The "Rational Federalist": Synthesizing Necessity And Propriety In The Sweeping Clause, Shane Magnetti
The "Rational Federalist": Synthesizing Necessity And Propriety In The Sweeping Clause, Shane Magnetti
St. John's Law Review
(Excerpt)
This Note will argue that flexibility as to what constitutes a “necessary” law combined with a rigid standard for what makes a law “proper” enables Congress to execute its enumerated powers without overreaching. Part I outlines differing scholarly theories as to the legal origins of the Necessary and Proper Clause. Sections A, B, and C outline the theories that the Clause stems from principles of agency law, administrative law, and corporate law, respectively. Section D examines the implied powers theory of the Clause’s genesis. Next, Part II examines the Supreme Court’s early Necessary and Proper Clause jurisprudence—namely McCulloch v. …

The Influence Of Selected Factors Impacting The Incidence And Severity Of Accidents Involving Pedestrian/Bicyclists And Motorized Vehicles In Urban Areas Of Louisiana, Randall M. Verret Jr.
LSU Doctoral Dissertations
The primary purpose of this study was to determine the influence of selected demographic, environmental and infrastructure factors on the incidence and severity of traffic accidents involving a motorized vehicle and a non-motorized (pedestrian or bicyclist) individual. Identification of influential factors can aid in developing more effective countermeasures, targeted education and training programs to reduce the fatality and injury risks to vulnerable road users. A total of 9,538 crash data records involving vulnerable road users and motor vehicle drivers were utilized in this study.
Overall, vulnerable road users were found to have higher incidences of impairment than motorized vehicle drivers …

On The Reactionary Treatment Of American Radicals By J. Edgar Hoover's Fbi, Sonia Potter
Student Projects from the Archives
African Americans, who had been systematically oppressed from the very beginning of their time in the United States, were calling more and more loudly for freedom and equality in the mid-twentieth century. Compounded with the fear and hatred of communism was also a fear of black Americans ascending to the same societal plane as white Americans, especially among individuals and groups of people who held racist views and had reservations about equality between blacks and whites.
One of the groups of people who seemed to have reservations about such a concept was the United States’ own Federal Bureau of Investigation …

The Danger In New Mexico's Method Of Deciding Whether An Out-Of-State Conviction Is A Registrable Sex Offense, Sam Ashman
New Mexico Law Review
Plea offers present criminal defendants with the option of acquiescing to specific punitive or rehabilitative measures rather than allowing judges and juries to determine those measures at trial. Defendants often accept plea offers over going to trial because a plea agreement provides the comfort of knowing what consequences to expect. However, in cases involving sexual misconduct, it is more difficult to anticipate the consequences of plea agreements. All fifty states maintain sex-offender registries with varying criteria for when a resident must register. In 2013, the New Mexico Supreme Court decided State v. Hall and held that it may be necessary …

Mobile Ad Hoc Networks In Transportation Data Collection And Dissemination, Kardigue Konte
Theses and Dissertations
The field of transportation is rapidly changing with new opportunities for systems solutions and emerging technologies. The global economic impact of congestion and accidents are significant. Improved means are needed to solve them. Combined with the increasing numbers of vehicles on the road, the net economic impact is measured in the many billions of dollars. Promising methodologies explored in this thesis include the use of the Internet of Things (IoT) and Mobile Ad Hoc Networks (MANET). Interconnecting vehicles using Dedicated Short Range Communication technology (DSRC) brings many benefits. Integrating DSRC into roadway vehicles offers the promise of reducing the problems …

Plant-Produced Oxidation/Reduction Enzymes As Bioremediation Agents, Joshua Byrd
Plant-Produced Oxidation/Reduction Enzymes As Bioremediation Agents, Joshua Byrd
Student Theses and Dissertations
Contamination of the environment directly impacts animal, plant, and human health and agricultural production. A potential solution this project is offering incorporates the use of enzymes from fungi; manganese peroxidase and laccase. Two formulations of recombinant manganese peroxidase (MnP) from corn and commercial laccase have been tested on synthetic dyes and atrazine in an aqueous environment. Laccase utilizes oxygen when degrading these pollutants. All dyes were degraded to some extent by both enzymes. The products from the enzymatic reactions of one dye, Methyl Orange were analyzed with High Performance Liquid Chromatography (HPLC). The HPLC showed that there were products of …

From Memphis, With Love: A Model To Protect Protesters In The Age Of Surveillance, Farrah Bara
From Memphis, With Love: A Model To Protect Protesters In The Age Of Surveillance, Farrah Bara
Duke Law Journal
In 1978, after two years of contentious litigation, the City of Memphis entered into a unique agreement with its citizens: it signed a consent decree, stipulating that it would halt its interference with First Amendment–protected activities. More specifically, the Consent Decree barred the City from surveilling protesters—the very conduct that triggered litigation.
Fast forward forty years. In 2018, narratives of police brutality dominated the nation’s headlines. Consequently, protesters demonstrated from the streets of Ferguson, Missouri to Oakland, California. And in Memphis, Tennessee, those who protested were often met with an all-too-familiar response—surveillance by the Memphis Police Department. That is until …

Journal of Vincentian Social Action
U.S. foreign policy took a dramatic shift since the Trump Administration took office in 2017. The country has pulled out of the Paris Agreement, has imposed more sanctions on Russia, and has vowed to renegotiate international trade deals to “Make America Great Again.” U.S. foreign policy has an enormous impact on the lives of foreign professionals, from the ability to obtain work visas to being able to simply travel to the U.S. to pursue employment opportunities.
