The Intensification Of Hurricane Maria 2017 In The Antilles, Mark Jury, Sen Chiao, Raphael Cécé Oct 2019

The Intensification Of Hurricane Maria 2017 In The Antilles, Mark Jury, Sen Chiao, Raphael Cécé

Faculty Publications, Meteorology and Climate Science

Environmental influences on Hurricane Maria in the Antilles Islands are analyzed at the large-scale (1–25 September) and at the meso-scale (17–20 September 2017). The storm intensified rapidly prior to landfall in Dominica, going from category 1 to 5 in 15 h. As the storm progressed toward Puerto Rico (PR), its NE flank entrained air from seas cooled by the earlier passage of two hurricanes, and strengthened on its SW flank. Operational model forecasts tended to delay intensification until west of the Antilles Islands, thus motivating two independent weather research and forecasting (WRF) simulations. These gave minimal track errors at 1- …

Race, Ethnicity, And Prosecution In Cook County, Illinois, Besiki Luka Kutateladze, Rebecca Richardson, Ryan Meldrum, Don Stemen, David Olson, Elizabeth H. Webster, Maria Arndt, Dylan Matthews, Sadhika Soor

Criminal Justice & Criminology: Faculty Publications & Other Works

The analyses reveal few differences in outcomes across racial/ ethnic groups in Cook County. When looking at case approval, dispositions, and charge reductions for all felony offenses combined, differences in the probability of specific outcomes by race/ethnicity are relatively small after accounting for other case factors such as offense severity or number of charges. For many decision points, differences in the probability of specific outcomes range from just 0 percentage points to 4 percentage points across racial/ethnic groups. When looking at specific offense types – person, weapons, property, drugs – differences in the probability of case approval, dispositions, and charge …

In this issue, we explore several important social justice issues; first among these, the legacy of …

Perceptions Of Higher Education In Nonmetropolitan Nebraska: Research Report 19‐4, Rebecca Vogt, Cheryl A. Burkhart-Kriesel, Randolph L. Cantrell, Bradley Lubben, L. J. Mcelravy, Timothy Meyer, Jason L. Weigle

Rural Futures Institute: Publications

Some recent national polls have shown a decline in confidence in higher education. The cited reasons for this decline are concerns about affordability, access and the political culture on campuses. Given these national trends, how do rural Nebraskans view the impacts of their education? Do they view higher education as important for individuals and the economy? Have these views changed over the past four years? What types of higher education institutions have their households attended? This paper provides a detailed analysis of these questions. This report details 1,776 responses to the 2019 Nebraska Rural Poll, the 24th annual effort to …

A Content Analysis Case Study Of Media And Public Trust In Japan: After The Quake, Rose G. Campbell Oct 2019

A Content Analysis Case Study Of Media And Public Trust In Japan: After The Quake, Rose G. Campbell

Scholarship and Professional Work - Communication

On March 11, 2011, a magnitude 9.0 (Mw) earthquake off the Pacific coast of Honshu, Japan, caused a devastating tsunami, killing thousands of people. The 2011 Great Eastern Japan Earthquake also created a partial meltdown at the Fukushima Daiichi Nuclear Power Plant, operated by TEPCO. TEPCO’s and Japan’s government response during this tragedy is the focus of this study. How institutions handle crises impacts public trust in institutions, which is a central theme. Using Situational Crisis Communication Theory (SCCT) as a framework, a content analysis of a U.S. national newspaper and a Japan-based English language newspaper was conducted covering a …

The Myth Of Enforcing Border Security Versus The Reality Of Enforcing Dominant Masculinities, Jamie Abrams Oct 2019

The Myth Of Enforcing Border Security Versus The Reality Of Enforcing Dominant Masculinities, Jamie Abrams

Scholarly Articles in Law Reviews & Journals

This essay explores the masculinities underpinnings in modern immigration law, policy, and rhetoric. Existing analysis has captured the ways in which Trump-era immigration laws, policies, and rhetoric are explicitly and implicitly packaged in alarming racism and xenophobia. These critical lenses continue a long and deeply worrisome legacy of “othering” and dehumanizing immigrants and, more broadly, marginalizing communities of color in the United States.

Outside of the immigration law lens, separate strands of scholarship and media coverage have highlighted the toxic masculinities of the Trump era. These discussions have generally focused on President Trump’s treatment of women, the gendered campaign dynamics …

Makeup Or Fakeup?: The Need To Regulate Counterfeit Cosmetics Through Improved Chinese Intellectual Property Enforcement, Jennifer Lei Oct 2019

Makeup Or Fakeup?: The Need To Regulate Counterfeit Cosmetics Through Improved Chinese Intellectual Property Enforcement, Jennifer Lei

Fordham Law Review

This Note examines whether new developments in intellectual property enforcement are able to fix the notorious counterfeiting issue in China, particularly with counterfeit cosmetics. Counterfeit cosmetics are a threat to public safety in the United States and globally, especially as the cosmetics industry continues to expand. There are two opposing views on whether China’s intellectual property regime—in light of the 2017 to 2019 developments—is able to address the issue. This Note proposes that even with recent developments, current laws and enforcement methods do not reduce counterfeit production. Instead, this Note argues that the Chinese government should use educational campaigns to …

Prosecuting Dark Net Drug Marketplace Operators Under The Federal Crack House Statute, Thomas J. Nugent Oct 2019

Prosecuting Dark Net Drug Marketplace Operators Under The Federal Crack House Statute, Thomas J. Nugent

Fordham Law Review

Over 70,000 Americans died as the result of a drug overdose in 2017, a record year following a record year. Amidst this crisis, the popularity of drug marketplaces on what has been called the “dark net” has exploded. Illicit substances are sold freely on such marketplaces, and the anonymity these marketplaces provide has proved troublesome for law enforcement. Law enforcement has responded by taking down several of these marketplaces and prosecuting their creators, such as Ross Ulbricht of the former Silk Road. Prosecutors have typically leveled conspiracy charges against the operators of these marketplaces—in Ulbricht’s case, alleging a single drug …

The Kentucky Cabinet For Health And Family Services’ Response To The Hepatitis A Virus Outbreak In Kentucky: An Idea Model Analysis, Rachel Leigh Cato Oct 2019

The Kentucky Cabinet For Health And Family Services’ Response To The Hepatitis A Virus Outbreak In Kentucky: An Idea Model Analysis, Rachel Leigh Cato

Masters Theses & Specialist Projects

The hepatitis A crisis in Kentucky is unprecedented compared to other states. With thousands of hospitalizations and over 60 deaths in the state of Kentucky alone, there is a need to evaluate the government’s response to the hepatitis A virus (HAV) epidemic. Therefore, the instructional risk communication messages that are being conveyed by the Kentucky Cabinet for Health and Family Services (KCHFS) are instrumental in the education and action plans of Kentuckians who are at risk of contracting HAV.

This study utilizes the IDEA Model Thematic Analysis Codebook as a guide to analyze the KCHFS’ risk communication regarding the hepatitis …

Khookha Mcqueer: Advocacy For Non-Binary Queerness And Lgbtqi+ Representation In Tunisia, Jake Gomez Oct 2019

Khookha Mcqueer: Advocacy For Non-Binary Queerness And Lgbtqi+ Representation In Tunisia, Jake Gomez

Independent Study Project (ISP) Collection

In 2018, the Tunisian government arrested 127 Tunisians on the basis of suspicions regarding non-heterosexual and non-cisgendered acts. Tunisian civil society centralizes its core missions around advocating for the rights of LGBT individuals through attempts to target the measures that allow for such unlawful imprisonment: Articles 230 and 226 of the Tunisian Constitution. But within the undiscussed gaps between laws, cultures of homo and transphobia, and civil society lies alternative measures for non-linear forms of queer advocacy. This research engages with the work of Khookha McQueer -- a Tunisian LGBTQI+ rights activist -- and documents conversations had with Khookha regarding …

An “Untrammeled Right”? The Mccarran Immigration Subcommittee And The Origins Of Presidential Authority To Suspend And Restrict Alien Entry Under §1182(F), H. Richard Friman Oct 2019

An “Untrammeled Right”? The Mccarran Immigration Subcommittee And The Origins Of Presidential Authority To Suspend And Restrict Alien Entry Under §1182(F), H. Richard Friman

Political Science Faculty Research and Publications

The language of Section 212(e) of the 1952 Immigration and Nationality Act, 8 U.S.C. §1182(f), contains a sweeping authorization of presidential discretion to suspend and restrict alien entry into the United States. Senator Pat McCarran (D-NV) first introduced the subsection in 1950 as part of the omnibus immigration bill drafted by his Judiciary Committee’s immigration subcommittee. The specific origins of the language and the original intent behind the subsection remain missing pieces in the extensive scholarly literature on the 1952 INA and legislative history as explored by the courts. This article reveals that the subcommittee modeled the subsection on the …

Assumptions About Terrorism And The Brandenburg Incitement Test, Christina E. Wells Oct 2019

Assumptions About Terrorism And The Brandenburg Incitement Test, Christina E. Wells

Faculty Publications

The incitement standard announced in Brandenburg v. Ohio is one of the most familiar tests in the Supreme Court's jurisprudence. It prohibits government officials from punishing advocacy of illegal activity unless it is directed and likely to imminently incite such activity. Brandenburg's standard has become a pillar of free speech law, allowing government officials to protect public safety by punishing only speech intended and likely to create an imminent danger of harm, while protecting even the most abhorrent of speakers from suppression of their speech simply because government officials fear or dislike it. Terrorist advocacy, however, is putting pressure on …

Tangled Arms: Modernizing And Unifying The Arm-Of-The-State Doctrine, Kelsey Joyce Dayton Oct 2019

Tangled Arms: Modernizing And Unifying The Arm-Of-The-State Doctrine, Kelsey Joyce Dayton

University of Chicago Law Review

The arm-of-the-state doctrine, which entitles certain governmental entities to the states’ sovereign immunity, is an embodiment of American federalism. In theory, this doctrine ensures that federal courts appreciate the concerns for state sovereignty and solvency that motivated the passage of the Eleventh Amendment. However, a combination of factors—the Supreme Court’s sparse guidance, the growth and diffusion of power across local, state, and federal governments, and the availability of other immunity doctrines—has rendered the arm-of-the-state doctrine an incomprehensible anachronism. Most courts determine whether an entity defendant receives arm-of-the-state immunity by examining the entity’s legal status and structure. But many courts applying …

Truth, Lies, And Copyright, Cathay Y. N. Smith

Faculty Law Review Articles

Fake news may be trending right now, but fake news is not the only source of fake facts that we consume. We encounter fake facts every day in the historical or biographical books we read, the movies we watch, the maps we study, the tele-phone directories and dictionaries we reference, and the religious or spiritual guides we consult. While it is well-established that copyright does not protect facts because facts are discovered rather than created, fake facts are created and can often be as original and creative as fiction.

This Article is the first to offer a comprehensive analysis of …

Rethinking Emergency Legislation In Washington State, Eva Sharf Oct 2019

Rethinking Emergency Legislation In Washington State, Eva Sharf

Washington Law Review

The people’s right to referendum in Washington State is substantively limited in only one way: the people cannot block through referendum “such laws as may be necessary for the immediate preservation of the public peace, health or safety, support of the state government and its existing public institutions.” This emergency exception to the referendum power must be explicitly invoked by the Washington State Legislature in what is called an “emergency clause.” Washington courts are willing to review emergency clauses to determine if a bill is, in fact, “necessary for the immediate preservation of the public peace, health or safety.” However, …

Law Enforcement Officers' Romantic Relationships Strengths : A Mixed Methods Analysis, Mary Telisak

Dissertations

This study explores the diversity of personal and interpersonal features associated with relationship quality for law enforcement officers and their romantic partners. A concurrent, embedded, mixed methods design was used to address the central research question, "What interpersonal characteristics and work- and home-based contextual factors are associated with relationship quality for law enforcement officers and their romantic partners?" Specific efforts were made to account for the gaps left by existing literature on the romantic relationships of law enforcement officers. Participants were recruited from four Midwestern communities of similar size and demographic composition in the winter of 2018-2019. One hundred ten …
