เน้นแก้ปัญหาการออกแบบตามความต้องการของตลาด วัดและประเมินผลจากกระบวนการคิดแก้ปัญหาการออกแบบ

This essay has been developed from the conviction that scholars of all disciplines, particularly from Southeast Asia, must work together to prioritize the task of recording the traditions of “marginalized peoples” before practices, beliefs and memories disappear completely. Although anthropologists dominate contemporary studies, historians have much to offer, especially in dealing with the relationship between such groups and the state. Here I provide a background to historical work on sea peoples, tracking the evolution of the now accepted view that, traditionally, they were respected by land-based states and that this relationship was mutually beneficial. Civil Service And Oligarchy: American Colonial Principles In Early Twentieth Century Philippines And Hawai'i, Lance D. Collins

This paper surveys the history of the introduction of an American-style merit-principle in the creation of a classified civil service system in the Philippines and Hawai'i. The paper illustrates how the implementation of the idea of the "merit principle" in civil service and in organizing public workers in the Philippines and Hawai'i was undermined by opposing forces within the American colonial governing apparatus. Southeast Asia’s ethnic, political and cultural diversity continues to pose major policy and governance hurdles in enforcing a common community born out of the post-colonial nationalist baggage of almost all the region’s countries. ASEAN’s “non-interference” clause gives leeway to each member state to respond to its ethnic diversity with nation-building projects through exclusionary governance. With this leeway, each Southeast Asian country’s nation-building policies legitimize a particular, existing ethno-nationalist or “ethno-religious” majority at the expense of democratic accountability. This study proposes a preliminary quantitative model which uses regression analysis to compare Southeast Asian countries’ data on their religious and ethnic populations. …

Current global news is focused on China’s territorial claims in the South China Sea and the ensuing clash with the United States over the “freedom of marine navigation.” Against this background of territorial claims lies the complex history of old Asian civilizations which undergird no easy resolution of such territorial issues. This paper interrogates the region’s cultural identity paradigm arising from China’s territorial claims, the US-China hegemonic global contestation, the US-China trade war and ASEAN’s responses to the changing geopolitics and extension of China’s geography. It argues that both domestic changes and externalities are affecting ASEAN’s regional cohesion.

In May of 2018, the University of Denver repeated on-road optical remote sensing measurements at two locations in Lynwood, CA. Lynwood area vehicle tailpipe emissions were first surveyed in 1989 and 1991 because the area suffered with a large number of carbon monoxide (CO) air quality violations. These new measurements allow for the estimation of fuel specific CO and total hydrocarbon (HC) emissions reductions, changes in the longevity of emission-control components, and the prevalence of high emitters in the current fleet.

This research aims to identify the role of natural wetlands in arsenic (As) removal. Phu Lek wetland in Loei Province, Thailand, was selected as the study area. Monthly samples of water (144), plant (360), and sediment (144) were collected from the wetland for 24 months. As concentration in the surface water at the wetland inlet was 0.85±0.26 mg L-1, and 0.02±0.01 mg L-1 at the wetland outlet. This study investigated the adsorption kinetics of 1-nitronaphthalene solution (a polycyclic aromatic hydrocarbon, PAH) onto seven different masses of activated carbon. The coefficient of determination (r2) was used to determine the best-fit kinetic model and to confirm agreement between experimental data and the kinetic rate equations. The results indicated that adsorption could be defined with masses of 0.0200 g and 0.0501 g when fitted using a second order rate equation. Adsorption on to masses of 0.1003 g, 0.1203, 0.1501 g, and 0.2001 g was best defined when data were fitted to a pseudo second order rate equation. However, adsorption onto …

Thus, the habenula is strongly connected to both the reward system and motor regions. Objectives: This study sought to assess the utility of Imagery Rehearsal Therapy (IRT) for nightmares in an inpatient psychiatric setting. Although IRT enjoys a substantial evidence base for efficacy in various populations, data with psychiatric inpatients are lacking.

Participants: Participants were 20 adult psychiatric inpatients (11 male, 9 female; mean age=43.4), in an extended stay psychiatric inpatient facility. All participants were diagnosed with multiple, treatment resistant, comorbid conditions, including mood disorders, anxiety disorders, personality disorders, and substance-related disorders. Patients with active psychosis or significant cognitive impairment were excluded.
