In the U.S., prison administrators often rely on risk assessment instruments to place and supervise inmates, as well as manage, plan and allocate resources. Hence, any improvement in the accuracy performance of risk assessment instruments is likely to result in significant benefits for offender classification and rehabilitation, management systems, and public safety. To date, researchers have explored the relative predictive performance between regression and non-regression methods and the overall evidence is inconclusive. In this study, we seek to advance the debate regarding the efficacy of traditional regression methods versus the utility of machine learning techniques in forecasting inmate misconduct by …

Medical Marijuana Policy Conflicts Within The District Of Columbia Private Workplace, Robert B. Kennedy
Medical Marijuana Policy Conflicts Within The District Of Columbia Private Workplace, Robert B. Kennedy
Walden Dissertations and Doctoral Studies
The District of Colombia poses a unique challenge to private employers because the passage of a local medical marijuana policy was instituted in a federalized district that is obligated to abide by federal Schedule 1 narcotic laws. Using punctuated equilibrium as the theoretical foundation, the purpose of this case study was to understand how managers maintain compliance and address the conflict between different levels of government. Data were collected from interviews with 8 private industry hiring personnel who operate within the District of Columbia. These interviews were transcribed, inductively coded using a 2 cycle coding procedure, and then subjected to …

Though the American legal system is deferential toward religion and churches, it is undeniable that the Church of Latter-day Saints-and other like organizations-are not just churches. They are, instead, important participants in the market economy, some of them global business enterprises of major proportions. This twinning of profit and spirit is seamless for many religions, with numerous modem churches preaching a "prosperity gospel" that promises spiritual and temporal blessings in return for donations."' Still other churches-such as the Church of Scientology-directly charge for religious services that are "necessary" for spiritual improvement and advancement in the church hierarchy. And still others …
Student Loan Discharge: Reevaluating Undue Hardship Under A Presumption Of Consistent Usage, Ashley M. Bykerk
Student Loan Discharge: Reevaluating Undue Hardship Under A Presumption Of Consistent Usage, Ashley M. Bykerk
Emory Bankruptcy Developments Journal
An increasing number of Americans are suffering from financial distress caused by educational debt. Some of those individuals seek relief from that distress through the bankruptcy system, where they must establish that repaying their educational debt would impose an undue hardship in order to obtain a discharge of such debt. The author focuses on § 523(a)(8) of the U.S. Bankruptcy Code, which sets forth educational debt as an exception to bankruptcy discharge unless the repayment of student loan obligations imposes an 'undue hardship.' The author concludes that the primary inquiry into a debtor's undue hardship claim must focus on the …

Lead Us Not Into Temptation: A Response To Barbara Fedders’S “Opioid Policing”, Anna Roberts
Lead Us Not Into Temptation: A Response To Barbara Fedders’S “Opioid Policing”, Anna Roberts
Indiana Law Journal
In “Opioid Policing,”1 Barbara Fedders contributes to the law review literature the first joint scholarly analysis of two drug policing innovations: Seattle’s Law Enforcement Assisted Diversion (LEAD) program and the Angel Initiative, which originated in Gloucester, Massachusetts. Even while welcoming the innovation and inspiration of these programs, she remains clear-eyed about the need to scrutinize their potential downsides. Her work is crucially timed. While still just a few years old, LEAD has been replicated many times2 and appears likely to be replicated still further—and to be written about much more. Inspired by Fedders’s call for a balanced take, this Response …

Health Care Ai: Law, Regulation, And Policy., W. Nicholson Price Ii
Health Care Ai: Law, Regulation, And Policy., W. Nicholson Price Ii
Book Chapters
As discussed in previous chapters, artificial intelligence (AI) has the potential to be involved in almost all aspects of the health care industry. The legal landscape for health care AI is complex; AI systems with different intended uses, audiences, and use environments face different requirements at state, federal, and international levels. A full accounting of these legal requirements, or of the policy questions involved, is far beyond the scope of this chapter. Additionally, the legal and regulatory framework for AI in health care continues to evolve, given the nascent stage of the industry.
In this chapter, we offer an overview …

A Beaconing-Based Roadside Services Discovery Protocol For Vehicular Ad Hoc Networks, Kifayat Ullah, Ali Sayyed, Muhammad Aziz, Edson Moreira
Turkish Journal of Electrical Engineering and Computer Sciences
Recently, research on vehicular ad hoc networks (VANETs) has gained momentum all over the world. These emerging networks promise to make our driving experience more efficient, safer, comfortable, and enjoyable. VANETs have the potential to support a wide range of interesting applications. One such promising application area is the discovery of roadside services on the highways. Drivers need an efficient way to find these services during their journeys. However, due to the unique features of VANETs, the design and implementation of such applications is a challenging task. In this paper, we propose an application layer beaconing-based roadside services discovery protocol …

A Common Law Of Zoning, Michael Allan Wolf
A Common Law Of Zoning, Michael Allan Wolf
UF Law Faculty Publications
This Article for the first time identifies a common law of zoning, describes the typology of this essential and overlooked element of American land use law, and establishes the historical and structural context for its pervasive set of rules and principles. Over the past 100 years, American judges, filling in the gaps and resolving the ambiguities of a surprisingly uniform set of state enabling statutes, have produced this body of common law. The story will take the reader to Iowa cornfields that surround an iconic baseball diamond; to a federal agency that gave an important impetus to the nationwide adoption …
Equality, Equity, And Dignity, Nancy E. Dowd
Equality, Equity, And Dignity, Nancy E. Dowd
UF Law Faculty Publications
In this Essay I explore the definition and scope of children’s equality. I argue that equality includes equity and dignity. The meaning of each of these concepts is critical in imagining a deep, rich vision of equality, and in constructing policies to achieve that vision. This definition of equality creates affirmative rights, demands action to resolve structural discrimination that creates and sustains hierarchies among children, and requires affirmative support for children’s developmental equality.
Reconceptualizing Criminal Justice Reform For Offenders With Serious Mental Illness, E. Lea Johnston
Reconceptualizing Criminal Justice Reform For Offenders With Serious Mental Illness, E. Lea Johnston
UF Law Faculty Publications
Roughly 14% of male inmates and 31% of female inmates suffer from one or more serious mental illnesses, such as schizophrenia, bipolar disorder, and major depressive disorder. Policymakers and the public widely ascribe the overrepresentation of offenders with serious mental illness in the justice system to the “criminalization” of the symptoms of this afflicted population. The criminalization theory posits that the criminal justice system has served as the primary agent of social control over symptomatic individuals since the closure of state psychiatric hospitals in the 1950s and the tightening of civil commitment laws. The theory identifies untreated mental illness as …

Assessment Of Observed Weather Impacts On Small Unmanned Aircraft (Ua) Operations, Nicole Stevens
Assessment Of Observed Weather Impacts On Small Unmanned Aircraft (Ua) Operations, Nicole Stevens
Theses and Dissertations
Unmanned Aircraft (UA) are being used more frequently and for an increased variety of purposes, from military use to medical deliveries, disaster and building infrastructure imagery, and agriculture. While the interest in and usage of UA grows, little is known about how often UA flight operations are impacted by different meteorological phenomenon. In this study, a 30-year climatology of surface stations and sounding observations are used to determine the likelihood of UA operations without weather-driven restrictions or grounding at five locations. The locations of Bismarck, ND, Riverton, WY, Oakland, CA, Albuquerque, NM, and Miami, FL are selected to represent different …

Analysis Of Nurses’ Perceptions Of Their Role In A Multidisciplinary Team, Jessica Ann Dempsey
Analysis Of Nurses’ Perceptions Of Their Role In A Multidisciplinary Team, Jessica Ann Dempsey
Walden Dissertations and Doctoral Studies
A better understanding of task allocation for the registered nurse (RN) within the scope of the multidisciplinary care team model is required. Patients, healthcare staff, and medical facilities that utilize RNs in multidisciplinary care teams will benefit from improved role identification. A multidisciplinary care team consists of a variety of health care professionals and without role identification, confusion, miscommunication, and negative patient outcomes can occur. A literature review demonstrated that a gap in knowledge existed related to task allocation and role identification of RNs within a multidisciplinary care team. The purpose of this study was to evaluate RNs’ scope of …
