As numerous governments and commercial entities plan ambitious expeditions into outer space and to celestial bodies, humanity’s heritage in space is threatened. Fifty years following the Apollo 11 landing, we have recognized the historic, scientific, and cultural importance of this event and other spacefaring firsts, but the existing means to protect the resulting heritage is inadequate. This Article examines the protections currently available to those objects and sites that represent the great achievements of humankind in using and exploring space, with a focus on Tranquility Base—the Apollo 11 landing site. Space, The Final Frontier For Negligence Suits—Why Commercial Space Operators Should Be Liable For Personal Injuries To Space Flight Participants, Andrea Reed

The commercial space transportation industry is rapidly approaching the first launches of paying passengers into space—a technological and legal milestone for the maturing sector. Unfortunately, the liability regime governing the relationship between commercial space operators and spaceflight participants inadequately protects private passengers’ safety and financial interests. As part of the Commercial Space Launch Competitiveness Act of 2015 (CSLCA), Congress enacted negligence waiver and informed consent requirements that shift almost all legal liability onto spaceflight participants for death or bodily injury caused by an operator’s negligence. Private citizens should not bear the risk of these accidents.

Preventing Drunk Flying: A Legislative Solution, John Sivils

Journal of Air Law and Commerce

Drunk flying poses a serious safety risk to airline passengers. The current system of detecting pilot intoxication and preventing drunk flying relies on the vigilance of coworkers, and statutes prohibiting “operating” an airplane while intoxicated. Courts have stretched the meaning of “operating” to criminalize pre-flight conduct, such as fueling and visual airplane checks. When viewed in conjunction with courts’ inconsistent and varied application of preemption doctrine to federal and state regulations of flying, it is evident that courts are tightening control over flight and pre-flight activities through complex judicial interpretation of facially simple statutes. The Effects Of A Makerspace Curriculum On The 4c'S In Education, Staci Novak

Makerspaces are becoming more common in schools K-12 as well as at the university level and encourage educators to think differently about learning. This review examines how a makerspace curriculum impacts the way in which learners apply the 4 C’s (creativity, critical thinking, collaboration, and communication). Thirteen peer-reviewed research studies published between 2014 and 2018 were selected for analysis. The reviewed research studies indicated that students who participate in makerspaces tend to use their creativity to problem-solve, are communicative and collaborative with other makers, and tend to use critical thinking skills when presented with an obstacle. This Article dives into the long-standing debate about the propriety of altering the time-honored Federal Rules of Evidence. Noted authorities, such as the late Chief Justice Rehnquist, have eschewed any modification to the Rules, claiming that they must remain essentially fixed in their original form to maximize their utility to trial advocates and to avoid wasteful dislocation costs that accompany updates. On December 28, 2017, the federal Department of Health and Human Services ("HHS") settled its fiftieth case involving potential violations of the privacy, security, and breach notification rules ("Rules") that implement the Health Insurance Portability and Accountability Act ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HITECH"). Student engagement in novels is a key factor in whether or not a student can be successful in reading. The purpose of this study was to analyze student engagement with graphic novels and traditional novels, and to describe any preferences students had when selecting novels to read independently. The study was centered around two questions: How does the reading of graphic novels impact the level of reading engagement? Do students prefer the use of graphic novels over traditional novels within their own independent reading? This dissertation focused on whether managers affect employee performance and turnover. In particular, this research focused on multinational organisations in Ireland. The focal point was to gain an understanding of this topic from a manger and employee point of view. For the sake of this research the managers that were involved were only managers of employees and not other managers.

This research project adopts a mixed research method of data collections. It applies both face to face interviews with managers and online questionnaires with employees.

Background: Ensuring adequate rest and recovery is critical for the avoidance of overtraining and the achievement of optimal performance, therefore it is recommended that training load and recovery be continually monitored throughout the training year. The purpose of this research was to investigate training load and markers of wellness among elite Gaelic footballers to assist the regulation of such loading to optimise performance in an amateur sports setting.

Background

Nosocomial infections pose a challenge to the medical field and are a global safety issue for both patients and health care providers. In developing countries, the magnitude of the problem remains underestimated and literature is very scarce. Some nosocomial infections spread via contaminated medical equipment such as stethoscopes. No data reported from Tanzania about the potential role of stethoscopes in spreading these infections.

Code crashes. Yet for decades, software failures have escaped scrutiny for tort liability. Those halcyon days are numbered: self-driving cars, delivery drones, networked medical devices, and other cyber-physical systems have rekindled interest in understanding how tort law will apply when software errors lead to loss of life or limb.

Even after all this time, however, no consensus has emerged. Many feel strongly that victims should not bear financial responsibility for decisions that are entirely automated, while others fear that cyber-physical manufacturers must be shielded from crushing legal costs if we want such companies to exist at all.
