Dewan Perwakilan Rakyat Dan Majelis Permusyawaratan Rakyat Dalam Proses Impeachment Presiden Abdurrahman Wahid, Kukuh Bergas

Jurnal Hukum & Pembangunan

As a country that uses presidential systems, Indonesia realizes that the role of the president as an executive is powerful. Therefore it is necessary to establish legal rules or supervisory institutions as a counterweight to avoid abuse of authority. The DPR and MPR are legislative institutions whose task is to oversee the performance of the president. If a suspected violation is found, the DPR may submit a proposal for the dismissal of the president. Indonesia's 4th President experienced this case, K. H. Abdurrahman Wahid is also known as Gus Dur, because he was considered to have committed a violation which …

The historical background of contractual choice of law is still hardly discussed in the literature of Indonesian private international law. The available literature merely focuses on the scope and limitation of the choice of law. The choice of law is accepted and discussed as a widely acknowledged doctrine without sufficiently addressing its origin and evolvement until it became the concept as we understand to date. Employing an exposition through the academic literature, this article studies the narrative that began the idea of contractual choice of law up to the end of the 19th century as an intricate idea in private …

Ketetapan Mpr Dalam Tata Urutan Peraturan Perundang-Undangan Di Indonesia, Nisrina Irbah Sati

Jurnal Hukum & Pembangunan

As a result of deliberation and representation based democracy in Indonesia, the UUD 1945 before the amendment presented MPR as the highest state institution that absorbed people's sovereignty, so it gained legitimacy to be a superordinate of state institutions in various branches of power. The MPR’s position as the highest state institution was also accompanied by a legislative function, in which the MPR was able to make its legal product known as Tap MPR. The change in the position of the MPR, which was no longer the highest institution of the state in the constitutional structure since the enactment of …

Intergovernmental Relations In A World Of Governance: A Consideration Of International Experiences, Challenges, And New Directions, Grichawat Lowatcharin, Charles David Crumpton, Sittipol Pacharoen

Asia-Pacific Social Science Review

The concept of intergovernmental relations (IGR) primarily focuses on the interactions among different levels and types of governments. With the proliferation of the concept of governance that calls for more actors in the public affairs arena, the traditional focus of IGR is challenged. The objectives of this article are to perform a fresh review of the concept of IGR and the practice of IGR research and to address contemporary challenges to them. We find that although the pervasive concept of governance has played an important role in IGR, it is confronted with a number of crucial questions, one of which …

Humanitarianism, Sovereignty, And Asean Mode Of Governance: Another Perspective From The Global South, Nandang Sutrisno Dec 2019

Humanitarianism, Sovereignty, And Asean Mode Of Governance: Another Perspective From The Global South, Nandang Sutrisno

Asia-Pacific Social Science Review

As the world has become increasingly more connected, the nature of humanitarian problems has also become transnational. To confront them, as a consequence, international cooperation is inevitably needed. In particular, the ongoing Rohingya crisis is the latest example that showcases the state-centered model of ASEAN (or the Southeast Asian) model of regional cooperation that has failed in the area of humanitarian management. Furthermore, it suggests that ASEAN has abandoned the very purpose of its existence as it was conceived in its founding document, the Bangkok Declaration. Against this background, this paper argues that the region’s failure cannot be separated from …

Understanding The Role Of Consciousness In Maruyama’S Political Philosophy, Pamela Ann J. Boongaling Dec 2019

Understanding The Role Of Consciousness In Maruyama’S Political Philosophy, Pamela Ann J. Boongaling

Asia-Pacific Social Science Review

In this paper, I will argue that Masao Maruyama’s concept, basso ostinato, is best understood in conjunction with the evolution of the term consciousness in Japanese intellectual thought. Doing so allows us (1) to provide a more charitable interpretation of Maruyama’s basso ostinato and (2) to supply a more methodological account of Maruyama’s political philosophy. Such an interpretation of Maruyama’s views also enables us (3) to demonstrate the continuous significance and applicability of his framework and methodology as I use his basso ostinato to show why Japan’s “education-based nation” policy cannot sustain its post-war form of ultranationalism due to the …

The Administrative Performance Of The Laguna Lake Development Authority On The Small Lakes Of The Laguna De Bay Region, Philippines, Bing Baltazar C. Brillo, Rolando R. Bello, Evelie P. Serrano

Asia-Pacific Social Science Review

Few studies have dealt with small lakes in the Philippines, particularly aspects of their governance, which translate to information deficit on the status of administration of many lakes in the country. At the core of governance in any lake is its administrative agency, and in the eight crater lakes of San Pablo City, it is the Laguna Lake Development Authority (LLDA). Under this context, this article examines the administrative performance of the LLDA on the eight small lakes (i.e., Sampaloc Lake, Bunot Lake, Palakpakin Lake, Calibato Lake, Mohicap Lake, Pandin Lake, Yambo Lake, and Tadlac Lake) of the Laguna de …

Climate-Driven Insect Herbivory In Mixed Coast Live Oak Woodlands Within The Mt. Hamilton Range, Santa Clara County, Michelle Domocol Dec 2019

Climate-Driven Insect Herbivory In Mixed Coast Live Oak Woodlands Within The Mt. Hamilton Range, Santa Clara County, Michelle Domocol

Master's Theses

Climate change is expected to dramatically alter and destabilize critical functions of oak woodlands (Quercus spp.) in California. Oak woodlands support hundreds of vertebrate species and thousands of native insect species. Climate-driven changes in annual temperature, annual rainfall, and spatial climatic variability may increase insect herbivore pressures on mixed coast live oak (Quercus agrifolia) woodlands. The Mt. Hamilton Range of Santa Clara County, California offers a unique matrix to study oak-insect herbivore relationship using elevation as a proxy for climate change. This thesis research assessed the relationship between lepidopteran herbivory and coast live oak with insect surveys and the laboratory …

Chemical Composition And Behavioural Responses Of Male And Female Bactrocera Dorsalis To Their Volatile Emissions, Fikira Kimbokota Dec 2019

Chemical Composition And Behavioural Responses Of Male And Female Bactrocera Dorsalis To Their Volatile Emissions, Fikira Kimbokota

Journal of Humanities and Social Sciences

Bactrocera dorsalis, (Tephritidae) presented a grave threat to a broad range of fruit and vegetables in the tropics, including Tanzania. Bactrocera dorsalis is among the most destructive tephritid fruit fly, causing devastating loss of fruits especially mango. Insects use olfactory cues to locate hosts, oviposition sites and mating, in which pheromones are believed to be a strong cue used by insect to locate their mates. However, due to their high ability to adapt and occupy different ecological niches into various agroecological zones, there is a need to evaluate pheromonal composition from time to time to improve their control strategies. Therefore, …

The current study analyses newspaper headlines in respect to three categories: international, local, and business news (irrespective of the geographical scope) of two English dailies: a government-owned Daily News, and a privately-owned The Guardian. The study sought to analyse newspaper headlines guided by semantic under-determinacy, an important theoretical framework in accounting for a balance between linguistic economy that characterises newspaper headlines and communicative precision. The data were collected via documentary review. The headlines were analysed under three categories: local, international, and business news that included local and international spectrums. A total of 2004 headlines were randomly selected for analysis: 1088 …

Psychoanalytic Interpretation Of Marina’S Character In Kyomuhendo’S Secrets No More, Esther J. Masele, Deogratias M. Kisweka Dec 2019

Psychoanalytic Interpretation Of Marina’S Character In Kyomuhendo’S Secrets No More, Esther J. Masele, Deogratias M. Kisweka

Journal of Humanities and Social Sciences

Based on the assumption that characters in a literary text are true representations of human beings, this paper intends to interpret Kyomuhendo’s characterization of Marina in Secrets No More, applying psychoanalytic theory thereby, authenticating Freud’s concept of personality in the understanding of characters’ deeds in the novel. Taking into consideration that Freud’s psychoanalysis is a wide and complex theory, this paper focuses on the basics of ‘Id’, ‘Ego’ and ‘Super-ego’ as modes of interpretation to evaluate the effectiveness of the theory in providing a deeper understanding of a character’s personality and meaningful interpretation of a text. In the same context, …

I Don’T Know How To Talk About These Wor(L)Ds, But I Do Walk, I Shoot, And I Write: Autoethnographic Written And Visual Cures For A Fragmented Identity, Ursula-Helen Kassaveti

The Qualitative Report

In this article, I examine how my unprogrammatized and spontaneous informal fieldwork in Athens, undertaken in a rather unconsciously autoethnographic vein, has helped me while on the process of investigating my personal identity. My temporary change of academic direction and my delving into the ocean of fieldwork have shaped and answered my endless quest for important answers about a researcher’s own self. Through the use of written text, photography and other visual indexes, “thin” and “thick” description, I argue that autoethnography as a method could be a healing process, providing therapy for a researcher’s “fragmented” heart and identity.

Disaster Resilience As Communication Practice: Remembering And Forgetting Lessons From Past Disasters Through Practices That Prepare For The Next One, Rebecca M. Rice, Jody L. S. Jahn

Communication Studies Faculty Research

Communities learn important lessons about their vulnerabilities from disasters. A crucial aspect of resilience is how communities apply past lessons to prepare for future events. We use a practice lens to examine how communities remember and forget lessons through everyday communication surrounding their preparedness activities. We analyze two cases of disaster preparedness in one community. The first site, a local Office of Emergency Management, adapted national policies to the community while also keeping local disaster lessons in mind (i.e. remembering lessons). The second site represented an intractable conflict between the U.S. Forest Service and a community group that inhibited the …
