This proposal document examines the collaboration between the Bend Police Department, Deschutes County Sheriff’s Office Jail, and St. Charles Medical Center Emergency Department and takes into consideration the professional opinions of all stakeholders who currently serve the community of Central Oregon in a variety of different capacities. In this article, we have examined the policies of the Trump Administration as they relate to extractive development on and near Indian country, and policies related to the protection of Native people from rape and sexual assault. As demonstrated above, the Administration’s policies are likely to increase both the environmental and physical vulnerabilities of Native people. Native people will not only likely face exasperated physical insecurity, but their environments will likely be increasingly stripped on natural resources. Exculpatory Evidence Pre-Plea Without Extending Brady, Brian Sanders

Innocent defendants sometimes plead guilty. This is a problem. Some suggest fixing this problem with a constitutional requirement that prosecutors disclose exculpatory evidence before a defendant pleads guilty. A circuit split has thus developed concerning whether Brady, which requires disclosure of exculpatory evidence, extends to the pre-plea context. The Supreme Court’s jurisprudence, however, likely bars a constitutional requirement for pre-plea disclosure of exculpatory evidence. Faced with this exigency, this Comment argues that contract law should form the legal basis for pre-plea disclosure. Specifically, the contract doctrine of constructive fraud provides a suitable remedy. While big boy clauses, which defeat constructive …

The Wrongful Conviction Program: A Program Evaluation, Ashley M. Chlebek

The Western Michigan University Wrongful Conviction Program (WCP) operated under a grant awarded by the Department of Justice (DOJ) from 2015 through 2018. The WCP partnered with the Western Michigan University Cooley Law School’s Innocence Project (WMU-CIP) to assist in the screening, review, and investigation of claims of innocence. The WCP trained undergraduate students to conduct case investigations and supported WMU-CIP in several ways.
The evaluation presented here examines the activities of the WCP to understand the ways in which it achieved its intended goals, as well as the ways in which it impacts participating students and the innocence movement. …

Immigration law fails to align with the contemporary understanding of substance addiction as a medical condition. The Immigration and Nationality Act regards noncitizens who suffer from drug or alcohol substance use disorder as immoral and undesirable. Addiction is a ground of exclusion and deportation and can prevent the finding of "good moral character" needed for certain immigration applications. Substance use disorder can lead to criminal behavior that lands noncitizens, including lawful permanent residents, in removal proceedings with no defense. The time has come for immigration law to catch up to today's understanding of addiction. The damage done by failing to …

Perinatal mental health issues including depression, anxiety, posttraumatic stress disorder, mania, and psychosis occur frequently during pregnancy and after delivery; these issues have potentially devastating impacts on mothers, infants, other family members, and communities. Despite increasing awareness of perinatal mental health issues and formal recommendations to implement universal screening and ensure access to appropriate follow-up, there is wide variation in clinical practice across regions and providers. Exclusionary suspensions have been used extensively to handle student discipline and promote a perception of a safer environment in schools. However, an increasing number of school administrators have begun seeking alternative methods, such as restorative practices, in an effort to change the approach towards handling misbehaviors, conflict, and damaged relationships. This study occurred in a Grade 9 campus in northern Texas. The goal of the researcher was to better understand the challenges and successes of implementing restorative practices at the school during the 2018–2019 school year from multiple perspectives. Although adulthood legally begins at age eighteen, young adults between the ages of eighteen and twenty-one are distinct from the rest of the adult population. Many studies conducted over the last two decades have revealed that the prefrontal cortex, the part of the brain responsible for social and emotional maturity as well as impulse control, is not fully developed until near the age of twenty-five. Thus, young adults have a neurobiologically-compromised ability to exercise self-control, adequately consider the consequences of their actions, and resist coercive pressures from others. At the turn of the twenty-first century, the country entered its third era of judicial federalism. That era is defined by federal judicial expansion into areas of statecourt power and federal monopolization of large and complex litigation. These changes, in turn, have coincided with the decay of state courts. Whether measured by funding, delays, or docket loads, state courts—the true workhorses of the American legal system—have declined relative to federal courts. Indeed, over the last decade, state chief justices have complained that state courts are “financially bankrupt,” “at ‘the tipping point of dysfunction,’” and “on the edge of an abyss.” …

Due to the massive prison population in America, correctional agencies are considering alternatives to standard incarceration. These programs are designed to redirect individuals from serving a prison sentence, and are instead assigned to a program specifically targeted at reducing offenders’ likelihood at recidivating. Typically, the main focus of these programs centers on education, job training, and various types of counseling. The Mississippi Department of Corrections (MDOC) has implemented two programs that aim at reducing recidivism: the first was the Regimented Inmate Discipline Program (RID), which was later replaced with the Recidivism Reduction Program (RRP). Recent national events have increased attention towards immigrant youth. Youth placed in juvenile justice facilities go through processes overseen by the U.S. Citizen and Immigration Services, the Office of Refugee Resettlement, and the Unaccompanied Children’s Program. While in placement youth are exposed to risk factors and face cultural barriers being in a new country. Youth’s structured (e.g., sports) and unstructured (e.g., socializing) activities are key contexts for positive development. Both behavioral participation (e.g., frequency) and elements of psychological engagement (e.g., enjoyment, challenge) in programs and activities have been linked to components of youth development. We tested a model in which both psychological engagement and behavioral participation in activities predicted overall positive youth development in older adolescent and emerging adult samples (Sample 1, n = 235, mean age = 18.7 years, SD = 1.4 years, 67.7% female; Sample 2, n = 186, mean age = 20.0 years, SD = 2.1 years, 68.8% female). The growth in the number of Spanish heritage language learners in languages for specific purposes classes has been accompanied by an increase in the number and types of community service learning programs in which these students can participate to better prepare them for future employment opportunities. This dissertation examines the utility of general strain theory in explaining substance use as a form of coping among a sample of police officers in a Midwestern, metropolitan city. The dissertation is comprised of five chapters, including the introduction, literature review, method, results, and discussion. Chapter one describes the stressful nature of a career in law enforcement, concentrating on the adverse consequences of prolonged stress, including depression and substance use. Chapter one also examines strain, depression, and substance use among police officers using a general strain perspective, highlighting the limitations of existing empirical studies. Juvenile mentoring programs are an institution of informal social control that through programmatic design intends to mitigate delinquent behaviors with the development of strong quality social bonds. In these programs, mentees involved in the juvenile justice system are matched with older mentors to form social bonds as a method of encouraging prosocial behaviors. The Juvenile Reentry Mentoring Project (JRMP) is one such mentoring program matching juvenile mentees in the justice system with undergraduate mentors. This report presents quarterly data and evaluation updates for the Vocational and Life Skills Program (VLS) through Quarter Six of Grant Cycle Three. VLS was created by the Nebraska Legislative Bill 907 in 2014 to reduce recidivism and increase meaningful employment for Nebraskans convicted of a crime. The report contains 1) descriptions of the eight funded programs across the state, 2) a snapshot of program participation across the programs, 3) demographics of the participants served by the VLS initiative, and 4) participation breakdowns and descriptions of the skills participants are gaining through VLS programming. Background and Significance: Deaths related to opioid overdose are increasing. Treatment for opioid use disorder (OUD) is necessary to help prevent future opioid abuse, and often involves opioid detoxification, followed by short-term residential treatment, typically lasting about 28 days. Literature regarding OUD and short-term residential treatment is limited. Predictors of short-term residential completion, including whether detoxification was performed, may help addiction professionals individualize treatments. This study’s purpose was to determine predictors of short-term residential completion treatment for OUD, and whether detoxification prior to entering residential treatment may also be a factor in residential completion.
