New students, who are applying to the criminal justice program or the human services program for spring semester 2020, may be eligible for these grants. Every day the criminal legal system hauls poor and marginalized individuals through a process wrought with trauma, indignity, and abuse. Public defenders representing the criminally accused view their clients and the system from a unique vantage point: they bear witness to the human costs of a system that falls far short of its purported norms and ideals. For the public defender who works within this reality day in and day out, fighting for each individual client might feel limited in its wider impact. The United States has always had a very complicated and tense relationship with the International Criminal Court (ICC) and with international criminal law generally. Yet, under the Trump administration, the U.S.–ICC relationship has deteriorated to an unprecedented level. Within the last few years, the U.S. government has launched a full-scale attack on the ICC—denouncing its legitimacy, authority, and achievements, blocking investigations, and loudly withdrawing all once-existing support for the court.
These hostilities bubbled over following the November 2017 request by the ICC Chief Prosecutor, Fatou Bensouda, for the court to open an investigation into alleged war crimes and crimes against …

This is the third piece in a trilogy that examines and evaluates the standards that American courts apply to admit forensic “science” evidence proffered by prosecutors in criminal trials. The first two articles in the trilogy expose the criminal courts’ on-going practice of admitting false forensic evidence that is virtually always excluded in civil cases. They also advance a panoply of procedural and evidentiary solutions aimed at reforming this legally unviable discrepancy. Those solutions are court-centric insofar as they advocate for, among other things, open and early criminal discovery, pre-trial Daubert hearings to challenge evidence and experts, and court-appointment of …

There are more slaves today than at any other time in human history. The International Labour Organization (ILO) estimates that there are more than 40 million slaves worldwide. This paper accompanies a 6-part webinar series of the same title that explores how gender inequality, capitalism, and pornography are driving a $99 billion illegal industry. The paper begins by defining what human trafficking is and includes both forced labor and commercial sexual exploitation. Six primary forms of human trafficking are explored, including domestic servitude, bonded labor, child slavery, sex trafficking, and forced marriage. Next, the paper explores who the victims of …

The Cruel and Unusual Punishments Clause prohibits, under its original meaning, punishments that are unjustly harsh in light of longstanding prior practice. The Clause does not prohibit all new punishments; rather, it directs that when a new punishment is introduced it should be compared to traditional punishments that enjoy long usage. This standard presents a challenge when the government introduces a new method of punishment, particularly one that is advertised as more “progressive” or “humane” than those it replaces. Combating Judicial Misconduct: A Stoic Approach, Michael D. Cicchini
Buffalo Law Review
Judicial ethics rules require criminal court judges to be competent, even-tempered, and impartial. In reality, however, many judges are grossly ignorant of the law, incredibly hostile toward the defense, and outright biased in favor of the state. Such acts of judicial misconduct pose serious problems for the criminal defense lawyer and violate many of the defendant’s statutory and constitutional rights.
This Article presents a framework for the defense lawyer to use in combating judicial misconduct. The approach is rooted in a principle of Stoic philosophy called “negative visualization.” That is, the lawyer should anticipate and visualize judicial incompetence, hostility, and …

Universities should adopt restorative justice practices to serve the legal and personal needs of student survivors of sexual violence. Title IX prohibits discrimination on the basis of sex in education programs and activities operated by recipients of federal financial assistance. Since 1997, the Department of Education’s Office for Civil Rights has issued “Dear Colleague Letters” to federally funded institutions to assist with Title IX compliance and implement procedures for complaints of sexual violence. In 2011, Assistant Secretary for Civil Rights Russlyn Ali under the Obama administration issued a Dear Colleague Letter, which expanded protections for survivors. However, it prohibited the …

The purpose of this study is to engage in a systematic inquiry of juvenile delinquency in Texas public schools and respond to the statement made by a member of the Texas Legislature who challenged public school officials to predict delinquency in order to keep students out of the court system. The study is based on the assumption that a profile for juvenile delinquency can be developed using the existing data submitted by Texas public school districts through the Public Education Information. The correlation between undergraduate majors/colleges and their corresponding levels of physical activity was investigated at the University of Texas at Arlington. The relationship between the two subjects of research was determined by the method of a survey, as inspired by the International Physical Activity Questionnaire (IPAQ). The IPAQ serves to analyze data through a series of questions that determine an individual’s weekly average of vigorous to moderate exercise based on their job, major, leisure activity, and time spent sedentary. Calls for accountability for gender violence have permeated public discourse in the aftermath of the #MeToo movement. While much attention has focused on high profile individuals accused of harassment, less attention has been paid to sexual assaults of more vulnerable and marginalized people, including low wage workers, lesbian, gay, bisexual, transgender and gender non-conforming people, and immigrants. In addition, at the same time that calls for accountability have targeted Hollywood, employers, universities, and even the Catholic church, relatively little outcry has focused on the longstanding and under-recognized problem of sexual assaults by government actors. Immigration law fails to align with the contemporary understanding of substance addiction as a medical condition. The Immigration and Nationality Act regards noncitizens who suffer from drug or alcohol substance use disorder as immoral and undesirable. Addiction is a ground of exclusion and deportation and can prevent the finding of “good moral character” needed for certain immigration applications. Substance use disorder can lead to criminal behavior that lands noncitizens, including lawful permanent residents, in removal proceedings with no defense. Research suggests that Restorative Justice approaches have shown promise in terms of their impact on school climate, student behavior, and relationships. The purpose of this study is to explore Black female students’ perceptions of Restorative Practice (RP) talking circles at an alternative school. The study examined literature on Zero Tolerance, School Discipline Disparities, African American Female students, Intersectionality, Restorative Justice, and Alternative Schools. A qualitative case study method was used for this study, drawing from two sources: (a) face-to-face interviews and (b) observations of the Black female students who attend the alternative school and participate in the talking circles. Neurobiological and epidemiological research suggests that abuse and adverse events experienced as a child can increase an adult’s risk of brain dysfunction associated with disorders related to criminality and violence. Much of this research is predictive, based on psychological evaluations of children; few studies have focused on whether or how criminal proceedings against adult defendants consider indicators of childhood trauma. This Article analyzes a subset of criminal cases pulled from an 800-case database created as part of an original, large-scale, empirical research project known as the Neuroscience Study. This Article argues that the assumptions that underlie how we currently conceptualize equal access to justice ensure that we will never achieve it. Much scholarly attention has been paid to the problem of access to justice for lowincome people, which is typically defined as unmet legal need. Most of this attention focuses on the crisis in civil courts of unrepresented parties. These scholars suggest court-focused solutions centered on providing more lawyers and legal advice to help deal with this pro se crisis. As responses to first-time, nonviolent juvenile offenders move towards community-based restorative justice, approaches such as the Balanced and Restorative Justice (BARJ) Model are prominent. The BARJ Model engages the youth offender, offense victim(s), and community in which the offense occurred with three associated goals: accountability, community safety, and competency development. However, while the goals of accountability and community safety are often prioritized, many community-based restorative justice programs neglect the goal of competency development, which is ultimately a disservice not only to the youth offender, but to the community. Many users and/or consumers of law reports grapple with two major questions. The first question revolves around the issue why some judicial decisions are referred to as reported decisions, while others are referred to as unreported decisions. This question therefore deals with the dichotomy between reported judicial decisions and unreported judicial decisions. The second question flows from the first and relates to which categories of decisions appear in law reports (and therefore are classified as ‘reported’) and which ones do not (and therefore are classified as ‘unreported’).
