Finding Law, Stephen E. Sachs Jan 2019

Finding Law, Stephen E. Sachs

Faculty Scholarship

That the judge's task is to find the law, not to make it, was once a commonplace of our legal culture. Today, decades after Erie, the idea of a common law discovered by judges is commonly dismissed -- as a "fallacy," an "illusion," a "brooding omnipresence in the sky." That dismissive view is wrong. Expecting judges to find unwritten law is no childish fiction of the benighted past, but a real and plausible option for a modern legal system.

This Essay seeks to restore the respectability of finding law, in part by responding to two criticisms made by Erie and …

Natural History Of The Eastern Harvest Mouse In Southeastern Virginia, Robert K. Rose Jan 2019

Natural History Of The Eastern Harvest Mouse In Southeastern Virginia, Robert K. Rose

Biological Sciences Faculty Publications

The Eastern Harvest Mouse, Reithrodontomys humulis, has been studied extensively in southeastern Virginia since 1979, using a combination of live and pitfall trapping methods. This smallest rodent of eastern North America also is one of most versatile, occupying a range of habitats in southeastern Virginia from old fields in different stages of succession, brushy edges, and forests of different types. As with other species of Reithrodontomys, R. humulis often is associated with the Hispid Cotton Rat, Sigmodon hispidus, with both reaching modest densities in old fields. Two capture-mark-release studies of small mammal communities in southern Chesapeake lasting …

Enhancing The Productivity, Competitiveness And Independence Of Productive Cooperatives In Egypt / تحسين الانتاجية والتنافسية والاستقلالية للتعاونيات الإنتاجية بمصر, Yomna Mohamed Gamil Esmat Jan 2019

Enhancing The Productivity, Competitiveness And Independence Of Productive Cooperatives In Egypt / تحسين الانتاجية والتنافسية والاستقلالية للتعاونيات الإنتاجية بمصر, Yomna Mohamed Gamil Esmat

Papers, Posters, and Presentations

This paper sheds light on the conceptual framework of productive cooperatives, identifies the distinctive characteristics of this type of enterprises and examines the economic and social relative importance of the sector. Based on the importance of the cooperatives sector at the international level, and because of the many local efforts in Egypt that are aimed at promoting cooperatives at large, this paper identifies areas which need to be attended to by suitable legesilative and policy support and also examines selected international experiences, in order to draw lessons learned that can positively reflect on the situation in Egypt.

Long-Term Effects Of Teacher Training And Other Intervening Factors On Teaching Styles Of Foreign-Language Instructors, Hamid Mohammed-Ahmed Jan 2019

Long-Term Effects Of Teacher Training And Other Intervening Factors On Teaching Styles Of Foreign-Language Instructors, Hamid Mohammed-Ahmed

Doctoral Dissertations

This study investigated the long-term effects of a learner-centered-oriented-teacher training on teaching styles of foreign-language instructors at a multilanguage institute to assess the relationship between the training and the teaching practice. A mixed-method design was employed, and the data were collected from 165 participants who took the Principles of Adult Learning Style (Conti, 1978, 2004) and who provided their written reflections on the training, in addition to follow-up interviews with 12 language instructors. Results of one-sample t tests showed statistically significant differences between the teaching styles of language instructors at the institute and the general population of adult educators indicating …

Scanning Probe Microscopy Measurements On 2d Materials And Iridates, Armin Ansary Jan 2019

Scanning Probe Microscopy Measurements On 2d Materials And Iridates, Armin Ansary

Theses and Dissertations--Physics and Astronomy

In the past two decades, there has been a quest to understand and utilize novel materials such as iridates and two-dimensional (2D) materials. These classes of materials show a lot of interesting properties both in theoretical predictions as well as experimental results. Physical properties of some of these materials have been investigated using scanning probe measurements, along with other techniques.

One-dimensional (1D) catalytic etching was investigated in few-layer hexagonal boron nitride (hBN) films. Etching of hBN was shown to share several similarities with that of graphitic films. As in graphitic films, etch tracks in hBN commenced at film edges and …

A Detection And Data Acquisition System For Precision Beta Decay Spectroscopy, Aaron P. Jezghani Jan 2019

A Detection And Data Acquisition System For Precision Beta Decay Spectroscopy, Aaron P. Jezghani

Theses and Dissertations--Physics and Astronomy

Free neutron and nuclear beta decay spectroscopy serves as a robust laboratory for investigations of the Standard Model of Particle Physics. Observables such as decay product angular correlations and energy spectra overconstrain the Standard Model and serve as a sensitive probe for Beyond the Standard Model physics. Improved measurement of these quantities is necessary to complement the TeV scale physics being conducted at the Large Hadron Collider. The UCNB, 45Ca, and Nab experiments aim to improve upon existing measurements of free neutron decay angular correlations and set new limits in the search for exotic couplings in beta decay. To …

Prime-Boost Vaccine Regimen For Sjtpl And Sjc23 Schistosome Vaccines, Increases Efficacy In Water Buffalo In A Field Trial In China, Akram A. Da'dara, Changlin Li, Xinling Yu, Mao Zheng, Jie Zhou, Lisa M. Shollenberger, Yue-Sheng Li, Donald A. Ham Jan 2019

Prime-Boost Vaccine Regimen For Sjtpl And Sjc23 Schistosome Vaccines, Increases Efficacy In Water Buffalo In A Field Trial In China, Akram A. Da'dara, Changlin Li, Xinling Yu, Mao Zheng, Jie Zhou, Lisa M. Shollenberger, Yue-Sheng Li, Donald A. Ham

Biological Sciences Faculty Publications

Schistosomiasis remains a serious zoonotic disease in China and the Philippines. Water buffalo and cattle account for the majority of transmission. Vaccination of water buffalo is considered a key strategy to reduce disease prevalence. Previously, we showed that vaccination of water buffalo with SjC23 or SjCTPI plasmid DNA vaccines, induced 50% efficacy to challenge infection. Here, we evaluated several parameters to determine if we can develop a two dose vaccine that maintains the efficacy of the three dose vaccine. We performed four trials evaluating: (1) lab produced vs. GLP grade vaccines, (2) varying the time between prime and boost, (3) …

Diversity Of Nitrogen-Fixing Symbionts Of Chamaecrista Fasciculata (Partridge Pea) Across Variable Soils, Hanna E. Dorman, Lisa E. Wallace Jan 2019

Diversity Of Nitrogen-Fixing Symbionts Of Chamaecrista Fasciculata (Partridge Pea) Across Variable Soils, Hanna E. Dorman, Lisa E. Wallace

Biological Sciences Faculty Publications

We evaluated whether geographic distance and soil characteristics influence genetic structure of nitrogen-fixing bacterial symbionts associated with the host plant Chamaecrista fasciculata (Partridge Pea). We tested phylogeographic clustering and associations between genetic distance, geographic distance, and soil variables using sequences of 2 bacterial genes and soil chemistry across 23 sites in Mississippi. We identified rhizobia isolated from Partridge Pea as Bradyrhizobium. We detected significant genetic structure at a regional level, and determined that rhizobia within each region were more phylogenetically related than expected. Significant correlation between genetic distance and distances based on soil chemistry suggests environmental influences on rhizobia …
