Disrupting Business As Usual: Considering Teaching Methods In Business Law Classrooms, Jeffery Hewitt, Shanthi E. Senthe

Dalhousie Law Journal

The Truth and Reconciliation Commission of Canada (TRC)’s Calls to Action propose signimcant changes to legal education. No law school classroom is exempt, including business law courses. We are two of a growing number ofscholars in the legal academy actively incorporating Indigenous laws, critical race theory and socio-economic perspectives into business law courses as part of our responses to the TRC. This paper explores a field school we developed at Windsor Law as a response to the Calls to Action. In a temporary fusion of two courses, Secured Transactions along with Indigenous Peoples, Art & Human Rights, a synergy emerges …

Let’S Be Friends: Black Theology, Climate Change, And Trust, Nathaniel Holmes Jr. Dec 2019

Let’S Be Friends: Black Theology, Climate Change, And Trust, Nathaniel Holmes Jr.

Journal of the Black Catholic Theological Symposium

Climate change is a worldwide issue with ramifications for all ethnic groups. Yet, there is a dearth of engagement of climate change issues by Black theology and Black churches, even though the effects of climate change are predicted to affect African Americans and other racial minorities to a greater extent than other groups. Given the history of mistrust of the uses of scientific research and practices that have themselves caused negative impacts within the African American communities (e.g., Tuskegee Syphilis Experiment), this disconnect is not surprising. Furthermore, some view the attention given to anything other than criminal justice reform, police …

Priestly Formation And Sexual Abuse In The Roman Catholic Church: In Dialogue With The Nigerian Church, Simonmary Asese Aihiokhai

Journal of the Black Catholic Theological Symposium

Reading the signs of the times today cannot be done legitimately without a critical look at the current sex abuse crisis perpetuated by the clergy of the Roman Catholic Church. To deny the fact that the Church has a crisis on its hands is to trivialize the pain and sorrow experienced by all in the Church, and most especially by the victims of the crisis. This work provides an x-ray vision of some of the factors shaping this crisis and boldly offers some interventions that can help the Church to navigate its way out of the crisis. There is an …

The Legalization Of Restorative Justice: A Fifty-State Empirical Analysis, Thalia González Dec 2019

The Legalization Of Restorative Justice: A Fifty-State Empirical Analysis, Thalia González

Utah Law Review

This Article addresses the increasing formal legal nature of restorative justice in the United States. Over the last three decades, a substantial body of research has demonstrated the ways in which restorative justice offers an alternative societal response to crime and harm. It has also examined how restorative justice empowers individuals and groups to address violence, respond to social, political and economic injustice, and engage in resistance to existing structural inequities. Yet a prominent gap in the field exists: a comprehensive theoretical and empirical examination of the codification of restorative justice in state law. Studies of this nature are essential …

Defining Worthy Victims: State-Level Legislative Decisions To Prevent The Criminalization Of Commercially Sexually Exploited Children In The United States, Kathleen A. Price Dec 2019

Defining Worthy Victims: State-Level Legislative Decisions To Prevent The Criminalization Of Commercially Sexually Exploited Children In The United States, Kathleen A. Price

Graduate Doctoral Dissertations

The federal Trafficking Victims Protection Act of 2000 (TVPA) includes children (anyone under 18) who are sexually exploited for commercial purposes in its definition of human trafficking victims. However, most states currently arrest and/or prosecute sex trafficked children for prostitution. From 2008 to 2017, six states neither arrested nor prosecuted sexually exploited children for prostitution; eight retained the right to arrest, but not prosecute minors for prostitution; and 36 states both arrested and prosecuted this population for prostitution. All 50 states passed their first human trafficking laws between 2003 and 2013. Washington passed the first in 2003 and Wyoming was …

Going Hemp Wild: Understanding The Challenges And Opportunities For Fda Regulation Of Cbd In Food Products, Hannah Catt

Journal of Food Law & Policy

After the passage of the 2018 Farm Bill, champions of hemp began to tout opportunities for farmers and businesses involved with the crop. The industry has rallied around one of hemp’s major byproducts, cannabidiol, or CBD. However, the demand for CBD has left the Food and Drug Administration (“FDA”) playing catch-up. This article explains what CBD is, how it is derived, current FDA-approved uses, and a current path forward for the FDA in creating guidance for industry and consumers.

Examining The Perceptions Of School Teams Participating In Professional Development On Restorative Practice, Clinton A. Bell Dec 2019

Examining The Perceptions Of School Teams Participating In Professional Development On Restorative Practice, Clinton A. Bell

Education Doctoral

In recent years, restorative justice (RJ) has been used by the criminal justice system to provide an alternative to punishment and retribution in response to crime. Restorative justice’s response to crime requires all parties affected or involved in the crime to come together to repair the harm done to the victim. The parties involved or affected include victim, offender, family, and community. Many schools have considered restorative justice as alternative to suspension and a way to build school community. The purpose of this study was to explore the perceptions of school faculty participating in professional development on restorative practices (RP). …

Perceptions Of Probation Officers' On Interconnections: A Mentoring Program, Vanessa Arellano Dec 2019

Perceptions Of Probation Officers' On Interconnections: A Mentoring Program, Vanessa Arellano

Master's Theses

Mentoring programs provide disadvantaged, at-risk, and adjudicated youth with positive role models that can bestow support and guidance (Grossman & Tierney, 1998). The mentoring phenomenon has grown tremendously with over 5,000 mentoring programs in the United States and serving about 3 million juveniles (MENTOR/National Mentoring Partnership, 2006). Additionally, mentoring yields numerous positive outcomes, such as dissuading risky behavior and advocating prosocial behavior (Haddock et al., 2017). The current literature focuses on mentor, mentee and parental perspectives on mentoring programs with little information about probation officers. The current study relied on in-depth interviews with six probation officers who referred juvenile probationers …

An Analysis Of Registered Sex Offender Reentry Challenges In Mississippi, Kitsya Cordova Dec 2019

An Analysis Of Registered Sex Offender Reentry Challenges In Mississippi, Kitsya Cordova

Master's Theses

Sex offenders are often considered the most dangerous type of criminal by the public, which is a common misconception (Levenson & D’Amora, 2007; Tewksbury & Copes, 2012). Registered sex offenders usually have the lowest recidivism rates when compared to other offenders (Robbers, 2009). The issue is that registered sex offenders are targeted by multiple set of laws such as the Wetterling Act, Megan’s Law, Adam Walsh Act, among others, Such sex offender legislation creates multiple reentry challenges that other type of offenders may not face (Grossi, 2017; Tewksbury & Copes, 2012). By using secondary data from Griffin and Evans (2019), …

Community Policing As Defined By Officers, Benjamin Hesse Dec 2019

Community Policing As Defined By Officers, Benjamin Hesse

Master's Theses

Researchers have struggled to define community policing in a consistent manner for use in scientific study. This study attempts to rectify the disparity in definitions used for research by creating a cohesive definition for use in future research. This definition is was created by conducting in depth interviews with officers as well as by doing a content analysis of police department websites. This research concluded that officers and departments define community policing slightly differently- officers emphasize respect and rapport with the community while departments focus on the specific programs they can implement. Due to these differences, the definition that was …

An Analysis Of The Effects Between Prison Documentaries And Popularity Among Viewers, Dominique Malone Dec 2019

An Analysis Of The Effects Between Prison Documentaries And Popularity Among Viewers, Dominique Malone

Honors Theses

This research examines the themes between a variety of prison documentaries and the subsequent viewership. In recent years, documentaries depicting prison life have risen in popularity due to a number of factors such as violence, drama, hysteria, and an overall sense of fascination (Cecil, 2009). This popularity may have impacted views on the current criminal justice system considering most people never have contact with the criminal justice system in their lifetimes (Cecil, 2009). Therefore, these documentaries may serve as one of the only bases for information that they may have about the system (Cecil, 2009). Because prison documentaries are fulfilling …

Exploration Of Human Nature In The Federalist Papers, Jenna Ashley Salzman Dec 2019

Exploration Of Human Nature In The Federalist Papers, Jenna Ashley Salzman

Honors College

The Federalist Papers are the canon of American political thought. Scholars have been dissecting their meaning for 250 years. Much of the analysis has focused on the structure of government and the aim for liberty and freedom. A smaller amount focused on the presentation of human nature found within the writings. To understand human nature is to understand how a government should be established and administered. This paper seeks to examine how the Federalist writers Alexander Hamilton and James Madison understood human nature by comparing their writings to John Locke, Thomas Hobbes, and David Hume. I argue that the writers …

Illuminating Pay Secrecy: Construct Clarification And An Exploration Of Effects Via The Incentive And Sorting Tracks, Sarah Holtzen Dec 2019

Illuminating Pay Secrecy: Construct Clarification And An Exploration Of Effects Via The Incentive And Sorting Tracks, Sarah Holtzen

Graduate Theses and Dissertations

Pay secrecy is a burgeoning debate in compensation research. On one side of the debate, it is argued that pay secrecy is a useful and beneficial practice because it can prevent potential dissatisfaction and destructive competition possible when people make unfavorable pay comparisons. On the other side, it is argued that pay secrecy is undesirable because it obscures the motivational properties of pay and does not prevent people from making pay comparisons, nor safeguard them from the resulting dissatisfaction. Despite the popularity of pay secrecy in organizations today, extant research has failed to provide any definitive answers as to whether …

What’S The Point? The Missing Piece Of Criminal Justice Reform Through Consensus And Compromise, Jelani Jefferson Exum Dec 2019

What’S The Point? The Missing Piece Of Criminal Justice Reform Through Consensus And Compromise, Jelani Jefferson Exum

Faculty Publications

(Excerpt)

Criminal justice reform has had a firm place in news headlines for more than a decade. When the mass incarceration crisis came to the fore in 2008, with reports that one in a hundred adults in America was behind bars, there had already long been cries for reducing the prison and jail populations. Reform has mainly been sought through two approaches: consensus through ballot initiative or legislative compromise. But these modes of reform share a fundamental failure: both often lack a clear articulation of the purpose of criminal sentencing. In other words, “What’s the point?” Without an agreement on …

Increasing Active Engagement & Participation In The Guardian Scholars Program, Cali Trimble

Capstone Projects and Master's Theses

The Guardian Scholars Program at California State University Monterey Bay (CSUMB) serves college students who have experienced foster care and/or homelessness. The program seeks to holistically support students from these historically underserved populations. Former foster youth, in particular, have extremely low college graduation rates. Students from these backgrounds have to overcome personal struggles and academic troubles as well as a lack of knowledge/awareness of how to succeed in college. For many years, the Guardian Scholars Program at CSUMB has experienced a lack of active participation among its members. As a result, many Guardian Scholars members are not utilizing the services …

Expanding Gender Non-Binary Access In California’S Victim Compensation Program, Vianeth Gonzalez Muro Dec 2019

Expanding Gender Non-Binary Access In California’S Victim Compensation Program, Vianeth Gonzalez Muro

Capstone Projects and Master's Theses

Monterey County transgender people do not feel supported seeking services at Monterey County District Attorney’s office. Many feel like they are at a higher risk of being victimized, mistreated or discriminated against when seeking services. non-binary people currently have the right to be legally designated as non-binary on their California identification documents, but when seeking services at the DAs office they are not provided that gender option. This creates a negative environment for the transgender community. Many crimes go unreported because of the fear the transgender community has when seeking support and their voices are not being heard. The capstone …

Fraud Prevention For Seniors, Claudia Rodriguez Dec 2019

Fraud Prevention For Seniors, Claudia Rodriguez

Capstone Projects and Master's Theses

The senior population has been a target for fraudulent crimes. The determined contributing factors for the senior population being susceptible to fraud is being gullible, lacking knowledge of strategies to prevent fraud, and having cognitive decline due to aging. Fraudulent crimes can have major consequences such as, monetary cost, negative effects on health and unreported cases. Fraudulent crimes against seniors is a growing issue and must be addressed. In order to address this issue within the community a capstone project was developed and implemented in collaboration with the Monterey County District Attorney's Office of Consumerism and Environmental Protection Division.
