Canada's Assisted Human Reproduction Act: Pragmatic Reforms In Support Of Research, Tania M. Bubela, Erika Kleiderman, Zubin Master, Ubaka Ogbogu, Vardit Ravitsky, Amy Zarzeczny, Bartha Maria Knoppers
Office of the Provost
Canada's Assisted Human Reproduction Act is long overdue for Parliamentary review. We argue that the current regulation of research using human reproductive materials is not proportionate, not responsive to the uncertain threats posed to human and environmental health and safety, and is not considerate of diverse values in a democratic society. We propose tailored regulatory carve-outs for in vitro research for currently prohibited activities, such as gene editing, and for the exercise of Ministerial Discretion for access by Canadians to experimental in vivo interventions that are currently prohibited, such as mitochondrial replacement therapy. Our recommendations are bounded by constitutional constraints …

Part of the purpose of Justice Reinvestment Initiatives (JRIs) involve a focus of funds and effort toward implementing practices that increase the chances of successful reintegration of people recently released from incarceration. Similar to other jurisdictions, Oregon's JRI has taken a number of forms of reintegrative efforts. In 2016, JRI funding opened a services hub and reintegration/reentry center in a rural county. The Center offers a central location for reentry services, such as employment and housing assistance, but is not a requirement of an offender's supervision. Relying on the risk-need-responsivity framework, this program aims to reduce recidivism by mitigating barriers …
Entry And Stability Of Cross-National Marriages In The United States, Igor Ryabov, Yuanting Zhang
Entry And Stability Of Cross-National Marriages In The United States, Igor Ryabov, Yuanting Zhang
Sociology Faculty Publications
As more and more people move across borders, marriage is becoming an increasingly global affair. Yet cross-national marriage (CNM) migration has not received the scholarly attention it deserves. The present study examines the characteristics and marital stability of unions between U.S. nationals and their foreign-born (FB) spouses residing in the United States. Two data sources were used in the analysis—the American Community Survey (ACS) and the Survey of Income and Program Participation (SIPP). Our results indicated that, after controlling for race/ethnicity, socioeconomic background and marital history, marriages between U.S. nationals and their FB spouses who entered the United States as …

Have You Seen The Poop Fairy?, Sergio Lozoya
Architecture and Planning ETDs
This research seeks to understand the effectiveness of the There is no Poop Fairy campaign through a public survey of dog owners. The There Is No Poop Fairy campaign was initiated in Albuquerque, New Mexico, in 2014, with the goal of getting dog owners to pick up and properly dispose of their dogs’ waste. The Rio Grande is contaminated with E. coli bacteria that originates in part from dog waste, which is carried to the river through storm water. Levels of E. coli in the Rio Grande have decreased dramatically within the past few years, coincident with the campaign. The …

Economic Impacts Of The Vetoes On The Alaska Economy, Mouhcine Guettabi, Nolan Klouda
ISER Reports
On June 28, 2019 Governor Mike Dunleavy announced line-item vetoes totaling $409 million from the State of Alaska budget for Fiscal Year 2020. These vetoes include significant cuts to the University of Alaska, Medicaid, payments to local governments, public assistance programs, state personnel headcounts, and numerous other categories. The full consequences of these cuts on the state economy, fiscal health, population, and policy outcomes will take years to develop. In this paper, we provide the short term impacts of the cuts, how they interact with the current state of the economy, and a descriptive outlook of the some of the …

"Its Cargo Is People": Repositioning Commuter Rail As Public Transit To Save The New York–New Haven Line, 1960–1990, Seamus C. Joyce-Johnson
Harvey M. Applebaum ’59 Award
This essay explores the creation of the Metro-North Railroad in 1983 as a public agency to provide commuter train services on the New York–New Haven Line. The essay begins by bringing out the central role commuter rail services played in the negotiations over the New Haven Railroad’s bankruptcy in the 1960s. I argue that New Haven Line’s near liquidation during the bankruptcy prompted advocacy from commuters, urban planners, and politicians that pushed back against the trend towards automobile-centric urban transportation planning. In the next section, I use the New Haven Line’s subsequent operation in the 1970s under subsidy arrangements with …

Artificially Intelligent Copyright: Rethinking Copyright Boundaries, Aviv Hertzel Gaon
PhD Dissertations
My dissertation explores the legal boundaries of copyright law in the wake of artificial intelligence (AI) technology. In building the theoretical foundations for my dissertation, I go through several key phases. First, I highlight important historical events and milestones in AI. I further develop the philosophical debate on AI legal personhood and deliberate whether we are approaching a singularity the next stage of AI evolution. I also explore the concept of AI as it matured through the years. In the second part, I theorize how AI can be regarded as an author under IP normative standards. Part of accepting the …

State Standing And Cooperative Federalism, Ernest A. Young
State Standing And Cooperative Federalism, Ernest A. Young
Notre Dame Law Review
State lawsuits challenging federal policy generally encounter arguments that the states lack standing to sue, either under Article III’s “case or controversy” clause or under various prudential standing doctrines. These arguments have often taken novel forms—such as claims that states’ injuries are “self-inflicted” or offset by other benefits of federal policies—that have few precedents or analogs in the standing jurisprudence governing suits by private individuals. The United States has taken the position, in other words, that states should have special disabilities in filing lawsuits that would not apply to ordinary litigants. Likewise, prominent academics have argued that uniquely narrow standing …
The Use Of Vouchers To Negatively Reinforce Number Of Weeks Compliant Among Clients In A Mental Health Court, Michele Nicole Murdock
The Use Of Vouchers To Negatively Reinforce Number Of Weeks Compliant Among Clients In A Mental Health Court, Michele Nicole Murdock
Dissertations
The literature is sparse on the use of contingency management procedures in a mental health court (MHC). The purpose of this study was to examine the use of negative reinforcement for behavioral changes in a MHC. Specifically, the present study explored whether a voucher-based contingency management intervention improved the number of weeks compliant on MHC probation and whether participants were more externally than internally motivated to comply with MHC probation requirements. Vouchers were given for compliance with MHC probation requirements. The vouchers allowed participants to miss a future court date. It was hypothesized that participants who received the voucher would …

Speech, Intent, And The President, Katherine Shaw
Speech, Intent, And The President, Katherine Shaw
Cornell Law Review
Judicial inquiries into official intent are a familiar feature of the legal landscape. Across various bodies of constitutional and public law-from equal protection and due process to the First Amendment's Free Exercise and Establishment Clauses, from the Eighth Amendment to the Dormant Commerce Clause, and in statutory interpretation and administrative law cases across a range of domains-assessments of the intent of government actors are ubiquitous in our law.
But whose intent matters to courts evaluating the meaning or lawfulness of government action? When it comes to statutes, forests have been felled debating the place of legislative intent. But, although the …
Human-Animal Bonding In Animal-Assisted Interventions In Counseling, Ariann Evans Robino, Virginia Buechener-Maxwell
Human-Animal Bonding In Animal-Assisted Interventions In Counseling, Ariann Evans Robino, Virginia Buechener-Maxwell
Faculty Proceedings, Presentations, Speeches and Lectures
Animal-assisted interventionists incorporating an animal into clinical practice must harness the human–animal bond for therapeutic benefit. Therapists have a duty to understand the complex relational processes occurring in this modality (Stewart, Chang, Parker, & Grubbs, 2016). This paper describes the results of a preliminary study exploring the bonding and attachment processes in animal-assisted interventions in counseling (AAI-C).
Can A Distant Relative Allow The Government Access To Your Dna? The Fourth Amendment Implications Of Law Enforcement’S Genealogical Search For The Golden State Killer And Other Genetic Genealogy Investigations, George M. Dery Iii
UC Law Science and Technology Journal
This Article considers the advent of genetic genealogy, used by law enforcement in capturing the Golden State Killer suspect and in other cold cases. In these investigations, police used genetic information obtained from the open source genealogy site, GEDmatch, to build vast family trees spanning the entire country and several generations in order to locate suspects whose DNA matched that left at a crime scene. This Article analyzes the Fourth Amendment implications of government use of such powerful technology to explore such sensitive information as DNA. The conclusion the Supreme Court could reach, should it be called upon to examine …

Rural Futures Institute: Publications
Community leadership and involvement are important parts of community development. Rural communities rely on volunteers for many community development activities as well as local leadership positions. In smaller communities in particular, community members often take on multiple roles. Given these challenges, how involved are rural Nebraskans in community and political activities? How do they feel about the leadership in their community? How often do they have social interactions with others during a typical month? This paper provides a detailed analysis of these questions. This report details 1,776 responses to the 2019 Nebraska Rural Poll, the 24th annual effort to understand …

Violence Implicit In Hijab Suppression Laws In Uzbekistan, Tajikistan, And France Under The Cedaw Framework, Jordan Elizabeth Pahl
Violence Implicit In Hijab Suppression Laws In Uzbekistan, Tajikistan, And France Under The Cedaw Framework, Jordan Elizabeth Pahl
Washington International Law Journal
This Comment examines three instances of laws banning hijab, the headscarf worn by many Muslim women. These laws, as enacted in Soviet Uzbekistan, France, and Tajikistan provide justifications for violence against women on a number of levels and, as such, violate the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW). The stigmatization of Muslim women these laws perpetuate result in women’s lack of access to work and education as guaranteed by CEDAW, and also act as a catalyst for violence against women who violate these laws. This paper argues that hijab suppression laws violate CEDAW …
