The Kent State Shootings at 50: Rage, Reflection, and Remembrance

Drawing from over 50 interviews from The Kent State Shootings Oral History Project, the authors examine how these detailed, varied and at-times contradictory accounts challenge and deepen our understanding of the events of May 4, 1970, which culminated in four KSU students killed and nine more wounded by gunfire from the Ohio National Guard. Simpson will explore how their methodology led to both obstacles and opportunities, resulting in a text departing in some ways from its original conception, yet one that fulfilled their objective to show how “The Long …

From La Beauce To Le Bayou: A Transsystemic Voyage, Rosalie Jukier Oct 2019

From La Beauce To Le Bayou: A Transsystemic Voyage, Rosalie Jukier

Journal of Civil Law Studies

This paper is an adaptation of the Tucker Lecture that I delivered in October of 2017. Its title depicts two iconic places, one in the Canadian province of Quebec, from where I hail, and the other in Louisiana, the locale of my audience. La Beauce, an enchanting part of Quebec, stretches along the Chaudière River and is located about thirty minutes south of Quebec City. Le Bayou refers to the low-lying wetlands found primarily in the southern part of Louisiana, a defining feature of this part of the United States.

In this paper, I attempt to guide an allegorical voyage …

French Jurisdictional Complexity On The Fringe— Acadia 1667-1710, Jacques Vanderlinden Oct 2019

French Jurisdictional Complexity On The Fringe— Acadia 1667-1710, Jacques Vanderlinden

Journal of Civil Law Studies

During the second half of the 17th century of French formally institutionalized colonial power in Acadia, the province was in an interesting state of jurisdictional complexity insofar as French colonists were concerned. While native Amerindians, mostly Malecites and Micmawqs, carried their precolonial political order and jurisdictional organisation without almost any interference of the colonial power, imported normative systems derived from feudalism, the Catholic Church, French colonial order, French provincial customs and family organisation were juxtaposed and interacted, each of them were a well-known part of the Western legal tradition. Yet—and this is the most interesting—the state power, which was prevalent …

Developing The Civil Law Of Incorporeal Things, Ricardo Bethencourt, Aniceto Masferrer Oct 2019

Developing The Civil Law Of Incorporeal Things, Ricardo Bethencourt, Aniceto Masferrer

Journal of Civil Law Studies

This article offers the legal profession a method to effectuate on behalf of authors, designers, or inventors who are residents of Louisiana (or for Louisiana transactions) the rights recognized by federal law on intellectual property (IP) and unfair competition by activating the civil law on incorporeal things. Additionally, it offers a way to enhance the civil law practitioners’ stock of solutions with the regular notions of property, contracts, and torts in IP and unfair competition law for fascinating results. Also, it enables civil law academia to teach IP and unfair competition law through regular courses such as property, contracts, and …

Examining Why And For Whom Reflection Diversity Training Works, Alex P. Lindsey, Eden King, Brittney Amber, Isaac Sabat, Afra S. Ahmad Oct 2019

Examining Why And For Whom Reflection Diversity Training Works, Alex P. Lindsey, Eden King, Brittney Amber, Isaac Sabat, Afra S. Ahmad

Personnel Assessment and Decisions

This research introduces a novel approach to diversity training by theoretically developing and empirically testing a model that considers a new training exercise aimed at improving proximal and distal pro-diversity outcomes. This new training exercise, reflection, is proposed to be effective at increasing pro-diversity attitudes and behaviors due to the promotion of one's internal motivations to respond without prejudice. Further, we test a critical trainee characteristic, social dominance orientation (SDO), as a boundary condition of our proposed effects. Results from an online experiment with two time points indicate that reflection can be an effective diversity training exercise and leads to …

Framing Matters: The Influence Of Group-Image Threat On Reactions To Affirmative Action Policies, Kisha S. Jones, Anuradha Anantharaman, Anjali Bhatt Oct 2019

Framing Matters: The Influence Of Group-Image Threat On Reactions To Affirmative Action Policies, Kisha S. Jones, Anuradha Anantharaman, Anjali Bhatt

Personnel Assessment and Decisions

Affirmative action (AA) attempts to rectify the institutional effects of prior employment discrimination toward minority groups. Although AA has played a large role in increasing workplace diversity, organizations may vary in their perspectives towards diversity itself, ranging from a sole focus on increasing diversity to appreciating the value diversity may add. Support for AA has been considered as a form of White identity management (Knowles, Lowery, Chow, & Unzueta, 2014) and is impacted by the extent to which White people experience group-image threat to their racial identity. Our findings suggest that the level of group-image threat experienced by White people …

Motivations To Control Prejudice Bias Performance Feedback In Developmental Relationships, C. Malik Boykin, Christine R. Smith Oct 2019

Motivations To Control Prejudice Bias Performance Feedback In Developmental Relationships, C. Malik Boykin, Christine R. Smith

Personnel Assessment and Decisions

In developmental relationships, providing accurate assessments of performance is necessary to maximize the developmental benefits for those receiving the feedback. Research suggests that performance assessments for underrepresented minorities are susceptible to biases related to out-group prejudice; however, little is known about the contributions of motivations to control prejudice, particularly in face-to-face settings. Addressing this, we examined the influences of internal and external motivations to control prejudice (IMS and EMS) on the positivity of White mentor’s feedback about their underrepresented minority mentee’s task performance. We analyzed video-recorded interactions between 56 randomly assigned cross-racial dyads, wherein mentees performed a speech task and …

Boomers And Fraudsters: A Closer Look At The Financial Elder Abuse Cycle In America, Ryan E. Brown Oct 2019

Boomers And Fraudsters: A Closer Look At The Financial Elder Abuse Cycle In America, Ryan E. Brown

Marriott Student Review

In 2011, a landmark study was published by the Metlife Mature Market Institute claiming that nearly $3 billion disappears from the wallets and bank accounts of senior citizens annually. More surprising is that a similar study reported that figure could be as high as $36 billion. Because so many seniors let incidents of fraud or financial deceit go unreported, there is a huge discrepancy in annual reporting. This contributes to the overall lack of understanding we have of elder financial abuse, or why seniors continue to lose to fraudsters and scam artists. In a brief overview of financial elder abuse …

Spatio-Temporal Analysis Of Highway Congestion And Accidents: A Case Study Of Interstate 285 In Georgia, Melodi Zhan-Moodie

Master of Science in Civil Engineering Theses

Road traffic crashes threaten thousands of drivers every day and significant efforts have been put forth to reduce the number of traffic crashes and their impact. Traffic congestion could be both a result of and a contributing factor to traffic crashes. The aim of this study is to investigate spatio-temporal traffic congestion and crash patterns to gain a better understanding of the causation of congestion and accidents, and their interaction. The Interstate 285 (I-285) in Georgia was used as a case study. With the aid of Geographic Information Systems (GIS), spatial clustering and densities of accidents were performed by following …

The Impact Of Integrating Traditional Ecological Knowledge In Summer Camps On Middle School Students' Understanding Of The Nature Of Science, SapoóQ'Is WiíIt'es Ciarra Solina Greene

Dissertations and Theses

The Nature of Science (NOS) and traditional ecological knowledge (TEK) have commonalities in the knowledge bases: they are both ways of explaining the natural world; founded on a set of practices and the historical accumulation of knowledge; and part of the education is learning practices and developing knowledge of the concepts that are foundational to the disciplines. Throughout the United States, schools are attempting to strengthen students' understanding of NOS through various approaches, although few have adopted the integration of TEK into curriculum. This research assesses two summer camps for middle school students that are science focused, one with TEK …

Multidecadal Climate Variability And The Florescence Of Fremont Societies In Eastern Utah, Judson Byrd Finley, Erick Robinson, R. Justin Derose, Elizabeth Hora Oct 2019

Multidecadal Climate Variability And The Florescence Of Fremont Societies In Eastern Utah, Judson Byrd Finley, Erick Robinson, R. Justin Derose, Elizabeth Hora

Sociology, Social Work and Anthropology Faculty Publications

Fremont societies of the Uinta Basin incorporated domesticates into a foraging lifeway over a 1,000-year period from AD 300 to 1300. Fremont research provides a unique opportunity to critically examine the social and ecological processes behind the adoption and abandonment of domesticates by hunter-gatherers. We develop and integrate a 2,115-year precipitation reconstruction with a Bayesian chronological model for the growth of Fremont societies in the Cub Creek reach of Dinosaur National Monument. Comparison of the archaeological chronology with the precipitation record suggests that the florescence of Fremont societies was an adaptation to multidecadal precipitation variability with an approximately 30-plus-year periodicity …

Using Interviewing In Public Health Research: Experiences Of Novice Researchers, Caroline I. Wood, Nancy Daley-Moore, Rachel Powell Oct 2019

Using Interviewing In Public Health Research: Experiences Of Novice Researchers, Caroline I. Wood, Nancy Daley-Moore, Rachel Powell

The Qualitative Report

In this article, we provide the experiences of three novice public health researchers conducting studies with several vulnerable populations: women, people with disabilities, and children. We describe all phases of our interview studies including developing data collection guides, planning the interview in an appropriate setting, conducting the interviews, and bringing the interview to a close. Specific components of the interviews that are discussed include establishing rapport and minimizing the power imbalance inherent between interviewer and interviewee, including the added power imbalance that vulnerable populations experience. Issues of maintaining quality and rigor, as well as ethical considerations for working with our …

Feminism As An Evolving Culture Of Inclusion And Affirmation: A Review Of Contemporary Feminist Research From Theory To Practice, Alexandra Ch Nowakowski

The Qualitative Report

In Contemporary Feminist Research from Theory to Practice, Dr. Patricia Leavy and Dr. Anne Harris (2019) translate feminist principles into good research practice to offer learners of all career stages a concise and lively blueprint for bringing feminism out of the realm of theory and into that of application. Their constant critical thinking and consistent attention to detail orient readers to feminism as a dynamic, continuously evolving culture of inclusion and affirmation.
