Open Access Master's Theses

Literally translated, Wergild is an Anglo-Saxon word that means “man-price.” Wergild can broadly be defined as the compensation owed for the injury of another. Wergild grew exponentially between the formation of the first written law code and those that followed. The later laws emphasized both material wealth as well as land ownership in the settlement of disputes. They also integrated oaths into the legal system. Later wergild laws also gave more power to the king within society, allowed the king to secure revenue through additional means, protected the population from decimation, prevented needless feuding over murder and assault, as well …

The ideas I examine allow me to further the dialogue concerning quintessential questions pertaining to anti-Black racism that arise from the Black experience in America that are now reformulated to help African Americans respond to current forms of anti-Black racism. Have Black intellectuals historically accepted shared responsibility for racism? Do contemporary shared responsibility models hold African Americans responsible for anti-Black racism? Is national minority status a viable response to anti-Black racism? In each chapter, I enter the respective …

(Un)Civil Denaturalization, Cassandra Burke Robertson, Irina D. Manta Jan 2019

(Un)Civil Denaturalization, Cassandra Burke Robertson, Irina D. Manta

Hofstra Law Faculty Scholarship

Over the last fifty years, naturalized citizens in the United States were able to feel a sense of finality and security in their rights. Denaturalization, wielded frequently as a political tool in the McCarthy era, had become exceedingly rare. Indeed, denaturalization was best known as an adjunct to criminal proceedings brought against former Nazis and other war criminals who had entered the country under false pretenses.

Denaturalization is no longer so rare. Naturalized citizens’ sense of security has been fundamentally shaken by policy developments in the last five years. The number of denaturalization cases is growing, and if current trends …

A Political Interpretation Of Vagueness Doctrine, Guyora Binder, Brenner M. Fissell Jan 2019

A Political Interpretation Of Vagueness Doctrine, Guyora Binder, Brenner M. Fissell

Hofstra Law Faculty Scholarship

The “void-for-vagueness” doctrine requires the specific definition of criminal offenses. In this Article, though, we claim it does more: it largely restricts criminalization decisions to legislatures, which are unlikely to criminalize conduct they see as both harmless and widespread. Thus, rather than constitutionalizing the harm principle and thereby assuming a judicial obligation to define harm, the Supreme Court has used the vagueness doctrine to constrain majorities to make their own assessments of harmfulness. While American law has no explicit requirements that criminal liability be created by legislation or conditioned on harm, the vagueness doctrine achieves those ends indirectly.

Judge Damon Keith: The Judicial Antidote To Judge Julius Hoffman - Challenging Claims Of Unilateral Executive Authority, Ellen Yaroshefsky

Hofstra Law Faculty Scholarship

From some of the highly-publicized trials of the 1960's - namely the trials of the Chicago Eight, Panther Twenty-One, Weathermen - we can draw indispensable lessons about the role of the judges in upholding and promoting a fair justice system. The contract to Judge Julius Hoffman's notorious injudicious conduct in the Chicago 8 case is the courageous, thoughtful Judge Damon Keith, in the less publicized White Panther case in Detroit in the early 1970's. Judge Keith's overriding sense of fairness, exemplified the best of judicial independence in considering President Nixon's claims of unilateral executive authority in US v. Ayers and …

Explaining Criminal Sanctions In Intellectual Property Law, Irina D. Manta Jan 2019

Explaining Criminal Sanctions In Intellectual Property Law, Irina D. Manta

Hofstra Law Faculty Scholarship

This symposium piece first seeks to unpack the relationship between intellectual property infringement and property offenses, and then to understand how the connection between the two has informed when the former is criminalized. The piece examines the porous nature of the boundary line between intangible and tangible resources, showing the at-times uncomfortable fit of the non-rivalrous label to intellectual property. An analysis of the respective harms of the two types of violations follows. This symposium contribution shows how lawmakers have treated patents differently from other forms of intellectual property by choosing not to criminalize their infringement, due both to utilitarian …

Exploring Typology Categorizations Of Male Perpetrators: A Methodology Study, Emilyl N. Weber, Ashely R. Taylor, Arturo L. Cantos, Barbara G. Amado, K. Daniel O'Leary

Psychological Science Faculty Publications

Intimate partner violence (IPV) perpetrators were categorized based on whether they were generally violent (GV) or family only violent (FO) using self-report or arrest records. Classification criteria to assess recidivism in perpetrators of IPV were evaluated herein to determine the incremental validity of using a perpetrator’s criminal history in addition to their self-report information for categorization purposes. The concordance rates for categorizing subtypes of male perpetrators were compared for two methods, namely, self-report versus criminal history data. Categorizations were made based on self-reported history of violence and federal criminal records separately. Between measures consistency was defined as whether or not …

Essays: Color-Blind Or Race-Conscious Policies, Gus Castro, Hannah Lyons, Anna Eager, Jonathan Panton

Res Publica - Journal of Undergraduate Research

The debate between advocates color blind and race conscious policies has been perennial in the United States since Reconstruction and has recently been resuscitated in the popular press with the publication of Michelle Alexander’s The New Jim Crow: Mass Incarceration in the Age of Color Blindness (2010). Alexander’s book provided support for the race conscious side and students read Nathan Glazer’s Affirmative Discrimination: Ethnic Inequality and Public Policy (1975) for a defense of the color blind side. The debate was framed in an even-handed manner by a selection from Desmond King and Rogers M. Smith’s Still a House Divided: Race …

The Development And Validation Of The Attitudes Towards Individuals Who Sell Sex Inventory (Atiss), Madeline Rae Stenersen

Electronic Theses and Dissertations Archive

Previous research regarding public and individual attitudes about individuals who sell sex (ISS) suggest these attitudes have a significant impact on how this population is treated in various facets of their life (e.g. mental and physical healthcare, occupational opportunities, and daily interactions with others). The manner in which researchers have measured attitudes about ISS has been historically inconsistent and does not encompass all ISS, often excluding subsections of the population such as men who sell sex. Therefore, the purpose of the current study is to develop and validate the Attitudes Towards Individuals Who Sell Sex Inventory (ATISS), an instrument designed …

The low income and poverty-stricken areas of Mississippi have historically suffered from low-test scores, low graduation rates, and a high concentration of special education students Additionally, poor, Black Mississippians have performed lower, have lower graduation rates, and score lower in college readiness than do students in the rest of the nation. Similar, Mississippi continues to rank last or near the bottom on national measures of reading achievement. To reverse this trend, in 2013 the Mississippi State Legislature passed the Literacy- Based Promotion Act to improve the literacy skills of students beginning in kindergarten and extending through third grade. The law …

Motivation To Call Police: The Exploration Of Racial And Risk Averse Motivation, Alivia Lauren Zubrod Jan 2019

Motivation To Call Police: The Exploration Of Racial And Risk Averse Motivation, Alivia Lauren Zubrod

Dissertations and Theses @ UNI

When calls are made to the police, the magnitude of their impact is often overlooked. When calls are made to the police and there is no crime, police resources, time, and energy could be wasted (Sampson, 2002); however, when no call is made to the police and there is a crime, human lives could be put in danger (e.g., Felson, Messner, Hoskin, & Deane, 2002). Based on highly publicized news reports, it appears that being a racial minority is enough motivation to call the police in some situations (e.g., napping or humanitarian work; Griggs, 2018; Williams, 2018b). Aversive racism theory …

Foreign Affairs Prosecutions, Steven Arrigg Koh Jan 2019

Foreign Affairs Prosecutions, Steven Arrigg Koh

Faculty Scholarship

Contemporary global crime and cross-border law enforcement cooperation have multiplied “foreign affairs prosecutions,” cases that encompass foreign apprehension, evidence gathering, and criminal conduct, as well as cases that implicate foreign nations’ criminal justice interests. Robert Mueller’s Russia investigation, the fugitive Edward Snowden, and the cross-border crimes of FIFA and El Chapo all exemplify such foreign affairs prosecutions. This Article argues that foreign affairs prosecutions represent a consequential shift in U.S. criminal law, offering the promise of closing global impunity gaps. At the same time, however, such cases risk defendant interests at home and U.S. foreign policy abroad. This Article calls …
