The Role Of Therapeutic Communities In The Process Of Desistance: A Figurational Analysis, Darragh Farrell

Dissertations

The therapeutic community (TC) is predominantly used for the treatment of substance users. Its approach, which focuses on a strong sense of community, relies on the peer group itself as an agent of change. In one Irish TC, desistance from crime appears to be an unintended outcome of the social processes and cultural forces existing there. The current study utilises qualitative data collected from a small cohort of seven male therapeutic community graduates. All participants had histories of involvement in serious crime and had desisted to varying degrees. Using a figuarational approach, concerned with social processes, analysis of the data …

Privatizing Criminal Procedure, John D. King Jan 2019

Privatizing Criminal Procedure, John D. King

Scholarly Articles

As the staggering costs of the criminal justice system continue to rise, states have begun to look for nontraditional ways to pay for criminal prosecutions and to shift these costs onto criminal defendants. Many states now impose a surcharge on defendants who exercise their constitutional rights to counsel, confrontation, and trial by jury. As these “user fees” proliferate, they have the potential to fundamentally change the nature of criminal prosecutions and the way we think of constitutional rights. The shift from government funding of criminal litigation to user funding constitutes a privatization of criminal procedure. This intrusion of market ideology …

From Timbuktu To The Hague And Beyond: The War Crime Of Intentionally Attacking Cultural Property, Mark A. Drumbl Jan 2019

From Timbuktu To The Hague And Beyond: The War Crime Of Intentionally Attacking Cultural Property, Mark A. Drumbl

Scholarly Articles

This essay refracts the criminal conviction and reparations order of the International Criminal Court (ICC) in the Al Mahdi case into the much broader frame of increasingly heated public debates over the protection, removal, defacement, relocation, display and destruction of cultural heritage in all forms: monuments, artefacts, language instruction, art and literature. What might the work product of the ICC in the Al Mahdi proceedings -- and international criminal law more generally -- add, contribute or excise from these debates? This essay speculatively explores connections between the turn to penal law to protect cultural property and the transformative impulses that …

Will The Supreme Court Rein In “Excessive Fines” And Forfeitures? Don’T Rely On Timbs V. Indiana, Nora V. Demleitner Jan 2019

Will The Supreme Court Rein In “Excessive Fines” And Forfeitures? Don’T Rely On Timbs V. Indiana, Nora V. Demleitner

Scholarly Articles

The U.S. Supreme Court’s decision in Timbs v. Indiana buoyed the hopes of those who saw it as a powerful signal to states and municipalities to rein in excessive fines and forfeitures. One commentator deemed it “a blow to state and local governments, for whom fines and forfeitures have become an important source of funds.” That may have been an overstatement. The Court seems disinclined to fill the term proportionality with robust meaning or wrestle with Eighth Amendment challenges to fines and fees. Those steps would be required for the Excessive Fines Clause to function as an effective backstop against …

Saving Justice: Why Sentencing Errors Fall Within The Savings Clause, 28 U.S.C. § 2255(E), Brandon Hasbrouck Jan 2019

Saving Justice: Why Sentencing Errors Fall Within The Savings Clause, 28 U.S.C. § 2255(E), Brandon Hasbrouck

Scholarly Articles

Notwithstanding the extent to which scholars, lawyers, and community organizers are broadening their contestations of the criminal justice system, they have paid insufficient attention to federal sentencing regimes. Part of the reason for this is that sentencing is a “back-end” criminal justice problem and much of our nation’s focus on criminal justice issues privileges “front-end” problems like policing. Another explanation might be that the rules governing sentencing are complex and cannot be easily rearticulated in the form of political soundbites. Yet sentencing regimes are a criminal justice domain in which inequalities abound—and in ways that raise profound questions about fairness, …

Research needs to begin looking at new topics that have previously been ignored. Some of these topics include adult male victims’ personal experiences, male rape myths, female on male victimization, and societal perceptions. This research attempts to examine societal perceptions about adult …

Measuring The Impact Of Gun Theft On City-Level Gun Crime Rates, Thomas Senst Jan 2019

Measuring The Impact Of Gun Theft On City-Level Gun Crime Rates, Thomas Senst

Master’s Theses and Projects

The history of gun culture in the United States is complicated. Guns are an integral part of American history and attempts to control them through policy are often contentious. However, research suggests that gun crime occurs in areas where there are more guns (Braga, 2017; Braga & Pierce, 2005; Cook, Harris, Ludwig, & Pollack, 2015; Kennedy, 2011; Koper, 2013; Pierce, Braga, Hyatt, & Koper, 2004). Consequently, as gun accessibility increases within cities, the likelihood of gun crime also increases. When researching gun accessibility, it is important to note how guns are accessed. Often, guns are accessible in three ways: (1) …

#Metoo, Meet Inclusivity: Criminal Procedure In Sexual Assault Cases Should Include People With Intellectual Disabilities, Mercy Adoga

Fordham Undergraduate Law Review

This Note explores the legal history of criminal law involving sexual assault cases of persons with intellectual disabilities from 1989 to the present day. The nuances of this legal history will be analyzed through the lens of State v. Scherzer, otherwise known as the Glen Ridge case of 1989. This Note will analyze the effect the Glen Ridge case had on later cases, and how the criminal justice system continues to treat intellectually disabled survivors of sexual assault. Statistics show that people who have intellectual disabilities are more likely to be sexually assaulted, and that the conviction rate for these …

Connections Between Adolescents’ Parasocial Interactions And Recollections Of Childhood Imaginative Activities, Tracy R. Gleason, Sally A. Theran, Emily M. Newberg Jan 2019

Connections Between Adolescents’ Parasocial Interactions And Recollections Of Childhood Imaginative Activities, Tracy R. Gleason, Sally A. Theran, Emily M. Newberg

Faculty Research and Scholarship

Parasocial interactions (PSI; one-sided communication imagined with a media figure) in adolescence and imaginative activities in childhood, such as imaginary companions and role play, have a shared foundation in that both use imagination for social purposes. This commonality in both cognitive processes and social uses begs the question of whether they are related phenomena. We examined PSI’s connection to retrospective reports of childhood imaginative activities in the context of the social environment, including relationship functioning (attachment style, social support) and well-being (self-esteem, depressive symptoms), in 151 adolescents (Mage = 14.8 years). PSI and reports of childhood imagination were unrelated …

Opioid Epidemic, Amy Ford Jan 2019

Opioid Epidemic, Amy Ford

Integrated Studies

Most narcotics and non-synthetic drugs have medicinal values that have helped in treating various conditions in medical practice. Opium is a typical plant that has proved remarkable medicinal values. Opium extracts (opioids) are the most effective analgesics available for tackling pains. Unfortunately, while healthcare and pharmaceuticals exploited the health benefits of the substance, its dirty aspect (addiction) unveiled. As people developed dependence, the pharmaceutical players involved in opioids production increased quantities and enticed medical practitioners to increase prescriptions for the opioid-based painkillers. Consequently, the addiction grew, and healed patients continued the use that has led to widespread overdose and deaths. …
