No Soldier Left Behind: A Comprehensive Analysis Of Veterans’ Treatment Courts, Stephen Ramunno
No Soldier Left Behind: A Comprehensive Analysis Of Veterans’ Treatment Courts, Stephen Ramunno
Criminology Student Work
Veterans’ Treatment Courts (VTCs) focus on rehabilitation, rather than incarceration, to address underlying causes of criminal behavior among veterans. Some criminal behavior in this population arises from substance abuse, traumatic brain injury (TBI), post-traumatic stress disorder (PTSD), and other mental health concerns (Justice for Vets, 2018). In order to determine the effectiveness of VTCs and the services provided, an in-depth and systematic analysis is crucial. In this research, a systematic approach was employed to analyze the current VTC process, participants selected, and recidivism rates among those who complete the sanctioned requirements. Following an adapted meta-analysis framework, evaluations of VTCs were …

Smartphones And Schoolwork: Determining The Relationship Between Students’ Beliefs And Habits Regarding Phones, Luke Breems
Smartphones And Schoolwork: Determining The Relationship Between Students’ Beliefs And Habits Regarding Phones, Luke Breems
Master of Education Program Theses
This action research project investigated the relationship between students’ beliefs about the effects of using phones concurrently with schoolwork and the extent to which they engage in that behavior. Forty-five students from an independent school in southwestern Ontario participated in a study to determine their beliefs about phones’ effects on their schoolwork, and their responses were compared to observational data regarding how frequently they checked their phones during class. The results of the study indicate that, on average, students believe phones have little effect on their schoolwork, in contrast to current academic literature, which suggests an overall negative effect. This …

Local Transportation Decisions For A Resilient Future, New England Environmental Finance Center
Climate Change
This report documents results of a pilot project generously funded by the University of Maine system through the Research Reinvestment Fund. The work used a new tool created by the Maine Department of Transportation and evaluated its potential use for municipal governments. The tool assembles information about several types of risk to infrastructure project delivery (e.g., bridge and culvert upgrades) and makes it available to field engineers to enhance their design decisions.
The New England Environmental Finance Center tested the tool’s use in Scarborough, Maine and identified several ways public works managers could benefit from information provided by the tool, …

Second Chance For Youthful Offenders: Intervention, Prevention, Solution, Monieke Nikole Mcneil
Political Science Student Work
This thesis was written with the specific intent and purpose to address and bring awareness to the “true” underlying causations of juvenile crime and delinquency. To create a new systematic approach and set of policies that effectively diminishes juvenile crime and delinquency and implement and promote new effective solutions of systematic accountability. Although there have been several slight attempts to change the model in which we handle delinquency and crime, an overall change to the system as a whole is warranted. There must be a more comprehensive strategy and culpable understanding of the correlation between the behaviors of crime and …

Right At Home: Modeling Sub-Federal Resistance As Criminal Justice Reform, Trevor G. Gardner
Right At Home: Modeling Sub-Federal Resistance As Criminal Justice Reform, Trevor G. Gardner
Florida State University Law Review
Over the past two decades, state and local governments have crippled the federal war on marijuana as well as a series of federal initiatives designed to enforce federal immigration law through city and county police departments. This Article characterizes these and similar events as sub-federal government resistance in service of criminal justice reform. In keeping with recent sub-federal criminal reform movements, it prescribes a process model of reform consisting of four stages: enforcement abstinence, enforcement nullification, mimicry, and enforcement abolition. The state and local governments that pass through each of these stages can frustrate the enforcement of federal criminal law …
The Structure Of Torts, Thomas C. Galligan Jr
The Structure Of Torts, Thomas C. Galligan Jr
Florida State University Law Review
Tort law consists of a number of different causes of action which are seemingly unrelated except that all involve civil wrongs, other than mere breaches of contract. The various torts have different elements; some, like the nominate or intentional torts, very specific; others, like negligence, more general and vague. There is no apparent, coherent, or consistent structure applicable to all torts. This Article articulates just such a unified structure for all torts: one that arises out of and is based upon the elements of negligence. All torts involve the judicial delineation of the defendant's duty or legal obligation. All torts …

Vanderbilt Law Review
The modern President possesses enormous power. She can use military force abroad without congressional authorization, impose economic sanctions on foreign powers, or enter into trade agreements with foreign states. She can do all this on her own, with little constraint. Or so it seems. In reality, these important powers, along with numerous more mundane ones, are all contingent on the President first making certain factual determinations. For example, to use force abroad, the President must first determine that the use of force is in the "national interest," perhaps that it will preserve "regional stability" or protect American lives. To impose …

Global CWD Repository
This 18th Edition of To Walk the Earth In Safety summarizes the United States’ Conventional Weapons Destruction (CWD) programs in 2018. CWD assistance provides the United States with a powerful and flexible tool to help partner countries manage their stockpiles of munitions, destroy excess small arms and light weapons (SA/LW) and clear explosive hazards such as landmines, improvised explosive devices (IEDs), and unexploded ordnance (UXO). Our assistance also helps countries destroy illicitly-held or poorly-secured man-portable air defense systems (MANPADS) and mitigate their threat to civilian aviation and public safety.
In today’s dynamic world, threats to U.S. national security abound. The …

Socioeconomic And Demographic Correlates Of Sex Offender Residency In Massachusetts, Margaret Chiavelli
Socioeconomic And Demographic Correlates Of Sex Offender Residency In Massachusetts, Margaret Chiavelli
Criminology Student Work
In states with sex offender residency restrictions, sex offenders have been found to cluster in areas that are poorer, less white, and generally less advantaged, but little research has been done on whether these patterns exist without residency restrictions in place (Tewksbury & Mustaine, 2008). All cities and towns in the state of Massachusetts eliminated residency restrictions for sex offenders in 2015 by way of court order. This policy shift provides a unique opportunity to study sex offender residency patterns that are not constrained to certain geographic areas. Using publicly available data, multivariate regression was used to examine correlates of …

Mr. Toad’S Wild Ride: Business Deregulation In The Trump Era, Joan Macleod Heminway
Scholarly Works
This Essay identifies and takes stock of the Trump Administration’s deregulatory efforts as they impact business interests, with the thought that even incomplete or biased information may be useful to transactional business lawyering.
What of significance has been done to date? With what articulated policy goals, if any? How may — or how should — the success of the administration’s business deregulatory plans and programs be judged? What observations can be made about those successes? For example, who may win and lose in the revised regulatory framework that may emerge? The Essay approaches these questions from a transactional business law …
