Siena College Summer Institute: A Program Design For A Short-Term Program For Students From Siena's International Exchange Universities., Angelique Turman Corchado
Siena College Summer Institute: A Program Design For A Short-Term Program For Students From Siena's International Exchange Universities., Angelique Turman Corchado
Capstone Collection
This is a proposal of a program design for a three week summer program at Siena College for international students from Siena’s partner universities in Brazil and Columbia. The current trend of increased participation in short-term programs abroad has lead to the need for more programs. This is especially the case for thematic short-term programs for international students in the United States, as there is a lack of affordable options that offer college credit. The program’s curriculum is based on the Holistic and Emerging Adulthood development theories to ensure it meets the cognitive, interpersonal and intrapersonal needs of the students. …

Political Activists Or Violent Fans? Understanding The Moroccan Ultras Perspective Through Social Media Discourse Analysis, Mamer Alomari
Capstone Collection
This paper examines the origins, traditions, reasons behind rapid numbers expansion, and violent tendencies of organized groups of young football fans called Ultras. It also sheds the light on Al Raja Ultra groups, the first Moroccan Ultras groups and the most violent who started emerging in Casablanca in 2005, and since then thrived and diversified, not only in Casablanca but in Morocco as a whole. It’s unknown where the culture was derived from due to lack of literature on this matter but speculated to be a mimicking of neighboring countries such as Spain, and Tunisia where this phenomenon has been …
Daca, Government Lawyers, And The Public Interest, Stephen Lee, Sameer M. Ashar
Daca, Government Lawyers, And The Public Interest, Stephen Lee, Sameer M. Ashar
Fordham Law Review
On June 15, 2012, the Obama administration announced a significant change in immigration policy: Homeland Security Secretary Janet Napolitano began to instruct immigration officials to defer enforcement actions against those noncitizens who would likely be eligible for relief under the DREAM Act, should Congress choose to pass it. This program, which came to be known as Deferred Action for Childhood Arrivals (DACA), has become the most significant immigration-benefits program in a generation. Not since Congress passed a comprehensive reform bill in 1986, which included a pathway to citizenship, has an immigration program so quickly and positively changed the lives of …
Hidden Nondefense: Partisanship In State Attorneys General Amicus Briefs And The Need For Transparency, Lisa F. Grumet
Hidden Nondefense: Partisanship In State Attorneys General Amicus Briefs And The Need For Transparency, Lisa F. Grumet
Fordham Law Review
In all fifty states, the State Attorney General (SAG)—as the state’s chief legal officer—is charged with defending state laws that are challenged in court. If an SAG declines to defend or challenges a state law on the ground that it is unconstitutional—an action scholars describe as “nondefense”— the SAG ordinarily will disclose this decision to the public. This Essay discusses a hidden form of nondefense that can occur when SAGs file amicus curiae briefs on behalf of their states in matters before the U.S. Supreme Court. Surprisingly, some SAGs have joined multistate amicus briefs that support invalidating other states’ laws …

Emotional Intelligence As An Attribute Of Fire Service Leadership, Paul D. Froman Ma
Emotional Intelligence As An Attribute Of Fire Service Leadership, Paul D. Froman Ma
All Student Scholarship
Emotional intelligence is a critical attribute of successful leaders. Kastros (2014) and Hustoles (2017) present an argument that there is a lack of leadership within the modern Fire Service. Research to date has demonstrated a direct link between emotional intelligence and successful leadership. This principle applies to hierarchical organizations at large. The present study was designed as a qualitative evaluation of the extent to which emotional intelligence is found within the leadership of the United States Fire Service. The instrument used to conduct this research was a set of questions that were asked during personal interviews. On average, each interview …

Using Emotional Design And Culture Analysis To Develop An Effective Anti-Drinking And Driving Poster Campaign In Butte, Montana, Geeta Shrestha
Graduate Theses & Non-Theses
Driving Under the Influence (DUI) is a serious problem in the United States. According to a Mothers Against Drunk Driving (MADD) report in 2017, drunk driving kills 10,000 Americans every year. During 2016, Montana's alcohol impaired fatality rate ranked among the highest in the nation. Montana communities have attempted to implement several programs to try and reduce alcohol impaired driving fatalities and injuries. Educational campaigns, tougher DUI laws, ignition interlock systems, and Mariah's Challenge are a few such attempts. However, Montana's DUI problem has not been significantly reduced. This project studies drinking culture in Butte, Montana. It also examines the …

Meritless Historical Arguments In Second Amendment Litigation, Mark Anthony Frassetto
Meritless Historical Arguments In Second Amendment Litigation, Mark Anthony Frassetto
UC Law Constitutional Quarterly
Since Heller Second Amendment litigation and scholarship has focused in large part on questions about the historical understanding of the Second Amendment. One area where this historical analysis has been especially pronounced is in litigation over the scope of the Second Amendment right outside of the home. Litigants, amici, and scholars fiercely debate the meaning of historical statutes, treatises, and cases, arguing about the scope of the right to carry arms outside of the home at the time of the Second and Fourteenth Amendments’ ratifications. Most law review articles attempt to address difficult or hotly contested legal issues. This is …
A Secret Weapon?: Applying Privacy Doctrine To The Second Amendment, Jody Lyneé Madeira
A Secret Weapon?: Applying Privacy Doctrine To The Second Amendment, Jody Lyneé Madeira
UC Law Constitutional Quarterly
In the past decade, “gun rights” advocates have attempted to strategically articulate a Second Amendment privacy interest in being free from interference from both governmental actors and private actors with ownership of, access to, or use of firearms. This essay explores why privacy is an appealing framework for these purposes, and how courts have responded to such claims thus far. Part I analyzes privacy as a legal and sociocultural construct, assesses claims that firearms ownership and use are stigmatized, and discusses how privacy doctrine can be a stigma management strategy. Part II examines three cases in which gun rights supporters …

Analytical And Experimental Study Of Laser Cladding Of Ni/Wc Metal Matrix Powders Reinforced With Rare Earth Elements Using A High Power Direct Diode Laser, Mohammed Sayeed
Mechanical Engineering Research Theses and Dissertations
The corrosion and wear are major limiting factors for steel in the harsh environments and can be controlled by depositing protective passive coatings. Nickel based alloy cladding of steel offers a solution by enabling better corrosion and wear resistance, and high bonding strength. The laser surface cladding of steel was conducted using a high power direct diode laser. Layers of tungsten carbide in Ni (40%Ni-60%WC) combined with 1% and 2% Lanthanum Oxide (La2O3) and Cerium Oxide (CeO2) were deposited on ASTM A36 steel substrate. The X-ray diffraction and scanning electron microscopy were employed to …
Brief For 190 Bipartisan Elected Officials, Counties, And Cities From Arizona, Colorado, Connecticut, Florida, Georgia, Illinois, Nevada, New Jersey, New York, Pennsylvania, Virginia, Washington, And Wisconsin As Amici Curiae Supporting Respondents, Jeffrey M. Wice
Redistricting Resources
This amicus brief argues that the addition of a citizenship question to the census will have profound consequences. It will lead to an undercount of the populations in many communities nationwide, including those represented by amici. Such an undercount will cause hundreds of millions of dollars in federal funding to be improperly allocated away from these communities, thus reducing their access to critical federal programs and depriving them of vital public services.
Gun Safety In The Age Of Kavanaugh, Joseph S. Hartunian
Gun Safety In The Age Of Kavanaugh, Joseph S. Hartunian
Michigan Law Review Online
This Essay takes stock of the different approaches adopted and advocated for in evaluating constitutional challenges in Second Amendment opinions throughout the country. The author’s hope is that doing so will help highlight the contours for debate when the Supreme Court does finally start to define some of the limits purported to exist by Justice Scalia. Part I analyzes the paths explicitly rejected by Heller I by reviewing the limits considered allowable by Justice Scalia. Part II considers the ongoing debate between the courts on the application of “strict” or “intermediate” scrutiny for Second Amendment challenges. Part III examines then-Judge …

Opioid Policing, Barbara Fedders
Opioid Policing, Barbara Fedders
Indiana Law Journal
This Article identifies and explores a new, local law enforcement approach to alleged drug offenders. Initially limited to a few police departments, but now expanding rapidly across the country, this innovation takes one of two primary forms. The first is a diversion program through which officers refer alleged offenders to community-based social services rather than initiate criminal proceedings. The second form offers legal amnesty as well as priority access to drug detoxification programs to users who voluntarily relinquish illicit drugs. Because the upsurge in addiction to —and death from—opioids has spurred this innovation, I refer to it as “opioid policing.” …
Auditing Predictive Policing, Jeremiah Scanlan
Auditing Predictive Policing, Jeremiah Scanlan
Brigham Young University Prelaw Review
Predictive policing technology has been adopted by police departments in major cities throughout the US, and while its use continues to spread, the legal implications of its use have not been thoroughly examined. Predictive policing algorithms may be biased against minorities and other vulnerable groups, which may lead police departments to pursue policing strategies that harm these groups. This article proposes that legislatures should fill the current gap in legal oversight by requiring external audits of predictive policing algorithms as used by police departments. These audits would examine the algorithms for bias using up-to-date technological tools and release the results …
