Solving The Opioid Epidemic In Ohio, Lacy Leduc May 2019

Solving The Opioid Epidemic In Ohio, Lacy Leduc

Journal of Law and Health

On May 31, 2017, Ohio Attorney General Mike DeWine took a step in fighting Ohio's opioid epidemic, bringing the first of many lawsuits against five top pharmaceutical companies. However, under Federal and State law, there is an exception called the Learned Intermediary Doctrine, which can absolve drug manufacturers of liability from any misconduct that might be found and transfer that liability to a treating physician. This exception is the way many drug manufacturers were able to avoid being held responsible in the past. This Note proposes that with the current pending lawsuit in the State of Ohio, an exception to …

Student Conduct Officers’ Perceptions Of Restorative Practices Based On Educational And Professional Background, Gregroy William Robert Weaver May 2019

Student Conduct Officers’ Perceptions Of Restorative Practices Based On Educational And Professional Background, Gregroy William Robert Weaver

Dissertations

Student conduct officers have the ability to provide learning and growth opportunities for every student with whom they interact (Hyde, 2014; Jackson, 2014). It is important that student conduct officers be willing and able to utilize an array of tools, including alternative dispute resolution techniques to provide learning experiences (Bennett, Gregory, Loschiavo, & Waller, 2014; Clark, 2014; Hyde, 2014; Waryold & Lancaster, 2008). The educational and professional experiences of the student conduct officer vary, as many institutions employ conduct officers with an educational background and others employ conduct officers with a more formal legal background (Hyde, 2014; Jackson, 2014). In …

Vile Transgressor Of The Womb : Prosecution And Persecution For Concealment In Puritan Massachusetts., Jennifer White May 2019

Vile Transgressor Of The Womb : Prosecution And Persecution For Concealment In Puritan Massachusetts., Jennifer White

Electronic Theses and Dissertations

This dissertation investigates the crime of concealment in Puritan Massachusetts. The 1624 Jacobean statute, which specifically identified concealing as both the crime and the evidence, provided the basis for prosecuting women who concealed the death of an infant. This dissertation focuses on an analysis that connects the act of concealment to a larger discussion of a woman’s association with secrecy and hiding that led to labeling her postpartum, criminal body as a threat to the colony. The act of concealment was evidence of a woman’s ability to control her own reproduction and her unwillingness to acknowledge her calling in Puritan …

“There’S Voices In The Night Trying To Be Heard”: The Potential Impact Of The Convention On The Rights Of Persons With Disabilities On Domestic Mental Disability Law, Michael L. Perlin, Naomi M. Weinstein May 2019

“There’S Voices In The Night Trying To Be Heard”: The Potential Impact Of The Convention On The Rights Of Persons With Disabilities On Domestic Mental Disability Law, Michael L. Perlin, Naomi M. Weinstein

Brooklyn Law Review

This article carefully examines, through a therapeutic jurisprudence framework, the likely impact of the United States’ ratification of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) on U.S. society’s sanist attitudes towards persons with mental disabilities. Although the United Nations ratified the CRPD—the most significant historical development in the recognition of the human rights of persons with mental disabilities— in 2008, the United States has yet to ratify it. In this article, we consider whether the CRPD, if ratified, is likely to finally extinguish the toxic stench of sanism that permeates all levels of society. We …

For-Profit Prisons: How Lobbying Has Affected The Way America Houses Prisoners, Jacob F. Israel May 2019

For-Profit Prisons: How Lobbying Has Affected The Way America Houses Prisoners, Jacob F. Israel

Political Science Theses and Capstones

There seems to be limited research and understanding as to why for-profit prisons exist in the United States. The initial selling points used to sell private prisons to states and counties were that they would reduce recidivism and cost. Recent peer-reviewed studies have found, however, that neither are the case. This could lead one to ask why for-profit prisons are still used in America. That is what I hope to answer in this research paper. After research and analysis of campaign donations by the two largest for-profit prison corporations (collected from the National Institute on Money in State Politics) and …

Crafting A Corporate Analogue To Criminal Disenfranchisement, B. Graves Lee Jr. May 2019

Crafting A Corporate Analogue To Criminal Disenfranchisement, B. Graves Lee Jr.

Michigan Business & Entrepreneurial Law Review

The Supreme Court’s 2010 decision in Citizens United v. FEC represented a sea change in the world of corporate citizenship. Although the decision dealt with campaign finance law, it has sparked significant discussion of the concept of corporate personhood more broadly. Corporations have increasingly taken advantage of legal rights previously reserved for individuals. This Note argues that where corporations reap the benefits of constitutional entitlements intended for individuals, they should suffer consequences for malfeasance similar to those imposed on individuals who engage in criminal conduct. Specifically, this Note advocates for limitations on corporate electioneering as a collateral consequence of a …

Improving Information Sharing: Local Fusion Centers And Their Role In The Intelligence Cycle, Alexis Spall May 2019

Improving Information Sharing: Local Fusion Centers And Their Role In The Intelligence Cycle, Alexis Spall

Master in Management for Public Safety and Homeland Security Professionals Master's Projects

Abstract

My Master’s Project focuses on local fusion centers and the need for improved information sharing practices among law enforcement partners. After the tragic event of September 11th in 2001, the Department of Homeland Security and the Department of Justice recognized a communication gap between law enforcement agencies and a lack of effective information sharing efforts. Fusion centers play a significant role in supporting both criminal and terrorist investigations due to their ability to act as a conduit between various law enforcement partners. Due to their important responsibilities as information sharing hubs that provide valuable analysis and dissemination of …

Effects Of Family Treatment Drug Court On Reunification Of Families Involved With Child Protection, Carrie Meiners May 2019

Effects Of Family Treatment Drug Court On Reunification Of Families Involved With Child Protection, Carrie Meiners

Counselor Education Capstones

It is estimated 75% of families involved with child protection whose children are removed from the home due to safety or neglect concerns are experiencing substance abuse issues (Young, Gardner, & Dennis, 1998; Brook & McDonald, 2009). In the absence of egregious harm, family reunification is the primary goal of the judicial system and child protection agency. Parents who struggle with substance use often require professional treatment and are more likely be reunified with their children upon successful completion of recommended treatment. Family treatment drug court is a relatively new model, based on the drug court model used to address …

Infant And Early Childhood Mental Health: Relationship-Based Interventions For At-Risk Families, Britney Brennan May 2019

Infant And Early Childhood Mental Health: Relationship-Based Interventions For At-Risk Families, Britney Brennan

Counselor Education Capstones

This paper explores the literature regarding relationship-based interventions for building caregiver capabilities in at-risk families to improve Infant and Early Childhood Mental Health (IECMH). An overview of IECMH establishes the importance of early intervention in preventing more severe mental health issues across the lifespan, followed by a discussion of caregiver roles in early childhood development, presentation of IECMH issues, and the complexity of risk factors for maladaptive outcomes. A case is made for relationship-based interventions performed within the home, such as Parent-Child Interaction Therapy (PCIT) and Attachment and Biobehavioral Catch-Up (ABC), as most efficacious in reducing barriers and achieving desired …

Policy Analysis Of Tennessee's 51-To-Life Law: Juvenile Sentencing Reform, Natalie P. Hurst May 2019

Policy Analysis Of Tennessee's 51-To-Life Law: Juvenile Sentencing Reform, Natalie P. Hurst

Honors Theses

In the state of Tennessee, juvenile offenders convicted as adults for first-degree murder must receive a minimum sentence of 51 years in prison before becoming eligible for parole. Tennessee’s minimum juvenile sentencing guideline is the strictest in the United States. In 2012, the Supreme Court of the United States ruled that sentencing juvenile offenders to life is unconstitutional citing psychological evidence for a juvenile’s ability to be rehabilitated in comparison to adults (Miller v. Alabama, 2012). Tennessee’s 51-year minimum juvenile sentencing standard is a potential violation of this ruling because it has been shown that the life expectancy in prison …

A Child Litigant's Right To Counsel, Kevin Lapp May 2019

A Child Litigant's Right To Counsel, Kevin Lapp

Loyola of Los Angeles Law Review

As the Supreme Court put it a half century ago, the right tocounsel for juveniles reflects “society’s special concern for children” and “is of the essence of justice.” In a variety of legal proceedings, from delinquency matters to child welfare proceedings to judicial bypass hearings, the law requires the appointment of counsel to child litigants. While coherent in the whole, the law regarding counsel for child litigants is a patchwork of state and federal constitutional rulings by courts and statutory grants. Legal scholarship about a child litigant’s right to counsel is similarly fragmented. Predominantly, legal scholars have examined arguments for …

Suspensions And Referrals To Law Enforcement Of African American Students Pre And Post Restorative Justice, Adrienne Brown May 2019

Suspensions And Referrals To Law Enforcement Of African American Students Pre And Post Restorative Justice, Adrienne Brown

Electronic Theses and Dissertations

The purpose of this study was to compare the number of suspensions and referrals to law enforcement from traditional consequences administered to students in a large urban school district in southeastern United States for the school year 2013 to 2014 to the number of suspensions and referrals to law enforcement from consequences rendered after the implementation of restorative justice practices in the 2015 to 2016 school year, as reported to the Civil Rights Office of Data Collection (CRDC, 2016). There was statistical evidence that schools had policies and/or practices in place that had a discriminatory bias towards racial groups when …

Effects Of Skin Color And Clothing Color On Perceived Violence And Aggression Of Criminals, Courtney Merchant May 2019

Effects Of Skin Color And Clothing Color On Perceived Violence And Aggression Of Criminals, Courtney Merchant

USC Aiken Psychology Theses

Introduction: Society has a history of attaching meaning to colors, and few colors have been given as much attention as red and black. In many contexts, these colors have strong negative associations. Red has long been representative of danger and aggression (Young, Elliot, Feltman, & Ambady, 2013), while black represents death and evil (Adams & Osgood, 1973; Sherman & Clore, 2009). Unfortunately, color associations are not limited to clothing or advertisements; skin color is also a subject of negative associations in the form of stereotyping. Darker skinned people, especially African-Americans, have long been subjected to negative stereotypes. The current …

Do You Trust Me(Dia)?: How Students Perceive And Identify Fake News, Kamari Stewart May 2019

Do You Trust Me(Dia)?: How Students Perceive And Identify Fake News, Kamari Stewart

Honors College Theses

Social media has become an increasingly popular source of news among young adults. However, with the rise of “fake news,” credibility comes into question and young adults are left on their own to determine which news is real and which is false. Two focus groups were employed in this study to gain a greater understanding of how college students aged 18-24 determine what news to trust on social media and the factors that impacted those decisions. Young adults in that age group trust news found on social media based on a variety of factors including the person that is sharing …

Detection Of Larval Aggregations Using A Drone Mounted Thermal Imaging Camera, Megan Descalzi May 2019

Detection Of Larval Aggregations Using A Drone Mounted Thermal Imaging Camera, Megan Descalzi

Master's Theses

When a body’s temperature reaches ambient temperature after death, remote detection of the body can become difficult. At this point, useful search tactics include the use of cadaver dogs, search parties and aerial imaging devices, all of which can be costly and time-consuming for every day law enforcement use. This study investigated the potential of a novel search technique in which a small, unmanned aerial system (drone) mounted with a forward-looking infrared radar (FLIR) was utilized to detect decomposing animal carcasses via the heat generated by associated Diptera larval aggregations. Hot water baths were utilized as analogs for larval aggregations …

Mapping Sex Offenders And Treatment Centers In Relation To Social Disorganization, Amber Amin May 2019

Mapping Sex Offenders And Treatment Centers In Relation To Social Disorganization, Amber Amin

Master's Theses

Research shows that the clustering of Registered Sex Offenders (RSOs) is connected to social disorganization. Residential patterns disrupt the reintegration of the RSO population. Utilizing data from Queens and the Bronx, NYC, this study examines RSO clustering in the two boroughs and explores the proximity of community resources to RSO addresses that may assist reintegration. Using data from the New York Megan’s Law and census data for Queens and Bronx Counties, maps were created to study the residential patterns of RSOs. The results show clustering of RSOs in areas with variables pertaining to high social disorganization and a lack of …
