This Note examines the history of the social-visibility requirement for Particular Social Groups in Eleventh Circuit asylum claims and the adjudication disparities that have resulted from its imposition in the southeastern United States. Part I of this Note introduces the asylum application process, examines the historical treatment of Particular Social Groups nationally, and traces the recent restrictions on Particular Social Groups within the Eleventh Circuit in particular. Part II compares the Eleventh Circuit’s treatment of Particular Social Groups to treatment in the Third and Seventh Circuits and considers how previously successful claims for asylum would fare under the current state …

The purpose of this study was to explore the relationship between physical fitness and academic skills among a group of 110 aircrew flight officers. The study compared Air Force flight officers’ physical fitness scores to academic skills. Prior research suggests a person’s physical fitness levels are directly related to academic skills; however, current research has not addressed a military aviation population. This study used regression analysis to examine the relationship between physical fitness scores as tested by the Air Force physical fitness test (predictor instrument) and academic skills as tested by the Wechsler Fundamentals: Academic Skills Numerical Operations Sub-Test (criterion …

As countries embrace innovative technologies, thus increasing the speed of interstate communication, the overall nature of interactions between states is changing. Consequently, core diplomatic structures are shifting from the private realm to the public sphere. I argue that Information Communication Technology (ICT) is the major agent of this shift. Less distance between electorates and diplomatic agents due to ICT allows the public to more directly influence international diplomacy. By studying the impact of the telegraph, telephone, Internet, etc., this study examines ICT’s influence on diplomacy, contending that the trend toward an increased dependence on technology will mark another pivotal moment …

The events of the twentieth century were undoubtedly some of the most significant in human history. Exponentially increasing levels of military technology combined with antiquated methods of peacekeeping and archaic systems of government in Europe meant that by the middle of the century the world would see international conflict on an unprecedented scale. This paper aims to examine the role of United States in these events and to question, with the benefit of hindsight, whether the path taken by the Wilson administration was the most prudent.

Prior research across disciplines has established the value of dialogic, whole-class discussions. Previous studies have often defined discussions in opposition to the notorious triadic pattern called recitation, or IRE/F, focusing on variations to the teacher’s initiating question or evaluative follow-up on students’ responses. Recent scholarship has also identified variations on recitations and dialogic discussions that suggest these categories might be flexible, containing types of interaction associated with particular contexts. These uniquely designed materials use coherent electron oscillations to accomplish an astonishing array of tasks, and they present diverse opportunities in many scientific fields.
This paper consists of an explanation of the scientific background of PMMs and some technological applications of these fascinating materials. The Navy’s Littoral Combat Ships were designed to be relatively small surface vessels for operations near a littoral shore theater. These ships were envisioned to be highly automated, networked, agile, stealthy surface combatants capable of defeating anti-access and asymmetric threats in the littorals with minimum manpower. To date, however, some of these ships have experienced significant engineering and propulsion plant failures that impacted mission accomplishment and were attributable, at least in part, to under staffing and over scheduling the human component of the automation-human operational environment. This paper explores the underlying, foundational politico-social theories and themes that relate closely to radicalization, terrorism, democracy and the rule of law. It examines factors (touchstones) critical to these areas (political violence, terrorism, rule of law and democracy, along with democratic institutions). The purpose of this study is to identify the age, country and place of origin, function (e.g. fusil, pistol), and intended use (e.g. military, trade gun) of flintlock components recovered from Fort St. Joseph (20BE23), an eighteenth-century French mission-garrison-trading post in southwest Michigan. Flintlock muskets were a vital technology in New France throughout the fur trade era, both in their roles as weapons and as hunting implements. They were also important because their relatively complex nature necessitated localized, frontier supply and repair; their use and maintenance were integrated into many facets of frontier life. On October 30, 2017, the General Assembly of Pennsylvania passed an act that repealed the state’s fireworks law, which had prohibited the sale of most fireworks to Pennsylvanian consumers for nearly 80 years. The law’s replacement generally permits Pennsylvanians over 18 years old to purchase, possess, and use “Consumer Fireworks.” Bottle rockets, firecrackers, Roman candles, and aerial shells are now available to amateur celebrants for holidays like Independence Day and New Year’s Eve. The law also regulates a category of larger “Display Fireworks,” sets standards for fireworks vendors, and introduces a 12-percent excise tax on fireworks sales that serves to …

The legal regime regulating cross-border investment gives key rights to foreign investors and places significant duties on states hosting that investment. It also raises distinctive moral questions due to its potential to constrain a state’s ability to manage its economy and protect its people. Yet international investment law remains virtually untouched as a subject of philosophical inquiry. The questions of international political morality surrounding investment rules can be mapped through the lens of two critiques of the law – that it systemically takes advantage of the global South and that it constrains the policy choices of states hosting investment. Many recent assessments of space power have posited a US decline and predicted a gloomy future in comparison to China and Russia. However, such analyses—based almost exclusively on state-run activities—present only part of the picture. In the twenty-first century, a new form of bottom-up, net-centric, commercially led space innovation is emerging that promises cheaper and more timely technological developments to those nations that can effectively tap into them, thus reshaping traditional definitions of space power. Modern conflict is dominated by proxy wars but the United States military fails to account for this type of environment. Instead, it speaks euphemistically by using phrases like, By, With, and Through to articulate the complexities of proxy environments. In doing so, it falls short in understanding the dynamics at work between actors in a proxy relationship, which has resulted in it doing poorly in modern proxy wars. Lasers are a common tool in standoff detection because of their small divergence, large amount of power, and multiple wavelengths available for optical interaction. Optical signatures of targets can be composed of but are not limited to absorption, fluorescence, backscatter, polarization manipulation, and plasma spectra. This work was an investigation of a new signature phenomenon: Dispersion of middle infrared ultrashort laser pulses through gas and vapor phase molecules. Vibrational and rovibrational absorption lines of molecular species affect the spectral phase and spectral amplitude of ultrashort light pulses leading an inititally gaussian temporal profile to become distorted. This thesis is a theoretical meditation on the modern project of education. Situated in the broad field of critical studies in education, this work aims to consider the work of Hannah Arendt and Jacques Ranciere in context of the contemporary rationalities and technologies of schooling. The West Virginia Mine Wars are etched in the popular memory of West Virginians, who view these events as an important part of their identity as Mountaineers; yet, there is still much historians do not know about the Mine Wars, especially when concentrating on the perspectives and experiences of the working-class miners. These everyday miners and their families are the topic of this thesis. Using oral histories from the Matewan Development Center Records housed in the W.L. Indigenous dispossession and environmental devastation are intertwined outcomes of settler colonialism’s cycle of violence. However, indigenous people continue to draw from cultural and spiritual teachings to resist such forms of violence, and engage in what Leanne Simpson calls “radical resurgence.” Our paper analyzes the Yakama elders’ teachings about Tma’áakni (Respect), to examine principles and forms of indigenous resistance and resurgence, demonstrated by indigenous students in support of the NoDAPL(No Dakota Access PipeLine) movement. Cultural Impairment And The Genocidal Potential Of Intoxicants: Alcohol Use In Colonial North America, Elena Lesley

As a number of scholars have noted in recent critical genocide studies, Raphael Lemkin’s formulation of the “genocide” concept was much broader than the definition later enshrined in the UN Convention. Various facets of settler colonialism framed his conception, including the widespread distribution of intoxicants among subjugated peoples. In Lemkin’s view, culture was the force undergirding human collectivities and intoxicants disrupted social functioning in a number of ways -- through creating internal strife and violence, upsetting previous authority structures, causing premature deaths and eroding pre-existing cultural practices. This article draws upon Lemkin’s unfinished works to examine his case for the …

This paper offers a new ethical and legalframework for undercover warfare. It begins by criticizing the traditional reasoning for the duty to wear unform. It demonstrates the insufficiency of the principle of 'distinction'. which dominates current discourse. It argues, instead, that the rationale for the duty to wear unforms is based on a new principle in international law that this paper advocates: the principle of accountability. The active form of global accountability requires some degree of states' transparency about their military activity. This allows other states to respond by exercising passive form of accountability and punish violations of international law. …

In this article, we outline the significance of the special issue on the scholarship of Raphaël Lemkin. We argue that genocide scholars tend to identify with one of three different types of Lemkin scholarship. Each of the articles for the special issue challenges these genres in an effort to extend the study of genocide in new directions. Moreover, we contend that this work suggests that genocide scholars should endeavor to extend the study of genocide beyond Lemkin's vision and writings.

This paper is an exploration of genocide prosecutions since the inception of the term in 1944 by Raphael Lemkin, its legal definition by the United Nations in 1948, and the eventual establishing of the International Criminal Court in 1998. The paper is in three parts. The first part examines the history of genocide legislation, particularly the international legal frameworks established since Lemkin first devised the term in 1944. The second part details, for the first time, the extent of genocide prosecutions to date. The Soviet Union played a major role in the establishment of the International Military Tribunal (IMT) that tried Nazi Germany’s leaders for their criminal actions at Nuremberg. Only a handful of Western scholars have noted that the Soviets were early proponents of the use of the legal principle of conspiracy and in establishing the principle that a war of aggression in and of itself could be legally construed as a criminal act.
