Whistleblowing As A Ciceronian Moral Obligation To The State, Hailey Sylvander
Whistleblowing As A Ciceronian Moral Obligation To The State, Hailey Sylvander
Fordham Undergraduate Law Review
This Note explores the public law of whistleblowing through the lens of the Ancient Roman philosopher Marcus Tullius Cicero (106-43 BC). It first describes the current discourse on whistleblowing, justifications for whistleblowing, and a contemporary jurisprudential theory that examines those justifications. Then, the Note will explain Cicero’s theory on one’s duty to the state through acceptable public behavior, and how it relates to jurisprudence via the lens of morality. Next, the Note will apply Cicero’s theory to the case Department of Homeland Security v. Maclean to illustrate how the Supreme Court of the United States (the “Court”) has used precedent …

Demystifying Nationwide Injunctions, Alan M. Trammell
Demystifying Nationwide Injunctions, Alan M. Trammell
Scholarly Articles
The phenomenon of nationwide injunctions—when a single district court judge completely prevents the government from enforcing a statute, regulation, or policy—has spawned a vigorous debate. A tentative consensus has emerged that an injunction should benefit only the actual plaintiffs to a lawsuit and should not apply to persons who were not parties. These critics root their arguments in various constitutional and structural constraints on federal courts, including due process, judicial hierarchy, and inherent limits on “judicial power.” Demystifying Nationwide Injunctions shows why these arguments fail.
This Article offers one of the few defenses of nationwide injunctions and is grounded in …

3d Printing And U.S. Copyright Law, Ryan G. Vacca, Peter S. Menell
Law Faculty Scholarship
This article explores how 3D printing fits within US copyright law. US copyright law provides a well-developed general framework for the protection of creative designs, whether fixed in CAD files or 3D objects. Enforcement of copyright protection in this industry faces some of the same challenges encountered by other content industries whose works were disrupted by the digital revolution. Nonetheless, 3D printing brings distinctive issues. Although grounded in statute, US copyright law has a rich common law tradition that affords courts significant leeway in adapting doctrines to new and unforeseen technological developments. This capacity is reinforced by the range of …

A Rational Approach To The Role Of Publicity And Condemnation In The Sentencing Of Offenders, Mirko Bagaric, Peter Isham
A Rational Approach To The Role Of Publicity And Condemnation In The Sentencing Of Offenders, Mirko Bagaric, Peter Isham
Florida State University Law Review
The punishment imposed on criminal offenders by courts often does not exhaust the hardship they experience. There are a number of collateral forms of punishment that many offenders are subjected to as a result of their offense(s). Some of these deprivations are institutional, such as being dismissed from employment or being disqualified to vote. Other hardships are less predictable and harder to quantify. Public scorn-often directed towards high profile offenders, such as O.J. Simpson and Anthony Weiner-can be the cause of considerable, additional suffering to offenders. It can engender feelings of shame, embarrassment, and humiliation. At the same time, the …

Framing Hate: Moral Foundations, Party Cues, And (In)Tolerance Of Offensive Speech, Grant M. Armstrong, Julie Wronski
Faculty and Student Publications
© 2017, PsychOpen. All rights reserved. One of the most controversial elements of political tolerance concerns support for hate speech. We argue that there are two factors that can reduce tolerance for hate speech: 1) moral foundations and 2) party cues. U.S. citizens’ tolerance of hate speech will be reduced when it is framed as a violation of a specific moral foundation, opposed by a political party, or when the morality violation is utilized by party elites. Using two survey experiments, we manipulated the target of hate speech (i.e. Muslims or the American flag), whether the speech violated a moral …

Locked Out And Locked Up: Assessing The Relationship Between Housing Instability And Recidivism For People With Criminal Drug Records Using A General Strain Theory Framework, Mark Paul Plassmeyer
Locked Out And Locked Up: Assessing The Relationship Between Housing Instability And Recidivism For People With Criminal Drug Records Using A General Strain Theory Framework, Mark Paul Plassmeyer
Electronic Theses and Dissertations
More than 32.5 million Americans have been arrested for drug offenses since 1996 contributing to the fact that currently nearly as many Americans have a criminal record as a college degree. After an arrest for a drug offense, often regardless of whether one is convicted, people are subject to civil penalties known as collateral sanctions. These sanctions include restrictions on access to subsidized housing, financial benefits, student loans, employment, and important aspects of civic life such as voting or holding office.
Due to recent recidivism rates - over 75% for people exiting prison with a drug record - researchers and …

Senate Bill 4: Police Officer's Opinions On Texas's Ban Of Sanctuary Cities, Megan E. Reed
Student Scholarship
For this Article, the Author interviewed six local law enforcement agencies in Texas regarding SB4. Based on those interviews and other research, this Article concludes that SB4 likely does not uproot and change Texas policing practices and asserts that SB4 may in fact be highly ineffective at improving resident safety, which was Texas lawmakers’ stated purpose for SB4. SB4 continues to have far reaching impacts, including concerns of racial profiling, victims and witnesses refusing to come forward due to fears of deportation, and damage to police officers’ reputations. Further, while some local law enforcement agencies claim they will not have …
Placemaking/Displacement: Architectures Of Exclusion In The Bay Area, Gordon Douglas
Placemaking/Displacement: Architectures Of Exclusion In The Bay Area, Gordon Douglas
Faculty Publications, Urban and Regional Planning
This working paper presents new research and argumentation regarding the way we think about the material culture of place and argues that thinking hard about place is essential for addressing social inequality in our cities. Drawing on new empirical research – ethnographic observation, photography, and interviews – it takes the varied communities and landscapes of the San Francisco Bay Area as a lens through which to interrogate the prominent trend of so-called “placemaking” in urban planning, development, and design. I argue that placemaking is intellectually incoherent and frequently elitist in practice, often ignoring existing places while portending a real possibility …
