The United States' Relationship With The Insanity Defense Before And After United States V. Hinckley, Natalie R. Peterman
The United States' Relationship With The Insanity Defense Before And After United States V. Hinckley, Natalie R. Peterman
Young Historians Conference
The United States legal system has had a fluctuating relationship with the insanity defense for decades, and the trial of United States v. Hinckley was a critical milestone for this development. Before John Hinckley, Jr. attempted to assassinate President Ronald Reagan in 1981 and the jury of his trial found him not guilty, American society generally supported the insanity defense, but both the public and the government were outraged after Hinckley’s verdict. This outrage and the subsequent political backlash against the insanity defense were motivated by progress in the area of mental illness treatment in the United States. In the …

Faculty & Staff Scholarship
Project FORESIGHT is a business-guided self-evaluation of forensic science laboratories across the globe. The participating laboratories represent local, regional, state, and national agencies. Economics, accounting, finance, and forensic faculty provide assistance, guidance, and analysis. Laboratories participating in Project FORESIGHT have developed standardized definitions for metrics to evaluate work processes, linking financial information to work tasks, and functions. Laboratory managers can then assess resource allocations, efficiencies, and value of services—the mission of Project FORESIGHT is to measure, preserve what works, and change what does not.

Villains, Morality, And Redemption: A Content Analysis Of Children’S Movies, Iqra Ishaq
Villains, Morality, And Redemption: A Content Analysis Of Children’S Movies, Iqra Ishaq
Senior Honors Projects
Research on children’s movies has yielded important findings on messaging about gender, race, ethnicity, sexuality, (dis)ability, mental illness, aging, and even death. All of this research has recognized the important role children’s movies play in children’s upbringing and informal education. Not only do children’s movies reflect the commonly-held values of the time, but they impart these values to their audience. Children, as the target audience of these movies, are extremely susceptible to absorbing these values and messages.
My research examines what messages children’s movies impart about villains. It includes a content-analysis of 80 full-length animated movies released by Disney, DreamWorks, …
Incarceration Or E-Carceration: California’S Sb 10 Bail Reform And The Potential Pitfalls For Pretrial Detainees, Ashley Mullen
Incarceration Or E-Carceration: California’S Sb 10 Bail Reform And The Potential Pitfalls For Pretrial Detainees, Ashley Mullen
Cornell Law Library Prize for Exemplary Student Research Papers
California’s bail system not only infringes on individual rights, but also exacerbates a cobweb criminal justice system. The In re Humphrey court framed the issue perfectly when it stated that the problem with the bail system stems “from the enduring unwillingness of our society, including the courts, to correct a deformity in our criminal justice system that close observers have long considered a blight on the system.” California sought to rectify this “deformity” of a wealth-based bail system by passing SB 10 (the California Money Bail Reform Act of 2017).
This Note addresses the arguments that will likely be raised …
Sentencing Persons Convicted Of Minor Offences In Ghana: Reducing Judicial Over-Reliance On Imprisonment, Nenyo Kwasitsu
Sentencing Persons Convicted Of Minor Offences In Ghana: Reducing Judicial Over-Reliance On Imprisonment, Nenyo Kwasitsu
LLM Theses
This thesis argues that there is overuse of imprisonment for minor offenders in Ghana. These are offenders whose punishments go up to 3 years of jail time, essentially offending mainly for reasons of material poverty. Statutory sentencing provisions have essentially limited judges to impose jail terms. It is argued that one way to decongest Ghana’s prisons is to consider the institutionalization of a regime of community service orders and probation, the administration of which would equip the offenders with income-earning skills while they also reform. Drawing on Kenya, a country that has achieved reasonable success in this reform effort, this …
An Analysis Of The Impact Of Immigration On The Labor Market And Economy, Shelby Lynn Weddle
An Analysis Of The Impact Of Immigration On The Labor Market And Economy, Shelby Lynn Weddle
Honors College
Immigration is major topic discussed in politics today, and an issue that I have become quite interested in over the last couple of years of studying political science and international relations. I interned last summer at the International Rescue Committee (IRC) of Abilene where I worked as an intensive case management caseworker, assisting clients with transportation to pay bills, set up social security, and bank accounts. This paper provides an overview of immigration, and then dives into the immigrant visa process which I learned about during my internship at IRC, the economic benefits of immigration, the importance of family-based immigration, …

Betrayals In Academia And A Black Demon From Ephesus, Suleman Lazarus
Betrayals In Academia And A Black Demon From Ephesus, Suleman Lazarus
Journal of Critical Issues in Educational Practice
The poem is about my PhD experience. The title and parts of the themes are derived from an incident in the Bible (Acts 19:13-20). In order to provide a deeper meaning to my story, I have deployed a biblical allusion which connects with the story of the sons of Sceva, who made unsuccessful attempts to exorcise a man from Ephesus. They failed primarily because they operated not in the spirit but in the flesh.

Associations Between Mmpi-2-Rf Scale Scores And Institutional Violence Among Patients Detained Under Sexually Violent Predator Laws, Anthony M. Tarescavage, Allen Azizian, Charles Broderick, Peter English
2019 Faculty Bibliography
Sexually violent predator (SVP) laws allow the postprison civil commitment of sex offenders to a secure psychiatric hospital because of mental abnormality and posing a serious risk to public safety. Research on predictors of future institutional violence in this population is lacking because adequately sized samples are difficult to obtain. In the current study, we examined psychological predictors of future institutional violence in a sample of 171 psychiatrically hospitalized males detained or civilly committed under an SVP laws. Using the Minnesota Multiphasic-Personality Inventory-2–Restructured Form (Ben-Porath & Tellegen, 2008/2011), we found that scales assessing thought dysfunction, emotional dysregulation, and externalizing behaviors …
The Thirteenth Amendment: Modern Slavery, Capitalism, And Mass Incarceration, Michele Goodwin
The Thirteenth Amendment: Modern Slavery, Capitalism, And Mass Incarceration, Michele Goodwin
Cornell Law Review
Slavery's preservation in the United State can-in part-be explained by its fluid transformations, which continuously exacted economic gains, preserved southern social order, and inured benefits to private parties as well as the state. These transformations did not outpace law. Rather, the rule of law in the south and lawlessness among local law enforcement frequently accommodated these transformations and innovations. Historically, efforts to stamp out the myriad forms of slavery-convict leasing, peonage, contract transfers, so-called "apprenticeships," and chain gangs-frequently fell short because of local collusion and complicity, weak federal interventions and protections, and violence. The specter of lynching, which included the …
Media Coverage Of Law Enforcement And Effects Of The Image Created, James Schultz
Media Coverage Of Law Enforcement And Effects Of The Image Created, James Schultz
Senior Theses
This paper examines a number of case studies and articles concerning media’s depiction of law enforcement and its effects on the officers’ duties to the public. Recent stories of excessive use of force by police throughout the country began a new generation of activists for civil rights, exposed to a more advanced news media. Nationwide coverage displayed an image of law enforcement which was overly aggressive. For citizens who have little to no interaction with law enforcement, this image being depicted is the only basis for definition of what is a “police officer”. Combined with the history of civil rights …

Parental Incarceration: The Childs Rights And Needs, Adam T. Bahr
Counselor Education Capstones
The population of minor children with an incarcerated parent has grown by 80% since 1991 (Glaze & Maruschak, 2008). Often referred to as the forgotten population, children of incarcerated parents can exhibit many setbacks, socially and psychologically. The effects of the trauma related to having a parent incarcerated include isolating functions, anxiety, low concentration in school, problems sleeping, juvenile incarceration, criminal behavior, depression, and vulnerability towards peer pressure. Without proper intervention, these children have a 70% chance of following their parents into incarceration which leads to a trend as intergenerational incarceration. When a parent is incarcerated, the child faces several …

Military Rules: Expert Qualifications, Admissibility Of Expert Testimony, And Competency Hearings, Joshua E. Kastenberg
Faculty Book Display Case
This book provides a comprehensive review of the many valuable roles that psychologists can play in courts-martial and how they can collaborate with military attorneys to make effective trial teams.
Even though psychologists are becoming increasingly important in military trials, many are unfamiliar with the unique nature of this system. Likewise, lawyers often do not know how to effectively utilize psychologists' expertise.
This volume thus offers much-needed guidance for civilian psychologists and military counsel alike.
The chapter authors are forensic psychologists and military legal personnel — including defense attorneys, prosecutors, and judges — who offer expert tips and strategies for …

Effect Of Prison Length Of Stay In Oregon, Mark Harmon, Christopher M. Campbell, Kris R. Henning, Brian Renauer
Criminology and Criminal Justice Faculty Publications and Presentations
Oregon’s Justice Reinvestment Initiative (JRI), “is an approach to spending resources more effectively with the goals of reducing recidivism, decreasing prison use, protecting the public and holding offenders accountable (Oregon Criminal Justice Commission, 2019).” To maximize the effectiveness of Justice Reinvestment programs, policy makers need to understand the relationship between imprisonment, particularly length of stay (LOS), and recidivism. Subsequently, the Oregon Criminal Justice Commission (CJC) sought to conduct a LOS study in Oregon similar to a study completed by Snodgrass et al (2011). The goal of Portland State University’s (PSU) analysis is to provide useful information for Oregon’s JRI effort …

The Lawyer As Superhero: How Marvel Comics' Daredevil Depicts The American Court System And Legal Practice, Louis Michael Rosen

This article will explore on the portrayal of lawyers and the legal system in Daredevil comic books, particularly issues published in the Twenty-First Century. Because the Daredevil movie and the first two seasons of the Netflix television series have already been examined from various legal perspectives in past articles, this piece will highlight legal storylines from the comics themselves. This exploration is important because writers of future Netflix seasons will surely draw story elements from the comics discussed here and will very likely adapt these exact stories, encouraging the larger television audience to seek out and read the original comics. …
